SAN JUAN COUNTY COMMISSION MEETING MINUTES November 4, 1991 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present:Ty Lewis, Chairman Mark Maryboy, Vice Chairman Dena Hunter, Deputy Clerk Excused:Bill Redd, Commissioner Rick Bailey, Administrative Assistant A motion to approve the minutes of the October 28, 1991 meeting as written was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS Beer Licenses Ruben Carson met with the Commission to discuss the location of his business for which he has requested a packaged beer license. Mr. Carson told the Commission that his business is not in a residential area. Sheriff Lacy was present and said he would send a Deputy to talk with the neighbors about issuing a packaged beer license in this area. A motion to approve the license contingent on compliance with all the regulations and approval by the Sheriff was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. An application for a license to sell packaged beer at a business in Bluff was received from Fay Belle. This application will be given to County Attorney Craig Halls to review before a decision is made on the issuance of a license. Sheriff's Department Sheriff Claude Lacy and Deputy Kelly Bradford met with the Commission to present a request to hire for a corrections officer. Sheriff Lacy said one corrections officer has terminated and another one will be terminating on November 19, 1991. Sheriff Lacy requested that Lorraine Kemner be hired. Ms. Kemner is on the hiring roster. Ms. Kemner is a trained Corrections Officer and has been employed by Davis County for the past five years. Ms. Kemner will need time to give notice to Davis County before starting to work. Sheriff Lacy said that he felt with the five years experience in the corrections field that Ms. Kemner should be hired at Grade 14 Step 5, $1565 per month with a probationary increase in one year to Grade 14 Step 9, $1629 per month, effective 11/18/91. A motion to approve the hiring at the Grade 14 and Step 5 requested by the Sheriff was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. Deputy Bradford presented bids for three typewriters for the Sheriff's Department. Bids were received from Office Outpost for Panasonic KX-E3000 at $399 each. Communications Plus bid $519.00 each for a Sharp ZX-426. A motion to approve the bid from Office Outpost was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. A discussion was held on a new wage scale that Sheriff Lacy has proposed for the Sheriff's Department. Sheriff Lacy said he used the pay scale for the Navajo Police to determine the recommendation for the new pay scale. Procurements Senior Citizens Director Frank Morrell presented bids for a VCR for the Monticello Senior Center. Bids were received from Sears for $214.99 for a Gold Star VCR and Blue Mountain Music bid $259.00 for a Samsung VCR. A motion to approve the bid from Sears was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. Data Processing Specialist John Fellmeth presented bids for a computer for the Historical Society. This Computer is being purchased in part with a Grant from the State Historical Society. Bids were received from Office Equipment for $1,225, Petra Computer for $1,470, Zeos International for $1,636 and San Juan Computer for $1,135. Mr. Fellmeth recommended purchasing from San Juan Computers if they can agree to provided the needed service. A discussion was held about the recent request by the Blanding Historical Society to purchase a used McIntosh Computer. A motion to approve the purchase from San Juan Computer contingent on resolving the computer purchase for the Blanding Historical Society and the service problem with San Juan Computers was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. Commission Meeting Canceled Commission meeting scheduled to be held on November 12, 1991 will be canceled due to commitments of the Commission at the Utah Association of Counties Annual Convention. Navajo Tribal Funding/Chapters The $200,000 that was allocated for the County from the Navajo Tribe to hire grader operators and purchase culverts and gravel for the roads to residences on the Navajo Reservation was discussed. It was the decision of the Commission that the funds would be allocated to each Chapter on the basis of 50% of the funds by population and 50% of the funds for road mileage. The time sheets for the grader operators will be collected by Process Facilatator Edward Tapaha and submitted to the Tribe for payment. The need for equipment to maintain the graders was also discussed. Public Safety Building/Heating System Maintenance Supervisor Dell Hunter discussed the costs for repairs on the heating system at the Public Safety Building to the Commission. Mr. Hunter said he would like to get phase one of the projected started. Mr. Hunter said there were sufficient funds in this years budget to cover this. The Commission gave Mr. Hunter approval to get bids for this project. Tentative 1992 Budget Clerk-Auditor Gail Northern and Deputy Auditor John Fellmeth presented the Commission with a copy of the tentative 1992 budget. The October financial statement was presented and reviewed with the Commission. Federal Land Conference County Attorney Craig Halls met with the Commission to discuss the Federal Lands Conference that he attended in Salt Lake City on November 2-3, 1991. Mr. Halls said that Catron County New Mexico Attorney spoke concerning land use and the rights of the permittee's on the Forest Service and Bureau of Land Management lands. Mr. Halls said that the County land use plan must be considered by the Federal Government agencies when they are doing their land management plans. Sealed Bids/Capital Offense Bids were opened for the defense of two capital offense cases. The Court has appointed public defenders for both of the defendants. Bids were received from Clayton Huntsman and William Schultz. Mr. Huntsman bid $20,000 for the defense of Jeffery Heird and $28,000 for the defense of Andy Gomez. Mr. Schultz bid $35,000 for the defense of either defendant plus specified costs. The Commission will analyze the bids before a decision is made. PROCESS FACILATATOR EDWARD TAPAHA'S REPORT Utah Navajo Development Council Process Facilatator Edward Tapaha said he stopped at the UNDC office and was given a letter from UNDC concerning the footbridge across the San Juan River west of Aneth. The UNDC requested that the County purchase the lumber and the UNDC would provide the labor. Commissioner Maryboy said this request and the Resolution from the Aneth Red Mesa Chapter should be sent to Norman Cabin of the Navajo Tribe Miscellaneous Funds to see if there are monies available for this project. A discussion was held on possible funding help from the Bureau of Indian Affairs and the San Juan School District. Mr. Tapaha will contact the UNDC for a detailed estimate of the material that are needed. Mr. Tapaha will investigate these possible sources of funding. Law Enforcement Meeting Process Facilatator Edward Tapaha attended a law enforcement meeting on October 30, 1991. Franklin Morris, Deputy Chief of Police was in attendance. The biggest problem the Navajo Tribal Law Enforcement has with the placing of Navajo Police officers in Montezuma Creek is housing. Mr. Tapaha said he has located mobile homes that belong to the Navajo Tribal Public Safety that could be relocated to the Montezuma Creek area. Mr. Tapaha is also checking on housing at the Aneth Boarding School and Phillips Petroleum Camp. The next law enforcement meeting will be held on November 6, 1991 at 11:00 A.M. Voter Awareness Bilingual Voting Coordinator Edward Tapaha reported he conducted voter awareness at the Mexican Water and Red Mesa Chapters Flu Vaccine Clinics last week. Navajo Mountain Chapter Planning Meeting Process Facilatator Edward Tapaha will be attending the Navajo Mountain Chapter Planning meeting on November 7, 1991. Shiprock Agency Planning Meeting Process Facilatator Edward Tapaha will be attending a Shiprock Agency planning meeting on November 7, 1991. Mr. Tapaha will try to get the Aneth to Ismay road project as number one priority on the Shiprock Agency road priority list. Commissioner Maryboy is also planning to attend. Blue Mountain Dine` Chapter Process facilatator Edward Tapaha will attend a meeting of the Blue Mountain Dine` Chapter on November 5, 1991. The Community improvements at Westwater will be discussed. The Chapter has been reorganized and the new officers are: Harry Jelly, President, Dan Nakai, Vice President, Helen Yazzie, Secretary, and Dale Oshley, Chapter Manager. Interagency Meeting There will be an Interagency Meeting in Montezuma Creek, Utah on November 13, 1991. COMMISSIONER MARK MARYBOY'S REPORT Navajo Trust Funds Commissioner Maryboy said the Legislative Audit of the Navajo Trust Funds will be released by the State Senate on November 11, 1991. Commissioner Maryboy will be attending this meeting. Aneth to Ismay Road Project Commissioner Maryboy met with Freddie Hudson to discuss the Aneth to Ismay road project last week. Mr. Hudson has been assigned by the Navajo Transportation Committee to work on this project. Navajo Tribal Council Commissioner Maryboy will travel to Window Rock to attend a meeting of the Budget and Finance Committee on November 5, 1991. The Navajo Tribal Council will be in Special Session on November 8, 1991. Mexican Hat Housing Commissioner Maryboy said he had talked with the Navajo Housing Authority and they are willing to fund the San Juan School District's proposed Mexican Hat Teacher Housing project for $250,000. The County will need to send a letter to the Navajo Housing Authority for a match in the funding of $250,000. It was the decision of the the Commission to wait to write a letter of support for the School District for this project until the School District brings their proposal to the Commission. COMMISSIONER TY LEWIS' REPORT Contractors Association Commissioner Lewis attended a meeting on October 29, 1991 with the Contractor's Association. The book rates on equipment rental was discussed. This meeting was to simplify the way the Counties determine equipment rental rates for the road work that they do. The counties will decide on what table to use for equipment rental rates and give the proposal to the Contractor's Association for their review. New District Manager/Bureau of Land Management An open house will be held at the Monticello Area Office of the BLM at 1:00 P.M. on November 7, 1991 for the new Moab District Director Roger Zortman. Mr. Zortman will be replacing Gene Nodine who is retiring. Utah Association of Counties Commissioner Lewis will be attending the UAC Annual Convention in St. George, Utah on November 13-15, 1991.
