SAN JUAN COUNTY COMMISSION MEETING May 14, 2007 The regular meeting of the San Juan County Commission was held on May 14, 2007 at 9:00 A.M. in the Commission Room at Monticello, Utah Present: Bruce Adams, Commission Chair Kenneth Maryboy, Commission Vice Chair Lynn Stevens, Commissioner Norman Johnson, SJC Clerk/Auditor Tammy Gallegos, SJC Administrative Assistant Dianne F. Bellson Commissioner Lynn Stevens made a motion to approve the minutes of May 7, 2007. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Lynn Stevens and Calvin Blake, Rainbow Air Commissioner Stevens invited Calvin Blake to discuss Cal Black Airport and the inability to move forward with plans to improve the airport due to a pending lawsuit with the Sierra Club. Calvin explained that he has been in contact with the owner of World Jet in Florida who is interested in building a hanger at the airport. He also expressed interest in building a store and a dry dock marina. He is willing to post a bond for liability and reclamation, if necessary. Commissioner Stevens said that the agreement is clearly negotiable and could probably be paid as a one time fee. He would like to get started leveling the ground this summer so that they can begin construction of the 100' x 100' hanger this winter. Commissioner Stevens noted that it would be an advantage to the County increasing our tax base. Calvin Blake has been in contact with the FAA in Washington State and in Oregon but they seem to be putting him off. The BLM has no objection to the improvement of the airport. Calvin said that it is a real drawback not having a permanent hanger or any other services available at the airport. Commissioner Stevens will obtain the background information from Rick and try and get an update regarding this issue. There is also a question of ownership of the airport property. Commissioner Stevens will check with the BLM and contact the interested party in Florida to discuss his plans. Norman Johnson - SJC Clerk-Auditor Norman requested approval and signature for the 2007-2008 SSBG Contract. Norman discussed the details of the contract which is for $59,668.08. Commissioner Lynn Stevens made a motion to approve the 2007-2008 SSBG Contract for signature. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. It was noted that Dan Rogers, of the SJC Mental Health, recently received $70,000 for the indigent population He will be in later today to update the Commissioners regarding this funding. Cyndi Eldredge - SJC Human Resources Office Cyndi recently conducted interviews along with Anna Thayn, SJC Fair Manager, for a Fairgrounds Maintenance Worker. Cyndi recommended Jared Anderson for this temporary position at $9.68 per hour. Commissioner Kenneth Maryboy made a motion to approve hiring Jared Anderson for the Fairgrounds Maintenance Worker. Commissioner Lynn Stevens seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Rob Winthrop, BLM Acting Field Director Evan introduced Rob Winthrop, Acting Monticello BLM Field Director, who is temporarily taking Sandy Meyers place. Sandy was promoted and is now in Washington, D.C. Nick Sandberg from the BLM accompanied Mr. Winthrop to the meeting today. Mr. Winthrop stated that he will be in the Monticello Field Office for sixty days and hopes that he can continue to be of assistance with ongoing BLM projects. He said he will be leaving to attend a State Wide BLM Meeting in SLC today but will return at the end of the week. He met with Evan Lowry recently and discussed the ongoing BLM Resource Management Project. He is most interested in the socioeconomic impacts of the BLM locally and regionally and said that he assisted in writing the new Cooperative Agreement for the BLM. He has been briefed by staff members on issues such as minerals, roads and recreation and is extremely impressed by the Monticello BLM staff and especially with Nick Sandberg. Commissioner Adams said that the Congressional Delegation is concerned about moving the RMP process along. He also advised Mr. Winthrop that, since over half of San Juan County residents are Native Americans, it is very important to all three Commissioners that Native American interests be met and that they are included in any decisions that are made by the BLM. The Native American perception is that they are not fully informed or included in the process or decisions that are made. Commissioner Adams noted that Commissioner Stevens continually supports and works to assist Native Americans in his district as well as in the entire County and commended him for his accomplishments. Commissioner Maryboy explained that there are seven Native American Chapters in the County and that efforts should be made to communicate and coordinate with members of the Chapters. He stressed the importance of getting to know the needs of medicine men and herbal practitioners so that decisions are not made that adversely effect their access to wilderness areas. Commissioner Maryboy said that Native American government is structured including national leadership. He said that he is available to assist in any way to promote communication between the BLM and the Native American Community. Rob said that he will work to protect the interest of Native Americans and would welcome the opportunity to attend Chapter Meetings. Commissioner Adams invited him to the Oljato Chapter Meeting which will be held on Sunday, May 20th. Rob is available and will make arrangements to attend. Edward Tapaha, the liaison between Native Americans and the County is also available whenever needed and an interpreter is available at all Chapter meetings. Commissioner Stevens explained that it is totally foreign to Native Americans when they are cited for a violation of regulations on lands they used long before the white man came and noted that more needs to be done to coordinate efforts with Native American groups. Rob said that he and the BLM Staff have been working on what needs to be done to expedite the Clay Draw Water Project and expressed his willingness to help in any way while he is here. The Commissioners thanked him for coming in today. Jim Keyes and David Ketron - USU Extension Jim and David presented additional information related to the purchase of a 6 x 6 ATV for the Weed Department. David stated that he has done some investigating and the Ranger seems to fit with their needs because it has a higher weight capacity than the Yamaha Rino. It was noted that the Sheriff's Department uses Rangers and the Road Department has experience maintaining them. Commissioner Stevens made a motion to approve the purchase of the Ranger ATV for the Weed Department. Commissioner Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Lynn Stevens - Southern Fair Plans for the Southern Fair were discussed. Commissioner Maryboy attended the last Fair Board Advisory Group and said that they will decide at the next meeting who will manage and coordinate the various events for the Southern Fair, including the Rodeo. He said that they are considering Brenda Harvey who managed the fair in the past. He also said that the date will be set based on the other events that will be taking place in the area. Charles DeLorme and Jim Keyes as well as Anna Thayn are anxious to know the date of the fair. Commissioner Maryboy expressed his preference to involve local people rather than hire an outside group for the rodeo and other events. The next meeting will be this coming Friday evening at Twin Rocks in Bluff 6 p.m. Charles will not be available on Friday but Commissioner Maryboy will attend along with Jim Keyes. Commissioner Maryboy will update the Commission next Monday as to the date and other details regarding the fair. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Open Time and Other Business Marilyn Boynton, a resident of Blanding, asked about the dying Cottonwood Trees in Bluff that she brought to the attention of the Commission last week. Commissioner Stevens said that he is not sure if the County or the State is responsible for the trees since they are along the highway. He will contact someone at the State level to find out what needs to be done. A draft of a letter from Charles DeLorme to Chet Johnson, Monticello Station Supervisor for UDOT, was submitted for approval regarding the poor road conditions in Monticello. The letter relates to how this effects the impression tourists get when they visit the area. Commissioner Stevens made a motion to approve the letter. Commissioner Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. A letter to be published in the newspapers thanking all of the people who assisted with the Red Bull Air Race in Monument Valley last week was presented for approval and signature. Commissioners noted that the event went extremely well and that all of the County employees and volunteers were very much appreciated and helped to make the event a great success. Commissioner Lynn Stevens made a motion to approve the letter for signature. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried. Commissioner Stevens noted that the 4-H Club will be holding an event at the arena in Blanding this coming weekend and there will need to be a water truck available for the event. Tammy will make the arrangements. Brandy and Jeff Tomhave, of the Tomhave Group, will attend the May 29th Commission Meeting to discuss fund-raising and other issues related to the needs of the County. Commissioner Adams reminded Commissioners of the 8:00 a.m. Road Meeting on May 21st in Commission Chambers. A member of the public reported that tractor trailer trucks and other vehicles have been passing school buses illegally causing a danger to school children. He said that his wife is a school bus driver and that, although it has been reported, it continues to occur. Commissioner Adams will contact the Sheriffs Office and State Highway Department to voice these concerns. A question was asked related to the Denison Uranium Mine Owners purchasing uranium from small private miners. Commissioner Stevens will try and obtain more information from the company about their plans. Charles Delorme said that Commnet is working on the cellular infrastructure and will be in the area for the next two weeks. He questioned the requirements necessary to locate and build a tower in the County. He said they are planning to use SITLA land. The Commission advised that after Commnet enters into a lease with SITLA, the County will be notified and, at that time, they will need to apply for a building permit for the tower through Bruce Bunker. Charles said that he and Commissioner Maryboy worked hard to get temporary cellular service in Monument Valley during the Red Bull event and that Commnet will leave the temporary equipment there until a permanent tower is erected. He said that visitors to the area as well as residents were thrilled with the cellular service provided. Commissioner's Reports Commissioner Stevens attended the Navajo Trust Fund Board Meeting last Wednesday. He will be in Salt Lake City on Wednesday and Thursday and will also attend the State Aging Meeting while there. Commissioner Maryboy attended the Navajo Oversight Budget Audit Meeting in Las Vegas. He traveled to Monument Valley to MC at the event and was impressed by the number of people who attended. He said it was quite an experience. He will be in Window Rock for a Economic Development Committee Meeting and will be in SLC on Wednesday and Thursday to attend meetings regarding Hwy 191 and land and road issues. Commissioner Adams attended the AOG meeting last week and the Forest Service Open House last Tuesday regarding Wild and Scenic Rivers. He also met with Crown Quest Gas Company last week along with Lynn Laws to discuss drilling a well. He will attend a RAC Meeting this week in Green River. He noted that the Republican Convention will meet on May 15th at 7:30 p.m. to elect local officers in the Commissioner Chambers. Members of Senator Bennett's office will also attend the Convention. 11:00 Commissioner Lynn Steven made a motion to into a Public Hearing to address approval of two variance requests for permission to use non-standard road materials for subdivisions roads. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Adams read the requests for approval of a Variance from Brenda Stocks and Teague Eskelsen for use of road materials that do not meet County standards. A discussion ensued. Two of the roads were previously constructed and two are planned for construction. It was noted that this material was previously approved when the more appropriate material was unavailable. If approved today, it will not be acceptable in the future. Commissioner Bruce Adams asked for comment from the Public. There were none. 11:14 a.m. - Commissioner Lynn Stevens made a motion to exit the Public Hearing. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Lynn Stevens made a motion to approve variance requests for Teague Eskelsen and Brenda Stocks. Commissioner Maryboy seconded the motion. Commissioner Bruce Adams abstained from the vote. The motion was passed with two for and one abstention. 11:15 a.m. - Commissioner Lynn Stevens made a motion to go into a Public Hearing to address a request for approval of a Variance for a 10 foot boundary set back for Donald and Denise Oblak. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. After discussion of this request it was determined that since it will not effect other property owners there would be no objection to granting the variance. Commissioner Bruce Adams asked for Public comment. There was none. 11:25 a.m. - Commissioner Lynn Stevens made a motion of exit the Public Hearing. Commissioner Kenneth Maryboy seconded the motion.
