SAN JUAN COUNTY COMMISSION MEETING September 24, 2007 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Rick Bailey, San Juan County Administrator Norman L. Johnson, County Clerk /Auditor Absent: Lynn Stevens, Commissioner Attendees: Bob Bushart, David Carpenter, Cyndi Eldridge, Lynn Laws, Evan Lowry, Jim Keyes, Dave Ketron, Shorty Todacheenie A motion to approve the minutes of September 17, 2007, with corrections, was made by Commissioner Kenneth Maryboy. Commissioner Bruce Adams seconded the motion with the stipulation that Commissioner Stevens be allowed to make adjustments. None opposed. Commissioner Bruce Adams declared the motion carried. Cyndi Eldredge - Personnel Office Cyndi advised that the Road Department is requesting Brandon Profaizer be moved from temporary to permanent full-time. The pay step remains at 33. A motion to approve the change was made by Commissioner Kenneth Maryboy. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. There was a discussion on a citizen complaint about a broken windshield from a rock which they claim came from a County Dump Truck. At the present time we do not feel there is any liability but all policy and procedures relating to the covering of loads are being reviewed. Evan Lowry - San Juan County Planning Office Advised the Commission of several open houses to be held this week including, the Forrest Service ESI on Oil & Gas this evening at 6:30 and the Welcome Center open house today from 4 to 7:00 pm. Wednesday is the BLM RMP meeting. Evan asked if the Commission was aware the Governor plans to hike up Salt Creek Canyon with a group from SUWA. Jim Keyes and David Ketron - County Weed Management Association Jim and Dave discussed a proposed project to control knapweed, in association with the City, on the South end of Blanding. Most of the project area is on private property and will therefore require property owner permission. Each property owner will be required to sign a waiver. The County's policy is to not go on private property and therefore the Commission would have to grant special permission. Commissioner Maryboy would like to see the waivers prior to granting that permission. Rick Bailey, San Juan County Administrator Rick submitted seven (7) building permits for approval and signature. Rick requested the Commission accept and sign the Department of Public Safety, 9-1-1 Telecommunications Enhanced, Phase 1 and Phase 2, Grant in the amount of $87,243. This grant is in association with Grand County. A motion to approve and sign the grant was made by Commissioner Kenneth Maryboy. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Presented the Memorandum of Understanding between the Utah Division of Forestry, Fire and State Lands and the individual fire departments within San Juan County. Not all the individual department signatures have been secured, but will be in the near future. A motion to approve signing the individual Memorandum of Understanding, as signatures are received, was made by Commissioner Kenneth Maryboy. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Rick requested approval on a procurement in the amount of $117,353.70 to purchase 6 Senior Citizen vans. The USDA Rural Development Grant covers $100,000 and the county is required to put up a 1/3 match. A motion to approve the purchase, was made by Commissioner Maryboy and seconded by Commissioner Adams. None opposed. Commissioner Adams declared the motion carried. Rick requested approval on three procurement's for the Wild Land Fire Department. 6 VX-924 VHF portable radios $3912.00, 6 GPH5102X Bendex King Radios $9000.00 and a Toshiba America laptop and accessories at $6,280.00. A motion to approve the purchases, was made by Commissioner Maryboy and seconded by Commissioner Adams. None opposed. Commissioner Adams declared the motion carried. Rick requested approval to purchase 4 mobile radios, with encoding capability, from the Homeland Security Grant in the amount of $3,300.00. A motion to approve the purchases, was made by Commissioner Maryboy and seconded by Commissioner Adams. None opposed. Commissioner Adams declared the motion carried. Due to the fact that there was only one bidder on the Highway 191 intersection work, in Spanish Valley, Rick recommended to the Commission that they award Schedules "B", "C" and "D" in the amount of $799.334.80 to LeGrand Johnson Construction. The Transportation District is contributing $400,000 to the project. Awarding of the Schedule "A" project will be held until we see what UDOT is able to contribute. A motion to award the contract as recommended was made by Commissioner Maryboy and seconded by Commissioner Adams. None opposed. Commissioner Adams declared the motion carried. In other business Rick said several inquiries have been received concerning the County Health, Workers Compensation and Property & Casualty Insurance. After a discussion it was felt that only the Health Insurance should be available for review and that can take place after the 1st of the year so that ample time can be devoted to it before the next renewal period of January 2009. Rick advised the Commission of a check, in today's batch, for $7600 to pay for services by the GE Corporation at the Mexican Hat Water Plant. The expense was incurred several months ago prior to the Commission's taking over the District. The money will be reimbursed by the State. Open Time and Other Business Mr Shorty Todachennie came to discuss a washout on County Road 414. This is an area which was worked on a few years ago with Lansing Construction, a private contractor. Lynn Laws will go look at the situation tomorrow. Rick Bailey indicated this may be a Navajo Department of Emergency Management project. Mr. Bob Bushart discussed the information processes used concerning communication towers in the County. He feels that the responsible local government officials are not being properly notified, such as the Navajo Mountain Chapter and the Bluff Service Area. The Commission agreed to review their communication procedure. San Juan Mental Health and Substance Abuse SSD Following a discussion concerning the San Juan Mental Health and Substance Abuse Special Service District a motion was made by Commissioner Maryboy and Seconded by Commissioner Adams to temporarily place Commissioners Maryboy and Stevens on the Administrative control board along with Commissioner Adams. None opposed. Commissioner Adams declared the motion carried. Commissioner Adams requested Rick Bailey notify Dan Rogers, Execuitive Director, of the action and have him prepare additional packets for the scheduled Board Meeting next Monday. Commission Reports Commissioner Maryboy attended the meetings of the UACCC in Midway last week and felt they were very informative. He also attended a meeting of the Northern Agency where they are considering the appointment of the Chairman of the Navajo Oil and Gas Agency standing committee. Commissioner Maryboy also reported on his activities with the "Santa goes to school" project which will be in Bluff this year. Many good things have come from this project. He will attend a Special Session of the Navajo Nation Council on the 27th and there is a Northern Agency caucus meeting on the 28th in Window Rock. Commissioner Adams said he also attended the UACCC meetings and the sub-division informational meeting last week. This week he will be out of town on Tuesday and Wednesday but will attend AOG in Price. There will be a ribbon cutting, at Kane Springs, on the 3rd for the recently completed UDOT projects along Hwy 191. Adjourned 12:02 P.M.
