SAN JUAN COUNTY COMMISSION MEETING May 21, 2007 The regular meeting of the San Juan County Commission was held on May 21, 2007 at 9:00 A.M. in the Commission Room at Monticello, Utah Present: Bruce Adams, Commission Chair Kenneth Maryboy, Commission Vice Chair Lynn Stevens, Commissioner Norman Johnson, SJC Clerk/Auditor Tammy Gallegos, SJC Administrative Assistant Dianne F. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Susan Taylor - SJC Economic Development Susan along with Charlie DeLorme and KC Hickman attended the State Tourism Conference which was held in Price last week. Susan said that she is extremely pleased to report that SJC Economic Development won two Statewide yearly awards. One award was for "Best Radio Ad" and the other for "Best CD and DVD." Susan also discussed the recent Red Bull Air Race and the efforts made by Charlie to address organizational concerns clearing the way for the event to be held in San Juan County. She said that Charlie met with Jeff Robinson from the Utah Sports Commission regarding the event and reached an understanding regarding communication and cooperation in 2008 assuming they hold the event here again. Commissioner Adams said that he attended the Oljato Chapter meeting yesterday and there were some members who had problems with the event. These will need to be addressed if the event is held in Monument Valley in the future. Susan also noted that the director of a German Tour Company has decided to book tours in San Juan County beginning in 2008. Charlie met with the director of this company at the International Tourism Marketing Conference he attended in Germany several months ago. Tammy Gallegos - SJC Administrative Assistant Tammy said that she received a request from Monty Perkins for approval of a proposal for the County to deed an eight foot strip of unpaved County property near the Blanding Senior Center to Utah State University. They would like to erect a fence on the property and proposed that they pay for the fence and, in addition to the County deeding the land, asked that the County erect and maintain the fence. Commissioner Stevens expressed his view that he sees no need or justification for a fence in the area and is against the proposal. After a brief discussion it was put to a vote. Commissioner Lynn Stevens made a motion to deny the proposal. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Walter Bird - SJC Assistant Attorney Water presented a proposal from Baseline Minerals to lease County road sites for Oil and Gas mining. Walter explained the proposal in more detail. The lease would be for five years or more, depending on use of the leased property. It was decided that there is no significant financial incentive and that if the County decided to lease road sites, it would put it up for a competitive bid. Commissioner Lynn Stevens made a motion to disapprove further action on the lease process for Baseline Minerals. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Bruce Bunker - SJC Building Inspector Bruce Bunker, SJC Building Inspector, presented three separate amendments to the Pupalo Subdivision, Phase One, Two and Three. Two of the three have been signed by the appropriate entities but one of the amendments had an easement issue. Although the utilities have been placed in the ground and an access point is available for connection to the utilities, the easements are not shown on the Plat for Amendment 3, Phase 1 of the Subdivision. There was controversy regarding this issue and a lengthy discussion took place between the Pupalo Subdivision Surveyor, Doug Pearson, David Bronson, SJC Surveyor, and Commission members. After each explained and demonstrated their viewpoint on the issue, it was decided that Doug and David would write a description and make notes on the Plat showing the point of accessability to utilities for the lots in question and to also show the easements to satisfy the requirements for approval and signature. They also discussed the Old School House Subdivision which was presented for approval and signature. This subdivision also had a issue with utility easements and after discussion it was determined that it could also be amended to meet requirements. Other issues discussed were Green belt status as it relates to subdivisions. Commissioner Lynn Stevens made a motion to approve Pupalo Subdivision Phase One, Amendment 1 and Phase Two, Amendment 1. Phase Three, Amendment 1 of the Pupalo Subdivision and the Old School House Subdivision are approved with the required changes to the Plats. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried. The Spring Draw and Wilson Arch Subdivisions were unable to be presented today for approval and signature due to easement and sewer issues respectively. Jim Keyes - Utah State University Extension Jim put three bids out for the purchase of chemicals to treat weeds in the County. He received only one bid back from the Steve Regan Company and recommended purchasing the chemicals from them. Commissioner Lynn Stevens made a motion to approve the purchase of the chemicals from the Steve Regan Company. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. He noted that there will be a horse sale and that an add will be placed in the newspapers advertising the date and time. He said the sale will probably be limited to 55 or 60 horses. Commissioner Stevens reported that the 4H Club's horse show last weekend was a very positive event. It was held at Commissioner Stevens' Arena in Blanding and there were participants from Blanding, Monticello and Bluff. Kim Christy, Adam Robison, Cary Zielinsky and Richard Wilcox - SITLA Bryan Torgerson was unable to attend today's meeting due to illness. Adam Robison, Forester from Hanksville, gave a power point presentation regarding the LaSal Mountain Management and Stewardship Project. Adam showed a map of the area where SITLA plans to realign a road, decommissioning part of it and constructing a new road that ties into the County Road near Two Mile Creek. This project will prevent rutting and further damage from water runoff and sediment deposits. They also plan to grade, install cross pipes and gravel to the existing County road and the new portion of the road. He showed photos of the road damage and explained what needs to be done to correct the problems in the area. They plan to begin the project the third week in June. The Commissioner requested that they meet with Lynn Laws, Road Superintendent and Jack Randolph, North Forman, to discuss the project. Kim said they would be happy to meet with members of the Road Department today and look forward to establishing a relationship with the County Commission and the opportunity to take care of the some of the other forest issues in the County. Open Time and Other Business Commissioner Stevens said that about a year ago Mr. Lunt asked that a road on his land be taken off the County Road System. Walter will check and see if a Public Hearing was held to address this request and will contact Mr. Lunt to let him know if the road has been taken off the system. Commissioner's Reports Commissioner Stevens will attend the South Eastern Regional Public Health Board Meeting in Green River on Tuesday and will travel to Salt Lake City on Wednesday and will attend the Association of County Commissions of UAC on Thursday. Commissioner Adams attended the Oljato Chapter meeting on Sunday and will attend the UAC meeting on Wednesday. He plans to be in the County for the remainder of the week. Commissioner Adams said that the Tomhave Group will be in the County on Sunday to Wednesday of next week and, if possible, he would like to fly them around the County. 12:36 p.m. - Commissioner Lynn Stevens made a motion to go into an Executive Session to address a Personnel Issue. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. 12:44 p.m. - Commissioner Lynn Stevens made a motion to exit the Executive Session. Commissioner Lynn Stevens moved to terminate Steve Meehan as a County Employee and authorize the Chairman of the Commission and Assistant Attorney Bird to notify Mr. Meehan of the decision.
