SAN JUAN COUNTY COMMISSION MEETING December 3, 2007 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Bruce Adams, Chairman Lynn Stevens, Commissioner Rick Bailey, SJC Administrator Norman L. Johnson, SJC County Clerk /Auditor Dawn Shaw, Deputy Clerk Absent: Kenneth Maryboy, Vice Chairman Attendees: Bob Bushart, Marilyn Boynton, Neil Joslin, Evan Lowry, Louise Jones, Charlie DeLorme, Bill Boyle, Cleal Bradford, Lynn Laws, Jim Keyes, Howard Randall, Bryce Redd, Craig Preston, Maxine Deeter A motion to approve the minutes of November 26, 2007 with adjustments, was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion reserving the right for Commissioner Kenneth Maryboy to make comments. None opposed. Commissioner Bruce Adams declared the motion carried. Evan Lowry - SJC Planning Evan gave a copy of the County Comments on the Moab RMP to the Commissioners. He also reported that the Moab office is working on the Little Mule Shoe area and is close to issuing a Title 5. Unconsolidate Surveyor Commission Office The Commissioners discussed an agenda item from last week concerning the resolution to unconsolidate the Survey Commission Office. After a discussion the Commissioners decide to table the issue saying they would make a decision before the March election filling. Cleal Bradford - Director of Four Corners Heritage Council Cleal showed the Commission a draft brochure of The Trail of the Ancients and gave a report on the progress of the National Heritage Designation. The Commission gave Cleal their okay to proceed with a four state, seven county plan. A bill has already been introduced to pay for the planning of the four corners region Trail of the Ancients Heritage area. Cleal updated the Commission on the Four Corners Monument and boundary disputes between the Ute and Navajo Tribes. At present, all have agreed to ask for a time extension so the funding -1- will not be returned. Progress is being made on the project. Bryce Redd - Greenbelt Land Issue Bryce requested that some property of which he is the trustee, be returned to greenbelt status. A motion to go into Board of Equalization was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Mr . Bryce Redd explained the circumstances relating to parcel # 36S 22E 344800 and how it had been removed from greenbelt. After a discussion on the status of this piece of property, a motion to approve returning the parcel to greenbelt and abating all penalties and interest accrued after the thirtieth of November was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Mr. Redd will need to reapply for greenbelt status today. A motion to go out of Board of Equalization was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Charlie DeLorme Charlie discussed the Lisbon Valley Mine closure and the potential impact it could have on San Juan County. Commissioner Adams read a letter dated November 30th from mine officials stating that the mining side of the operation will be closing down in sixty days and the leeching/milling operation will stay open for an optimistic two years. Rick Bailey - SJC Administrator Rick presented a procurement request from Monty Perkins for six windows from Rick's Glass to do the north side of the Courthouse at a cost of $3,689.58. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Rick addressed last weeks agenda item concerning Oil and Gas leases. He presented the Commission a map showing the property to be drilled is located near the transfer station in LaSal. He reported again that Sampson was the only company to bid on the leases. A motion to approve Sampson's offer was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Rick presented a request to change the name of San Juan Special Service District 1 to Mexican Hat Special Service District 1. A motion to approve the name change was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None -2- opposed. Commissioner Bruce Adams declared the motion carried. Rick presented a procurement request from the Road Department for a Fill Rite FR 4210 DGR 20qpm Fuel Pump from Granger. A motion to approve the procurement request was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Rick presented one building permit for approval and signature. Daniel Chapman - 2505 Tera Lane - Mfgr. Home - Spanish Valley A motion to approve the building permit, provided all appropriate signatures are in place, was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Bruce Adams - SJC Commissioner Commissioner Adams discussed getting the minutes and additional information from the Road Department so he could discuss and provide Sue Halliday the County's past position on County Road 375. Open Time and Other Business Norman L. Johnson, acting as Chairman of the SJ Water Conservancy District, reported for the record that the SJWCD signed a contract to lease water rights to Transition Power Development, LLC for seventy years. The overall lease is worth nearly 50 million dollars if the Nuclear Power Plant is built as planned. Craig Preston, the new Executive Director of SJC Health Department introduced himself to the Commission. The Commissioners welcomed him to the County. Commission Reports Commissioner Stevens met with the staff from Senator Bennett's office last Tuesday. He will be attending the Navajo Trust Fund Board meeting this Thursday. He will be in the County all week and can be reached by phone. Commissioner Adams attended the Design/Build presentations for the jail expansion last Tuesday. On Wednesday he spent most of the day in Price meeting with Water Resources and on Thursday he attended a Water Conservancy meeting and Chaired a Public Hearing in Mexican Hat to discuss proposed water rate increases. Today he will meet with the BLM at 1:00 and attend the SJC Budget Hearing tonight at 6:00. On Thursday he will be attending an annual UCIP meeting at Thanksgiving Point.
