SAN JUAN COUNTY COMMISSION MEETING January 22, 2007 The regular meeting of the San Juan County Commission was held on January 22, 2007 at 9:00 A.M. in the Commission Room at Monticello, Utah Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Lynn Stevens, Commissioner Rick Bailey, SJC Administrator Norman L. Johnson, SJC Clerk /Auditor Dianne F. Neuss, SJC Deputy Clerk Commissioner Lynn Stevens made a motion to approve the minutes of January 8, 2007 with the correction noted. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Evan Lowry - SJC Planning Office Evan said the Forest Service Plan, including the Clay Draw Reservoir, is moving forward but has not been received as yet. A grant in the amount of $38,000 was received from the Utah Division of Parks and Recreation Department for OHV trails construction and maintenance. This is a federal program grant that Ben Nielson worked hard to obtain. All three Commissioner's signatures are required for receipt of the grant. Matching funds required to qualify for the grant included the purchase of a trail cat and other in-kind contributions from the County such as signs and kiosks. Cyndi Eldredge - SJC Personnel Office Marylou Harvey, the Bluff Senior Center Director, has agreed to take on the duties of Ombudsman along with her present job responsibilities. She is a Certified Social Worker and well qualified for the position's additional responsibilities. It is recommended that the position be reclassified from a Step 40 to Step 55 with the accompanying pay increase. Commissioner Kenneth Maryboy made a motion to approve the recommendation to reclassify Marylou Harvey's position to include Ombudsman. Commissioner Lynn Stevens seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Sheriff Lacy recommended that Lyle Bayles be hired for the position of Task Force Director. This is a full time position and is at Step 194. Commissioner Lynn Stevens made a motion to approve the recommendation to hire Lyle Bayles for the position of Task Force Director. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Sheriff Lacy recommended that Jaren Adams be promoted to Task Force Second Man, from Step 173 to Step 180 and that Jerald J. Bradford be promoted to Lead Investigator, from Step 152 to Step 170. Commissioner Kenneth Maryboy made a motion to approve the recommended promotions for Jaren Adams and Jerald J. Bradford. Commissioner Lynn Stevens seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. A request for the assignment of a Risk Manager/Workers Compensation Coordinator for the County was received and was presented for signature. Cyndi Eldredge will continue as Risk Manager and Workers Compensation Coordinator. Commissioner Kenneth Maryboy made a motion to approve the assignment of Cyndi Eldredge as Risk Manager and Workers Compensation Coordinator. Commissioner Lynn Stevens seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Robert Gilbert and Steven Jensen - Department of Workforce Services Steven Jensen invited everyone to attend the Annual Business Expo at the Blanding Arts and Events Center on February 7th . This event was organized by the Department of Workforce Services. They will have a national guest speaker, booths and break-out sessions related to business in the area. A great response was received from the Monticello and Blanding Chambers of Commerce and all of the booths are full. This is a sponsored event and Mr. Jensen thanked Charles DeLorme for the generous contribution from the San Juan County Economic Development Department supporting the event. He noted that the unemployment rate is down to 5.1% in the County but that 20% of residents are still receiving food stamps, Medicaid, Chip Medical Coverage and other child care related assistance. A good portion of funding also goes to training programs to help individuals to try and get better jobs. He discussed the departments investigation of fraud and their high recovery rate. The Advisory Council, run by Bob Roosevelt, reviews and approves workforce programs and spending. Robert Gilbert distributed a handout related to the purpose and function of the Southeast Regional Council and discussed the 11 regional programs that are evaluated for improvement and strengthening by the Council. He asked for a Commissioner from San Juan County to become a member of the Council. County Commissioner's from Carbon and Emery Counties are presently represented. Norman Johnson and Charles DeLorme are also members of the Council. Although Commissioner Lynn Stevens foresees some conflicts, he volunteered with the understanding that if he is unable to attend a meeting, Commissioner Adams or Commissioner Maryboy would take his place. He asked that this item be added to the Commission Roster of Commission Assignments. The details of the unemployment percentages, and the fact that statistics only track individuals who are searching for employment was discussed as well as the various reasons for unemployment in the area. Companies that cannot find qualified and suitable employees bring in crews from outside the area and rotate their crews in order to fill jobs. It seems that companies in this area are heading in that direction. There are many opportunities that are provided by companies and by Workforce Services to recruit people from the area. Company based training and reimbursement for outside training, CDL in house training and many more programs through Workforce Services. Charles DeLorme, Director of SJC Economic Development noted that if persons are brought into the County on a temporary basis and stay at motels in our area they are exempt from paying TRT which is not good for the County. He suggested for the long term, we should try and work with children at the elementary school level to teach them about work ethics and responsibility in the workplace so that in 10 to 15 years we will not have these same problems. Norman Johnson - SJC Clerk/Auditor Norman presented one beer license renewal for approval and signature. William W. Simpson Enterprises, Inc. - Twin rocks Café - Bluff, Utah Commissioner Kenneth Maryboy made a motion to approve the beer license renewal for the Twin Rocks Café in Bluff. Commissioner Lynn Stevens seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Norman noted that the assignment of a board member for the Blanding Cemetery District needs to be addressed. Commissioner Stevens said he spoke with LouAnn Grover and she would like to serve on the board. Phil Palmer and Calvin Blake are the other two members of the board. The board can be comprised of a maximum of five members. Commissioner Lynn Stevens made a motion to approve the appointment of LouAnn Grover to the Blanding Cemetery Board. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Charles DeLorme - SJC Economic Development Director Charles reported that he and Lynn Laws went down to Bluff last Thursday to look at the Swinging Bridge and the possibility of including the bridge in the County road system. Commissioner Stevens thought that Evan Lowry and Lynn Laws could network to get it into the system. The engineering aspects of the project relating to increasing the height of the bridge, eliminating the center piling to avoid further damage, and possibly using a composite material for the planking were discussed. Several engineering opinions are being taken into consideration. David Bronson will come up with the measurements for the design and once completed a team of engineers from the State Park Service will come up with a cost. Charles said they have $25,000 toward the project so far and that because the bridge is an existing structure there is no need for a permit to make the repairs. Commissioner Adams told Charles that he appreciated his effort in holding the recent telecommunications conference. Charles noted that he has had positive feedback so far and that CommNet wants to erect a tower in Bluff and that Gouldings identified an area where a tower could be built. Commissioner Maryboy asked Charles if he would draft a letter of appreciation and support to Steve Simpson and the Business Owners of Bluff, for hosting the Bluff International Balloon Festival. The event was very successful in spite of the weather. Charles will draft the letter for Commission signature. Jim Keyes - USU Extension Jim requested approval for out-of-state travel to Reno, NV in February to attend a meeting of the Society for Range Management. The Commission asked that Jim give a report to the Commission upon his return. Commissioner Lynn Stevens made a motion to approve the out-of-state travel request for Jim Keyes to attend the Society for Range Management meeting. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Paul Barr - SJC Treasurer Paul requested approval to purchase a computer for his department. He presented two bids, one from Tiger Direct and one from Dell Computers. The low bid was from Tiger Direct and Paul would like to purchase the computer from them at a cost of $753.96. Commissioner Lynn Stevens made a motion to approve the purchase of a computer from Tiger Direct in the amount of $753.96 for the Treasurers Office. Commission Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Rick Bailey - SJC Administrator Rick presented three building permits for approval and signature. Samantha Sheets - 48 E. Bobcat Ct., Moab - Residence Randy Lee - 1445 South Highway 191, Blanding - Residence John & Susan Bloomqust - Lot 12 Wilson Arch - Residence Commissioner Lynn Stevens made a motion to approve the building permits provided all appropriate signatures are placed. Commissioner Kenneth Maryboy seconded the motion and Commissioner Bruce Adams declared the motion carried by unanimous vote. Michael Adams, Developer of the Ranch at Elk Meadows, north of Monticello, requested approval of the subdivision which is comprised of 126 lots. The lots are from 3.86 to 5 acres each which more than meets the Counties requirement of one acre lots. The septic issue was discussed and Mr. Adams was advised that for the County's protection, it should be recorded on the deed whether or not the lot passed the perk test. A suggestion was made that it should be noted on the building permit and on the Plat and possibly included in the subdivision Covenants. The buyer should be fully informed before purchasing the property. If the lot does not pass the perk test the buyer will be referred to the State level to determine what kind of system. Commissioner Stevens made a motion to approve The Ranches at Elk Meadows subdivision. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams disclosed that Michael Adams is his brother and abstained from the vote. The motion was passed with two in favor and one abstaining. Rick said the owner, Sam Summerville, of an approved subdivision in Spanish called Tera Lane is requesting approval for another subdivision across the road. Rick recommended that the new subdivision which is comprised of six lots be approved but with the stipulation that the road be brought up to County standards as they have already received complaints about the road. The first subdivision was approved subject to bringing the public road up to County standards (graveled) but so far it has not been done. It was decided to approve the additional subdivision with the stipulation that before any building permits are issued, the road will have to be graveled. Rick will send a letter to the owner advising him of this decision. Rick will followup on their progress. Commissioner Lynn Stevens made a motion to approve the request with the stipulation that no building permits will be issued until the road improvement is completed. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Rick received a letter Mike Adams requesting approval to form a Special Service Water and Sewer District. Rick will request that Walter draft a Resolution for Commission approval. A notice will be published for a Public Hearing. Following the Public Hearing it will be submitted to the Commission for approval. Rick presented a Procurement Request from the Road Department for a new Ingersoll-ran 1" Drive Impact Wrench to replace one that is malfunctioning. Three bids were received and Northern Tool Companies bid of $643.00 was recommended for approval. Commissioner Lynn Stevens made a motion to approve the purchase requested by the Road Department. Commissioner Kenneth Maryboy seconded the motion and Commissioner Bruce Adams declared the motion carried by unanimous vote. Rick presented an additional Procurement Request for five computers for the Aging Department. Four are replacements, and one is an additional computer. Four bids were received with the lowest from HP at a cost of $369.98 for each computer. The recommendation is to go with HP. There is $2,000 in the Aging budget for the computer purchase. Commissioner Lynn Stevens made a motion to approve the purchase of five computers for the Aging Department. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Rick said that the UDOT 491 Project, Phase 2 has not been awarded as yet. LaGrand Johnson came in with the low bid at 9 million dollars, 3 million dollars lower than others. Other issues related to roads were discussed including road damage on the loop road and Spanish Valley road. It was decided that a meeting should be arranged regarding transportation issues and that an hour should be set aside. Some additional issues of concern are the highway from Bluff to the State line, the counties road priorities, barriers on the road from Monument Valley to Mexican Hat as well as turn lanes. UDOT did fund our requests for the two passing lanes on 491 and for the eight foot shoulders. The Commission asked if information is available regarding the number of trucks that enter through the Port of Entry in Monticello. Trent Schafer said the information should be available from the weigh station. Commissioner Adams said that he would like to compare that numbers with the trucks that go through St. George's Port of Entry. The Commission asked Trent about the plan to relocation the Port of Entry. He said he has not received the determination from the FAA as yet about moving the location. He expects them to get back to him this week but will followup if necessary. The surveying is done and if possible a temporary facility could be erected for now. National Weather Service - NOAA (National Oceanic & Atmospheric Administrtion) Weather Radio Ceremony Members of the Grand Junction Warning and Forecast Office (WFO), Doug Crowley, John Kyle, Troy Lindquist and Jim Pringle as well as others came today to make a presentation and congratulate everyone who made it possible for the Monticello All-Hazards National Oceanic & Atmospheric Administration Weather Radio to become a reality. The new station is WNG-687 162.450 MHz which covers San Juan County, Utah, Western Montezuma County, Western San Miguel County, Western Dolores County, and Western Montrose County. A slide show was presented giving details of the new All-Hazards NOAA Weather Radio transmitting service that will provide warnings and information greatly increasing the ability to protect lives and property to the Western Colorado and Eastern Utah area. San Juan County was presented with a gift of a Weather Radio which can be turned off and set to be automatically activated by the station office. Allan Orton, from the State of Utah Division of Information Technology Services, is in charge of maintaining the station.. Rick Bailey and Tammy Gallegos were presented with awards for all their contributions in their capacity as the San Juan County Emergency Management Team. Jim Pringle and Allan Orton's personal dedication and the whole Colorado staff were also recognized for their efforts. Monetary donors were: USDA whose grant paid for 7% percent of the transmitter system, San Juan County who funded 25 percent of the transmitter system, the State of Utah Division of Information Technology Services, the State of Colorado Communication Services and the National Weather Service Central Region Headquarters. Liz Black and Donna Burke from the USDA Rural Development office presented an awards to San Juan County and to Rick Bailey and Tammy Gallegos. Commissioner Bruce Adams presented an award of a Key to members of the WFO in appreciation of all their work to get the radio station up and running. San Juan County Healthcare Special Service District Board Appointment Since Mark Maryboy withdrew his application to serve on the Healthcare Special Service District Board, and a letter of application was received from Burton Black for membership on the Board, Commissioner Lynn Stevens made a motion to accept Mark Maryboy's withdrawal and approve the application of Burton Black for a seat on the Healthcare Special Service District Board. Commissioner Kenneth Maryboy seconded the motion. Commissioner Bruce Adams declared the motion carried by unanimous vote. Discussion - Amendments to Resolution #'s 2006-07, 2006-08 and 2006-09 Commissioner Adams opened discussion regarding proposed Amendments to Resolution #'s 2006-7, 08 and 09. The first to be discussed was the amendment relating to the San Juan Hospital closure and the Blue Mountain Hospital and the other two relate to the "Governing Authority" of districts. After Commissioner Adams read the proposed Amendments, he asked for comments from the other Commissioners. Commissioner Stevens objected to the Amendments to the Resolution dealing with the Blue Mountain Hospital project and he especially objected to the word "reckless", when referring to the closure of the San Juan Hospital. He suggested changing it to "inappropriate" and/or "detrimental". He also had strong objections to the portion of the proposed Amendment that states that the IHS should divide their contract between the two hospitals. He said that the County is opening itself up to a law suit because the approved Resolution guaranteed the closure of the San Juan Hospital allowing the Blue Mountain Hospital to be eligible for critical access status in order to qualify for insurance through HUD. Commissioner Stevens stated that it is his believe that government should not compete or interfere with private enterprise. He further suggested that the County request something in writing from HUD that if the Amendment is approved it will not jeopardize The Blue Mountain Hospital's ability to get their loan. Commissioner Kenneth Maryboy said he would save his comments for the Public Hearing. The other two proposed Amendments would change the wording of the paragraph, relating to the district's "Governing Authority", back to the original wording of the Resolutions that were adopted in 1988 and 1998. Commissioner Stevens objected to these Amendments because he believes that under State law it is unnecessary for districts to have "Governing Authority" because it gives them more authority than they need to perform their duties and that their having Governing Authority puts the County at risk. A notice of a Public Hearing to address Amendments will be advertised. The hearing will be scheduled in three weeks when the Public will have the chance to comment. Open time and Other Business A new member, Toni Turk, of the Healthcare Special Service District Board, was concerned because he was told that meetings were held on the 3rd Wednesday of the month and when he arrived no one was there. The Healthcare Board meetings are on the 4th Wednesday of each month and there may have been a misunderstanding due to the holiday schedule. Commissioner Stevens recommended that a Resolution be drafted to create a Planning and Zoning Commission for the County. The Resolution should include the responsibilities of the new Commission as well as the number of representatives from the various areas of the County. The need for this new Commission is becoming more and more necessary as new subdivisions are coming into the County. Rick and Walter will work on the Resolution and a Public Hearing will be scheduled. After the commission is formed, and members are appointed, formal training will need to be scheduled . It was advised that five or seven members should be appointed to the commission and a staff member should also be assigned to work with the new commission. The budget may have to be adjusted to accommodate the cost of the new commission. Commissioner Lynn Stevens asked to go on record saying that he categorically denies the allegations made by Mark Maryboy, former San Juan County Commissioner, in a letter he wrote to the Editor of the Salt Lake Tribune, which was published in their January 20, 2007 issue. Commissioner Stevens said that the allegations made in the article were completely false and that he has spent the last four years, along with other members of the SJC Commission and members and staff, promoting good relations between Native Americans, who make up half of the residents of our County. Commissioner Bruce Adams stated that there are obviously communication problems with members of the Utah Navajo Commission and asked Commissioner Maryboy if he had set up a meeting between the Utah Navajo Commission and the San Juan County Commission. Commissioner Maryboy said that members of the Utah Navajo Commission asked that Commissioner Lynn Stevens contact them to request a meeting. Commissioner Stevens said that it would be more appropriate for Commissioner Bruce Adams, as Commission Chair, to contact the Utah Navajo Commission and Commissioner Adams agreed. Commissioner Stevens requested that the issue of Public Lands and Roads be placed on the Commissioner Agenda for the next Commission Meeting. He would like representatives from the County Survey office and Planning office to attend the meeting as well as the County Attorney. Charles DeLorme and Cleal Bradford presented the letter of support for inclusion with the application to the UDOT Enhancement Fund for the Bluff Project. A letter signed by the Governor was also included with the grant request. Gloria Begay, Blue Mountain Hospital Board Member, asked if she could be provided a copy of the Resolution having to do with Blue Mountain Hospital to distribute to the various Chapters for their information. She will be sent a copy of the Resolution. Commissioner's Reports Commissioner Stevens will attend all of the legislative sessions this week, particularly the ones that address bills relating to Voter Registration and Indian rights. He will attend the Western County Alliance meeting on Friday. Commissioner Stevens attended the Association of County Legislative Meeting on Thursday and the Cowboy Caucus on Friday. Commissioner Adams attended the Cowboy Caucus and the Department of Natural Resources meeting where the upper Colorado River and Snake Valley issues were addressed. Funds for wells in that area, the commitment to preserve water rights and to build a pipeline were discussed. He will attend the Utah Partners for Conservation Committee meeting which will meet on Wednesday to approve nine projects ranked for the State. Commissioner Adams met with Dan Rogers Thursday as a followup to another meeting that he had with Senator Mike Dmitrich and others. They came up with some suggestions to meet the mental health needs of our County. He will be in town for the rest of the week due to a death in his family. Commissioner Maryboy said that he spent some time driving the school bus route and senior citizen routes in the southern part of the County. He took pictures of road conditions and of areas that need service and repair. He also said that the Navajo Nation is in session until Friday of this week.
