SAN JUAN COUNTY COMMISSION MEETING October 8, 2007 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Lynn Stevens, Commissioner Rick Bailey, San Juan County Administrator Norman L. Johnson, County Clerk /Auditor Attendees: Bob Bushart, Mike Lacy, John Scorup, Sarah Lupis, Neal Joslin, Marilyn Boynton, Less Rogers, Steve Rogers, J. W. Rogers, Clem Washburn and Bud & Linda Cunningham A motion to approve the minutes of October 1, 2007, was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion . None opposed. Commissioner Bruce Adams declared the motion carried. Norman Johnson - SJC Clerk Auditor Norman presented information proposing joining with other Counties and the Utah State Archives Office to purchase an archive-writer. The archive-writer will be kept at the State Archives and available to the county using scanned documents electronically sent to them. The State would then produce the microfilm and send it to us. The archive-writer would be used by the Recorder, Treasurer, Clerk / Auditor and the Sheriff. The Commission gave permission to proceed with the planning and get more information to be included in the budget. Presented the 2008 Budget preparation and adoption schedule for the commissions to review. Norman handed out a copy of the 2007 Property Tax Abatements list for the qualified Circuit Breaker, Veteran and Blind persons. This years total is $83,466.98. Following a discussion a motion to approve the abatements, as presented, was made by Commissioner Kenneth Maryboy. Commissioner Lynn Stevens seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Sarah G. Lupis - USU Cooperative Extension - Prairie Dog Conservantion Plan Sarah presented to the Commission the basic concepts and reasons the Prairie Dog Conservancy plan was implemented. One of the foremost purposes was to prevent the Gunnison Prairie Dog from being placed on the National Endangered Species List. The population study was conducted last year by DWR personnel, who were to have received permission from private landowners. The study was conducted on public as well as the private lands in San Juan County. Questions were raised by the audience concerning the purpose for the study and why the private landowners were not contacted for approval prior to the DWR personnel going on their property. Comments were made relating to the prairie dog being a "keystone animal" in the ecosystem and that other animal species depended on them for survival. The Commission thanked Sarah for coming and being willing to field the questions relating to the study and conservation plan. A motion to accept the report and distribute the information to their constituents, was made by Commissioner Maryboy. Commissioner Stevens seconded the motion . None opposed. Commissioner Bruce Adams declared the motion carried. Mike Lacy - SJC Sheriff - US Forrest Service Contract Sheriff Lacy presented the annual Forrest Service Contract for approval and signature. This years contract is for $5,600. The contract includes patrol and enforcement on Forest Service roads and in the campgrounds. A motion to accept and sign the contract, was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion . None opposed. Commissioner Bruce Adams declared the motion carried. Sheriff Lacy requested approval to purchase a Stocker Radar Unit for $3,010 from the Forrest Service Contract funds. A motion to approve the purchase, was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion . None opposed. Commissioner Bruce Adams declared the motion carried. The Drug Court program was discussed with the Commission. As a part of that program the County was to have a part time "Drug Tracker" position. As the Sheriff's Office has become extremely busy, in the north end of the County, Sheriff Lacy requested approval to budget for a full time position there and combine it with the Drug Tracker Funds. A motion to approve including the request in the budget, was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion . None opposed. Charles Delorme - Economic Development and Visitor Services Charles updated the Commission on the Bluff Swinging Bridge project and presented an additional $1,572 received in donations from the sale of "Bridge Beads". In association with Commissioner Maryboy, Charles reported on the visit from Navajo Nation Vice-President Ben Shelly to the bridge location. They said that Mr. Shelly was aware of the history of the bridge and the service it had rendered to the local people and visitors. The Vice-President made a commitment from the Navajo Nation to use NECA, administered by Nielson Construction, to replace the foundation structure for the new bridge. The value of this commitment is around $250,000. Charles reported that SITLA would be holding a comment meeting for a proposed Cell Tower, near Bluff, on October 23. The time and location were yet to be decided but that they would keep the Bluff Service Area Board well informed. Rick Bailey - San Juan County Administrator Presented an Easement and Right of Way Agreement for the North Road, located in Township 27 South, Range 22 & 23 East. A motion to accept and sign the Easement, was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion . None opposed. Commissioner Bruce Adams declared the motion carried. Rick advised the Commission that we have received the Class I permit renewal for the Landfill. This permit will not expire until, September 30, 2017. Rick handed out conceptual drawings of the Mexican Hat Building and an agreement with Chamberlain Architects, P.C. of Grand Junction and requested Commission approval and signature. A motion to approve and sign the agreement was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion . None opposed. Commissioner Bruce Adams declared the motion carried. An agreement, which was approved last week, for the limited architectural services on the County Library Buildings by Chamberlain Architects was presented for signature. Rick also handed out copies of the NTUA report on the Montezuma Creek Lagoons and a copy of a letter received from Congressman Matheson congratulating the County on receiving the $100,000 USDA Rural Development Grant. Rick presented the name of Steven Redd for appointment to the Planning and Zoning Commission, representing LaSal. A motion to approve the appointment of Steven Redd to the San Juan County Planning and Zoning Commission was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion . None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was absent for the vote. Rick advised the Commission of the need for them to attend an, Engineer of Record, video conference on October 31st in Blanding. Commissioner Adams will be out of the area but try to make contact by phone. Commissioner Stevens will plan to attend. Rick discussed a notice we received from the BLM indicating the DOE wanted to segregate the ground at the old Rio Algom Mill and Mine. The Commission requested Rick write a letter to secure our rights to the existing, roads, water and grazing in the area. A motion to go into a Public Hearing at 11:45 AM to discus and review the 2008 CIB request list, was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion . None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Maryboy was not present for the vote. The current list of requested or proposed funding items from San Juan County was reviewed along with a list receive from the Bluff Service Area, the Clay Draw project of the Water District and the sewer infrastructure in Spanish Valley. Following a discussion it was decided to add $100,000 for the Bluff Swinging Bridge to the 2008 schedule and $2,000,000 for potential Fair Grounds improvements and additions to the 2009 list. Rick explained that the next step would be in three weeks when all the individual City and entity requests would be brought together for another public hearing. Open Time and Other Business Marilyn Boynton said she had received information from the State Engineers office stating the full lagoon system was still an option for Bluff and that the decision would depend on service demand from Bluff or the County. Commission Reports Commissioner Stevens said he had contacted the State and that they were wanting our response on the Contract Environmental's request for additional use near Hovenweep. He indicated that they also expressed dissatisfaction with Mr. Adams operations and request for expansion. The closing date for comments is October 17th. Commissioner Stevens discussed the 10th Circuit Court ruling on Salt Creek and that SUWA was not granted intervening status as they do not qualify as having a public interest. He also discussed what maintenance we may need to do on county roads since there is an upsurge in mining activity. He will check with Lynn Laws on some particular roads in question. Clayton Long of the Blue Mt. Dine' and Chairman of the County Homeless Committee has requested consideration in having a staff person on the County payroll to function for that Committee. The Counties financial obligation to the Committee was discussed, along with what the definition of homeless really is. Last Week Commissioner Stevens attended the Mental Health Board meeting and the CIB meeting where he was able to have the $200,000 loan on the Mexican Hat Building changed to a Grant. This week he will be in the County but out of touch quite a bit of the time. However, he will attend the meeting on Thursday with Selma Sierra on the BLM Resource Management Plan. Commissioner Adams indicated that the attended the Mental Health Board meeting last week and the ribbon cutting ceremony along with Representative King and Senator Dmitrich. This week he will also meet on the BLM Resource Management Plan and attend AOG and the Joint Highway Committee meetings. Commissioner Adams will be out of the area next week and not be able to attend Commission meeting on Monday.
