SAN JUAN COUNTY COMMISSION MEETING MINUTES MARCH 26, 1990 The regular meeting of the San Juan County Commission was held at 10:00 A. M. in the Commission Chambers at Monticello, Utah. Present:Ty Lewis, Chairman Mark Maryboy, Vice Chairman Calvin Black, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the March 19, 1990 meeting as amended was made by Commissioner Maryboy and seconded by Commissioner Black. UNANIMOUS. CURRENT BUSINESS Mexican Water Chapter/Road Concerns Mexican Water Chapter president David Yanito presented the following letter to the Commission. Dear, County Commissioners; We want the road be full extended to the last junction toward North, two more miles from the ended of construction and there is some white shale to be use for the road and it has already approve by Nancy Yanito for the continued road construction by the County Road Department. It'll be helpful for the school buses and people use. Thank You Mexican Water Chapter President /s/ David Yanito Mr. Yanito said that he had spoken with Stan Hawkins and had been told that they were not going to finish shaling county road #438 because there was not enough shale in the present pit to finish this project. Road Superintendent Tony Brandt was out of the office. The Commission will contact Mr. Brandt and let him know of the Mexican Water Chapter's concerns and the available shale source. The Commission will inform Mr. Yanito of their findings after talking with Mr. Brandt. Assessing and Collecting Clerk/Auditor Gail Johnson discussed with the commission the four proposals the UAC will be discussing on assessing and collecting at the April conference. After a discussion it was decided that the Commission and Mrs. Johnson will meet after Commission meeting to discuss the proposals and how they will affect the County. This will help them to know if the County would support one of the proposals or to vote to repeal the assessing and collecting tax levy. The Uac meeting to discuss these proposals will be held on April 11, 1990 from 10:00 a.m. to 3:00 p.m. Wilderness Impact Report Copies of the Wilderness Impact report that was done by Dr. George Leeming are available for the public to see in Administrative Assistant Rick Bailey's office. The Commission has requested that this reports not leave the building. Request to Hire Recorder Louise Jones met with the Commission to request permission to advertise for a part- time position in the Recorder's office. Julie Bailey who is presently working in this position has accepted full- time employment as District Court Clerk. The Commission gave Mrs. Jones permission to advertise to fill the part-time position. Mrs. Jones also questioned about a salary increase she had submitted in May for Edna Rogers and had not heard anything about. The Commission stated that Administrative Assistant Rick Bailey will be working on a salary survey this week. County Attorney Craig Halls/Commissioner of the Poor County Attorney Craig Halls met with the Commission, at the request of Commissioner Maryboy, to discuss the Utah Code Section 17-5-64. Mr. Halls stated that the law provided that the Commission could, if it was deemed necessary, appoint one of its members to be a Commissioner of the poor. This would provide for the indigent poor in the County. Mr. Halls stated that the county in the past has given this responsibility and a budget to cover it to the County Sheriff. The law also provides that the County will be responsible for the hospital care for the indigent that are deemed necessary to be hospitalized. This statute is only for those people who are not provided for by other programs. Mr. Halls said the these provisions were passed before the State provided medicaid and Social Services and Hill Burton funds to help the poor. Commissioner Black stated that when he became a Commissioner that Commissioner Hazleton was the Commissioner for the poor and he was also on the hospital board and it worked out good. Later Commissioner Harold Young felt that the Sheriff's Office could give the indigent people gas and meals and with the approval of one of the Commissioners. It was later decided to just let the Sheriff handle this program. The Sheriff office also handles the Salvation Army account for the County. Mancos Mesa /IBLA County Attorney Craig Halls informed the Commission that he had sent an appeal to the Interior Board of Land Appeals concerning the Mancos Mesa road restoration. Copies of the letter were sent to Ed Scherick,BLM San Juan Area Manager, Gene Nodine, BLM Moab District Manager, James Parker, BLM State Director and Senator Jake Garn. Recreation Trust Agreement A discussion was held concerning the draft Recreation Trust agreement. Commissioner Maryboy said that he had discussed the recreation with the Chapters and that they are willing to have the UNDC handle the funds for the Chapters. A discussion was held about the possibility of having a board of trustees to oversee the distribution of the recreation funds for the county. Tony Dayish, an observer, commented that he would like to see some of the interest from the bonds returned to the principal instead of spending it all for recreation each year so that the dollar would buy the same amount in the future. Building Permit An application for a building permit was presented for Kim Hoggard for a log home. Mr. Hoggard has requested a zoning variance for a 10 foot back yard instead of a 30 foot back yard. The Commission requested that Mr. Hoggard receive written approval from the adjacent property owner, Gary Halls. A motion to approve the building permit contingent on the written approval of the adjacent property owner was made by Commissioner Black and seconded by Commissioner Lewis. UNANIMOUS. Telephone Proposals A telephone review was presented to the Commission by Administrative Assistant Rick Bailey. The review stated that a lease system is considerably more expensive that the purchase price for the telephone systems. The low bidder on a PBX system was Communications Plus for the total of $18,775.50 which includes an estimated $5,328.80 in line charges for a year. The low bid on a non-PBX system was AT&T. The review made the assumption that each line would require a separate incoming line. The total cost for the system would be $32,381.37 which includes an estimate of $13,172.20 for yearly line charges. The third system reviewed was for the Contel-Centrex was the total cost for the system would be $21,219.40 with the estimated $7,529.40 for yearly line charges. The other option would be to move the present system to the new clerk's office. The cost of time a materials is unknown, but the cost could be as high as $1,000. A maintenance contract has not been available for the current system. The current system could be sold for approximately $3,000 for the telephones and hardware. The cost of removing the system is unknown. After a discussion of the different systems with Colleen Johnson of Contel and Kim Hoggard of Communications Plus Commissioner Black made a motion to purchase a non-PBX system. Second Commissioner Lewis. UNANIMOUS. It was the decision of the Commission that Communications Plus and Contel would resubmit a bid for a Centrex system for the courthouse and the road shed. The bids will be due at 9:00 a.m. on March 27, 1990. The motion was made by Commissioner Black and seconded by Commissioner Lewis. UNANIMOUS. Bids were opened at 9:00 A.M. on March 27, 1990. Communications Plus bid $12758.80 for the installation, removal of the old system and training. Contel bid $13895.00 for the installation, removal of the old system and training. A motion to accept the bid from Communications Plus was made by Commissioner Black and seconded by Commissioner Lewis. UNANIMOUS. Procurement Maintenance Supervisor Dell Hunter presented bids for blinds for the courthouse. These blinds will be used in the newly remodeled section. Bids were received for 17 blinds from Sears at $15.00 each for 1" vinyl and $32.00 each for 1" steel. Custom Floor bid $52.49 each for the 1" steel blind. Custom Floors had no bid on vinyl blinds. A motion to approve the bid for vinyl blind from Sears was made by Commissioner Black and seconded by Commissioner Lewis. UNANIMOUS. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT National Wilderness Conference Administrative Assistant Rick Bailey reported that he and Commissioner Lewis attended the National Wilderness Conference in Salt Lake City on March 21-23, 1990. There were more private users in attendance at the conference this year than Governments. Mr. Bailey said the Governor Bangerter spoke and talked about every issue but wilderness. Senator Garn's Office Administrative Assistant Rick Bailey reported that Bob Weidner of Senator Garn's office will be meeting with Cy Jamison of the BLM to discuss the Halls Crossing Airport site. Class D Roads A discussion was held concerning Class D roads in the county. Commissioner Black stated that it is imperative that all Class D roads are up to date and mapped so the documentation can be filed with the local BLM office. Interagency Form Meeting An Interagency form meeting will be held in Moab on April 11, 1990. Halls Crossing Airport Administrative Assistant Rick Bailey reported that he had talked with Ron Theobald and Mr. Theobald indicated that the funding for the Halls Crossing Airport has been approved. The funding is for the site inside of the recreation area. The County needs to file a new application for the new site. Emergency Medical Grant Application Administrative Assistant Rick Bailey presented an Emergency Medical Grant application to the State of Utah to the Commission for signature and approval. A motion to approve the signing and the application was made by Commissioner Black and seconded by Commissioner Maryboy. UNANIMOUS. COMMISSIONER MARK MARYBOY'S REPORT Montezuma Creek Trash Dump Commissioner Maryboy reported that he had left a message with the road department advising them that the road to the Montezuma Creek Trash Dump needs to be graded. The dump that was located on the West side of Montezuma Creek has been closed. Chuska Oil Company Encroachment Request Commissioner Maryboy presented a request from Chuska Oil Company to install some corrugated pipe by the road on Cahone Mesa. Administrative Assistant Rick Bailey will forward this encroachment request to the road department. San Juan Dine`Fair Commissioner Maryboy reported that he will attend a meeting of the San Juan Dine` Fair board today at 2:00 p.m. Mexican Hat Community Meeting Commissioner Maryboy reported that the Mexican Hat Community has ask him to come to their meeting at 6:00 p.m. tonight to discuss the recreation decision. COMMISSIONER CALVIN BLACK'S REPORT Television Problem Commission Black stated that he felt the public and cable company needed to be better informed that it is impossible to get up to Abajo Peak and repair the television problem at times in the winter. Commissioner Black said that the cable company customers need to understand that their signal for the Salt Lake channels is picked up off from the mountain so the signal they receive is the same as that transmitted off the mountain and not any better. Lake Powell Charter Flights A copy of a letter was received from Lake Powell Express Company of Grand Junction, Colorado concerning a concession and flight operation at Bullfrog and later Halls Crossing. The flights will run from Grand Junction to Bullfrog and Salt Lake City. The company will be using a single engine 208 Caravan. Halls Crossing Airport A copy of a letter that was sent to Dave Krouskop by the Utah Department of Transportation requesting a site for a wind station at the new site for the Halls Crossing Airport was sent to the Commission. Joint Road Meeting Commissioner Black is planning to attend the Joint Road Committee Meeting at Ruby's Inn at Bryce Canyon on March 30, 1990. If Commissioner Black is unable to attend Commissioner Lewis will attend in his place. COMMISSIONER TY LEWIS' REPORT National Wilderness Conference Commissioner Lewis reported that he had attended the National Wilderness Conference in Salt Lake City on March 21-23, 1990. BLM Mancos Mesa Commissioner Lewis reported that he has talked with Ed Scherick of the BLM and Mr. Scherick indicated that the Mancos Mesa decision from the IBLA would be resolved speedily.
