SAN JUAN COUNTY COMMISSION MEETING February 11, 2008 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Rick Bailey, SJC Administrator Norman L. Johnson, SJC Clerk/Auditor Dawn Shaw, SCJ Deputy Clerk Attendees: Lynn Laws, Shurrell Meyer, Evan Lowry, Cyndi Eldredge, Walter Bird, David Bronson, Mike Lacy, Greg Adams, Janet Ross, Reena Mathews, Charles Laurencis, Therald Edwards, Lannie Yeager, Louetta Edwards, Christy Wallis, Randy Wallis, Karen Hostetter, Lantz Indergard Absent: Lynn Stevens, Commissioner Lynn Laws - SJC Road Dept. Lynn presented a procurement request for a 20ft. Tilt Trailer from 01' West Trailers at a cost of $5295. A motion to approve the request was made by Commissioner Kenneth Maryboy. Shurrell Meyer - SJC Library Shurrell presented a procurement request for a XE Rox 8560 DT Color Printer from Tiger Direct at a cost of $1329. A motion to approve the request was made by Commissioner Kenneth Maryboy. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Shurrell presented a procurement request for a Book Cart from Highsmith at a cost of $381.65. A motion to approve the request was made by Commissioner Kenneth Maryboy. Evan Lowry - SJC Planning Evan received invitations from the State of Utah and the Rural Water Association to attend a meeting on February 27 for Small Water Supply. The Commissioners would like Evan to attend that meeting since they will be in Washington D.C. for meetings at that time. -1- Evan received proposals from the Forest Service on grazing allotments. The Commission agreed to Evan responding in favor toward the permits. Evan reported that comments are due this Friday on Wild and Scenic Rivers. The Commission stated that they did not want Hammond Canyon included in this because it infringes on private property rights. Walter Bird - Assistant County Attorney Walter received a request from Denison Mine to obtain a sublease from HECLA mining. Denison already has 50% of this lease and would like to aquire the other 50% to have the full 100%. Walter also states that Denison would like to sublease surface area to Energy Fuels. A motion to approve both requests was made by Commissioner Kenneth Maryboy. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Cyndi Eldredge - SJC Personnel Cyndi presented a request to hire Kimberly Haller as a full time Dispatcher for the Sheriff's Office, a Step 63 position. A motion to approve the request was made by Commissioner Kenneth Maryboy. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Cyndi presented a request to hire Ricky Gillis Sr. as a full time Light Equipment Operator, a Step 89 position. A motion to approve the request was made by Commissioner Kenneth Maryboy. Johnson - SJC Clerk/Auditor Norman presented a draft of the Tax Sale Calendar to the Commissioners. Currently there are 26 properties on the calendar and he is hoping that number will go down by the time of the sale. Norman asked the Commission if they would like county representation at the WIR Conference May 21-23, 2008 in St. George. The Commission agreed they did and said to also offer help to Washington County wherever needed. Rick Bailey - SJC Administrator Rick presented four building permits for approval and signature. Rick presented a procurement request from the Sheriff's Office for a Large Display Monitor from CDWG at a cost of $627.42. A motion to approve the request was made by Commissioner Kenneth Maryboy. Rick presented a procurement request from Emergency Services for four Toshiba Tekbright 22" LCD Monitors at a total cost of $1261. Rick presented a procurement request from Emergency Services for three Conference Room Projectors and a Ceiling Mount at a total cost of $4400. Rick presented a contract from UDOT to crack seal the Bluff Airport in the amount of $24, 500. A motion to approve the contract was made by Commissioner Kenneth Maryboy. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. The bid to crack seal the Bluff Airport will be awarded March 10, 2008. Following a discussion and a review of the concerns expressed by the Utah Department of Corrections the Commissioners would like to follow up with State Legislatures on the Public Safety Building Expansion and make a determination at next weeks Commission Meeting on how to proceed. Lannie Yeager - SJC Resident Mr. Yeager along with others presented the Commission containing a petition with 38 signatures and letters from residents in Spanish Valley to have a road paved. Their concerns were health and safety stating that people travel too fast down the road and kick up dust while kids are walking to and from school. They also said there were slick spots that caused people to slid off the road. After a discussion it was decided that it is not the County's responsibility to pave the road, but if the developer brought the road up to county specifications the County would maintain it. The residents said they would donate money to help with costs to get something done. There were asked by the Commission work with Lynn Laws and David Bronson if they decided to do something themselves. Lynn Laws will go to Spanish Valley Wednesday afternoon to review the road conditions there. -3- Open Time and Other Business Tammy Gallegos thanked Commissioner Adams and Commissioner Stevens for coming to Senior Day at the State Legislature. She said the Seniors really appreciated it. David Bronson presented a resolution establishing the office of SJC Surveyor as an elected office. Resolution No. 2008-04 RESOLUTION TO ESTABLISH THE OFFICE OF THE SAN JUAN COUNTY SURVEYOR AS AN ELECTED OFFICE WHEREAS, pursuant to Subsection 17-23-1(1)(a), Utah Code Annotated (1953, as amended), "[t]he office of the county surveyor shall be filled by election, and except as provided in (1)(b), the county surveyor shall be a licensed profession land surveyor in the state"; WHEREAS, pursuant to Subsection 17-23-1(2), Utah Code Annotated (1953, as amended), "[t]he county surveyor shall execute: (a) all orders directed to the surveyor by any court; and (b) all orders of survey required by the county executive or county legislative body"; WHEREAS, pursuant to Subsection 17-23-1(3)(a), Utah Code Annotated (1953, as amended), "[t]he county surveyor shall: (I) advise the county executive and county legislative body regarding all survey work; (ii) perform or arrange for the performance of all surveying work for the county; (iii) permanently keep at county government offices at the county seat a fair and accurate record of all surveys made, including legal descriptions and geographic coordinates, all surveys received pursuant to Section 17-23-17, and all corner files received pursuant to Section 17-23-17.5; (iv) number progressively all surveys received and state by whom and for whom the surveys were made; (v) deliver a copy of any survey to any person or court requiring the survey after payment of the fee established by the county legislative body; (vi) ensure that all surveys of legal subdivisions of sections are made according to the United States Manual of Surveying Instructions in effect at the time the survey is completed; (vii) verify the correctness of or establish correct coordinates for all survey reference monuments set in place and shown on all subdivision maps and plats which have a spatial relationship with any section or quarter section corner; and (viii) perform other duties required by law."; WHEREAS, pursuant to Subsection 17-23-1(4), Utah Code Annotated (1953, as amended), "(a) The county surveyor or his designee shall establish all corners or government surveys and reestablish all corners of government surveys where corners have been destroyed and where witness markers or other evidences of the government corners remain so that the corners established by government survey can be positively located. (b) The corners shall be reestablished in the manner provided in Section 17-23-13 for establishing corners. ©) The county surveyor shall keep a separate record of the established and reestablished corners of government surveys, giving the date and names of persons present and shall provide those records to his -4- successor when he vacates his office."; and WHEREAS, pursuant to Subsection 17-23-1(5), Utah Code Annotated (1953, as amended), "[t]he county executive or legislative body may direct the county surveyor or his staff to preform engineering and architectural work if the county surveyor or his staff is qualified and licensed to perform that work." NOW, THEREFORE, BE IT RESOLVED BY THE COUNTY LEGISLATIVE BODY OF SAN JUAN COUNTY, UTAH, THAT: the office of county surveyor shall be filled by election, by a State of Utah licensed professional land surveyor, to carry out and fulfill the duties required by law. Commission Reports Commissioner Adams went to Salt Lake last week and met with some people from the legislature to give a presentation on wind power. He will meet with the Mental Health Board today at 3:30. On Wednesday he will attend a UCIP Board meeting and go to Salt Lake for the legislature. Commissioner Maryboy was in Salt Lake last week for the legislature and has attended several Chapter meetings. He will be going back up to Salt Lake later this week. He also indicated that he would like a letter sent to the FBI requesting a letter of recognition to the Navajo Police on their efforts with the manhunt. -5- Norman L. Johnson - SJC Clerk/Auditor - Canvass of 2008 Presidential Primary Election Norman presented the individual poll books and documentation on the final totals for the Presidential Primary Election. A motion to approve the position of Activity Coordinator at 30 hours a week and eligible for retirement benefits was made by Commissioner Kenneth Maryboy.
