SAN JUAN COUNTY COMMISSION MEETING August 13, 2007 The regular meeting of the San Juan County Commission was held on August 13, 2007 At 10:00 A.M. in the Commission Room at Monticello, Utah Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Lynn Stevens, Commissioner Tammy Gallegos, Administrative Assistant Dianne F. Neuss, SJC Deputy Clerk Attendees: Bob Bushart, David Carpenter, Gerard James, Shurrell Meyer, Joella Krall, Lana Latham, Georgiana Simpson, Nancy Verling, Phil Glaze, Chad Niehaus, Katie Stevens, Howard Randall, Susan DeLorme Commissioner Stevens made a motion to approve the Minutes of August 6th with corrections. Commissioner Bruce Adams seconded the motion provided Commissioner Maryboy has no objection. Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Maryboy was absent for the vote. Norman Johnson - SJC Clerk/Auditor Norman was unable to be present due to other obligations. Commissioner Adams, acting on his behalf, requested Commission approval and signature for the renewal of the Predator Control Contract for FY2008 from the State Department of Agriculture. The Contract provides $5,000. Commissioner Lynn Stevens made a motion to approve the renewal of the FY2008 Predator Control Contract in the amount of $5,000. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Kenneth Maryboy was absent for the vote. Norman received an e-mail from Jean Shaw, Research Consultant for the Utah State Property Tax Division, inviting anyone interested to attend a free class relating to the Utah Property Tax System and Administration. It will be held in various locations throughout August and in Grand County on September 5th and 6th at the Grand County School District Office from 6:00-9:00 p.m. Joella Krall and Members of the San Juan County Library Board Joella and the other members of the SJC Library Board introduced themselves to the Commissioners: Lana Latham, Shurrell Meyer, Georgiana Simpson, Nancy Verling and Susan Taylor. After attending the Annual Library Trustees Meeting in May, they learned that they need to make an annual report to the Commission. Nancy reported that the SJC Library staff is doing a terrific job under difficult circumstances carrying on traditional library services as well as other library programs. Although, Lana will be leaving her position as Library Director, Shurrell Meyer will take on the responsibilities as Acting Interim Library Director. The Commission expressed their appreciation for all of Lana's efforts on behalf of the County. Shurrell distributed a report with information detailing some of the recent accomplishments that have been completed. A web page was developed enabling the public to access the library catalog on line. One can also check their account and renew books, CD's and other materials on line. She reviewed the statistical information showing substantial growth in the use of library facilities. Commissioner Stevens asked if there are any statistics showing what kind of materials are checked out during the school year. Shurrell said there are none but there is a way to obtain that information. Lana detailed other programs offered by the library which include Story Hour, a Summer Reading Program, a Book Club and activities such as reading time accompanied by prizes and a Puppet Show. The plan is to provide these activities at both Libraries. Nancy also discussed the Library's involvement with other programs around the State such as the Utah Arts Council Great Reads Program and others. Lana also discussed grants in progress and the Bill and Melinda Gates Foundation Grant which will provide eleven new computers. Georgiana discussed the vision for the Library System including trying to find a place for the Bookmobile in Bluff with a facility where they can, not only store books for the Bookmobile, but make them available to the public as well. They are also planning to expand the Monticello and Blanding libraries making use of the unoccupied space in both buildings. They have formed a partnership with the San Juan Foundation and hope they can help in trying to obtain funding for these projects. The possibility of the School District's help in expanding one of their educational facilities to allow for library services along with a gym was discussed. Monty Perkins is arranging a meeting with an architect to discuss the plans for the changes at the Monticello and Blanding Libraries. After discussion, it was suggested that we should try to find a way to access CIB Funds for some of the projects. Cleal Bradford has a lot of experience with obtaining grant funds. David Carpenter, from the Bluff Service Area, also suggested that they may be able to be of some help in some way as they are in charge of recreation. Joella requested suggestions from the Commission to help them find funding to create another full-time librarian position for the Blanding Library. Commissioner Bruce Adams advised that they submit their request in November for next year's budget. It was also suggested that Joella meet with John Fellmeth to go over the Library Budget and look at the possibility of reallocating funds to provide more money for a new position. In November, when new budgets are submitted, adjustments will be made after review of the overall County budget. A suggestion was made that library facility maintenance could possibly be paid from the General Fund or obtained from other sources rather than from the Library Fund. The Commission complimented the Library Board Members and Employees for all their efforts in trying to maintain and improve the San Juan County Library System. It was noted that, with the two new members appointed to the board at last week's Commission Meeting, there are now nine members, creating a full board. Commissioner Adams is a Library Board member and he will make every effort to attend board meetings and can be contacted by phone. Cyndi Eldredge - Human Resources Office Cyndi requested approval to hire James Walker for the position of EMT-1, Step 134, for the SJC Emergency Medical Service. He is experienced and highly qualified for the position and is presently employed with the Forest Service. Commissioner Kenneth Maryboy made a motion to approve the request to hire James Walker for the EMT-1 position at Step 134 as recommended. Commissioner Lynn Stevens seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous. Chad Niehaus and Katie Stevens, Moab BLM - Request Road Closure Chad and Katie, of the BLM, are working on a permit for the Granny Gear Production Company for the upcoming bike race, "24 Hours in Moab" scheduled for October 12th and 13th. This is an annual event held since 1995. The request is to close the "Behind-the-Rocks" road from 10:00 a.m. Saturday until 2:00 p.m. on Sunday. The purpose of the request is to ensure safety for participants, spectators and the public in general. It was noted that the entire event takes place in San Juan County with the event headquarters on SITLA land. Commissioners consulted Evan Lowry and he is in favor of closing the road for the event as long as the public is notified in advance. A discussion regarding proper notice to the public, EMS service and law enforcement ensued. In the past, EMS Services have been provided by Grand County. Tammy Gallegos suggested that they should discuss EMS Service with Linda Larsen, SJC EMS Director to make sure there are no jurisdiction issues. It was recommended that a notice should be published in the local newspapers as well as in the Times Independent two weeks in advance of the event, notifying the public of the road closure. It was agreed that a sign will be erected with the dates and time of the road closure well in advance of the event and also that Sheriff Lacy should be contacted advising him of the plans for this event. Commissioner Lynn Stevens made a motion to grant the request to close the entire course for the race as recommended by the BLM. Commissioner Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Evan Lowry - SJC Planning Office Evan said he had not had a chance to write the letter regarding the Wild and Scenic River designation but will have the letter to the Commission for signature today. Evan said he was in Cedar City last week attending the Rural Summit Meeting. Tammy Gallegos - SJC Administrative Assistant Tammy requested approval for two building permits. Jeffrey Foster - 15 south McElhaney Lane, Moab - Barn/Shed Britt R. Barton - 461 West 500 South, Blanding - Residence Commissioner Lynn Stevens made a motion to approve the building permits providing all appropriate signatures are placed. Commissioner Maryboy seconded the motion. Commissioner Adams declared the motion carried by unanimous vote. Open Time and Other Business Bob Bushart asked if the Commissioners had received his E-mail concerning the placement of a cell tower in the Bluff area. Commissioner Adams said he received numerous e-mails from concerned Bluff residents as well as his. Bob requested Commissioner Adams to read the latter part of his e-mail. The e-mail centered around claims regarding Charles DeLorme's involvement with the plan for the site of a cell tower near Bluff. Commissioner Stevens informed Bob that this was not the forum to air personal accusations against a San Juan County employee and that he found Bob's claims to be aggressive and unsubstantiated. Bob said that he did not mean it to be personal but agreed that his e-mail was aggressive, and apologized. Commissioner Stevens expressed the Commissions sensitively to the great need for phone service on the Reservation where there is no hard line service, 911 services or cell service. He said he also understands that Bluff residents are uncomfortable and concerned about cell tower placement interfering with scenic byways and historical sites. So far we know that the Red Mesa Chapter was negotiating for a tower to be placed south of Bluff and Commissioner Maryboy will look into the agreement made with Red Mesa. It is understood that Bluff residents are concerned with the plans and want to be informed of any plans for cell tower placement. Phil Glaze, from the Wilson Arch Subdivision, reported that UDOT placed three small garbage cans at the Wilson Arch site but that they are inadequate and garbage is overflowing and blowing all over. He expected a large dumpster to be provided. He also complained that truckers and others leave buckets of oil at the site. He reported that a sign was also placed indicating a rest area 10 miles from Wilson Arch going north. Another issue he is upset about is that UDOT changed the requirements for the A and D lanes he is putting in for the subdivision in the middle of the design process. The Commission will write a followup letter to Hugh Kirkum and to Tom North advising them of the problems that Mr. Glaze is encountering. Jerard James, from the Hovenweep area, said that he lost his trailer home on June 11th due to a fire. He requested the County's assistance to widen the road and level the property to allow for a new modular home to be delivered. Lynn Laws, Road Superintendent, said that the department funding only allows maintenance of County B-Roads and that funds are allocated to the Chapters for road maintenance. Commissioner Maryboy said that the Aneth Chapter does not have the right equipment for the job. It was suggested Navajo Trust Fund or Revitalization funds could be obtained to help Mr. James and that Lansing Construction could be hired to do the work. Commissioner Maryboy will follow up in trying to obtain the funds to help Mr. James. Linda Larsen reported that she met with Charles DeLorme and that he will provide $5,000 to Mr. Barton, the owner of the Bull Hollow Raceway, to help pay for emergency services. Mr. Barton will make payments to the County for the remainder of the debt. Lynn Laws, SJC Road Superintendent, spoke with Rick Bailey about repairing the San Juan Hospital parking lot. He recommended that Paul Sonderegger take a look at the parking lot to see what he thought about the repairs that need to be made. The original plan was to patch the surface but Paul said that the surface is unstable and needs to be torn out and recommended that it be resurfaced with six inches of cement providing a more permanent fix. He submitted an estimate for resurfacing the parking lot and other designated areas in the amount of approximately $100,000. Commissioner Stevens, who is on the Transportation District Board, said that the Transportation District provides funding to the County and asked Lynn to check with Rick to see if there are funds to cover the project. Lynn will provide Rick with the estimate and let him know that the Commission approves of the project, if the money is available. Commissioner Lynn Stevens made a motion to approve the concept of resurfacing the parking lot area at the San Juan Hospital provided the money is available. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. The Commission expressed their appreciation to Lynn and his crew for road improvements made to the Fairgrounds. The Commission agreed that the San Juan County Fair was a great success and would like to publish a Resolution in the local newspapers a week from this Wednesday recognizing Anna Thayn, Fair Manager, sponsors and everyone who contributed to the organization of the fair. Tammy will work on getting the Resolution of appreciation published in the local newspapers. Commissioner Stevens said that he received a brochure announcing that representatives of the State's Health Insurance Program for children, CHIPS, will be stationed at the Navajo Fairgrounds on November 14th to distribute information and to enroll children in the program. The insurance is for children who have no health insurance. Since most Native American children are covered by the Navajo Healthcare Services, he suggested that the program representatives be contacted to let them know that other children in the County may not come to the Fair and that it might be a good idea for them to visit other parts of the County, (LaSal, Monticello and Bluff). Tammy will find out who to contact at the Utah State Health Department. Commissioner Adams said he spent most of the week at the San Juan County Fair. He will be traveling to Cedar City today but will return to attend the RAC meeting at 6:30 a.m. on Wednesday in Green River. Commissioner Maryboy will be in the County until Wednesday when he will travel to Window Rock to attend an Economic Development Meeting. He attended the Aneth Chapter Meeting and will attend the Red Mesa Chapter meeting tonight. He also thought that the fair went very well. Commissioner Stevens met with the Governor in SLC last week and also attended the SJC Fair. He will attend the BOE Meeting beginning at 3:00 p.m. this afternoon.
