SAN JUAN COUNTY COMMISSION MEETING March 23, 2009 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Lynn Stevens, Commissioner Rick Bailey, SJC Administrator Norman L. Johnson, SJC Clerk/Auditor Dawn Shaw, SCJ Deputy Clerk Attendees: Scott Burton, Jerry McNeely, Cyndi Eldredge, David Bronson, Lynn Laws, Mike Lacy, Howard Randall A motion to approve the minutes of March16, 2009 was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was not present for the vote. Cyndi Eldredge - SJC Personnel Cyndi presented a request to promote Damon Orr, SJC Sheriff's Office, to a Corporal Corrections Officer. Damon would be going from Step 136 to Step 149. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was not present for the vote. David Bronson - SJC Surveyor David presented a procurement request for a 2009 2500 4x4 Truck from Ken Garff in the amount of $19,868. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was not present for the vote. Lynn Laws - SJC Road Department Lynn presented a request to go with the low bidder, Brown Brothers, for the 2009 Lem's Draw gravel crushing project in the amount of $438,500. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was not present for the vote. Rick Bailey - SJC Administrator Rick reports that the State requires the Justice Court to have a resolution stating that there will be a temporary judge lined up for when the regular judge is not there. Ricks states that this practice is already in place but will write up a resolution. Rick presented a request to consider the adoption of a resolution: RESOLUTION NO. 2009-02 A RESOLUTION AUTHORIZING THE ISSUANCE AND SALE OF NOT MORE THAN $2,000,000 AGGREGATE PRINCIPAL AMOUNT OF CLASS B ROAD REVENUE BONDS, SERIES 2009, OF SAN JUAN COUNTY, UTAH; FIXING THE MAXIMUM AGGREGATE PRINCIPAL AMOUNT OF THE BONDS, THE MAXIMUM NUMBER OF YEARS OVER WHICH THE BONDS MAY MATURE, THE MAXIMUM INTEREST RATE WHICH THE BONDS MAY BEAR, AND THE MAXIMUM DISCOUNT FROM PAR AT WHICH THE BONDS MAY BE SOLD; PROVIDING FOR THE PUBLICATION OF A NOTICE HEARING AND BONDS TO BE ISSUED; PROVIDING FOR THE RUNNING OF A CONTEST PERIOD; AND RELATED MATTERS. A copy of the entire resolution is hereto attached and made a part of the minutes. After a brief discussion a motion to pass the resolution, make proper adjustments and set a public hearing date, was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Rick presented one building permit for approval and signature. Susan Moran - Addition to Residence - N Hwy 191, Blanding A motion to approve the building permit, provided all appropriate signatures are in place, was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was absent for the vote. Rick reports that some of the original components of the bid for the Montezuma Creek bridge need to be removed and that additional materials will need to be brought in to build up the bridge. Open Time and Other Business Mike Lacy, SJC Sheriff, reported to Commissioners and discussed the States legislative action toward county jails. He stated they are looking into other resources to come up with money for jail reimbursement. Commission Reports Commissioner Maryboy reports he met with the TCDC to discuss BIA funding. He plans to be in the County most of the week but will be returning to Washington D.C. the first part of next week. Commissioner Stevens attended a CEU Board of Trustees meeting last week where they discussed how CEU plans to survive budget cuts. He plans to attend a Southeast Utah Health District Board of Directors meeting in Green River tomorrow then on to Salt Lake Wednesday for UAC legislative reports. Monday, March 30, 2009 Commissioner Stevens plans to be in Salt Lake to lobby at the economic summit for the Governor. Commissioner Adams participated in a meeting last week in Dove Creek with Commissioners from Colorado Counties to discuss the extraction of gas from shale near Narraguinnep Lake. He plans to attend a UCIP meeting on Thursday. He plans to be in Salt Lake March 30, 2009 to lobby at the economic summit. Jerry McNeely updated Commissioners on issues he is working on.
