SAN JUAN COUNTY COMMISSION MEETING November 19, 2007 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Lynn Stevens, Commissioner Tammy Gallegos, SJC Administrative Assistant Norman L. Johnson, SJC County Clerk /Auditor Dawn Shaw, Deputy Clerk Attendees: Bob Bushart, Cyndi Eldredge, Greg Adams, Neil Joslin, Julie Sampson, Earl Lee, Lisa Moore, Marilyn Boynton Cyndi Eldredge - SJC Human Resources Cyndi presented a request to promote Clisbee Black to the Waste Facility Worker, a Step 114 position. A motion to approve the promotion was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was absent for the vote. Cyndi presented a request to promote Larry Mitch Mason to a full time Laborer at the landfill from part time, a Step 33 position. A motion to approve the promotion was made by Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was absent for the vote. Evan Lowry - SJC Planning Following a brief discussion on the County Master Plan the Commission decided it needs to be re-advertised for additional public input. Tammy will follow up on the advertisement. Evan advised the Commission that the Monticello BLM is willing to meet with them to answer any questions about the BLM Field Office Draft Resource Management Plan. That meeting is tentatively set for December 3rd at 1:00pm. Tammy Gallegos - SJC Administrative Assistant Tammy presented a resolution to annex an area of property by Ken's Lake into the Grand County Special Services District. The Commission would like more information, and have a public notice to advertise the proposed annexation and signatures from people it would impact since it is a taxing entity. -1- Tammy reported to the Commission the progress on the LaSal Senior Center. She has gone back to Tri Hurst Construction to negotiate the bid. Tri Hurst said they could "Stick" build the Center at a cost of $230,000 compared to the original bid of $280,000 for a modular. The Commissioners were pleased with the progress and requested she proceed with the contract. Commissioner Stevens suggested we see if there is any additional monetary help from the CIB or other sources for the project. Tammy presented a request to appoint Catherine Van Hoogen to the SJC Library Board. A motion to appoint Catherine Van Hoogen was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried. Tammy presented procurement requests from the Road Department for 2 truck dump bodies at a cost of $33,724 each from Tesco Williamsen and a 91 gallon fuel transfer tank at the cost of $499.99 from Northern. A motion to approve the procurements was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. Commissioner Kenneth Maryboy was absent for the vote. Mark Walsh and Ken Brown - Western Counties Alliance Via a conference call, Mr. Walsh and Mr. Brown invited SJC to become members of Western Counties Alliance. The Commission declined the invitation and instead offered WCA a $1,000 donation. Mr. Walsh and Mr. Brown accepted the donation with thanks to the Commission. Open Time and Other Business Julie Sampson, SJC Victims Advocate, presented a request for a 25% match from the County to the annual grant. The 25% match amounts to $13,000. A motion to approve the request and sign the grant application was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Mike Lacy, SJC Sheriff, presented a request to purchase a gun safe for the jail access area in the amount of $325. A motion to approve the purchase was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Earl Lee, Aneth UNHS, requested an additional $20,000 be budgeted for the Southern Fair from the County. The Commission asked Mr. Lee to give Norman Johnson information on justifying the budget increase so it can be considered in the budget process. Bob Bushart asked the Commission as to when they met to discuss his letter to them regarding Charles DeLorme. The Commission informed Mr. Bushart that they met unofficially the morning they signed the letter. The Commission made it clear that while they appreciated -2- citizens coming to them with concerns, it's not the citizens responsibility to decide how the Commission will resolve the concern. Greg Adams, SJC Deputy Assessor, made a request on behalf of Elk Meadows and Brittany Homes for the annexation of Haven Springs subdivision into Elk Meadows Special Service District. A motion that the County Commissioners, in their capacity as Board of Directors of the Elk Meadows Special Services District, approve the proposed expansion of the Special Services District and authorize them and the County to proceed forward with the formalities of getting the Lieutenant Governor's Office approval and get it properly recorded was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams stated his relationship to the property owners but declared no financial interest. None opposed. Commissioner Bruce Adams declared the motion carried. Greg presented a variance request on behalf of Elk Meadows subdivision and Brittany Homes to include lots with less than one acre. This subdivision will be serviced with a sewer system as approved by the state of Utah and included in the Elk Meadows Special Service District. A motion to respond to the District to indicate that the subdivision ordinance is now incomplete with respect to the size of lots required for structures that are connected to sewers and they are revising the subdivision ordinance to accommodate sewer system hook ups for things such as private homes, apartment buildings and condos was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams stated his relationship to the property owners but declared no financial interest. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Lynn Stevens made a motion to go into a Public Hearing to discuss the CIB Priority list Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. The CIB list including the Blanding, Monticello, and Bluff Service Area were reviewed and discussed with little public input. A motion to go out of the public hearing was made by Commissioner Kenneth Maryboy. Commissioner Lynn Stevens seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. A motion to approve forwarding the Priority list for CIB funding, on to the AOG was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commission Reports Commissioner Adams attended the UAC meeting in St. George last week. Sunday he attended the Oljato Chapter Meeting. He will be here the rest of the day and in Salt Lake Tuesday. Wednesday he will be in Price. -3- Commissioner Stevens attended the UAC meeting in St. George last week. He will be leaving for Salt Lake later today and be back in the County late Tuesday. Commissioner Maryboy said he has spent the week primarily on the Navajo Trust Fund issue. The Commission held a lengthy discussion on their concerns over management of the Fund and how it will benefit the San Juan County Chapters. There are several meetings scheduled on the issue over the next few days. Norman L. Johnson - SJC Clerk/Auditor Norman presented the results for the 2007 General Election. He reported that there was a total of 45 ballots counted as part of the canvass received since Tuesday November 6th. There was a 31.5% voter turnout for the County. The Commission reviewed the totals and related documents. A motion to certify the election was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed.
