SAN JUAN COUNTY COMMISSION MEETING April 16, 2007 The regular meeting of the San Juan County Commission was held on April 16, 2007 at 9:00 A.M. in the Commission Room at Monticello, Utah Present: Bruce Adams, Commission Chair Kenneth Maryboy, Commission Vice Chair Tammy Gallegos, SJC Administrative Assistant Norman Johnson, SJC Clerk-Auditor Dianne F. Adams Marilyn Boynton John Bell Phil Glaze Sheriff Mike Lacy Howard Randall Doug Pehrson Commissioner Kenneth Maryboy made a motion to approve the minutes of April 9, 2007 pending Commissioner Lynn Stevens' review and approval. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Adams said that Commissioners met with Rick Bailey and that he has taken a 30 day medical leave of absence. If, in fact, Rick needs additional time, his leave will be extended by 30 days. In the meantime, Tammy Gallegos and Susan DeLorme will field calls for Rick. Commissioner Adams asked that fellow employees be mindful and considerate of Rick during this time and wished him the best. Norman L. Johnson - SJC Clerk/Auditor Norman presented the Commission with a list of four properties that will be included in the tax sale. Norman advised the Commission that he has been in contact with three of the property owners. He recommended that bidding should begin with the fair market value of the property to be sold. Commissioner Adams noted that it is common for the taxes to be paid before the sale. Commissioner Kenneth Maryboy made a motion to approve the 2007 list of properties to be sold to satisfy tax liability. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Norman presented the final SSBG invoice for 2006-2007 in the amount of $43,000 for submission requiring Commissioner Adams' signature. The programs included are Aging, San Juan Counseling, Rocky Mountain Home Health and the LaSal Senior Center. Commissioner Kenneth Maryboy made a motion for Commission Chair, Bruce Adams to sign the SSBG invoice. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Cathy Hartman, Edward Stafford and Sandra Reategui - USU - Wind Power Survey Cathy Hartman, Ph.D. and Edwin Stafford, Ph.D., Utah State University Professors introduced Sandra Reategui, their Graduate Assistant, who is a USU Economics Development Graduate. Sandra gave a slide presentation showing research information regarding Renewable Energy for Rural Economic Development, specifically on wind power. Sandra introduced a research model called "JEDI", (Jobs and Economic Development Impact), that has been utilized to conduct research on wind power. They would like to gather information using the JEDI model in San Juan County. Her presentation included background information, current energy harvesting in Utah, future electricity demands, advantages and disadvantages of Coal, Natural Gas and Wind Power. The JEDI model includes statistics on Development, Analysis, Inputs, Economic Outputs, Local Spending, New Jobs Created, Earnings and Industry Spending. The results of the economic study previously done for the Spanish Fork - Utah County Wind Park project, were reviewed and discussed, including the level of economic impacts as well as the construction period and costs, annual operational costs and a summary regarding leases and taxes. Sandra also discussed supply and demand and the fact that consumption is growing while coal is dwindling in supply, natural gas, although preferable over coal, is more costly and unpredictable in addition to environmental issues. Wind energy is clean and efficient, agriculturally friendly and accessible. Commissioner Adams noted that he has been involved with wind power development in San Juan County for the last four or five years, and the City of Monticello, along with the County, recently obtained a grant to place anemometers on three sites in the County. Commissioner Adams said that it is a huge advantage that the County already has a transmission line in. There was also discussion regarding providing power to other States which would offset costs. Commissioner Maryboy invited the group to make the same presentation to the Utah Navajo Commission regarding renewable energy and wind power. Cathy said they would welcome the opportunity and a presentation will be arranged. In order to begin the economic research study the group will need tax information to start with. Commissioners thanked Professors Hartman and Stafford and Sandra for volunteering to do the Research Study/Survey and look forward to the report when it is completed. Melvin and Bill Gaines - County Road Issue Melvin and Bill Gaines addressed an issue regarding Road #1451, section 29. They requested that part of the road be taken off the County Road System. They said that a portion of the road is private and was put in by property owners and has not been maintained by the County. David Bronson, SJC Surveyor, presented an aerial view map of the road in addition to another road map showing where the road is located. After discussion it was decided that Melvin and Bill meet with David Bronson, Lynn Laws and Attorney Walter Bird to try and sort out the problem. If a decision is made to take the road off the County Road System there would have to be a public hearing to address abandoning the road. Meantime, a lock was put on the gate into BLM land at the end of the road and it will be removed by the Sheriff's office. Commissioner Maryboy said there are ongoing problems with Reservation boundries, access to roads and grazing land and said there is a need to better locate County easements. Commissioner Maryboy will report developments after he meets with the Navajo Justice Department regarding land issues. David Bronson - SJC Surveyor David requested approval to attend the ArcGISTM Training in Salt Lake City on May 14th and 15th, 2007. The cost for the training is $500.00. David's second request is to participate in the Certified Federal Surveyors Training Course. The cost for this training course is $800.00. These expenses are included in his 2006 budget. Commissioner Kenneth Maryboy made a motion to approve the requests for David Bronson to take the two training courses. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Tammy Gallegos - SJC Administrative Assistant Tammy presented two building permits for approval and signature. Brandon Kirk - 17 East Madison Avenue, La Sal - Manufactured Home A. Paul Mantz - 6900 South Hwy. 191, Monticello - Addition to Existing Home Commissioner Kenneth Maryboy made a motion to approve the two building permits provided all appropriate signatures at placed. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Tammy presented the letter drafted, with input from Cleal Bradford, to Sandra Meyers, Manager of the Monticello BLM Field Office, requesting the BLM to develop a plan to manage, preserve and mark appropriate locations on the Hole in the Rock Historic Trail. This was discussed at length at last week's Commission Meeting. The County feels that this is important, especially to the descendants of the pioneers who came into the area traveling this trail in 1879-80. Commissioner Bruce Adams read the letter which is as follows: Dear Ms Meyers, The San Juan County Commission has great interest in preserving the Hole in the Rock Historic Trail and marking the route used by our pioneers in 1879-80. We are aware that some of the original construction has either been swept away by floods, or destroyed by later road improvement. The remaining portions of the route deserves more attention than it has received. A local group has agreed to place 4x4 posts with an approved logo at strategic locations from the top of Cottonwood Hill into Bluff. A 1996 agreement with BlM authorized this from Escalante, and the west side of Lake Powell has been completed. We feel a management plan to interpret the route should be initiated by BLM. The County will participate throughout the planning process, but in advance of a formal plan being completed, we recommend that San Juan Hill be closed to motorized traffic. There is also little gain in no pre- approving the 4x4 posts from the east side of Lake Powell on into Bluff. Your effort to initiate Geotourism within San Juan County fits well with preserving heritage sites, marketing appropriate locations, and improving the economy through increased visitation. Adams, Chairman San Juan County Commission The group discussed the letter further and the Commission verified that the public will have input when the time comes for the BLM to begin their process of developing a management plan for the area. Commissioner Kenneth Maryboy made a motion to approve and sign the letter concerning the Hole in the Rock Trail to Sandy Meyers. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. A letter to Congressman Jim Matheson was presented for approval and signature relating to the Department of Energy's Atlas Tailings remediation which has caused road damage to County Road #127 (Spanish Valley Drive). The letter requests Congressman Matheson to intercede to have the damage to the road repaired at the State's expense. The letter is as follows: Dear Congressman Matheson: We are contacting you to request your assistance in helping us resolve a transportation problem the United States Department of Energy's (DOE) Atlas Tailings remediation has caused San Juan County, Unfortunately, trucks hauling gravel for DOE from borrow areas in Spanish Valley have destroyed approximately one half mile of the north bound shoulder of County Road 127, or Spanish Valley Drive, between Ken's Lake and Moab. San Juan County needs federal assistance to fix the road as soon as possible. County officials' efforts to work directly with Moab Federal Project Director, Mr. Donald R. Metzler, have thus far been rebuffed. Your help in bringing this situation to the attention of the appropriate parties at DOE Headquarters would be appreciated. Please advise your staff to work with San Juan County's inter-governmental relations consultants, The Tomhave Group, to follow through on the request. Sincerely, Bruce B. Cyndi Eldredge - SJC Human Resources Cyndi conducted interviews last week for the Blanding Senior Center Aide position and recommended Lisa Rhodes for the part-time Grade 1, Step 1 position. Commissioner Kenneth Maryboy made a motion to approve hiring Lisa Rhodes for the Blanding Senior Center Aide position. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Cyndi said that she received information from UCIP concerning additional coverage made available for terrorist or war acts for the Airport. This coverage would cost an additional $15,000 over and above the $12,000 cost that the County now pays for liability coverage for the Airport. Commissioner Adams will attend the UCIP Board Meeting tomorrow evening and will investigate the option further. Cyndi said that she has been communicating with Alan Freestone of the Sheriff's office regarding sharing an ID Photo Maker Machine and the related cost, (approximately $3,000). Alan was not able to be at the meeting today to present bids for the equipment so the issue was postponed until next week. Cyndi requested approval to purchase four signs for the County's Safety Program which will be used to post "lost time accidents". She said the signs automatically change the numbers when appropriate. They will be placed in the two road sheds, in the Sheriff's office and in Bluff. The cost for each sign is $419, a total of $1,675. Commissioner Maryboy made a motion to approve the purchase of the four signs. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. 11:00 A.M. - Public Hearing - Resolution to Establish Elk Meadows Special Service District Commissioner Kenneth Maryboy made a motion to go into a Public Hearing to hear public comment on the Resolution to Establish Elk Meadows Special Service District. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Lynn Stevens called from Salt Lake City and joined the meeting to address this issue. RESOLUTION 2007-05 DESCRIPTION OF THE PROPOSED DISTRICT The District shall have the following boundaries: Township 32 South , Range 23 East, SLB&M Section 13, 24 and 25. A portion of that land contained within section 24 as recorded in book 824 page 558, as well as a portion of that land contained within section 13 as recorded in book 827 page 404, and also a portion of that land contained within section 25 as recorded in book 824 page 558. PROPOSED SERVICES The District will be authorized to construct, repair, maintain and provide water and sewer services to be located within the District, together with acquisition of necessary facilities, appurtenances and equipment therefore or to enter into contracts or agreements with other agencies as to be determined by the Board of Administrative Control to be appointed by the County Commission. METHOD OF FINANCING Pursuant to the provisions of the Utah Special Services District Act, Chapter 17A, Title 13, Utah Code Annotated, 1953, as amended and Article XIV, Section 8 of the Constitution of Utah, the District may annually impose fees and charges to pay for all or a part of the services to be provided by the District. It may annually levy taxes upon all taxable property within the District to provide for the proposed services, and may issue bonds for the acquisition and/or construction of facilities or systems to provide said services, provided, however, that said levy to provide said services or to repay said bonds, must be authorized and approved by a majority of the qualified electors of the District at an election for that purpose. PUBLIC HEARING ON PROPOSED ESTABLISHMENT OF SPECIAL SERVICE DISTRICT The Board of County Commissioners will hold a public hearing on the establishment of the District and the proposed services to be provided within the District at the offices of the San Juan County Commission on April 16, 2007 at the hour of 11:00 A.M. Any interested person may protest the establishment of the District of the furnishing of services therein either orally at the hearing or in writing, at or at any time prior to the hearing. Written protests must be filed with the San Juan County Clerk, and may be withdrawn by the protestant at any time before the County establishes or abandons the District. Any protest signed on behalf of a corporation owning property within the District shall be sufficient if it is signed by the president, vice-president, or any duly authorized agent of the corporation. Where title to any property is held in the name of more than one person, all of the persons holding title to the property must join in the signing of the protest. At said public hearing, the Board of County Commissioners will give full consideration to all protests which shall have been filed and will hear and consider all interested persons desiring to be heard. The Board of County Commissioners may continue the hearing from time to time. After conclusion of the hearing, the Board of County Commissioners shall adopt a resolution either establishing the Elk Meadows Special Service District or determining that the establishment of the District shall be abandoned, or may, at its discretion, reduce the boundaries of the District and establish the District by resolution, as modified. If, within fifteen (15) days after the conclusion of the hearing, over fifty percent (50%) of the qualified voters of the territory proposed to be included within the District or the owners of over 50% of the taxable value of the taxable property included within the proposed District file written protests against the specified type of service to be provided within the District with the County Clerk, the Board is required by law, in the former instance to abandon the proposed establishment of the District and, in the latter instance, to eliminate the type of service objected to from the resolution finally establishing the District. Any person who shall, at any time prior to the date and time above-specified for the hearing, file a written protest with the County Clerk against the establishment of the District and whose property has been included within the boundaries of the proposed District notwithstanding such protest, may, within thirty (30) days after the adoption of the Resolution establishing the District, apply to the District Court of the 7th Judicial District for a writ of review of the actions of the County in establishing the District, only upon grounds, however, that his property will not be benefitted by the services authorized to be furnished by the District or that the proceedings taken in the establishment of the District have not been in compliance with law. A FAILURE TO APPLY FOR SUCH WRIT OF REVIEW WITHIN THE PRESCRIBED TIME SHALL FORECLOSE ALL OWNERS OF PROPERTY WITHIN THE DISTRICT SO ESTABLISHED FROM THE RIGHT TO FURTHER OBJECT THERETO. Johnson, County Clerk San Juan County Commissioner Bruce Adams asked if anyone in the room had objections to the proposed Resolution #2007-05. There were no objections. He then asked if anyone wanted to speak in favor of the Resolution. Tom Keogh stated that he owns land at Elk Meadows and is in favor of the Resolution establishing the District to construct, maintain and provide water and sewer services within the boundaries of the District. Mike Adams, who is requesting the County to establish the District, spoke in favor of the Resolution as did J.J. Adams and John Bell who are also affiliated with the project. 11:15 A.M. - Commissioner Kenneth Maryboy made a motion to exit the Public Hearing. Commissioner Lynn Stevens seconded the motion and Commissioner Bruce Adams declared the motion carried by unanimous vote. Commissioner Lynn Stevens made a motion to approve the establishment of the Elk Meadows Special Service District. Commissioner Bruce Adams stated that he would abstain from the vote because Mike Adams is his brother. He passed the Chair to Commissioner Kenneth Maryboy who seconded the motion. Commissioner Kenneth Maryboy declared the motion carried with two in favor and one abstention. Commissioner Maryboy passed the Chair back to Commissioner Adams. Teague Eskelsen - Subdivision Issues Teague reviewed the problems that she has had in trying to get approval for three subdivisions that she is developing. She said that the process for getting the subdivisions approved takes entirely too long (17 weeks) and that it is holding up property sales. She is extremely frustrated and asked the Commission if she could walk the paperwork through the various County offices to get final approval. Bruce Bunker and David Bronson disagreed with Teague as to the reason the subdivision approvals were held up. Apparently, poor communication held up the process. Commissioner Stevens and Adams apologized for the inconvenience and the time it has taken and indicated that the County is well aware of the problems. Commissioner Adams said that with the new County Planning and Zoning Commission, recently formed, he is optimistic that the process will improve significantly in the near future. In the meantime, he said there was no objection to Teague visiting the various offices by appointment in an effort to get the subdivisions approved and signed. Open Time and Other Business Greg Adams said that the Southeast Utah Association of Counties plans to provide training related to planning and zoning. The training will take place in Blanding in mid-May. When Greg obtains additional information, he will be contact members of the SJC Planning and Zoning Commission. Phil Glaze came in to touch basis with the Commission on the parking and road issues at Wilson Arch. The County has not received an answer from the State as yet. Commissioner Adams said he would see Dale Stapley, from UDOT, at a meeting today and he discuss Wilson Arch with him. Commissioner's Reports Commissioner Adams attended the Utah Navajo Commission and discussed roads, healthcare and other issues that the County is working on. He is optimistic about opening communication with the Utah Navajo Commission and is hopeful that the communication will continue in the future. Commissioner Adams attended AOG last Thursday in Price and talked about a discussion related to the designation of wild and scenic rivers by the Forest Service. Two rivers in San Juan County, Rock Creek and Neil Creek Gorge were designated as wild and scenic rivers. Only ½ mile of Rock Creek River is in Utah. Evan stated that since they are already categorized as research areas, they are protected even more. Commissioner Adams attended the Oljato Chapter Meeting on Sunday where he reported on roads. He also received a call from the Tomhave Group informing him of discretional UDOT money that was made available for Native American Projects and he helped put together a project to obtain one million dollars to overlay the road from the intersection to the Oljato Chapter which was approved. He plans to attend the UAC Management Conference in Logan beginning tomorrow with Commissioner Maryboy and will be out of the County the rest of the week. Commissioner Maryboy attended the Mexican Water and Aneth Chapter meetings. He said that at the Aneth Chapter meeting, members requested help from the Commission to try and increase the hours of service of the Blanding Drivers License Office to accommodate the public. Commissioner Maryboy said that members of the Utah Navajo Commission were very happy that Commissioner Adams attended their meeting and appreciated the report he provided regarding expenditures for roads. Commissioner Maryboy said that the Navajo Nation is in session today and he plans to try and attend tomorrow. Discussion about Navajo national health issues, funding for roads and gaming will be addressed. He also said that the issue of authorization to certify the Blue Mountain Chapter will be discussed. He noted that everyone is excited about the Red Bull Air Race and with the cooperation and involvement between the County and the Navajo Nation. Commissioner Maryboy expressed his disappointment with Dr. Gibbons' letter published in the local newspapers and he and other members of the Navajo community feel they deserve an apology from him. He also stated that he was pleased with the funding in the amount of 1.5 million dollars allocated to the San Juan Health Service District. He will attend the Red Mesa Chapter meeting this evening. Commissioner Maryboy said that the "Head Start Days" went very well and he thanked the County for their support and continued support in the future.
