SAN JUAN COUNTY COMMISSION MEETING SEPTEMBER 27, 1999 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk A motion to approve the minutes of the September 20, 1999 meeting as written was made by Commissioner Bill Redd and seconded by Commissioner Mark Maryboy. UNANIMOUS. County Meal Allowance Susan Taylor, Community Development, requested that the Commission reconsider the County policy on meal expenses within the County. The Commission will consider the issue. Navajo Nation Fuel Excise Tax Representatives from a Texaco Service station in Montezuma Creek inquired of the Commission concerning the Navajo Nation Fuel Excise tax which is to be imposed on service stations on the Utah portion of the Reservation effective October 1, 1999. They stated that no one has contacted the Utah State Tax Commission in behalf of the operators on the Utah side of the Reservation. Commissioner Lewis spoke with State Representative Keele Johnson concerning the matter. BLM/Road Maintenance Agreement Kent Walter, BLM, requested approval from the Commission to extend the time period on the road issues until November 1, 1999 in order that the draft interim management construction and maintenance road agreement can be reviewed by the State BLM. Commissioner Redd feels that enough time has been allowed. Commissioner Redd made a motion that this commission not extend any other time frames on the roads beyond the October 1st agreement that we made with the BLM so far as what we will do, not do; entertain, not entertain; improve, not improve; etc. And we after that date will treat the roads as though they were the public property of the state of Utah and San Juan County which we believe they are. Wherever the chips fall, after that they will have to fall simply because what we cannot do is give up the rights of the citizens of the County on any kind of an agreement. We are not even authorized to do that as county commissioners. As far as we are concerned they are the sovereign property of the state of Utah. We are duty bound by oath to protect that sovereign property until such time as the legislature relieves us of that obligation. Commissioner Mark Maryboy seconded. UNANIMOUS. Oil & Gas Kent Walter, BLM, reported there is increased activity in the oil & gas program. There are a couple of pending projects in the McCracken and Dry Valley area. An application for a permit to drill has been approved in the southern part of the county. Grazing Permits Renewals The BLM is sending out letters to permittee and asking them to submit back to them in writing their request to continue their grazing permit. Executive Session Commissioner Bill Redd made a motion to convene into an executive session. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Commissioner Bill Redd made a motion to exit the executive session. Commissioner Mark Maryboy seconded. UNANIMOUS. Road Department/Jonnie Alvarez Commissioner Bill Redd made a motion placing Jonnie Alvarez on administrative leave with pay. Documentation showing the necessity of conditions is required. He will remain on such until he is released by the doctor after which time new solutions must be explored. Commissioner Mark Maryboy seconded. UNANIMOUS. Road Department/Paul Langston Commissioner Bill Redd made a motion to approve Paul Langston to be the temporary shop foreman at the North Road Department moving him from Step 150 @$2074 per month to Step 169 @$2281 per month. The temporary promotion is effective September 1, 1999 - November 30, 1999. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid/Fire Equipment-Navajo Mountain A bid was presented for a slip on unit, jaws of life and rescue equipment from L.N. Curtis for $33,862.35 to be used at Navajo Mountain. Purchased with Revitalization Funds. Commissioner Bill Redd made a motion to approve the equipment purchase. Commissioner Mark Maryboy seconded. UNANIMOUS. Bid/Radios-Navajo Mountain A bid was presented from Motorola for four hand held radios and pagers and one mobil radio for the Navajo Mountain Fire/Rescue at $3884 to be purchased with Revitalization Funds. Commissioner Bill Redd made a motion to approve the bid. Commissioner Mark Maryboy seconded. UNANIMOUS. PLANNER-PERSONNEL EDWARD SCHERICK'S REPORT Request to Hire/Shocap Personnel Director Scherick presented the name of Cory Johnson to be hired in the Shocap position at Step 63 @$1344 per month effective September 27, 1999. The position is funded by a grant. Commissioner Bill Redd made a motion to approve the hire based on the fact that if the grant ends the position ends. Commissioner Ty Lewis seconded. Commissioner Mark Maryboy was not present at the time the action was taken. Copper Mine The Commission held a discussion concerning the status of the copper mine in the northern part of the county. The price of copper has started to go up. Governor 10-Point Road Planner Scherick reported that he has reviewed the Governors 10-Point road process. Schedule Planner Scherick will be on vacation on October 1, 1999. He will meet with Janette Kaiser, Forest Service and SULU on October 5, 1999. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Building Permits The following building permits were presented for approval: Wesley Hunt, shop Blanding; Art Moore, mobile home in Bluff; Merwin Shumway, addition to home in Blanding; Galen Headley, an addition to residence in Bluff; Jerald Larsen, storage in Bluff; and Alan Shumway a modular in Blanding area. Commissioner Bill Redd made a motion to approve the building permits and seconded by Commissioner Mark Maryboy. UNANIMOUS. Liability Insurance Administrative Assistant Rick Bailey reported on the fire and emergency services waiver that is to be attached to the building permits. The county liability insurance company suggested that those applying for building permits in areas where fire and emergency services are not readily available and that they initial the items so they know they are signing a wavier for those services. Home Health Agency Administrative Assistant Rick Bailey reported that the Home Health Office responsible for home health services in the county will close on September 30, 1999. Rocky Mountain Home Health Agency has agreed to furnish services and current employees for October at the current rates. Revitalization Fund Mr. Bailey reported on the reallocation of Revitalization funds. He would like purchase some equipment for the Navajo Mountain area to be used in fire and emergency services. Meetings There is a San Juan County Substance Abuse/Mental Health meeting on October 5, 1999 in Blanding. A Transportation District meeting will be scheduled for October 12, 1999 at 7:30 P.M. The Tri-County Commissioners meeting will be held in Flagstaff, Az on October 13, 1999. COMMISSIONER MARK MARYBOY'S REPORT Navajo Fuel Excise Tax Commissioner Maryboy reported on the Navajo Nation Fuel Excise Tax on the Utah portion of the Reservation. The legislation that was passed by the Navajo Nation for the Utah people won't go into effect until the first of the year because Utah did not pass legislation. Jim Family Property Commissioner Maryboy reported that he received a call from BIA stating that they are working with the BLM trying to solve the Jim family property issue. Schedule Commissioner Maryboy will be the area the remainder of the week. COMMISSIONER BILL REDD'S REPORT Commissioner Bill Redd attended the Southeastern Utah Health District meeting in Green River on September 21, 1999. Commissioner Redd went to Shiprock with Administrative Assistant Rick Bailey to attend the Singer lawsuit hearing. He will attend the UAC Board meeting in Ephriam, Utah on September 30, 1999. COMMISSIONER TY LEWIS' REPORT Commissioner Lewis will be in the county all week. He will attend the San Juan County Substance Abuse/Mental Health meeting in Blanding on October 5, 1999. Board of Equalization The Board of Equalization meeting was held from 1:00 - 5:00 P.M. in the Commission Room.
