SAN JUAN COUNTY COMMISSION MEETING March 16, 2009 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Bruce Adams, Chairman Lynn Stevens, Commissioner Rick Bailey, SJC Administrator Norman L. Johnson, SJC Clerk/Auditor Dawn Shaw, SCJ Deputy Clerk Absent: Kenneth Maryboy, Vice Chairman Attendees: Marilyn Boynton, Scott Burton, Larry Sorrel, Jerry McNeely, Val Dalton, Howard Randall, Georgiana Simpson, Tammy Gallegos, Cyndi Eldredge, Evan Lowry, Rowland Francom, Susan Taylor A motion to approve the minutes of March 2, 2009, with corrections and to be approved by Commissioner Kenneth Maryboy, was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Cyndi Eldredge - SJC Personnel Cyndi presented a request to hire John Casement as the Bluff/Mexican Hat Transfer Station Attendant, a part time Grade 1 Step 1 position. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Cyndi presented a request from Brittney Dalton, Aging Waiver Assistant Case Worker, to reduce her employment from full time to part time status. Brittney will forfeit retirement, health insurance and leave time. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Val Dalton - SJC Resident Mr. Dalton presented a request to trade a piece of property he owns with gravel on it for a piece of property owned by the County. The property is located at Castle Wash by Halls Crossing. After a discussion over how the property owned by the County was obtained and other relative issues, Commissioners directed Mr. Dalton to talk to Lynn Laws, SJC Road Department, to evaluate this request from a county road stand point. Rick Bailey - SJC Administrator Rick presented a procurement request for 40 wrap fixtures and 150, 32 watt lamps from TR Electric & Supply for the SJC Administration Building for the total amount of $2,609.09. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Evan Lowry - SJC Planning/GPS Evan presented a concurrence for a grazing permit at Brimley Ridge for approval and signature. A motion to approve the permit was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the request. None opposed. Commissioner Bruce Adams declared the motion carried. Evan reports that there is a request to maintain a road to an old well. Commissioners asked Evan to find the identity of the road and stated that the request may have to go to a public hearing if needed. Howard Randall - SJC Assessor Howard gave a report on oil and gas evaluations stating that the State Assessment would follow previous years procedure. The average value of value of oil for 2008 was $89 a barrel and that will be this years beginning point. The oil and gas industry people don't like the value and will most likely appeal this years evaluation. Howard wanted the Commissioners be aware of this situation. Tammy Gallegos - SJC Administrative Assistant Tammy presented a four year plan on Aging for approval and signature. A motion to approve the Aging plan was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the request. None opposed. Commissioner Bruce Adams declared the motion carried. Tammy presented a State of Utah Contract amendment to add $2,000 for approval and signature. A motion to approve the amendment was made by Commissioner Lynn Stevens. Johnson - SJC Clerk/Auditor Norman presented a beer license from SJ River Kitchen for renewal. A motion to approve the beer license renewal was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the request. None opposed. Commissioner Bruce Adams declared the motion carried. Rick Bailey - SJC Administrator Rick presented five building permits for approval and signature. Doug Brown - Residence - Spanish Valley Dr, Moab Franklin Hawkins - Residence - S Hwy 191, Blanding Shelton Shumway - Green House - N Grayson Parkway, Blanding Royce Electronics - Radio Tower - Old Airport Rd, Moab Terry Humo - Residence - S Beeman, La Sal A motion to approve the building permits, provided all appropriate signatures are in place was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Rick reports that he met with the five counties SRS RAC committee and states that one of the Commissioners needs to be on the RAC Board. After a discussion it was decided that Commissioner Stevens would be selected to be the county's representative on that board. Rick reports that the BIA called and UAC Conference Call Commissioners participated in a lengthy conference call regarding jail reimbursement issues. Open Time and Other Business John Billie, Aneth Chapter President, asked about the land status in the Montezuma Creek area. He states that some residents are being asked to move because of a SITLA trust land issue and asked that Commissioner Maryboy look at it the business committee side. Commissioners told Mr. Billie that they would try to find details on this and get back to him. Commission Reports Commissioner Stevens reports he was in Washington D.C. all last week for NACO and felt it was successful. He states that the stimulus package was undefined and confusing. This week he plans to attend a Board of Trustees meeting in Price tomorrow and be in the county the remainder of the week. Commissioner Adams was also in Washington D.C. last week and felt the stimulus money would be matching. He states that it was as good a trip as he has ever had. He plans to be in the county all week. 12:06 P.M. Executive Session A motion to go into executive session to discuss legal and personnel issues was made by Commissioner Lynn Stevens.
