Commissioner Lynn Stevens made a motion to go into Executive Session at 8:42 A.M. to discuss a personnel issue. Commissioner Kenneth Maryboy seconded the motion. Cyndi Eldredge - SJC Human Resources Cyndi requested approval to hire an additional full time staff member, a Cadastral Mapper/Deputy Recorder, for the Recorder's Office. Due to the increased volume of oil and gas leases and the increased land development in the County, the workload has increased significantly. Louise Jones, County Recorder, explained that in the first quarter of this year, her office has recorded more documents than they have in an entire year. Although the new position was in the original budget for this year, it was cut. With the increased volume, it has now become more critical to add a new staff member. If approved, an adjustment to the budget will need to be made at the end of the year Cyndi presented the job description which is classified between Grade 9 to 11 with the appropriate compensation and full benefits. Upon approval, the position will need to be advertised for two weeks after which interviews will take place. Commissioner Lynn Stevens made a motion to approve adding a new position, Cadastral Mapper/Deputy Recorder, for the Recorder's Office. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Monty Perkins - SJC Maintenance Supervisor A grant request was submitted to the ADA for funds to replace the vestibule doors in the Court House and was successful in receiving $6,600.00. An additional cost of $275.00 will be needed to complete the project and is in the budget. When applying for the grant, it was indicated that the County had plans to do additional ADA upgrades, including changing the pitch of the sidewalk for wheelchair accessability at the side of the building. He had a verbal bid from Sonderegger Construction Company for this project in the amount of $2,500.00. He received two bids for the door replacement, one from Rick's Glass and one from Jones Paint and Glass. Monty said his recommendation is to go with Jones Paint and Glass because Rick's Glass is completely swamped and will not be able to do the job for some time. The issue was raised of weather there would be objections to the door replacement by the Historical Commission. Monty will contact Corinne Roring and discuss it with her. Commissioner Stevens said no permission is necessary from the State level. Monty will submit the bid for the cement work on the sidewalk when he receives it in writing. Commissioner Lynn Stevens made a motion to approve the request to replace the vestibule doors with ADA Grant money and $275.00 from the budget. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion passed by unanimous vote. Sheriff Mike Lacy - SJC Sheriff Department Sheriff Lacy requested approval to purchase nine cell phone boosters for the Drug Task Force to be paid for from the Task Force budget. The boosters will provide extended cell service. Sheriff Lacy recommended going with the low bid from Connected Technologies, a local company, in the amount of $349.95 each, a total $3,149.55. Commissioner Lynn Stevens made a motion to approve the purchase of nine cell phone boosters in the amount of $3,149.55 for the Drug Task Force. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Krisanne Bender, representing Canyon County Heritage Association, voiced her concern regarding the next subject to be addressed on the Agenda today relating to marking the Hole in the Rock Trail. She indicated that if the Commission intends to vote on marking the portion of the trail from Cottonwood Hill into Bluff that a vote not be taken until a Public Hearing is scheduled allowing residents in the area to have a voice in the decision. Max Black and Evan Lowry - Hole in the Rock Trail Max Black, representing the Hole in the Rock Preservation Group, said that he has been in contact with Lynn Laws and David Bronson and they gave their permission for his group to use posts that are being stored in the Road Shed for marking the trail. He said that his group intends to mark the Hole in the Rock Trail from Collins Canyon (Rd. #276) South to Comb Wash. The poles to mark this part of the trail will be etched with a picture of the back end of a wagon. He anticipates using about 150 posts for the project. There are no plans to mark unestablished portions of the trail at this time. Evan indicated that the part of the trail they intend to mark has already been approved by the BLM and marked, but many of the signs have been knocked over. Nick Saudberg, from the BLM, agreed that marking this part of the trail was approved about 30 years ago and indicated the importance of making every effort to coordinate with all interested parties, including the members of the Hole in the Rock Foundation. The Commission agreed and said that the members of the Hole in the Rock Foundation are aware of the plans. Nick also said that in 1996 there was an Interagency Agreement related to marking and creating the logo for the Hole in the Rock Trail, but it did not include the County. It expired five years later. He suggested that another agreement be written to facilitate coordination. Evan agreed and said that this would get us all working together. Commissioner Adams asked Krisanne Bender if, after hearing the plan, there was any need for the Public Hearing. Krisanne said that there is no need for a hearing at this time but that she would appreciate the consideration of a holding a Public Hearing if future plans include marking the portion of the trail from San Juan Hill into Bluff. Evan said that he hopes that the BLM will take the lead in the development of a management plan for the entire Hole in the Rock Trail coordinating their effort with interested organizations and the County as well. Commissioner Lynn Stevens made a motion to approve using the posts to mark the Hole in the Rock Trail where approved by the BLM. Commissioner Maryboy will seconded the motion with the stipulation that, if there comes a time that plans include marking the trail between San Juan Hill and Bluff, a Public Hearing be scheduled for public input. Commissioner Bruce Adams declared the motion carried by unanimous vote. Evan said he has had several phone calls in the last week from individuals concerned about the washed out area in Lake Canyon. Visitors to the area tend to go around the washed out area which causes more damage and is dangerous. He stressed the need to reroute the trail. Nick Saudberg stated that the BLM is processing the environmental assessment of the area and it will soon be finalized for public review. Evan encouraged Commissioners to attend the Forest Service Wild and Scenic River Open House anytime between 4 p.m. and 8 p.m. tomorrow to review the plans and information. It will be held at the Moab Arts and Recreation Center, 111 East, 100 North. As of right now, there are only two sections that meet eligibility requirements. The first is three miles of Mill Creek and the other is Roc Creek, which is on the border side, flowing into Colorado. There is a total of about 8 miles, but only about a quarter of mile is in San Juan County and the rest is in Colorado. Evan said that we basically defer to Colorado. Evan said there are some groups lobbying the Forest Service to reconsider some of the segments that were deemed ineligible. The other segments, North Fork of Whiskers, Whiskers Draw, Posy Canyon, Notch Canyon and Upper Dark Canyon are all dry washes or ephemeral streams and they were dropped. Dark Canyon is already designated as a wilderness area. Commissioner Adams plans to go to the Open House later in the day. Evan will go for the first part of the Open House. Commissioner Stevens said that the Forest Service was never funded to do suitability studies and the States raised objections saying that as soon as you claim something is eligible it is treated as if it was already designated before evaluation for suitability occurs. This creates an enormous amount of defacto protection for characteristics that may or may not exist and States have now agreed to do suitability analysis. Most of the areas in San Juan County, that were previously designated, only have water in them occasionally during runoff and they do not meet the other criteria. The suitability analysis will allow for better expenditure of Federal Funding. Evan said that there are two eligibility requirements. The first is that the body of water is free flowing and the second is that there is something outstanding or remarkable about the area. But to be suitable they look at manageability, uses, type of recreation and development. There are a lot of criteria that are looked at for suitability that are not looked at in eligibility. Commissioner Stevens will adjust his schedule and attend the Open House. Evan said he continues to work with the BLM on their wilderness review. Jim Keyes - USU Extension Agency Jim is representing the Weed Board and presented bids for an six wheel ATV and a trailer that Dave Ketron has been working on. Jim presented the bids for the ATV, and said that David prefers to go with the bid from Carbon Emery Sports although it is approximately $700.00 more than the State Bid. If purchased from the State it is anticipated that they will need to travel a long distance to pick up the equipment and it won't be available for 6 to 8 weeks. Carbon Emery can have it in 1 to 2 weeks. Carbon also promised to take care of warranty issues right away. The cost is within the budget for the ATV. Commissioner Maryboy is concerned about maintenance costs for this particular ATV. He said that in his experience, the Yamaha Rino is a much heavier duty ATV. Jim said that the Weed Department needs a heavy duty ATV. Jim will ask Dave to check into the Rino ATV. Commissioner Stevens suggested that they check with the State to see if they can suggest a dealer that carries the Rino and that they may be able to purchase it from the State without having to travel too far. Two bids were presented for the trailer for the ATV. One from Lone Peak Trailers and one from White Brothers. Jim said that the recommendation is to purchase it from Lone Peak due to the better price and because it is stock. Commissioner Adams suggested that we take action on the purchase of the trailer and Jim will obtain additional information on the six wheel ATV purchase. Commissioner Lynn Stevens made a motion to approve the recommendation for the purchase of the Trailer from Lone Peak Trailers in the amount of $2,219.00. Commissioner Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Charles DeLorme - Director SJC Economic Development Charles said that the Red Bull Air Race plans are going fine. Charles said that the paving of the runway has been completed and there is 3900 feet of paved runway now. The grazing rights were yielded for the air strip footage and was granted by the Navajo Tribe. The first 300 feet of the north end (touch down area) is 4" thick and 2" on the remaining 3600 feet. The air racers arrived over the weekend and landed there and did some practicing. Discussion was had about compensation for area residents and the Oljato Chapter's experience. Charles said that they are 90% satisfied according to James Black. There will be no power at the visitors center because a generator has not been secured. Commissioner Stevens will attend the event on Saturday. Charles will meet with Commissioners after the meeting today to make arrangements for their transportation. Charles that the final details are being arranged for the T-1 connect to provide cellular service in the area by Wednesday. It will stay in place until a permanent tower is erected. Commissioner Maryboy assisted in getting a letter from President Shirley regarding the airstrip and also made some calls to make sure the telecom issue was taken care of providing cell service to the area. Because of concerns about the number of people coming into the area, parking arrangements and bus service has been arranged, Originally there were only 10 buses but they now have18 buses to transport people from the parking areas to the event. Because business owners in the area were concerned about being able to provide enough food during the event, they have contracted food vendors to provide supplemental services. Tickets for the race can still be purchased on the internet. Linda Lewis - City of Monticello on Parks and Beautification Linda said that the Monticello City Council approved placing pots of flowers up and down Main Street. She requested permission to place pots on the property in front of the Court House building. They would like to place them off the sidewalk in the circular area around the trees. Another idea is to place two benches which are about 3 ½ or 4 feet long and about 18" high in front of the Court House. The Commission asked Linda to coordinate her efforts with Monty Perkins. Commissioner Stevens said it would be a plus to have the benches. Commissioners agreed to help with the cost if we decide to put in cement pads for the benches. Linda expressed her appreciation for the Commission's support of the project. Bob Washnock and Lance Indergard - Lisbon Valley Copper Mine Road Issue Bob and Lantz requested approval to relocate County Road #313 near their mine sites. They presented photos of the mine area including the existing gas lines, power pole and existing road. The photos also showed the proposed road that will go along the re-routed gas line to accommodate the expansion of the mine pit. Details of the proposal to relocate the road were discussed. They would like to begin construction this year before November. The Company would be willing to provide engineering services, if needed, in addtion to the cost of the relocation of the road. Commissioner Adams suggested that the County take the lead on the project and bid the job out and coordinate it with the planed project to pave the graveled roads in the area in 2008. Bob said that time is of the essence and they would like to see if it could be done this year rather than in 2008. Commissioner Adams said that they will meet with Lynn Laws of the County Road Department and get it bid out for this summer or this fall and set up a meeting for Bob and Lantz to meet with Lynn Laws. Engineering design may be a roadblock but Bob and Lantz reiterated that their engineer can help with this aspect of the project. Commissioner Lynn Stevens made a motion to approve the relocation of County Road #313 to accommodate the expansion of the mine pit at the Lisbon Valley Mine. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Marilyn Boynton - Bluff Sewer System & Cottonwood Trees Marilyn is now a resident of Blanding but came to find out the status of the Bluff Sewer System for Jim Harden who is very concerned but was unable to come in today. He said that the Waste Water Committee is no longer holding scheduled meetings and have not been posted in the usual places. Commissioner Adams said that the Commission received an e-mail from Skip Meyer this past Sunday which gave details of what is going on. His e-mail said that they have the State Water Quality Board and the Southeast Utah Health Department involved and expect to have the overall current status of the plan ready by the end of April. Once the plan is presented, reviewed and approved, all parties will meet to choose a preferred option. This should be done before the end of May and then they will go into the funding phase. Commissioner Stevens said It is up to the citizens to complain if the Committee does not follow public meeting rules as spelled out in the State Statute on public meetings that citizens should follow the process if there is a problem. The Commission will discuss this issue with David Carpenter but Bob Bushard, a resident of Bluff, said that the meetings are held twice a month and have been posted in the usual paces as far as he knows. Marilyn's second concern is that the Cottonwood trees along the highway going down into Bluff are all dying. Last year one tree was totally destroyed by the tent caterpillars and nothing was done. Now all of the trees are affected. She is requesting that the County spray the trees to prevent them from dying. Commissioner Stevens will contact the Weed Board to see what can be done. Krisanne Bender asked to be notified if it is determined that the trees should be sprayed because she lives in the area. Jerry McNeely - Grand County Council Jerry was under the impression that UDOT was meeting today regarding the turning lanes into Sunny Acres and Flat Iron Mesa Subdivisions. The Commission had no knowledge of a scheduled meeting with UDOT today. Commissioner Adams said that the residents at Sunny Acres agreed to relocate their mailboxes to accommodate a turn lane which will be done soon, but they are not planning to put in acceleration or deceleration lanes. Commissioner Adams said that Dale Stapley, from UDOT, was to meet with Greg Adams and the Planning Commission and discuss it with them. Jerry requested a letter for the Grand County Clerk regarding the change in responsibility for the maintenance for B-roads from Grand County to San Juan County. Commissioner Adams said that the letter was sent out today. Lyman Duncan - San Juan Health Service District Lyman thanked the County Commission for their support and efforts to obtain the CIB grant and for the forgiveness of the loan. It is very much appreciated. Commissioner Adams said that Commissioner Stevens was very involved in the process and he wanted to thank him publically for his behind the scenes work with the CIB. Commissioner Adams said that it is a fantastic success story. In the last San Juan Health District Board Meeting, the group discussed the prospect of receiving CIB funding for a County Wide Strategic Plan and the Board made a motion that they would like to go forward with this effort. Lyman said that there has been a kind of flurry since then. They have communicated to Keith Burnett of CIB and gathered some information from him. They are requesting a letter of support and commitment from San Juan County Commission to include with the packet to the CIB along with the purpose for the grant request, how it will be utilized, the time line and matching funding. They need the letter of support and commitment by Friday of this week. Commissioner Adams said that the Commission understands this request and are supportive. The County has held $25,000 in the budget since 2005 earmarked for the Strategic study and plan. Commissioner Stevens made a motion to raise the amount to $50,000 and authorize the Chairman Adams to sign a letter of intent to the CIB stating the County's commitment and support of the County Wide Health Assessment Strategic Business Plan. Commissioner Maryboy seconded the motion and Commissioner Adams declared the motion carried by unanimous vote. Commissioner Adams said that Lyman brought a safety issue to his attention related to the employees parking lot at the hospital. Commissioner Adams suggested that we can possibly get city workers to use one of the County's sweepers to sweep the parking lot and get some mulch and a roller and fill some of the more dangerous areas as a temporary fix. Commissioner Stevens said that since it is County property we may be able to get the County crew to do the work. Commissioner Adams will follow up on getting something done there. Janet Ross - Discovery Center Four Corners School and the City of Monticello formed a partnership to build the Canyon Country Discovery Center here in Monticello. Since 2002 a little over $200,000 has been raised for planning the project. This resulted in the development of a Business Plan for the project. Janet said that the plan was revised and consolidated to reduce the cost after a donor qualification study was done. The study showed that they could raise between 6 ½ and 8 ½ million dollars for the project. Janet discussed the revised plans for the project and answered questions. The new plan brought the cost of the project down to $100 a foot less. Janet said that donors, and in particular the State, want to see a dollar commitment from the County to prove that the County is behind the project. Janet said that a commitment for bricks and mortar was suggested in the past when she spoke to Rick Bailey and that Commissioner Adams suggested that she come in today. Charles DeLorme suggested that some of the money could come from TRT in the amount of $400,000 over a five year period. Janet said that they are seeking another $100,000 for a total of $500,000. Even though the money does not need to be made available immediately, a formal commitment is needed so that they can solicit funding from other sources. Commissioner Adams said that since Charles is willing to commit $400,000, that the County should find a way to provide the other $100,000 or $20,000 a year over a five year period. Commissioner Adams said that he is in support the project. Commissioner Stevens suggested that we begin to set funds aside for the project starting in 2008. Charlie said that the Center will provide a space to hold conferences and would be a great asset to the community. Charles asked that it be clear that $400,000 will come from the Economic Development Department TRT funds. Commissioner Lynn Stevens made a motion to authorize the Commissioner Adams to sign a Letter of Support and Commitment to the project to provide $500,000 over a five year period. Commissioner Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Charles and Janet will work on the wording of the letter of support and commitment and submit it for signature. Bruce Bunker - SJC Building Inspector Bruce presented one building permit for approval and signature. Lola A. Muckey & Ivan L. Commissioner Stevens made a motion to go into Public Hearing to review the proposed Ordinance Establishing The SJC Public Land Corner Preservation Fund. Commissioner Maryboy seconded the motion. Ordinance No. 2007-02 ORDINANCE ESTABLISHING THE SAN JUAN COUNTY PUBLIC LAND CORNER PRESERVATION FUND WHEREAS, pursuant to Subsection 17-23-19(1), Utah Code Annotated (1953, as amended), "[t]he county legislative body may establish a fund known as the Public Land Corner Preservation Fund. Moneys generated for the fund shall be used only to pay expenses incurred and authorized by the county surveyor in the establishment, reestablishment, and maintenance of corners of government surveys pursuant to the powers and duties provided under Title 17, Chapter 23, and Title 57, Chapter 10"; and WHEREAS, pursuant to Subsection 17-23-19(2), Utah Code Annotated (1953, as amended), "[t]he county legislative body may by ordinance establish a fee schedule for filing maps in the county surveyor's office of surveys filed under Section 17-23-17, subdivisions, road dedication plats, ands other property plats". NOW, THEREFORE, BE IT ORDAINED BY THE COUNTY LEGISLATIVE BODY OF SAN JUAN COUNTY, UTAH, THAT: 1. There is hereby created a Public Land Corner Preservation Fund account. All monies collected pursuant to this ordinance shall be deposited with the county treasurer and credited to the Public Land Preservation Fund. 2. There is hereby imposed a fee of $10.00 for filing maps in the county surveyor's office filed under Section 17-23-17, subdivisions, road dedication plats, ands other property plats. All moneys collected under this subsection shall be deposited with the county treasurer and credited to the Public Land Preservation Fund. Commissioner Lynn Stevens made a motion to go into Public Hearing to hear comments related to the three requests for approval of variances. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. The first variance submitted for approval is for Eugene Meyer, for lot size, the second is for Richard J. Lamb for road variance approval and the third is for Teague Eskelsen also for a road variance approval. Both road variances related to accommodating curves in the roads and the variance for lot size was for allowing construction of a residence on a lot that is less than one acre. Rick Meyers approved the lot size variance based on proposed residence being connected to the city water system rather than a well. There is no problem with the drain field. Tyre Holfeltz - State of Utah Tyre Holfeltz presented the Regional Wildfire Protection Plan to be submitted to the State. The plan includes the plan for San Juan County. The purpose of the plan is to assist in protecting human life and reduce property loss due to wildfires in the communities and counties of Southeastern Utah and surrounding areas. Other components of the plan include management of hazardous fuels and managing wildfires when they occur. To address these issues, a group of multi-jurisdictional agencies (federal, state and local) organizations, stakeholders and residents have completed the process of developing the Southeastern Utah Regional Wildfire Protection Plan. After discussion of the plan related to San Juan County and after verification that the plan can be amended at any time by contacting Tyre, a decision was made to approve the plan. The plan will be submitted to the State when all parties give their approval. Tyre submitted a hard copy and a CD of the plan to the Commission. Commissioner's Reports Commissioner Stevens spent two days last week in the Statewide Resource Advisory Council for the State BLM. It was a good meeting regarding archeology and historic sites. He said that discussion concerning Nine Mile Canyon took up about three hours. The State Director, Selma Sierra and her staff seemed to be very responsive and interested in both the Public's and elected officia's input on the issues. He also attended meetings with the AGRC Geographic Reference Center on clarity of mapping for counties new roads. This week, Commissioner Stevens will be in SLC for two days at the Navajo Trust Fund Board Meeting on Wednesday and will meet with the State Institution of Trust Land Agency about land exchanges. The SITLA Bill that was passed last year will generate funds for San Juan County this year. The Bill will allow royalty revenues to come directly to the counties taking the State out of the loop. It is expected that our County will receive approximately $200,000 this year. Commissioner Maryboy said he attended a Chapter Meeting in Mexican Water and also a planning meeting in Aneth on Thursday. Aneth requested four more boxes of trash bags from the County as did the Mexican Water Chapter. There are some road concerns at Red Mesa and Aneth and Commissioner Maryboy will address them at the next road meeting on the 21st of May. The one other concern is for the Blanding Motor Vehicle office to offer extended hours to accommodate persons who work far from home and are unable to get to the office before they close. Commissioner Maryboy is leaving for Las Vegas for the Annual Budget Hearing regarding Navajo Nation Enterprises. He reported that he has recently received e-mails and phone calls regarding a planned protest of the high price of gas. The organizers are asking people to refrain from buying gas for one day, May 15th to bring attention to cost of gas. He will be return from Las Vegas on Thursday to participate in the Red Bull Air Race event. Commissioner Adams met with Monticello Seniors on Tuesday to update them on things that are going on in the County. He attended the University of Utah commencement on Friday and in the evening attended George Wythe philanthropic gala on the 24th floor of the Wells Fargo Building in SLC. They made the announcement that Monticello will be the permanent site of the George Wythe University. The have already closed on 200 of the 500 acres of property on the mountainside and hope to be up and running by 2012. Most of the City Council members attended as well as the Mayor and his wife and Trent and his wife. This week he plans to attend the Forest Service Meeting and AOG on Thursday. He will attend the Red Bull Air Race on Saturday. On Monday, May 14th, Commissioners will meet with Jeff Alexander and Lee Johnson at 1:00 p.m. to discuss forest highway money and some possible projects will be explored. Senator Bennett's staff will be in town again on May 15th and 16th. Commissioner Adams said that he thinks we have the TV equipment problem solved. Steve Bradford is going to obtain help from the technical advisor from Emery County to help get the equipment purchased. We have $300,000 from the CIB to be used to upgrade the TV equipment. Open Time and Other Business Steven Redd came in today to present a Survey Plat for the Mountain Home Subdivision in Old LaSal. The Survey Plat was presented at the May 23rd Commission Meeting by Teague Eskelsen and has been in the works for some time. Commissioner Lynn Stevens made a motion to approve and sign the Survey Plat for Mountain Home Subdivision provided all appropriate signatures are placed. Commissioner Bruce Adams seconded the motion.
