SAN JUAN COUNTY COMMISSION MEETING January 12, 2009 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Lynn Stevens, Commissioner Rick Bailey, SJC Administrator Norman L. Johnson, SJC Clerk/Auditor Dawn Shaw, SCJ Deputy Clerk Attendees: Marilyn Boynton, Scott Burton, Monte Dalton, Larry Sorrell, Louise Jones, Charlie DeLorme, Jim Keyes, Lynn Laws, Evan Lowry, Eli Tso, Linda Larson, Maxine Deeter, Jerry McNeely, A motion to amend the January 12, 2008 agenda to include an executive session to discuss possible litigation was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. A motion to approve the minutes of January 5, 2008, with corrections, was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Jim Keyes - USU Extension Jim presented an out of state travel request in the amount of $888 to attend the National Beef Industry Convention to be held in Phoenix, AZ. A motion to approve the request was made by Commissioner Kenneth Maryboy. Commissioner Lynn Stevens seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Jim presented a procurement request for two Inspiron 1525 Laptop Computers in the amount of $940.84 each. A motion to approve the request was made by Commission Lynn Stevens. Jim reported to Commissioners that there are a few events of interest coming up in February. They include a Stockman's Field Day and a Q&A with Bluff residents about weed control in Bluff. Monte Dalton - SJC Sheriff's Office Monte presented an out of state travel request in the amount of $847 to attend the Western States Livestock Investigators Association to be held in Reno, NV. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Louise Jones - SJC Recorder Louise presented a procurement request for a Xerox 3030 36" Analog Roll-Fed Engineering Copier in the amount of $6390 from Monsen Engineering. Louise states the cost will be split between the Recorder and Assessor Office's. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Charlie DeLorme - SJC Ec. Development Charlie presented a request to appoint Scott Ryan to the SJC Ec. Development and Visitor Services Advisory Council. A motion to approve the request was made by Commissioner Kenneth Maryboy. Commissioner Lynn Stevens seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Charlie drafted a letter to Governor Huntsman at the Commission's request, regarding the State of Utah's representation at trade shows, for Commission Chair signature. Evan Lowry - SJC Planning/GPS Evan updated Commissioners on the stream gauges at North and Spring Creeks saying that he has received a letter from the USGS asking for funds to help pay the costs of the gauges. Commissioners directed Evan to draft a letter to USGS telling them the County does not want to help with the cost. Rick Bailey - SJC Administrator Rick reports that he received a letter from the Natural Resources Conservation Service (NRCS) adding an amendment to cooperative agreement 68-8D43-8-21. He also received a letter from Navajo DOT concerning continuing road maintenance by SJC for BIA. Rick states he received a letter from the Utah State Tax Commission announcing the annual meeting with Oil and Gas Industry will be held February 18, 2009. Rick reports he received information concerning PELT vs. State of Utah. This addresses the issue of litigation against the state of Utah over how monies were spent as trustees of the Navajo Oil Trust Fund. Rick presented the 2009 Bookmobile Contract for approval. A motion to approve was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioners stated they would like to find an alternative solution to the bookmobile by next year. Rick states that every summer a group "of kids" come to the area to do work projects on homes mainly on the Reservation. Rick presented a request to have them concentrate on the Red Mesa and Mexican Water areas. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Open Time and Other Business Commissioners received a letter from the P&Z Commission recommending the adoption of the SJC, Utah Monticello Municipal Airport Overlay Zoning Ordinance. Commissioners asked Rick to set up a public hearing for this. Lynn Laws, SJC Road Department reported to Commissioners that he has received an offer from Falcon Construction to make more chips for the same price of the original quote. A motion to allow Lynn and Falcon to change the time and scope of the original contract was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Eli Tso, SJC Resident, requested that there be work done on CR 492. He states that it is very muddy and hard to travel. Commissioners directed Mr. Tso to meet with Lynn Laws from the Road Department to come up with a solution. Norman L. Johnson, SJC Clerk/Auditor, provided a report on the final budget and requested Commission Chair signature on official County pay scale. Maxine Deeter, BLM, reports that as soon as the weather permits they will be putting up the fence at the Blanding shooting range. She states that the BLM would like to issue a joint press release with SJC and Blanding City to citizens about not dumping trash at the shooting range. How to clean up the area was also discussed. Commission Reports Commissioner Maryboy reports that he attended the Mexican Water Chapter meeting yesterday and will be in Monument Valley tonight. He also plans to attend a SJ Health Board meeting tomorrow. Commissioner Stevens states that will be going to Price tomorrow and then on to Salt Lake for meetings. Commissioner Adams attended AOG last week and this week he plans to attend UCIP on Thursday. Commissioners wanted to remind everyone there would not be a Commission Meeting the week of January 20, 2008 as they will be out of town on other County business. 12:00 P.M. - Executive Session A motion to go into executive session to discuss possible litigation was made by Commissioner Lynn Stevens.
