SAN JUAN COUNTY COMMISSION MEETING January 5, 2009 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Lynn Stevens, Commissioner Tammy Gallegos, SJC Administrative Assistant Norman L. Johnson, SJC Clerk/Auditor Dawn Shaw, SCJ Deputy Clerk Attendees: Larry Sorrell, Lynn Martin, Stuart and Pat Smith, Charlie DeLorme, Andrew and Nicole Laren, Luther and Marie Wigginton, Scott Mitchell, David Bronson, Lynn Laws, Lyon Hazleton, Kristine Adams, Scott Burton, Lou Mueller, Howard Randall, Greg Adams Norman Johnson, SJC Clerk/ Auditor, presented a request to amend the agenda to included a public hearing to be held at 11:00 A.M. to discuss a request for a variance from the County's subdivision ordinance pertaining to road materials. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Elected Officials - Oath of Office Lyon Hazleton, SJC Justice Court Judge, administered the oath of office to the reappointed and newly elected County Officials. They are as follows: Bruce Adams, SJC Commissioner and David Bronson, SJC Surveyor. December 22, 2008 Approval of Minutes A motion to approve the minutes of December 22, 2008 was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was not present for the vote. Lou Mueller - USU Extension Lou reported to Commissioners on a National Native American Fathers and Families Conference she was a facilitator at in October. She said the response from those taking the class and the people holding the class was very encouraging. Lou presented two out of state travel requests for approval. One to Las Vegas, NV January 26- -1- 30, 2009 for a Home Energy Community of Practice Conference with a cost to the County of $337 and one to Washington , DC April 27-30, 2009 for a Public Issues Leadership Development Conference with a total cost of $341 to the County. A motion to approve both travel requests was made by Commissioner Kenneth Maryboy. Commissioner Lynn Stevens seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Charlie DeLorme - SJC Ec. Development Charlie reported to Commissioners that the TRT was over a half million dollars for 2008 which is up 26% over 2007. Charlie states that with the Governors budget cuts the tourism budget is expected to take a 38% cut State wide which can, and probably will, hurt the County. Charlie presented a procurement request for a trade show booth and necessary accessories from Sign Pro in the amount of $1,633. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Charlie presented out of state travel requests for January - March 2009. He explains that they have been awarded a co-op grant from the Utah Office of Tourism in the amount of $37,000 which will be applied to travel. The out of state travel requests are as follows: January: Go West Summit in Albuquerque, NM for Charlie at a total cost of $1,300. Adventures in Travel Expo (ATE) in Chicago, IL for Susan Taylor and Pam Hanson at a total cost of $2,084.96 International Sportsman's Expo (ISE) in Denver, CO for Susan and Pam at a total cost of $1647. February: ATE in Los Angeles, CA for Susan and Pam at a total cost of $2,587. ATE in Washington, DC for Susan and Pam at a total cost of $3,883.99 ISE in Phoenix, AZ for Susan and Pam at a total cost of $1,782. March: Affinity Sportsman's Show in Las Vegas, NV for Susan and Pam at a total cost of $1,975.64. ITB Berlin & French Sales Mission in Germany/France for Charlie at a total cost of $6,000. Travel Com in Atlanta, GA for Charlie at a total cost of $2,300. A motion to approve the requests was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. There was then a discussion of whether or not the State would be cutting more out of the tourism budget and how the County is essentially picking up the cost for the State when Charlie goes to the shows and represents the whole State. Following the discussion a vote was then called on the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioners asked Charlie to draft a letter to the Governor stating the feelings of the County wanting a State Representative at shows. -2- Howard Randall - SJC Assessor Howard presented a request to go into BOE to take a home off a piece land owned by Clyde Watkins. A motion to go into BOE was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Howard reports that one mobile home has been taxed on two different pieces of property and presented a request to remove it from parcel #37S22E016600. Johnson - SJC Clerk/Auditor Norman presented three Beer License renewals for approval. They are: Canyonlands/Needles Outpost, Out West Food & Fuel, and Dairy Café. A motion to approve the renewals was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared motion carried. Tammy Gallegos - SJC Administrative Assistant Tammy presented a request to reappoint Kedric Somerville to the Water Conservancy District. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Tammy reports that water is running through the pipe at Navajo Mountain thanks to help from the County, Arizona DOT, Navajo Nation, as well as others. 11:00 A.M. Public Hearing - Variance to County's Subdivision Ordinance A motion to go into public hearing, to receive comments on a request for a variance from the County's subdivision ordinance pertaining to road materials, was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was absent for the vote. Mike Adams, developer of Elk Meadows subdivision, presented a written variance request to Commissioners asking for the materials used on the roads at Elk Meadows to be approved by the County. -3- Commissioner Stevens stated that the "source pit" used for the materials used on the Elk Meadows subdivision was approved to be used on some roads in La Sal several years ago. At the time the source pit was screening the materials and they met the requirements set by the County for use on roads. Since that time they no longer screen the materials and the mix they use does not meet the County standards. Questions were raised by the County Surveyor as to the roads being in an approved subdivision. Other staff raised the validity of accepting the roads as constructed. A motion to go out of public hearing was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Adams abstained from the vote due to his relationship to the property's developer. Commission Reports Commissioner Maryboy plans to attend a planning meeting in Mexican Water today. A motion to reappoint Commissioner Adams as the Commission Chair was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed.
