SAN JUAN COUNTY COMMISSION MEETING NOVEMBER 27, 2006 The regular meeting of the San Juan County Commission was held on November 27, 2006 At 10:00 A.M. in the Commission Room at Monticello, Utah Present: Lynn Stevens , Chairman Bruce Adams, SJC Commissioner Tammy Gallegos, SJC Administrative Assistant Norman Johnson, SJC Clerk /Auditor Dianne F. Neuss, SJC Deputy Clerk Absent: Manuel Morgan, Vice Chairman Commissioner Bruce Adams made a motion to approve the minutes of November 20, 2006 with the correction noted. Commissioner Lynn Stevens seconded the motion. Commissioner Lynn Stevens declared the motion carried. Tammy Gallegos - SJC Administrative Assistant Tammy presented a resolution for approval and signature for the Recertification of the San Juan Justice Court. Commissioner Bruce Adams made a motion to approve the resolution to recertify the San Juan Justice Court for the next four years. Commissioner Lynn Stevens seconded the motion. Commissioner Lynn Stevens declared the motion carried. Tammy presented the following three building permits for approval and signature: Michael & Shelly Dyke - Deer Neck Rd., West Summit - Residence Isaac J. Chamberlain - 765 Ridgeway Dr., Blanding - Addition to Existing Home Alltel Communications - E. 500 S Street, Blanding - Cell Tower Commissioner Bruce Adams made a motion to approve the building permits for Michael & Shelly Dyke and for Isaac J. Chamberlain. The permit for Alltel Communications is approved pending receipt of their check . Commissioner Lynn Stevens seconded the motion. Commissioner Lynn Stevens declared the motion carried. Evan Lowry - Planning Office Evan received a letter from the State Parks and Recreation Department concerning the Federal Recreation Trails Grant. The grant is for matching funds in the amount of $37,000. There will be a meeting in SLC on December 12th to define the criteria and recording requirements for receiving the grant. Evan said that volunteer work and use of equipment as well as other resources in addition to actual funds are considered. He or Ben Nielson will attend the meeting. The County will also receive $1,500 from the State Parks Service for a printer for maps and ATV needs. The funds will be paid through the San Juan Foundation. Evan said that Maxine Deeter, from the BLM Office, is gathering old information on Arch Canyon from the State and she will forward it so that Evan can add it to the current information he has gathered. The old file includes three earlier affidavits as well as other information. Evan said he has six more affidavits regarding Arch Canyon and is pursuing a couple of others as well. He also has slides from Curtis Palmer of the Arch Canyon road in 1960. Norman Johnson said he can provide some home movies taken in the late 50's that show evidence of a road. Evan said he also has a picture of the jeep trail from1953. Commissioner Stevens noted that SUA has strongly insisted that there was never a road at Arch Canyon. The information clearly shows evidence that there has been a road there for many years. Charles DeLorme, SJC Director of Economic Development - Walter Bird, SJC Assistant Attorney Charles reported to the Commission that he has set up a Teleconference to take place on Tuesday, January 16th at 10:00 a.m. in the Commission Chambers, to discuss countywide wireless service. He has invited representatives from Frontier, Verizon and Alltel along with John Lewis . On the user side, IUC, Constellation Cooper, UNHS, Donna Singer, Bill Boyle, Jerry Oldroyd, Attorney with the State Office of Economic Development, Rick Bailey, Marilee Bailey, and San Juan Health Services were invited to participate. It was suggested that a representative from the Sheriff's Office and from Wilderness Quest should also be invited to participate. Wilderness Quest had asked the County previously if they would be interested in joining their plans for wireless service in the County. Charles reviewed the issue of raising the TRT rate. Most counties have already raised the tax by one 1/4%, from 3% to four 1/4%. Charles said he has spoken to members of the business community regarding the increase and the plan has been well received. The increase would allow for turning part of the funds back to the businesses to upgrade their facilities and possibly get together to form an organization to address the use of the funds. Charles has been working with Attorney Walter Bird regarding the steps that need to be taken to increase the tax. If the Commission agrees, Walter will prepare the Ordinance and recommended a month notice of the intention to increase the tax and hold a Public Hearing. Walter said that he is in agreement that we should raise the tax and Charles said that it will not affect business as this only effects hotel and motel rates and currently they are below market average. Charles also said that the increased tax would provide additional funding for the visitor centers in Monticello, Monument Valley and Blanding. It was decided that a Public Hearing will be held on January 2nd at 11:30 a.m. in the Commission Chambers. Walter will prepare the Ordinance according to code. Commissioner Stevens asked about the air strip in Monument Valley and whether the runway could be extended and paved. Some work has been done but it is not considered to be adequate for most mid-size aircraft to land there. Charles inquired about the issue and reported that because the air strip is on tribal land and there is no long term lease with the Navajo Tribe no investment will be made to upgrade the airstrip. If the County could facilitate a long term lease, it could be improved. It was determined that this would be worth investigating further. The group discussed the plan from Janet Wilcox to hold a Four Corners Quilting Convention in the County. Charles will contact Janet Wilcox to help her to set up a web site advertising the Convention that is planned for June of 2007. The County previously set aside $600 for this purpose. Open Time and Other Business Sandy Meyers, Monticello BLM Office, was asked if she would be able to contribute additional funds to the Monticello Visitors Center. Sandy said that she has limited funds and rarely has extra funding but she will do as much as possible to help. She will look into the suggestion of using fee money for this purpose but said that the fees pay for seasonal career employees. If there is money available, she will find out if it can be used to help with the funding for the visitor center. It was noted that the Moab BLM is not one of the Partners who contribute but that many visitors obtain information about the Moab area. Sandy reported that the additional information that was supposed to have been mailed to her office from Mr. Smith of the Jeep Jamboree has still not arrived. She said that they will not be able to proceed with the process of approval until she receives the needed information. Sandy said that two BLM employees will go down to Clay Hills to investigate the washout there and make recommendations as to what can be done. She said that Nancy Shearin, Archeologist, plans to do the archeological study on the site of the new trail planned at Hole in the Rock. She said that the new route is shorter (3 miles) than the original planned route. Sandy also said that two ATV connecter routes in Cedar Mesa and in the Indian Creek area are being worked on. The archeology studies have been completed for the ATV trails in Recapture and the report is expected by January. Sandy said she has had a couple of letters saying objecting to the trails and SUA specifically mentioned a large archeological site that is the trail is crossing over and causing damage to the site. Sandy will have Nancy go to the area to investigate their complaints. Sandy suggested that the County could help by prioritizing requests for archeological studies, mineral potential studies and environmental assessments so that her office could better handle the workload. Sandy reported that Kathleen Clark, BLM Director, will hold a one hour Satellite Broadcast on Thursday, November 30th at 11:00 a.m. The subject of the Broadcast will be "Futuring Excercise," discussing more efficient and effective methods and changes that will impact the BLM. Commissioner Stevens plans to view the Broadcast in the State office. Sandy mentioned the letter received from the Sonora Institute and their plans to visit the area. She will find out more of the details of the visit and let us know. Commissioner's Reports Commissioner Stevens attended two meetings with companies to discuss their exploration business plans. He will attend the Forest Service Draft Review Meeting in Price on November 29th and plans to view the Satellite Broadcast given by Kathleen Clark at the State Office in SLC. He plans to be in the County tomorrow and Wednesday. Commissioner Bruce Adams will attend the USACC Meeting at UAC tomorrow and the UCIP Meeting at Thanksgiving Point on November 30th.
