SAN JUAN COUNTY COMMISSION MEETING MINUTES January 19, 1993 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk Excused: Mark Maryboy, Vice Chairman A motion to approve the minutes of the January 4, 1993 meeting as written was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS Beer Licenses Clerk-Auditor Gail Northern presented beer license renewals for Burch's Trading Post and Burch's Cafe. A motion to approve the renewals was made by Commissioner Redd and seconded by Commissioner Redd. UNANIMOUS. Pay Scale Clerk-Auditor Gail Northern presented the new pay scale chart that has been adjusted one percent for the approval of the Commission. Mrs. Northern said there are some employees in the road department that when moved from hourly wages to salary will not be receiving an additional one percent increase when they are moved up a Step on the chart. A discussion on the amount of difference there would be in some of the increases with changing the road department from hourly to salary was held. A motion to adopt the Grade and Step chart that has been adjusted 1% and approve moving everyone up a step recognizing that because of the request made by the road department employees to go from hourly to salary the one step increase would not be uniform for all employees was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Fire Control/Mexican Hat Fire Warden Frank Morrell told the Commission that he received a call last Friday form the Mexican Hat fire station concerning the furnace malfunctioning. Mr. Morrell said he asked Clerk-Auditor Gail Northern for authorization for the necessary repairs. The furnace needs to be replaced. Aging Contract/Amendment Aging Director Frank Morrell presented an amendment to the Case Management/Home Health Services contract with the Southeastern Utah Health District. The amendment is for an additional $844.90 in funding. A motion to approve the amendment and the signing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Aging Department/Van Aging Director Frank Morrell discussed accepting bids for an aging van that he has budgeted in capital expenditures for 1993. After a discussion it was the decision of the Commission that Administrative Assistant Rick Bailey would prepare bids for all of the vehicles that the County has planned to purchase this year. Harold Lyman Harold Lyman, Job Service, met with the Commission to discuss the economy of the County. Mr. Lyman presented the Commission with documentation comparing the jobs and wages in the four county area of Southeastern Utah which includes San Juan , Grand Carbon and Emery counties. These wages and jobs are for non-agricultural related jobs. A comparison of jobs by industry for 1990 to 1992 was discussed. Mr. Lyman said a survey he has conducted of former employees of Energy Fuels shows that 50% of the former employees do not have permanent jobs. Those former employees that have permanent jobs are making $8,000 per year less than they were making at Energy Fuels. Mr. Lyman discussed the retail leakage out of the County and State. Mr. Lyman said he felt the County needs some commitment from the State to help identify some potential development to help the rural economy in the County. Mr. Lyman requested that the Commission put someone on staff to deal with economic development. Mr. Lyman discussed a list of items that he felt would help establish business in the County. Mr. Lyman said that Lt. Governor Oleen Walker will be in the County on February 12, 1993 and this matter could be discussed with her at that time. Sheriff's Department Sheriff Claude Lacy, Jail Administrator Bill Christensen and Assistant Jail Administrator Kelly Bradford met with the Commission to discuss Sheriff's Department matters. Sheriff Lacy updated the Commission n the condition of Deputy Rudy Cook who has undergone emergency brain surgery. Mr. Cook is still in intensive care in Farmington, New Mexico. Sheriff Lacy requested that the bids go out for the two new sheriff's department vehicles he has budgeted. The Commission told Sheriff Lacy that Administrative Assistant Rick Bailey is preparing the bids for advertising for all of the vehicles the County has planned to purchase this year. Mr. Christensen said that he budgeted for a postage meter in capital expenditures for this year. After checking prices for a postage meter he has found that the meters can be leased. The lease agreement with Pitney Bowes would be $38.00 per month for a four year lease. This meter would include a one pound scale. Mr. Christensen said he felt a postage meter for the Sheriff's department was justified because of the volume of mail that the jail creates and the timely manner in which the mail needs to be processed. Mr. Christensen said the postage machine would be in the Sheriff's office but that all of the offices at the Public Safety Building would have access to use the machine. Mr. Christensen said the Julie Wood, County Attorney secretary, will be running the machine. A motion to approve the lease agreement and the signing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. A Request to Hire was presented for a full time dispatcher. Karaleah Lee has terminated. Randall Bolos will be hired at Grade 9 Step 1, $1246.00 per month; effective 02/??/93. Mr. Bolos is next on the hiring roster. A motion to approve the hiring was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. The Emergency 911 Agreement with the Navajo Nation was discussed. Mr. Christensen said he had been contacted by Captain Nelson, Navajo Nation Chief of Police, about the agreement. Mr. Nelson said the agreement had been approved and sent back to San Juan County. Mr. Christensen said he was unable to find the agreement. Mr. Christensen faxed a copy of the agreement to Captain Nelson. Captain Nelson called later to say he had found the 911 agreement and the Cross Deputization Agreement in Tribal Department of Justice. Captain Nelson indicated that the Cross Deputization agreement has been signed and would be sent to the County. Mr. Christensen said that was a week ago and he has not received the agreement. Sheriff Lacy told the Commission the he has been notified by the Federal Bureau of Investigation that the County will be receiving 45 guns that were confiscated in a raid east of Monticello five years ago. Sheriff Lacy said he will be bidding out the handling of the sale of these guns with dealers. The public will then be given the opportunity to bid on the guns. The guns have not yet been received. Sheriff Lacy said that Doris Alvarez is currently working as a dispatcher. Sheriff Lacy said Mrs. Alvarez will be dispatching most of the time now. Sheriff Lacy said that Mrs. Alvarez's salary is $4.00 per month less than that of the current dispatchers and he would like to move her to the current dispatching salary. The Commission said that there was no problem with moving Mrs. Alvarez to the Grade and Step of a dispatcher as long as she agrees to be returned to her former Grade and Step when she is no longer dispatching. The paper work for Mrs. Alvarez will be brought to the Commission. Sheriff Lacy discussed with the Commission the revenue from the inmate telephones. Sheriff Lacy said he would like to use the revenue to purchase some weights for the inmates to use. The Commission advised Sheriff Lacy that his purchase should be made from his budget as the revenue goes into the General Fund. Sheriff Lacy, Mr. Christensen and Mr. Bradford discussed with the Commission a program they would like to try at the jail. This program would identify three lead shifters. They would be over the swing and graveyard shifts when there is no other supervisor in the building. Sheriff Lacy said he would like the lead shifters to be given the rank of a Corporal and receive a $75 per month increase. Sheriff Lacy said he would like to try this program for a six month period. The Commission said they would like to review the proposal before a decision is made on this request. Road Department Bids Office Manager Wanda Franklin and Monticello Shop Supervisor Max Ksiazkiewicz presented the bid comparison for corrugated steel pipe, oil, grease, antifreeze, batteries, tires and filters. It was recommended that the bid for corrugated steel pipe be awarded to Amcor. A motion to approve the bid was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. It was recommended that the bid for batteries be awarded to Parkway Texaco/Grand Tire. A motion to approve this request was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. It was recommended that the bid for oil, grease and antifreeze be awarded to Woody's Petroleum. A motion to approve this request was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. It was recommended that the large equipment tire be awarded to Redburn Tire and the remainder of the tires and the tubes be awarded to Schafer Tire and the recapping to Gay Johnson. A motion to approve this request was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. The Commission requested that Mrs. Franklin and Mr. Ksiazkiewcz do some comparisons on the quality of filters and the availability from the bidders before a decision is made on awarding the bid. Utah State University Extension Extension Agent Jim Keyes introduced to the Commission Joe Austin the new department head that will be over the USU Extension Service in the County. Mr. Keyes said the University is changing the extension programs and there are no longer supervisors over the extension agents but rather there are department heads. Centrally Assessed Property Arlo Fawcett and George Sampson met with the Commission to discuss escaped centrally assessed oil properties. Mr. Fawcett and Mr. Sampson are proposing to investigate oil properties for escaped taxes for a fee of 50% of the taxes owing. Commissioner Redd agreed to talk the other oil county commissioners at a workshop he will be attending this week. The Commission said they may be willing to hire Mr. Fawcett and Mr. Sampson if the other Counties were willing to do the same. Sealed Bids/ La Sal Property The sealed bids on Lot 2 Block B of the Stewart Subdivision were opened. Three bids were received. Ralph Ramstetter bid $600.00, Jeff Brown bid $757.85 and Stephen Schultz and Marianna Hutnick bid $3206.00. A motion to approve the bid from Stephen Schultz and Marianna Hutnick for $3206.00 was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. San Juan Health Care Services District/Board Members The request to increase the board members of the San Juan Health Care Services District from five to seven members was discussed. A Resolution was presented that would allow the membership to be divided as follows: two representatives from Monticello, two representatives from Blanding, two representatives from the Southern portion of the County and one representative from the Spanish Valley area. The matter was tabled until next week to allow Commissioner Redd to do further research. Transient Room Tax Increase After a discussion on the request to increase the transient room tax from 2 1/2% to 3% a motion to table the matter until next week was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Further discussion on the increase in the transient room tax was held with Peggy Humphreys, Travel Council Director, and Dianne Nielson, Economic Development Board Chairman. A motion was made by Commissioner Redd to increase the Transient Room Tax to 3% effective July 1, 1993 and reserve 1% of the tax for infrastructure. The Motion as seconded by Commissioner Lewis. UNANIMOUS. Film Commission Peggy Humphreys, Travel Council Director, and Dianne Nielson, Economic Development Board Chairman, discussed the film commission. Mrs. Nielson said there are four people that have expressed an interest in helping the film commission if their costs and mileage would be reimbursed by the County. Mrs. Nielson said the County will still be working under the Moab Film Commission. The Commission requested that a job description and a break down of the budget for this type of reimbursement be given to the Commission before a decision is made on this request. Travel Council Peggy Humphreys, Travel Council Director, and Dianne Nielson, Economic Development Chairman, discussed with the Commission the need to have Cordie Garcia as a full-time employee. Ms. Garcia is currently working as a seasonal part-time employee at thirty hours per week and should have been terminated on October 31, 1992. Mrs. Humphreys said the volume of requests for information on the area has increased and the mail keeps Ms. Garcia busy all year instead of just seasonal. After a lengthy discussion a motion to allow Ms. Garcia to be a permanent part-time employees at less that 30 hours per week was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Monument Valley Dump A request was received from the Oljato Chapter to remove the fencing around the Monument Valley dump and close the dump. The fencing belongs to Gouldings Trading Post so the County cannot remove the fencing. Process Facilatator Edward Tapaha was asked to meet with the Oljato Chapter concerning this request. Equipment Problems South Road Foreman Lynn Laws asked for permission to have parts shipped air freight in an emergency situation. Mr. Laws said the dozer used on the dumps broke down in Montezuma Creek and was needed at Halls Crossing so parts were needed immediately. The Commission told Mr. Laws that it was permissible to have parts sent United Parcel Service Blue Label. This is a second day air service. Mr. Laws and Engineer Doug Pehrson discussed a problem with trucks using the Alkali to Mustang road while the road is muddy. The possibility of a weight limit on the road was discussed. The Commission requested that Mr. Laws send a letter to the trucking companies involved and ask them to use the Perkins Road as an alternate route. Procurement Bids for a snowmobile for the Communications Department were presented. Handlebar Cycle bid $5300 for an Artic Cat 500 EXT EFI snowmobile. Tiger Paw bid $5899 for a Polaris Indy 500 EFI SKS snowmobile. A motion to approve the bid from Handlebar Cycle was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Building Permit A building permit for Hubert Davis for a garage was presented. A motion to approve the building permit was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Quit Claim Deed A quit Claim Deed for Parcel # 36S22E341227 was presented for the approval and signature of the Commission. This parcel is being deeded to Blanding City for the amount of the taxes owing at the time of the tax sale. A motion to approve the deed and the signing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Land Use Issues A motion to approve transferring $8,000 of San Juan County funds from the Association of Counties to Bob Wiedner for the study of land issues was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Payroll Changes Payroll changes were presented for Larry Begay and Robert Vigil. These changes are being made to adjust the salary for their current positions. Robert Vigil will be Grade 4 Step 12, $1148.00 per month; effective 1-1-93. Larry Begay will be Grade 13 Step 5, $1539.00 per month; effective 1-1-93. A motion to approve the adjustments was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Forest Service/Noxious Weeds The Commission received a letter from the Forest Service concerning the control of noxious weeds on Forest Service Lands. Administrative Assistant Rick Bailey will respond that the County would like the Forest Service to control their noxious weeds. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Construction Contract Administrative Assistant Rick Bailey presented the Construction Contract with Tri-Hurst Construction for the American With Disabilities construction was presented for the approval and signature of the Commission. The contract is in the amount of $113,594.00 with construction to begin on February 1, 1993 and be completed no later than August 1, 1993. A motion to approve the contract and the signing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Navajo Mountain Road Administrative Assistant Rick Bailey presented a proposal for the right of way work for the Navajo Mountain Road in the amount of $9067 from Creamer & Noble Engineers. A motion to accept the proposal was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Public Defender Billing Administrative Assistant Rick Bailey said he reviewed the response on the billing from Public Defender Keith Chiara and recommended that the billing be paid. A motion to approve the billing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Snow Day Administrative Assistant Rick Bailey proposed that the Commission allow all employees who made it to work with the snow conditions on January 11, 1993 to have a day off with pay. All employees who could not make it to work would be given that day off with pay. A motion to approve the proposal was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Mr. Bailey will send a memo to all employees. Service District Board Member Stipend A motion to allow Service District Board members to be paid $25.00 per month and the Board Chairman $50.00 per month was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. The District will be required to pay the stipends from their existing funds. The County will not subsidize the payments. State Surplus Agency Administrative Assistant Rick Bailey said the Commission needs to appoint a representative for the County for the State Surplus Agency. A motion to appoint Rick Bailey as the County State Surplus Representative was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Utah Association of Counties Insurance Mutual Administrative Assistant Rick Bialy said that the UAC Insurance Mutual will be holding a training session at the Courthouse on February 3, 1993. There is a $15.00 per person charge to attend the training. Commissioner Lewis as a member of the Board will discuss this cost at the next board meeting. D Roads A representative from Congressman Orton's office has been in the County reviewing the D road maps. Engineer Doug Pehrson has been working with the representative. Preconstruction Hearing/Aneth to Ismay Road Administrative Assistant Rick Bailey said the preconstruction hearing for the Aneth to Ismay Road project will be held on January 27, 1993 in Monticello. Engineer Doug Pehrson will represent the County at the hearing. Sexual Harassment Administrative Assistant Rick Bailey said concerns have been expressed over the posters and pictures that could be construed as sexual harassment being displayed in the road office and shop. The Commission requested that a memo be sent to the road department asking that the posters and pictures be removed. Solid Waste Planning Administrative Assistant Rick Bailey discussed with the Commission the need to have solid waste planning as a top priority. Solid Waste will be an agenda item every week until the plan is formulated. Indigent Burial Administrative Assistant Rick Bailey said he has been reviewing the County policy for indigent burial. Mr. Bailey said the term indigent as it applies to burials needs to be defined. The current policy states that County funds cannot be mixed with other funding for burial. The possibility of negotiating a price for indigent burial each year with the mortuary was discussed. The Navajo Tribe does not have an agreement with San Juan Mortuary for indigent burials. Mr. Bailey will handle this matter. Cal Black Memorial Airport/Telephone Administrative Assistant Rick Bailey said that the Federal Aviation Administration has said they will not be participating in the funding for telephone service at the Cal Black Memorial Airport. Mr. Bailey will contact Dixie Barksdale about funding from Economic Development. Mr. Bailey presented a summary of activity at the airport for December. Bureau of Indian Affairs Funding Administrative Assistant Rick Bailey said he had received a letter for the BIA stating that the funding from the BIA for the Aneth to Ismay Road project must be placed in a non-interest bearing account. Bluff Underground Storage Tank Administrative Assistant Rick Bailey said he has talked with a State officer about the cleanup of the contamination of the Bluff Underground Storage Tank. One monitoring well is still showing contamination. The State is not satisfied that the plume has been properly identified. The site needs a test well and some additional grab holes below the area. One these are drilled the area will probably clean itself out. Mr. Bailey said he felt the drilling could be done by a local company. Mr. Bailey said that Certified Environmental is doing the remedation at the Blanding Road Shop and he would like to use them to finish the Bluff project. PROCESS FACILATATOR EDWARD TAPAHA'S REPORT Navajo Nation Elections Process Facilatator Edward Tapaha met with the Navajo Election Administration Board of Directors on January 14, 1993. San Juan County's 1983 consent degree with the United Stated Department of Justice was discussed. The need to develop a standard translation to be used for voter information was discussed. This would insure all voters were receiving the same information. The Navajo Election Administration would like to meet with Commission in February or March to discuss the elections. Mr. Tapaha will arrange the meeting. Utah Dine` Committee Process Facilatator Edward Tapaha attended a meeting of the Utah Dine` Committee that was held at the Red Mesa Chapter. Funding from the Navajo Tribe in the amount of $852,000 will be matched by the Dine` Committee. An additional match of 50% will be requested from the Utah Division of Indian Affairs. Chapter Funding Process Facilatator Edward Tapaha and Commissioner Maryboy visited the Chapters to encourage them to utilize the funding allocated from the Navajo Tribe for emergency coal and feed hauling and snow removal. Mr. Tapaha talked with David Tsosie about requesting additional surplus equipment for the Utah Chapters so the road work to the residences can be done. Chapter Coordinators Meeting Process Facilatator Edward Tapaha attended a meeting of the Navajo Nation Chapter Coordinators in Window Rock, Arizona. Mr. Tapaha answered questions regarding his employment and responsibilities with the County. Chapter Officials Meeting Process Facilatator Edward Tapaha told the Commission that the meeting with the Utah Chapter Officials has been rescheduled for February 8, 1993 at the UNDC Education Building in Bluff. COMMISSIONER BILL REDD'S REPORT Monitored Retrievable Storage Facility Study Commissioner Redd met with Governor Leavitt last week to discuss San Juan County continuing with the MRS study. Governor Leavitt will not support San Juan County continuing with the study. Jail Reimbursement Commissioner Redd attended a meeting with Oleen Walker, Lieutenant Governor, Mark Walsh, Utah Association of Counties and County Sheriff's to discuss jail reimbursement from the State. The proposal being introduced to the Legislature to stop any future studies for a Monitored Retrievable Storage Facility in the State by Representative Norman Nielson was also discussed. Travel Commissioner Redd will be attended a meeting of the Utah Association of Counties Multi-County Appraisal Trust on January 20, 1993. Commissioner Redd will attend the New Commissioners Workshop on January 21 & 22, 1993. Commissioner Redd will attend a Utah Association of Counties Comprehensive Land Planning Meeting on January 22, 1993. COMMISSIONER TY LEWIS' REPORT Utah Association of Counties/Insurance Mutual Commissioner Lewis attended a meeting of the UAC Insurance Mutual on January 14, 1993. Association of Governments Commissioner Lewis attended a meeting of the Association of Governments on January 15, 1993. Commissioner Lewis was nominated as chairman of the AOG. Resource Conservation and Development Resource Conservation and Development Committee will be holding a meeting in Grand Junction, Colorado on January 21, 1993. Commissioner Lewis will be unable to attend. National Conference of Legislators Commissioner Lewis has been invited to speak on the Monitored Retrievable Storage Facility Study that San Juan County has just completed at the National Conference of Legislators on March 4-6, 1993 in Las Vegas, Nevada.
