SAN JUAN COUNTY COMMISSION MEETING SAN JUAN COUNTY COURT HOUSE, MONTICELLO, UTAH NOVEMBER 20, 2006 AT 10:00 A.M. The regular meeting of the San Juan County Commission was held on November 20, 2006 At 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Lynn Stevens , Chairman Manuel Morgan, Vice Chairman Bruce Adams, SJC Commissioner Rick Bailey, SJC Administrator Norman Johnson, SJC Clerk /Auditor Dianne F. Neuss, SJC Deputy Clerk Commissioner Manuel Morgan made a motion to approve the minutes of November 6th and of November 13th, 2006 with corrections. Commissioner Bruce Adams seconded the motion. Commissioner Lynn Stevens declared the motion carried by unanimous vote. Cyndi Eldredge - Personnel Office Cyndi presented a request for approval for a promotion for Benjamin Nielson based on a new job description and job title. This action was recommended by Evan Lowry. The new job title is Planning Aid II and he will be promoted from a Step 63, Grade 6 to Step 98, Grade 9. Commissioner Bruce Adams made a motion to approve the promotion and increased compensation for Benjamin Nielson. Commissioner Lynn Stevens seconded the motion. Commissioner Lynn Stevens declared the motion carried. Commissioner Manuel Morgan was absent for the vote. Cyndi presented a recommendation to change Warren Keith's job classification from a temporary position to a full-time, benefitted position as Maintenance worker. This action was requested and recommended by Monty Perkins, Supervisor. Commissioner Bruce Adams made a motion to change Warren Keith's job status from temporary to a full-time permanent position with benefits with the same compensation as before. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried by unanimous vote. Sheriff Mike Lacy requested that Marcia Shumway's position be classified as a Corrections Officer. Along with her other duties, Marcia performs correction officer duties. This change will allow the Ms. Shumway to enroll in the 20 year Public Safety Retirement Plan provided to correction officers. Commissioner Bruce Adams made a motion to approve the change in job classification for Marcia Shumway. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried by unanimous vote. Sandy Meyers - Monticello BLM Sandy reported that last Saturday a number of volunteers and two BLM employees went to Arch Canyon and worked to improve the area including blocking off side trails. Sandy said that their efforts are very much appreciated. Sheriff Mike Lacy - San Juan County Sheriff Sheriff Lacy requested approval for out of state travel to San Diego, CA for one employee of the department to attend a training class on the Voice Stress Analyzer. The Class will be held from December 2nd to December 6th and the total cost is $2,000 for registration and expenses. He is not certain who will attend as yet. Commissioner Bruce Adams made a motion to approve the out of state travel request. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried by unanimous vote. Sheriff Lacy requested approval for the purchase of four vehicles. Three of the vehicles (3/4 ton pick-up trucks) will be paid for by a grant from USDA and the other will be paid for from the department's 2006 budget. Rick said he expects to receive approval for the grant next week. The cost of each pick-up is $25,424 (total of $100,496) plus $8,172 (total $32,688) for equipment and accessories for each of the four vehicles. Commissioner Bruce Adams made a motion to approve the purchase of four vehicles from grant funds and from the 2006 budgeted funds. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried by unanimous vote. Evan Lowry - Planning Office Evan said that the information from the 1990 Non-Binding Determination for Arch Canyon should be included in the new determination. He said that Maxine Deeter, from the BLM, is getting this information from their files for us. We will include this along with the additional affidavits that we are obtaining at this time. Evan will be attending the meeting on November 22nd in Green River with other county representatives to discuss the Forest Service draft plan. Commissioner Adams is unable to attend. Commissioner Stevens said that he will attend the Forest Service Review meeting in Price on November 29th and 30th. Trent Schafer, Monticello City Manager - Howard Randall, SJC Assessor Trent explained that the City of Monticello acquired three parcels of property. Two parcels are within the city of Monticello and the other parcel is near the airport outside of town. He is seeking tax exemption for the property, from September when the property was purchased to the end of the 2006. Howard reported that the property belonged to he and his sister and that the pro- rated tax has been paid for 2006 prior to September when the property was sold to the City. The property at the airport was discussed and Trent is also requesting tax exemption for this property. He said that the taxes have been paid for the time before the property was transferred to the City. Howard advised Trent that construction would have to begin within three years of purchase for the property to continue to be tax exempt. Commissioner Manuel Morgan made a motion to go into a BOE hearing. Commissioner Bruce Adams seconded the motion. Commissioner Lynn Stevens declared the motion carried by unanimous vote. Commissioner Manuel Morgan made a motion to approve the tax exempt status for the two parcels, within city limits, owned by the City of Monticello. Commissioner Bruce Adams seconded the motion. Commissioner Bruce Adams made a motion to approve the tax exempt status of the property near the airport with the understanding that, if construction does not begin within a five year period, the tax exempt status could be rolled back. Howard informed the Commission that a new law was recently passed allowing small businesses to be exempt from paying tax on property used for their business if the property value is not more than $3,500. The business owner will need to apply for the exemption. Howard plans to send letters to business owners in the County to inform them of this change and how to apply for the exemption. He also plans to attend the Chamber of Commerce Meeting to explain the new tax exemption. Howard said that the meetings in St. George last Thursday and Friday were somewhat helpful but that the meeting on Friday was not as productive as it could have been. Commissioner Stevens is on the UAC Board and said that he welcomes feedback. Howard said that he, Greg and Lois will attend the Assessor's School in December where new laws and changes for 2007 will be discussed. Rick Bailey - SJC Administrator Rick requested approval for four Building Permits: Roylen Griffin - 686 No. Grayson, Blanding - Storage/Barn Kenneth Knight - 33 E. Jeppsen - 1-B South M Canyon Rd., Spanish Valley - Caretaker Home CM Construction Inc. - Browns Canyon Rd., Blanding - Residence Commissioner Bruce Adams made a motion to approve the building permits provided all signatures are placed. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried by unanimous vote. Rick presented an amendment to the Blankenagel Subdivision in LaSal and presented the Commission with the plat detailing the changes and signed by all parties. The subdivision is owned by David and Heidi Moser. Commissioner Manuel Morgan made a motion to approve the amendments to the subdivision. Commissioner Bruce Adams seconded the motion. Commissioner Lynn Stevens declared the motion carried by unanimous vote. Rick presented the agreement for funding for the Bookmobile for 2007 for approval and signature in the amount of $88,729. This is less than the 50% that the State usually pays. Rick will speak to Norman and John to try and find out why the allocation for the Bookmobile has been reduced. No action was taken today. Rick indicated that a formal appointment to UCIP needs to be decided upon. Commissioner Bruce Adams agreed to the appointment as the Primary Representative and Rick Bailey will serve as alternate. Rick presented proposal from the Tomhave Group to lobby the U.S. Congress, and necessary federal agencies, for authorizations, appropriations, policies and rules that Support San Juan County's community development and infrastructure priorities. The contract is in the amount of $80,000 per year which was recommended to be included in the budget. The funding will come from the B-Road Transportation Fund, Transportation District and Water Conservancy. If their services are approved they will begin work in January when the Legislative Session begins.. . Commissioner Bruce Adams made a motion to approve the contract between the Tomhave Group and the County for consulting services. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried by unanimous vote. Rick said that the old school building in Montezuma Creek will be taken down and the funding for the project will be provided by the Navajo Revitalization Fund. An Application was submitted to the Commission from Mayor Tony Turk to service on the Health Service District Board. Commissioner Bruce Adams made a motion to appoint Mayor Tony Turk to the Health Service District Board. Commissioner Manuel Morgan seconded the motion. Commissioner Lynn Stevens declared the motion carried by unanimous vote. Walter Atene, who is a Chapter Coordinator, and Cloyce Smith also applied to be considered for the Health Service District Board. Steve Simpson has already been appointed to the Board. Commissioner Lynn Stevens said that the Commission's goals are to get the Healthcare Service District Board up and running, amend the wording of the remaining Resolutions related to the powers and authority of the Boards, including holding a public hearing, and forming a Planning and Zoning Board before the end of the year. Attorney Walter Bird is working on the wording of the Resolutions and Rick will work on getting the word out to people who may be interested in serving on the County Planning and Zoning Board and will set up a meeting on December 18th at 1:30 p.m. It was suggested that one member should be from Spanish Valley, another from the border area of the Reservation, two members from the Blanding, one from Monticello and one member from the Montezuma Creek/Bluff area. Commissioner Stevens discussed the funding for the repairs of the Swinging Bridge in Bluff including what should be done with donations for the project. The State Parks Service agreed to send an engineer to the site to make recommendations for the repairs which have been estimated to be from $20,000 to $150,000. The issue and funding will be discussed with Charles DeLorme, Director, Economic Development. Suggestions for funding from the Transportation Service District (2007 budget) and from the CIB were made. Commissioner's Reports Commissioner Adams and Commissioner Stevens spent four days at the UAC Meeting in St. George last week. Commissioner Adams plans to attend the USACC meeting on November 28th and a UAC meeting on the 30th at Thanksgiving Point. He will be out of the area for the following four days including December 4th and will be unable to attend the Commissioner Meeting. Commissioner Adams will attend a meeting concerning ATV use on December 6th in Richfield and will also attend the Mineral Producers meeting on the same day. Commissioner Adams reported on the Ojato Chapter Meeting that he attended yesterday. He noted that awards were presented and that some of the issues that were brought to his attention had to do with phone service on Douglas Mesa, a Guardrail on Rd. 163 (Rick will forward a letter to Mr. Kirkam), and a request for a daycare center and a retirement home. Commissioner Adams said that Rd 420 past the Chapter House needs to be repaired and suggested that we contact Tuba City, AZ and see if they may want us to maintain the road and pay the County for the work. Rick will look into it. The road going out to Paiute Farms was also discussed. It was suggested that the Chapter may want to prioritize the projects that are most important to them and then coordinate with the County. Commissioner Adams said that the Chapter members were excited about the new bike and walking path from the school to Gouldings. He said that the ongoing issue related to beer being sold near the Reservation was discussed. Although the Commission is understanding of the problem, it may be considered discrimination if business owners near the Reservation border are treated differently than other County business owners. A suggestion to limit hours when beer is sold and to limit the quantity of beer sold was made but enforcement and the legality of these measures would be a problem. The Commission will revisit the issue with the Sheriff and see if there is a way to provide additional law enforcement. The other solution suggested is to provide additional education through community organizations. Nelson Yellowman, newly elected School Board Member, said that some educational programs are provided and questioned who had jurisdiction in the unincorporated areas of the County. Although the County Commission does have jurisdiction, they need to be consistent dealing with everyone in the County. Mr. Yellowman also noted that a pool has been suggested for the new clinic to be used for physical therapy and for recreation. Commissioner Manuel Morgan said that the pool in Montezuma Creek is extremely expensive to run. He said that the water supply to the pool is not coming from the School District but from the outdoor water supply and is very expensive. Rick said he was not aware of this and will investigate the problem. The Commission decided to cancel the December 26th Commission Meeting.
