SAN JUAN COUNTY COMMISSION MEETING July 2, 2007 The regular meeting of the San Juan County Commission was held on July 2, 2007 at 9:00 A.M. in the Commission Room at Monticello, Utah Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Lynn Stevens, Commissioner Rick Bailey, San Juan County Administrator Norman L. Johnson, County Clerk /Auditor Attendees: Bob Bushart, Greg Martin, Cyndi Eldredge, Monty Dalton, Charles DeLorme, Earl Lee, Evan Lowry Commissioner Lynn Stevens made a motion to approve the minutes of June 25, 2007, with corrections. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Cyndi Eldredge - Human Resources Office Cyndi advised the Commission that Lana Latham, Blanding Library Director, resigned her position effective August 17th and that the position needs to be advertised. The Library Board will be involved with the new selection and job description process. Cyndi verified that the Commission intends to hold the Department Head / Elected Official meeting at 8:00 a.m. before next week's Commissioner Meeting. The EMS Transport / Responder position has been advertised and there were five applicants of which two were interviewed. Cyndi requested approval to offer the position to Cory Taylor with Ray Whaley as an alternate if Mr. Taylor does not accept the position.. Following a discussion, Commissioner Stevens made a motion to approve the recommendation. Commissioner Maryboy seconded the motion. None opposed. Commissioner Adams declared the motion carried. Norman Johnson - SJC Clerk / Auditor Norman presented a list of sixty eight (68) EMS Ambulance accounts, totaling $67,688.39, to be written off. Following a short discussion, Commissioner Stevens made a motion to approve the accounts being written off, and follow the usual collection procedures. The motion was seconded by Commissioner Maryboy. None opposed. Commissioner Adams declared the motion carried. Evan Lowry - SJC Planning Office Evan discussed the road up cottonwood and the need to spend the State grant. Cleal Bradford has arranged a meeting with the Ute Tribe and the State for tomorrow at the Blue Mt. Café in Dove Creek. Commissioner Stevens will attend the meeting along with Evan. Evan requested that the Commission plan to meet with Alice Carlton and Lee Johnson at around 11:00 a.m. next Monday. The Commission agreed and asked Evan to follow up on the meeting. Evan reported that the Title 5 Permit for the Hole-in-the-Rock Trail has been received from the BLM, and the signs are being worked on. Rick Bailey, San Juan County Administrator Rick submitted six (6) building permits for approval and signature. Phillis Book - 225 S. Box 82 - Manufactured Home - LaSal Commissioner Maryboy made a motion to approve the building permits provided all the appropriate signatures are placed. Commissioner Stevens seconded the motion. None opposed. Commissioner Adams declared the motion carried. Rick provided the Commission with an updated STIP Management List and requested their review and comments. An e-mail from Energy Fuels was reviewed requesting permission to drill three geotechnical holes at the location of the old Energy Queen Mine also known as the Hecla Shaft. The old evaporation ponds are partly on County property. Rick feels it will be of advantage to the County, from a liability standpoint, to allow the drilling. Following a discussion, Commissioner Lynn Stevens made a motion to approve Energy Fuels drilling three geotechnical borings at the location of the old ponds on the San Juan County property to test the feasability of using the old pond location for the proposed mines new water treatment system ponds. Commissioner Maryboy seconded the motion None opposed. Commissioner Adams declared the motion carried. Rick reported that we have received around $46,000 from the State for the E911 Cell Phone Identification System and that the ongoing call assessment fees should pay for the network charges which are being levied on the County. There were three fires last week in the county and the large fires in Northeastern part of the State are spreading the resources very thin. Currently, there is a large haystack fire in LaSal. Rick feels there will be fire restrictions very soon on Federal and State lands. Rick requested approval on a procurement in the amount of approximately $1,800 to up-grade the 800 mz radio to link up with Montezuma and Delores Counties in Colorado. Even though he does not have an exact price, it is quite important to get this done very soon with the high fire danger. Commissioner Lynn Stevens made a motion to approve the purchase and the motion was seconded by Commissioner Maryboy. None opposed. Commissioner Adams declared the motion carried. Rick will be in Spanish Valley tomorrow meeting on the proposed sewer system. UDOT - Aviation has granted funds to patch and restripe the Bluff Airport but it will require a $5,000 match. Although the money is not budgeted, the Commission discussed the advantages of accepting the grant funds. Following a short discussion, Commissioner Stevens made a motion to approve accepting the grant. Commissioner Maryboy seconded the motion. None opposed. Commissioner Adams declared the motion carried. Open Time and Other Business Mr. Bob Bushart, of Bluff, discussed the continuing sewer lagoon problem in Montezuma Creek and the lack of attention it is being given by NTUA. It seems both lagoons are leaking into the river. Commissioner Maryboy will work on the issue with the Chapter.. Rick Bailey said that another NTUA problem is with the Monument Valley electric lines and that they are now going to require a full Environmental Impact Statement. President Shirley, of the Navajo Nation, is being contacted and Commissioner Maryboy will work on the issue and try to set up a meeting with him. Mr. Bushart reported an incident that took place on the highway between the State line and Bluff when he was chased by another vehicle. Law Enforcement arrested the driver in this instance, but there have been other situations of similar nature recently. Charles DeLorme , SJC Visitor Services, indicated there was a new person at UDOT and the Bluff Visitors Center project could be on hold for up to two years. He said the project construction money could be advanced and then reimbursed, but there is always risk with that. Greg Martin, of Monticello City, stated the same information had been received on the Monticello Visitor Center parking area. Monty Dalton asked the Commissioners if any help could be offered on a 1/4 mile road that leads to a private cemetery in Verdure. The Commission said they will have Lynn Laws look at it. Commissioner's Reports Commissioner Stevens enjoyed the experience of speaking to the School Bus Personnel and members of the Utah Highway Patrol. He plans to be in the County all week. Commissioner Maryboy will be at a Special Session of the Council tomorrow in Window Rock and plans to be in the County the balance of the week. He reported on the Governor's visit and discussed a few of the issues that were not covered while he was here. Commissioner Adams said he an Rick met with the Governor in Bluff and Monument Valley. They went to the Goosenecks State Park and into a private Navajo Family residence. He said that Governor Huntsman committed to return and go to Navajo Mountain in the future. Commissioner Adams will be out of the County the rest of the week. Earl R. Lee - Southern Fair Manager Mr Lee was introduced to the Commission as the Manager of the Southern Fair. He said the Vice- Chair is Magdalene Rock. It is their intent to make the Fair a Community event. He asked for the co-operation and understanding of law enforcement of people visiting from Arizona and New Mexico who have different automobile rules. He asked the Commission if there were any written rules, policies or procedures for the event. Mr. DeLorme will be working with them on the Fair as it progresses. In another issue, Mr. Lee indicated the UNHS Montezuma Creek Clinic will be part of a statewide influenza, disaster drill in the near future. Meeting Adjourned 10:34 a.m. PUBLIC HEARING An Ordinance vacation County Road #1251 in Long Canyon At 11:00 a.m. a Public Hearing was conducted by Commissioner Adams to hear comment from the public concerning the proposed closure of County Road #1251. Monty Dalton was present and indicated the road did not end on private property but continued to some old mining claims. He felt the County might want to check into this before closing the road. There were no other comments or members of the public present.
