SAN JUAN COUNTY COMMISSION MEETING January 2, 2007 The regular meeting of the San Juan County Commission was held on January 2, 2007 at 10:00 A.M. in the Commission Room at Monticello, Utah Present: Lynn Stevens, Chairman Bruce Adams, Commissioner Commissioner Elect Kenneth Maryboy, Norman L. Johnson, SJC Clerk /Auditor Tammy Gallegos, SJC Administrative Assistant Dianne F. Neuss, SJC Deputy Clerk A motion to approve the minutes of December 18, 2006 was made by Commissioner Bruce Adams. Commissioner Lynn Stevens seconded the motion. Commissioner Kenneth Maryboy abstained from the vote. Commissioner Lynn Stevens declared the motion carried. Elected Officials - Oath of Office San Juan County Clerk/Auditor, Norman L. Johnson, administered the oath of office to the newly elected Commissioners and officials for San Juan County. They are as follows: County Commissioners Lynn Stevens and Kenneth Maryboy, County Assessor Howard Randall, County Recorder Louise Jones, County Sheriff Mike Lacy and County Treasurer Paul Barr. San Juan County Attorney Craig Halls will be sworn at a later time. Judge Lyon Hazleton II was previously sworn in and Norman L. Johnson, County Clerk/Auditor was sworn in previously by Judge Lyon Hazleton II. Ben Nielsen - SJC Planning Office Ben presented a Joint Funding Agreement for Commissioner's signatures. The agreement is between the San Juan County and the U.S. Geological Survey Department. The agreement provides funding for water resources investigations (to operate and maintain stream flow gaging stations on North Creek and Spring Creek). The document was signed by all three members of the Commission. Cyndi Eldredge - SJC Personnel Office Cyndi made the recommendation to approve the promotion of Grayson Redd to the position of Chief Deputy in the Sheriff's Department. This is a newly created position that all agreed is much needed. If approved, Grayson Redd would go from a Step 204 to a Step 259. Commissioner Bruce Adams made a motion to approve the promotion of Grayson Redd to the new position of Chief Deputy. Commissioner Kenneth Maryboy seconded the motion. Commissioner Lynn Stevens declared the motion carried by unanimous vote. Clint Bradford reapplied for his previous position as Light Equipment Operator for the Road Department. It is recommended to reinstate Clint Bradford in accordance with personnel policy for the same position and at the same rate of pay as when he left. Jolynn Orr is recommended to fill the position of Director of the Blanding Senior Center. This is a full time position with benefits, at Step 25. She is presently employed at the center as a part time Senior Aid. If approved, Cyndi will begin advertising for the Senior Aid position. The previous director recently resigned her position. Commissioner Bruce Adams made a motion to approve the personnel actions recommended for Clint Bradford and for Jolynn Orr. Commissioner Kenneth Maryboy seconded the motion. Commissioner Lynn Stevens declared the motion carried by unanimous vote. 2007 Commission Assignments A list of Commission Assignments was distributed. Commissioner Lynn Stevens suggested that Commissioner Bruce Adams take the Association of Governments responsibility. This group meets at least once a month in Price, Utah. Mayor Doug Allen is a member of the Association which is made up of County Commissioners and Mayors. Commissioner Lynn Stevens explained that the current assignments can be retained for the most part and their were not objections. Commissioner Kenneth Maryboy will assume the assignments as liaison between the County and the various Native American Community entities. Gary L. Knecht - Canyonlands Needles Outpost - Hwy 211 Rogene Brundage - Cottonwood Steakhouse - Bluff Erik Hansen - Hole in the Rock General Store - Moab Marlene Allen - Old Bridge Grill - Mexican Hat Mark Sword/Julie Sword - San Juan Trading Post - Mexican Hat Norman reviewed the times and dates for Commission Meetings in 2007. The Commission Meeting will now begin at 9:00 a.m. The meeting originally scheduled for January 16th was changed to January 29th due to a conflict with a telecommunications meeting on that day. Norman advised the Commission that the independent auditors will attend the next Commission Meeting to review the 2005 audit. They will be in the County offices to work on the 2006 audit on January 8th, 9th, and 10th. Through a third party, LouAnn Grover expressed interest in continuing her service on the Blanding Cemetery District Board. Commissioner Stevens will verify that she is still willing to serve. The appointment was tabled until a future meeting. Norman presented the names of five San Juan Water Conservancy District Board Members whose terms have expired. All five would like to continue their service as members of the board. Norman is the Chair of the Water Conservancy District Board and recommended that they be reinstated. They are: Gary Halls, Sam Cantrell, Melvin Capitan, Gary Crowley and Danny Flemming. Commissioner Bruce Adams made a motion to approve the reinstatement of the five members named. Commissioner Kenneth Maryboy seconded the motion. Commissioner Lynn Stevens declared the motion carried by unanimous vote. Commissioner Maryboy will speak to Mr. Capitan, one of the six board members, to make sure he still wants to continue on the board since he was not able to attend some of the meetings. Commissioner Bruce Adams noted that three applications were received for the San Juan Health Care District Board. They are Cloyce Smith, Walter Atene from the Oljato Chapter and Mark Maryboy. Cloyce Smith may have a conflict because his wife works at the Hospital. Commissioner Adams recommended approval of Walter Atene for a seat on the board and to approve Mark Maryboy to the at large seat on the board. This action would fully staff the Health Care District Board. Commissioner Bruce Adams made a motion to approve the appointments of Walter Atene and Mark Maryboy to the San Juan Health Care District Board. Commissioner Kenneth Maryboy seconded the motion. Commissioner Lynn Stevens declared the motion carried. Cleal Bradford - UDOT Enhancement Fund Cleal, along with Corinne Roring presented the Commission with a new plan for the Bluff Fort Historical Site. The grant from the UDOT Enhancement Fund was originally denied because the structure on the property is registered as a ruin. They have chosen another lot to build on the lot and need to apply again for the grant. They will need new letters of support from the County as well as from the Governor and from Evan Lowry as was previously submitted with the application. The letter should include the agreement by the County to maintain the site for 25 years if there is a default. Support for this project was originally approved by the Commission on August 21, 2006. Commissioner Lynn Stevens will obtain another letter from the Governor's office and Evan will be asked to provide a letter of support along with the letter from the County. The application is due in by the end of January. Commissioner Bruce Adams asked Cleal if he had a chance to work on writing a grant to the UDOT Enhancement Fund to help fund a paved bike path and walk way from the school to Gouldings. This path would not only address the safety issue for students but will also be an advantage to the public. Members of the Oljato Chapter are very excited at the prospect of this project. Cleal said that he tried to see Rick Bailey on a couple of occasions but missed him. Rick will be contacted to see if he can help to get the grant request into UDOT before the end of January. Cleal asked if the County had budgeted for a contribution to the Save Americas Treasures group for 2007. The group intends to restore 20 Anasazi sites. It was determined that the allocation was not in the 2007 budget. Charles DeLorme suggested that his department could possibly help with a contribution if the TRT is increased. Jared and Heather Palmer - Zoning Change Jared and Heather Palmer provided the Commission with a list of signatures from their neighbors approving the zoning change they are requesting. The requested change is so that they can relocate a business to their property. They were unable to contact one person and the Commission suggested that they continue to make every effort to get the one remaining signature of approval to alleviate any future problems. In the meantime, Rick will be asked to set up and advertise the public hearing regarding the zone change. Mr. & Mrs. Palmer will be notified of the time and date of the hearing so that they can attend. 11:30 a.m. Public Hearing for an Increase in the Transient Room Tax Charles DeLorme, Director of SJC Economic Development made a presentation explaining the proposed increase in the Transient Room Tax from 3% to 4.25%. This tax money is for improving infrastructure and marketing to promote an increase in tourism and business in the County. Charles said that this increase will also help to staff the visitor centers in Monticello, Monument Valley and Blanding. He would like to provide $2,000 to each visitor center in the County and intends to make sure that businesses that collect the TRT have a greater input in how the funds are spent. The increased funding would also help to provide additional grants for tourism projects related to economic development. The tax is collected by hotels, motels and camping grounds and is returned to these business providing them with needed services. The increase would provide approximately $90,000 additional funds. A lengthy discussion with many positive comments from the public regarding the use of the funds, comparisons with other counties, who pays and who benefits from the TRT. The great majority of attendees (business owners, elected city officials, representatives from the local newspapers and others) were in favor of the increase and felt that it would benefit businesses in the County. Two people objected to the increase. One objection was that any tax increase for any purpose should not be granted and that the County should continue at the present rate and the other objection was from the owner of the Pack Creek Ranch who was not aware of the proposed increase until today and asked that the action be postponed. Commissioner Adams, although sympathetic to the reasons for the two objections, felt that since the majority of the public and other elected officials and business owners were in favor of the increase, and because the process for notification was followed, that the Commission should proceed with the vote on the Resolution. He assured Mr. Sleight, the owner of Pack Creek Ranch, that the Commission would be more than willing to address the concerns he has regarding the roads to his ranch (TRT cannot be used for road work according to Utah Code) as well as other issues that may be of concern to him. Commissioner Bruce Adams made a motion to adopt Resolution 2007-01 and increase the Transient Room Tax from 3% to 4.25%. Commissioner Kenneth Maryboy seconded the motion. Commissioner Lynn Stevens declared the motion carried by unanimous vote. Resolution No. 2007-01 RESOLUTION TO INCREASE THE SAN JUAN COUNTY TRANSIENT ROOM TAX (TRT) RATE FROM THE CURRENT RATE OF 3% TO THE NEW RATE OF 4.25% WHEREAS, pursuant to Subsection 59-12-301(1)(a), Utah Code Annotated (1953, as amended), "any county legislative body may impose a tax on charges for the accommodations and services described in Subsection 59-12-103(1)(I) at a rate of not to exceed: (I) 3% beginning on or after May 13, 1975, and ending on September 30, 2006; or (ii) 4.25% beginning on or after October 1, 2006"; WHEREAS, pursuant to Subsection 59-12-301(1)(b), Utah Code Annotated (1953, as amended); "the revenues raised from the tax imposed under Subsection (1)(a) shall be used for the purposes listed in Section 17-31-2"; WHEREAS, pursuant to Subsection 59-12-301(2)(b)(I), Utah Code Annotated (1953, as amended); "except as provided in Subsection (3)©), if, on or after July 1, 2004, a county enacts or repeals a tax or changes the rate of a tax under this part, the enactment, repeal, or change shall take effect: (A) on the first day of a calendar quarter; and (B) after a 90-day period beginning on the date the commission received notice meeting the requirements of Subsection (3)(b)(ii) from the county" and; WHEREAS, a public hearing was held on January 2, 2007, to receive public input, positive or negative, on the proposed tax rate change. NOW, THEREFORE, BE IT RESOLVED BY THE COUNTY LEGISLATIVE BODY OF SAN JUAN COUNTY, UTAH, that the San Juan County transient room tax (TRT) rate be increased from the current rate of 3% to the new maximum allowable rate of 4.25% and that the revenues be used only for the purposes listed in Section 17-31-2, Utah Code Annotated, (1953, as amended). Walter presented Resolution # 2007-02 that would grant approval to consolidate and divide lots 6-12 in block 20, Cottonwood Addition, Bluff, San Juan County, Utah into three (3) separate parcels. A Resolution is needed so that the action can be recorded without a subdivision amendment. Walter explained that each of the new parcels will have street frontages and, because it would be inequitable to require these landowners to follow the amendment process when others within the subdivision have routinely been allowed to consolidate and divide their lots without following the amendment process, that they should also be allowed to consolidate and divide their property. After discussion, it was recommended that the Resolution should be adopted with the understanding that when the Planning and Zoning Commission is up and running in a few months this problem will be addressed. Commissioner Kenneth Maryboy made a motion to adopt Resolution 2007-02 which approves the consolidation and division of lots 6-12 in block 20 owned by Teri Paul and Kyle Bauman into three parcels absent the amendment process required. Commissioner Bruce Adams seconded the motion. Commissioner Lynn Stevens declared the motion carried by unanimous vote. Resolution No. 2007-02 RESOLUTION GRANTING APPROVAL TO CONSOLIDATE AND DIVIDE LOTS 6-12 IN BLOCK 20, COTTONWOOD ADDITION, BLUFF, SAN JUAN COUNTY, UTAH, INTO THREE (3) SEPARATE PARCELS WHEREAS, a request was received by the county zoning administrator, from the landowner(s) of record, to consolidate and divide Lots 6-12 in Block 20, Cottonwood Addition, Section 26, T40S, R20E, SLB&M, Bluff, San Juan County, Utah, into three (3) parcels more particularly described as: Parcel #1: North 80 Feet of Lots 12 and 11. North 80 Feet of the West ½ Lot 10. Block 20, Cottonwood Addition, T41S, R20E, SLB&M; Parcel #2: South 60 Feet of Lots 12 and 11. South 60 Feet of the West ½ Lot 10. Everyone agreed that this was an excellent idea and long overdue. Steve Simpson, of Bluff, submitted donations in the amount of $3,479, plus another $500 that is on its way for the Swinging Bridge repair project in Bluff. Charles DeLorme said that he has collected about $2,100 in donations and Commissioner Stevens said that he has also received a couple of donations. The project is planned for March of 2007. Chairman & Vice-Chairman/Commission Commissioner Stevens asked for motions to select a Commission Chair and Vice Chair. Commissioner Kenneth Maryboy made a motion to nominate Commissioner Bruce Adams to serve as Commission Chairman. Commissioner Bruce Adams seconded the motion. Commissioners Adams and Maryboy voted aye and Commissioner Stevens voted nay. Commissioner Adams declared the motion carried by a two to one vote. Commissioner Bruce Adams nominated Commissioner Kenneth Maryboy to serve as Commissioner Vice Chair. Commissioner Lynn Stevens seconded the motion.
