SAN JUAN COUNTY COMMISSION MEETING March 5, 2007 The regular meeting of the San Juan County Commission was held on March 5, 2007 at 9:00 A.M. in the Commission Room at Monticello, Utah Present: Bruce Adams, Commission Chair Kenneth Maryboy, Commission Vice Chair Tammy Gallegos, SJC Administrative Assistant Norman Johnson, SJC Clerk-Auditor Dianne F. Neuss, SJC Deputy Clerk Absent: Lynn Stevens, Commissioner Attendees: Krisanne Bender Cyndi Eldredge Bob Bushart Evan Lowry Stephen Schultz John Fellmeth Lynn Laws Louise Jones Commissioner Kenneth Maryboy made a motion to approve the minutes of February 26, 2007 pending Commissioner Lynn Stevens' review and approval. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Evan Lowry - SJC Planning Office Evan reported that he attended a Canyon Country Heritage Association meeting where participants discussed OHV use. He also attended a meeting last Wednesday with Nancy Shearin from the BLM to discuss Hole-in-the-Rock Trail management plans. Evan said that the BLM is looking at the trail at Lake Canyon and that the Glen Canyon National Recreation Area is looking at possible roads that would allow OHV use. Commissioner Adams said that he was contacted by the National Guard and they want to send a Radiation Team to George Rock (also known as Alligator Rock) to look at the site of the B-52 wreak. He has tried to contact the property owner in the area for his permission but has not been able to contact him as yet. He will give Evan the information so that he can coordinate with the property owner and the National Guard. Cyndi Eldredge - Human Resources Office Cyndi presented a recommendation to hire Julie H. Sampson for the position of Victims Advocate. Julie has a background in criminal justice and legal law. This position is full time and funded through a grant. Commissioner Kenneth Maryboy made a motion to approve hiring Julie H. Sampson for the Victims Advocate position. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Cyndi also recommended hiring John Young for the Dispatcher position in the Sheriff's department. John was previously employed with the County and is Post Certified. The position is a full time entry level position, Step 114. Commissioner Kenneth Maryboy made a motion to approve the recommendation to hire John Young for the Dispatcher position in the Sheriff's department. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Louise Jones, Recorder and John Fellmeth, IT Manager Louise and John presented a request to purchase a high speed scanner for the Recorder's Office. This is a heavy duty high end scanner which will enable the staff to begin scanning all the documents presently stored in books, making them accessible by computer. With the present equipment, only one document can be scanned at a time. Louise noted that there has been an increase in the volume of documents to be recorded and that a high speed scanner will help expedite the process. Two bids were received, one from Tiger Direct and one from NEWEGG. The recommendation was to go with the low bid from NEWEGG a cost of $6,015.99 plus a shipping cost of $30.24. This item is in this year's budget. Commissioner Kenneth Maryboy made a motion to approve the purchase of a high speed scanner in the amount $6,015.99 plus shipping for the Recorder's Office. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Norman Johnson - SJC Clerk/Auditor Norman provided the Commission with a calendar listing the dates pertaining to the annual property tax sale. Originally ten properties were identified with two already redeemed. At the April 16th Commission Meeting, Norman will present the list of potential properties to be sold. Tammy Gallegos - SJC Administrative Assistant Tammy presented five Building Permits for approval and signature. Aluie L. Coranado Lane, Spanish Valley - Garage Ronald & Penny Gough - 1759 S. 500 E., Blanding - Manufactured Home Reena Matthews - 245 West Rio Grande Dr., Spanish Valley - Detached Garage Commissioner Kenneth Maryboy made a motion to approve the five Building Permits provided all appropriate signatures are placed. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Lynn Laws - SLC Road Supervisor Lynn was asked to address the road and airport runway damage at the Needles Outpost. A call was received from Tracy Napoleone concerning the damage. Lynn said that County regulations prohibit maintenance of private runways due to liability concerns. He will go there this afternoon and speak to Tracy about the issues and see what the County can do. Commissioner Adams said that he and Rick Bailey attended the Oljato Chapter Meeting. Some of the issues discussed related to roads in this area, including financing, identifying priorities, and roads that are on school bus routes. Commissioner Adams said that they explained how the County makes decisions concerning road repair and maintenance. Rick will write to UDOT informing them of problems on roads for which they are responsible. Steve Olson will also be contacted regarding school bus routes needing road repairs. Commissioner Maryboy is working on annual appropriations from the Navajo Trust Fund for special road problems on the reservation and other efforts are being made to obtain additional funding as well. Open Time and Other Business Steven Schultz, a La Sal resident, came in today to let the Commission know about his organization, "Back Country Horsemen of America". The organization works with the BLM and Forest Service and others to preserve horse riding trails including providing signs. They are located in Spanish Valley and perform their service in Grand County at this time. The organization has nine chapters in Utah and is in 20 States. Steven said that the organization is reviewing the possibility of opening a chapter in Monticello to preserve the trails in the Abajo Mountains. Commissioners agreed that they would welcome the group and their services if they do decide to come to San Juan County. Mr. Schultz discussed a private issue relating to leasing or purchasing a County right of way to enable him to erect a fence near his property in La Sal. The area is located in an established subdivision in LaSal. He was directed to speak to the County Assistant Attorney, Walter Bird, to get his advise on the matter. If it is possible for him to lease or purchase the right of way, there is a process in place for amending the subdivision status that would likely include a public hearing as well as the property owners approval. Mr. Bob Bushart, a Bluff resident, inquired about the Hole-in-the-Rock trail from San Juan Hill into Bluff. He noted that it was discussed at a Commission Meeting on September 25th of 2006 when Cleal Bradford of the San Juan Foundation, discussed the issue. Evan was called into the Commission Chambers for his input. Evan said that the BLM marked four GPS locations on the historic trail and they are obligated to preserve the trail but no other plans have been made to his knowledge. Mr. Bushart requested information that may have been submitted at the September 25th meeting relating to the trail. Commissioner Adams read the portion of the minutes relating to Cleal's presentation when he requested the County's support for marking, mapping and advertisement of the historic trail. Commissioner Adams will try and get in touch with Cleal to find out more about this issue and will contact Mr. Bushart. In the meantime, Mr. Bushart was directed to the BLM for any information they may have. Krisanne Bender, a resident of Bluff, said that she attended the meeting on February 21st of the Canyon Country Heritage Association. Evan Lowry and Charles DeLorme were also in attendance at the meeting. During the meeting a Canyon Rim Trail map was presented showing ATV trails. The map was developed by the BLM, Utah State University, San Juan County, the National Forest Service and the Spear organization. Krisanne is interested in obtaining a copy of the map which was not distributed at the meeting. Evan responded to her request and said that the map belongs to Spear, and because it is incomplete it is not readily available for distribution. Ms. Bender said that the map had San Juan County's name on it and should be made available to the public. She said that it is her understanding that the map is being used to place signs and stickers on various trails. Ms. Bender also would like a copy of financial records relating the Canyon Rim trails and a copy of the $37,000 grant which was received by the County for use for State Parks and Recreation. Norman Johnson, SJC Clerk, asked that Ms. Bender to submit a formal Gamma request to him detailing what she would like us to provide to her. Evan said that he will try and get her a copy of the map. Ms. Bender said that she is only interested in having everything pertaining to these plans out in the open eliminating any misunderstandings. Commissioner Maryboy agreed that if something is being displayed and discussed, it should be available to the public. Commissioner's Reports Commissioner Maryboy met with Rick Bailey and Mark Maryboy last Monday to discuss and identify road issues. He traveled to Farmington, NM and met with members of the Piute and Shoshone tribes to discuss gaming and obtain information for the Navajo Nation to put a gaming package together for the Arizona Monument Creek portion of the reservation. They are having problems with Arizona's Gaming Commission dictating how the gaming should be run even though the State of Arizona has no jurisdiction over the Navajo Nation. Commissioner Maryboy also reported that oil and gas companies, located on the Navajo Reservation, now provide 62 ½ % royalty to the tribe and 32 ½ % to the State of Utah for the Utah Navajos. He has a bill before the Council to return an additional 20% to 30% to the Utah Navajos. If the bill does not pass, there is consideration to make the Utah area an Agency which would force some action. There is sufficient numbers to create an Agency. He also attended a work session to address Navajo Nation litigation regarding water rights, negotiations with a coal company and the issue with the Arizona Gaming Commission. Commissioner Bruce Adams attended the Harvest Energy Summit and said they discussed wind energy and good information was shared. He was to meet with the Utah Navajo Commission to present Wind Proposals but he will not be in town. Commissioner Maryboy said that he would attend and make the presentation. Commissioner Adams will provide him with the packet of information for the meeting. Commissioner Adams will plan to meet with them in April to followup. Last week he attended the last of the legislative sessions which ended on Wednesday. He will attend the AOG meeting on Thursday of this week and a Mental Health Board Meeting this afternoon. He is unable to attend the Oljato Chapter Meeting this Sunday as he will be traveling to San Diego on Sunday morning. He reviewed the Resolutions to be considered. He said that the meeting yesterday at the Oljato Chapter was a good meeting. Road issues were discussed including how we get funding from the State and how it is distributed. There will be a UDOT meeting in Price on March 15th and 16th. Commissioner Maryboy also plans to attend this meeting. Commissioner Adams will be out of town and will not attend next week's Commission Meeting. Tammy said that she and Rick will not be at next week's Commission Meeting due to other commitments.
