SAN JUAN COUNTY COMMISSION MEETING July 23, 2007 The regular meeting of the San Juan County Commission was held on July 9, 2007 At 9:00 A.M. in the Commission Room at Monticello, Utah Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Lynn Stevens, Commissioner Rick Bailey, SJC Administrator Norman Johnson, SJC Clerk /Auditor Dianne F. Neuss, SJC Deputy Clerk Attendees: Walter Bird Bob Bushart Neil Joslin John Fellmeth Lynn Laws Howard Randall Commissioner Kenneth Maryboy made a motion to approve the minutes of July 23, 2007 with corrections. Commissioner Lynn Stevens seconded the motion. Commissioner Adams declared the motion carried by unanimous vote. Walter Bird, SJC Assistant Attorney - Human Resource Office Walter attended the recent Library Board Meeting and reported that the Board would like to make a changes employing a full time librarian for the Monticello Library and for the Blanding Library, in addition to a Library Director, whose hours would be determined. Lana Latham, Library Director, recently submitted her resignation and her last day is August 17th. Meanwhile Shurrell Meyer, from the Monticello Library, said that she plans to leave her position at the Monticello Library but is interested in the position of Library Director. Walter noted that the library budget is the limiting factor in this change. Commissioner Stevens advised that State Statute requires the County to have a Library Director. Walter suggested that, since they are probably a month or two away from hiring a Library Director, Shurrell Meyer could fill this position in the interim. Walter said he is encouraged by the direction the Board is taking but is concerned with budget issues related to the changes. Commissioner Stevens made a motion to recommend that Shurrell Meyer be reassigned to the position of interim Library Director and that the Library Board proceed with their plans. Commissioner Kenneth Maryboy seconded the position. Commissioner Bruce Adams declared the motion carried by unanimous vote. Charles DeLorme - SJC Economic Development Director Charlie presented a letter he drafted to the Kevin J. Martin, Chairman of the FCC, for Commission approval and signature. The letter expresses objection to the FCC's adoption of a recommendation, by the Federal-State Joint Board on Universal Service, to place a cap on the use of the Universal Service Funds to promote the build-out of wireless infrastructure. Our County is already using these funds to improve wireless service in rural areas. The group reviewed and discussed the issues of phone service in rural areas and agreed that, limiting the use of this fund, would be detrimental to our County. Rick noted that some areas will never be provided with hard line phone service making it all the more important that wireless infrastructure be pursued. Commissioner Stevens made a motion to approve the letter for all three Commissioner's signatures. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Charlie requested approval for Out-of-State travel to London at the end of September or the beginning of October of 2007. He explained that the Utah Office of Tourism invited him to go as a delegate with three other individuals to make presentations to tour companies regarding travel to Utah and to SJC. The invitation was extended to him based on his front line tour operator experience in conducting international trips. Although, air travel is covered, he will be responsible for hotel and meals. Commissioner Lynn Stevens made a motion to approve the Out-of-State Travel Request. Commissioner Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Charlie said that the Bluff Swinging Bridge Restoration project will cost considerably less than anticipated because the span of the bridge is only 240 feet, not 500 feet. This is due to several factors that caused narrowing of the river over time. Charlie also reported that the Engineer for the project got bumped off his flight but plans to come down on August 19th. Rick reported that he spoke to the Transportation District Board regarding funding and they have agreed to contribute to the project. Charles noted that there is a Utah Rural Summit Meeting in Cedar City on August 9th and 10th but explained that no one from his office will be available to attend the meeting this year. Evan Lowry - SJC Planning Office J.L. Thornton, from the SJC County Water Conservancy District, submitted an application to the BLM requesting a permit to work on an access road to the Clay Draw Reservoir site. Evan helped with the permit application. The BLM requires an archeologic study be done before a permit can be issued. Since the BLM archeologists are unavailable, Evan asked Lee Bennett to do the study. She agreed to do the work and submitted a cost estimate of $2,000. Mr. Thornton has been in touch with Lynn Laws and walked the area with him. If there are no archeological issues, the BLM will still need 30 days to approve the project. Commissioner Stevens said that he would try to expedite the process. The hope is that the drilling can begin at the end of August and, if the site is suitable, then the designing phase could begin as well as identifying funding sources for the project. Commissioner Adams said he spoke to members of the State Division of Water Rights before leaving for Richfield and they indicated that, if they can get the permit and get the road bladed so that they can get a drill rig into the area, they will be able to begin drilling. After they obtain the data from the drilling, the project will be locked into the State's time frame for designing and obtaining resources. He also learned that funding may be available at the federal level. Commissioner Lynn Stevens made a motion to approve the funding for Lee Bennett to do the archeological study north of the Clay Draw site. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Adams noted that he received an e-mail from Mark Stilson, from the State Division of Water Rights, and he would like to meet with the Commission to discuss Wilson Arch and Natural Bridges water issues from a State and Federal point of view. Commissioner Adams suggested that Evan and Norman Johnson also attend the meeting which will be on August 21st at 2:30. Evan reported that he received the invoice from USGS for $14,100 for the County's portion of the cost for the stream gages at Spring Creek and North Creek. Evan reported that he will meet with the Forest Service regarding the Travel Management Plan on Thursday. Rick Bailey - SJC Administrator Rick presented five building permits for approval and signature. Stuart W. Smith - Elk Meadows, Monticello - Storage Building Rex B. Trusler - 441 East 1250 North, Blanding - AG Building Erich Schneider - 43 Behind the Rocks, Moab - Carport Commissioner Lynn Stevens made a motion to approve the building permits provided all appropriate signatures are placed. Commissioner Bruce Adams seconded the motion and declared the motion carried by unanimous vote. Commissioner Maryboy was absent for the vote. Lynn Laws requested approval for the procurement of gravel and chips for the Road Department. He originally received two bids but decided to ask the two companies, Monument Resources and Crowley Construction, to re-bid, because he felt that the original bids were too high. Monument Resources came in with the low bid at $98,000. Lynn provided Commissioners with the information on the bids and the process was reviewed and discussed. Commissioner Lynn Stevens made a motion to approve the low bid from Monument Resources for gravel and chips in the amount of $98,000. Commissioner Bruce Adams seconded the motion and declared the motion carried by unanimous vote. Commissioner Maryboy was absent for the vote. Lynn discussed his negotiations with the Department of Energy in Moab for the purchase of mulch to be used in the northern part of the County. He was advised to calculate the amount of mulch needed. LeGrand Johnson presented a proposal indicating the cost to the County. Due to the favorable price, Lynn recommended purchasing the mulch from LeGrand Johnson. They will stockpile it for us so it can be used as needed. Lynn said he thinks it would even be cheaper to buy mulch from LeGrand to use in other parts of the County as it is cheaper even with transportation costs. Commissioner approval for the proposal is requested. Commissioner Lynn Stevens made a motion to approve proposal from LeGrand Johnson as recommended. Rick presented Resolution 2007-07 selecting the County Engineers of Record for a five year period of time. He received three proposals, one from Cramer & Noble and the other from Jones & Demille, who are the County's present Engineers of Record, and one from another applicant who decided to withdraw their proposal. Rick recommended Commission approval and signature for Resolution 2007-07 selecting Cramer & Noble and Jones & Demille as the County Engineers of Record based on their past service to the County. Commissioner Lynn Stevens made a motion to approve Resolution 2007-07, accepting Jones & Demille and Cramer & Noble as San Juan County's Engineers of Record beginning for a five year period of time ending on August 1, 2011. Commissioner Bruce Adams seconded the motion and declared the motion carried by unanimous vote. Commissioner Kenneth Maryboy was absent for the vote. RESOLUTION 2007-07 A RESOLUTION SELECTING ENGINEERS OF RECORD FOR SAN JUAN COUNTY FOR A FIVE YEAR PERIOD OF TIME. WHEREAS, San Juan County has requested through advertising "Requests for Proposals for an Engineer of Record" for the next five years; and WHEREAS, San Juan County received three proposals of which one requested that their proposal be pulled from consideration; and WHEREAS, San Juan County has used the two engineering firms of Jones and Demille Engineers and Creamer and Noble engineers for the last ten plus years; and WHEREAS, both of these engineering firms did submit a request for proposal and have provided work acceptable to the County. NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of San Juan County hereby select and approve Jones and Demille Engineers and Creamer and Noble as Engineers of Record for San Juan County for a five year period of time or until August 1, 2011. Commissioner Stevens noted that the declaration allows the County to continue to be eligible for specific funding related to drought conditions. Commissioner Lynn Stevens made a motion to Reaffirm the Emergency Drought Declaration for San Juan County extending it to August 22nd, 2007. REAFFIRMATION OF DECLARATION OF EMERGENCY DROUGHT The San Juan County Commission, on the 23rd day of July, 2007, reaffirmed its Emergency Drought Declaration originally declared on the 23rd day of April, 2007 (Declaration 2007-01) for another thirty (30) days or until the 22nd day of August, 2007. Johnson, Clerk-Auditor San Juan County Clerk-Auditor ATTACHMENT Rick requested approval to purchase a new generator from Northern Tool Company in the amount of $1,699.99 for the Blanding Rescue Unit. The present generator needs replacement. The price was the lowest of three comparison prices obtained. The second request was for the purchase of Amkus Hose Reels for the "Jaws of Life", in the amount of $4,500, including installation, from Diamondback Fire and Rescue in Farmington, Utah. This equipment is also for the Blanding Rescue Unit. The third request is to purchase a 13 KW generator for the Monument Valley Fire Department to be used until electric service is installed in the building. Rick's recommendation is to purchase the generator from Northern Tool Company for $2,369.99. Commissioner Stevens moved to approve all three procurement requests. Commissioner Kenneth Maryboy was absent for the vote. 10:00 A.M. - Public Hearing - SJC Building Code Ordinance Addition Commissioner Lynn Stevens made a motion to go into Public Hearing. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Kenneth Maryboy was absent for the vote. The Public Hearing is to address the San Juan Building Code Ordinance Addition: 7-1-4-D, The Utah Wildland-Urban Interface Code (UWUIC), as adopted by the State of Utah, adopting the code as the official Urban-Wildland Interface Code for the County, Subject to Section 7-1-3 of this Chapter (2007 Code). Commission Chair, Bruce Adams, asked for public input regarding this addition to the County's Building Code. Rick advised the Commission that he had not received comments, either written or verbal, concerning this issue. Charles DeLorme asked if the addition to the code would impact property owners as far as landscaping their property. Rick said that anyone who requests a permit for new construction will be advised of the required 20 foot buffer zone around the building to reduce the risk of fire and the loss of property. This will not effect existing buildings. Commissioner Lynn Stevens made a motion to exit the Public Hearing. Commissioner Kenneth Maryboy seconded the motion. Commissioner Stevens made a motion to adopt the Resolution #2007-08 approving the Utah Wildland-Urban Interface Code for San Juan County. Commissioner Kenneth Maryboy seconded the motion. RESOLUTION 2007-008 A RESOLUTION APPROVING THE UTAH WILDLAND-URBAN INTERFACE CODE (UWUIC), AS ADOPTED BY THE STATE OF UTAH AND ADOPTING THE CODE AS THE OFFICIAL URBAN-WILDLAND INTERFACE CODE FOR THE COUNTY, SUBJECT TO SECTION 7-1-3 OF THIS CHAPTER (2007 CODE). WHEREAS, San Juan County has previously approved several building codes; and WHEREAS, San Juan County has advertised the Urban-Wildland fire code proposal for three consecutive weeks in two local newspapers; and NOW, THEREFORE, BE IT RESOLVED that the San Juan County Commission approves the Urban-Wildland Code as the official code for San Juan County. Johnson, Clerk-auditor San Juan County Rick presented a Memorandum of Agreement between Utah Legal Services, Inc, the Utah Senior Medicare Patrol and the San Juan County Area Agency on Aging. The agreement is for twelve months from June 1, 2007 to May 31, 2008 providing $8,000 to be used to educate medicare/medicaid beneficiaries on how to better monitor what is paid on their behalf, and what to do about identified discrepancies as well as educating staff, volunteers and providers associated with the Agency to report fraud, abuse and questionable provider billings to the Utah Senior Medicare Patrol. The $8,000 provided will be administered by the County's Ombudsman Program. Commissioner Lynn Stevens made a motion to approve the Memorandum of Agreement between the Utah Legal Service, Inc for the Utah Senior Medicare Patrol and the San Juan County Area Agency on Aging. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Rick requested authorization and signature for the Task Agreement for the National Park Service to provide funding ($1,500) to the County for Cooperative Emergency Operations in San Juan County, Canyonlands National Park, Hovenweep and Natural Bridges National Monuments. The document covers fiscal year October 2006 through September 2007. Commissioner Lynn Stevens made a motion to authorize and sign the Task Agreement for the National Park Service providing funds for Cooperative Emergency Operations. Rick presented three copies of the proposed BIA Amendment Number Five (5) issued for County Road Maintenance Service in the amount of $82,720 for Commission approval and signature. It extends the maintenance service period to September 30, 2007. Commissioner Lynn Stevens made a motion to approve the proposed amendment from the BIA issued for County Road Maintenance Service in the amount of $82,720 which extends the service period to September 30, 2007. Rick has been working will Bill Howell, Executive Director of Southeastern Utah Government, regarding the Mexican Hat Building Project to provide housing for a Fire Station, Weatherization Facility and Election activities. A CIB Hearing will take place at 8:30 a.m. on September 6th in Salt Lake City to address suspension of the rules to allow funding for the project. Susan made reservations at the Crystal Inn in West Valley City for everyone attending. Bill Howell recommended that it would be an advantage for anyone who is available to attend the hearing to support the effort. Commissioner Stevens agreed to attend and articulate for the group. Commissioner Adams will also plan to attend. Rick will provide the pertinent documentation to Commissioner Stevens. Rick reported that he attended an Engineering Planning Review meeting to go over drawings for the proposed repairs to the Montezuma Creek Bridge that goes over the San Juan River. He noted that he also met with Bob Washnock and others regarding the road realignment at the Lisbon Valley Mine. They are working with the County engineers and he has been in contact with UDOT and they have no problem with going ahead with the plan. Rick had a meeting in Spanish Valley with a consultant and others to discuss options concerning the sewer plan/project there. They are in contact with SITLA regarding a water project as well. Sheriff Mike Lacy - Sheriff's Department Sheriff Lacy requested approval to purchase a fax machine for his office. He recommended purchasing the machine from the low bidder, Business Needz at a cost of $774.00. Commissioner Lynn Stevens made a motion to approve the purchase of a fax machine for the Sheriff's office from Business Needz for $774.00 Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Sheriff Lacy noted that the subject of adding additional jail space to the Pubic Safety Building was discussed at a previous meeting. In the meantime, it has come to his attention that the court rooms in the building need to be expanded to become compliant with State Code. He said that funding is available for court room facilities. Sheriff Lacy recommended that the renovations and/or additions all be done at once rather than trying to piece them together. He made a suggestion that the County consider purchasing the property across the street with a secure walkway from the old building to the new building. His requested Commission approval to conduct a feasibility study to decide on the best plan for expanding the facility. He noted that our court system is three to four times busier now than it has been in the past, especially with the new Drug Court. It was suggested that other counties in the State be contacted who are in the process of expanding their facilities and to try and locate a design firm that specializes in this area. After discussion, it was agreed that the public safety facility is inadequate and needs to be expanded and that plans should be pursued. Commissioner Lynn Stevens made a motion to approve of Sheriff Lacy's request for a feasibility study to be done. Commissioner Kenneth Maryboy seconded the motion and Commissioner Bruce Adams declared the motion carried by unanimous vote. Joyce Martin and Corrine Roring - SJC Historical Commission Joyce and Corrine requested approval to submit a Grant Request to the Utah State Historical Records Preservation Office for $7,500. This money would be combined with $4,200 that is left of the funds from the Hazel Adams Loomis gift to the Monticello Library along with approximately $5,000 from the County (includes in-kind contributions). The money will be used to provide public access to historic photographs in the Monticello Library. There are three thousand six hundred historic photos that have been collected from area residents. The plan is to have the photos computerized for public access. The $4,200 from the Hazel Adams Loomis gift specifically requires the money to be used at the Monticello Library. Commissioner Lynn Stevens made a motion to approve the application for the grant funding to be used for this project. Commissioner Bruce Adams seconded the motion. Open time and Other Business Commissioner Adams received an e-mail from James Adakai, V.P of the Oljato Chapter. The Oljato Chapter has approved FY-07 Navajo Revitalization Fund in the amount of $342.382 to finance the construction of the three phase power line project for Monument Valley Junction Development which includes the new UNHS Clinic, Fire Station, Welcome Center/Vendor Village and future MV Elementary School. The Resolution will be presented at the next Revitalization Board Meeting for official action and payment. Payment will be made to the NTUA immediately to commence with construction activity. Norman Johnson reminded everyone that Commission Meetings will begin at 10:00 a.m. beginning on August 6th. A Road Meeting is also scheduled at 8:00 a.m., before the Commission Meeting. Commissioner Adams noted the Navajo Mountain Pioneer Day celebration will take place on Saturday August 4th . The San Juan County Fair will begin on August the 4th with a Ribbon Cutting Ceremony on the August 8th at 6:00 p.m. Mark Wills will be in concert on Thursday, August 9th and the Rodeo events and the Junior Livestock events will be on Friday and Saturday. Commissioner Adams said that the road from Hwy 191 from the bridge to the State line will be smoothed out. Some drilling found that the road base was inadequate and it may need to be reconstructed. A Press Release from Representative Matheson's office stated that $50,000 would be available for the Halchita Bridge. Commissioner Adams said that the old road is washed out and creates problems. Primarily the money is for a feasibility study, not for the actual work construction costs which will be considerably more than $50,000. Commissioner Adams requested that Rick Bailey review the Travel Reimbursement Policy of the State of Utah as well as Federal Travel Policies. The Commission discussed the difference in travel expenses in large cities compared to in smaller rural areas and adjustments that are made for travel in different parts of the country by the State and Federal agencies. After Rick reviews the information he will forward it to the Human Resources Department for their review and recommendations. A letter from the BLM was sent to the Commission regarding maintenance on a road that is predominantly within an area closed to vehicle use by the San Juan RMP (north river corridor from Comb Wash to Lime Creek). The letter indicated that the work was done by members of SPEAR. The BLM proposes to install signs noting that the road is closed to vehicle use. Commissioner's Reports Commissioner Stevens spent ten days out of the County on a family vacation and returned to attend the State Association of County Commissioners and Council Members Meeting in Richfield on Friday. He met with Nick Sandberg, Acting Monticello BLM Field Manager, to discuss the Recapture Trail. As a new Trustee, he attended has first Eastern College of Utah Trustee Meeting and was appointed to the Audit Committee. He will meet with the Vice President of the College, to discuss the College and San Juan County issues. Commissioner Bruce Adams attended the NACO Convention in Richmond, Virginia and said it was a really good experience. He noted that Senator Hillary Clinton spoke at the conference. He also attended the State Association of County Commissioners Meeting in Richfield, Utah. He will be out of the County on Tuesday and in Durango on Wednesday. He will be in the County the remainder of the week. Commissioner Maryboy also attended the NACO Convention in Richmond, VA and said it was quite an interesting experience. Some concerns that impact Native Americans were addressed at the conference. He expressed his interest in being on the Finance Intergovernmental Native American Affairs Steering Committee. Commissioner Maryboy discussed gaming and said that SJC Navajos in Montezuma Creek and Aneth are pursuing class two gaming interests. He attended the Navajo Nation Council on Thursday where an agenda item preventing Supervisors and County Commissioners from serving on the Navajo Council was voted down and taken off the agenda. He traveled to SLC Thursday evening to attend a Dine' Committee Meeting on Friday. There were four Mexican Water Resolutions on the Agenda in addition to Veterans and Navajo Trust Fund Administration issues. Tomorrow he plans to travel to Albuquerque, NM with the Utah Navajo Commission to request additional money for the Economic Committee. He will also join the negotiations to try and purchase a NM Speedway where the Utah Navajos would like to establish a casino.
