SAN JUAN COUNTY COMMISSION MINUTES MAY 9, 1988

The regular session of the San Juan County Commission convened at 10:00 A.M. at the San Juan County Courthouse in Monticello, Utah.

A motion to approve the minutes of May 2, 1988 as corrected was made by Commissioner Maryboy and seconded by Commissioner Black. UNANIMOUS.

COMMISSIONER CALVIN BLACK'S REPORT

BLM National Advisory Council Tour - The tour began with a meeting and public comment period in Cedar City, Utah. Commissioner Black submitted the multiple use papers written by the San Juan County high school students. Three students from Panguitch, Boulder and Escalante made oral statements and presented approximately 250 papers from the Garfield County schools. The Council was very impressed by the interest of the young people. The tour continued on to the Cedar Breaks area and Zions National Park to observe BLM lands proposed for multiple use and wilderness areas as well as Forest Service and private lands. At the Uvimpa Point area the group viewed the Alton Coal Mine area. The area that can be seen visibly has previously been declared as unsuitable for coal mining in spite of the vast reserves located there. The night was spent at Bryce Canyon then proceeded on through Tropic and Escalante where they stopped at the Top of the Rocks area where the group was briefed on the buffalo herds in the area, wilderness study areas, coal, uranium and other multiple use resources. Council meetings were held at Bullfrog that night. Because of adverse weather conditions the Lake Powell ferry was not running so the tour drove across at Hite and on to the Mule Canyon/Butler Wash area. Throughout the tour, briefings were given on the areas they were going through, the uranium mining areas, the recreation aspects, oil and gas fields, the Lisbon Valley area and the Needles overlook. The tour concluded Saturday morning at a meeting in Moab where several resolutions were adopted. A resolution on the BLM resource management plans was not adopted at this meeting but is on the agenda for the Council meeting in July so the plans can be studied in depth and then recommendations made to the BLM on all of then. Resolutions that were adopted were:

Supporting oil and gas leasing on the Anwer Coastal Plain in Alaska

Supporting the National Petroleum Reserve and opposing a wildlife reserve in

Alaska.

Supporting a bill on uranium, the Revitalization Act.

A multiple use resolution.

Wild horse and burro management.

Introduction or augmentation of wildlife - transplants.

Recreation stressing multiple use management.

Local input into land use planning.

The County will award $100 to the first place winners, $60 to the second place winners and $40 to the third place winners.

National Inholding Association - Commissioner Black reported on two issues received from the National Inholding Association. Comments are being received by various Senators opposing the Tall Grass Prairie Preserve Bill in Oklahoma. A forest fire on the Siskiyou National Forest destroyed 96,000 acres and the environmentalists want to create a wilderness area and not salvage the timber or rehabilitate the land. A motion was made by Commissioner Maryboy and seconded by Commissioner Black to authorized Mr. Black to write letters supporting these issues. UNANIMOUS.

Blue Ribbon News - The Blue Ribbon News indicated that many of the same problems on wilderness issues and land management issues are evident throughout the West.

Atlas Minerals Salvage - A letter from Atlas Minerals indicates they intend to conduct salvage operations on some of its properties located in the Lisbon Valley, San Juan County. As there is a tax lien on the property, the Commissioners will drive down to the area this afternoon to see if it would be worth the County taking over the salvage operation.

Utah Power & Light/fracifiCorp Power & Light Merger - a Letter from the Committee of Consumer Services regarding the UP&L/PP&L merger concluded after analysis that the merger is unsupportable and should be opposed in its present form.

COMMISSIONER MARK MARYBOY'S REPORT

Red Mesa Road - The Red Mesa residents are concerned that the road between Todahaidekani and Red Mesa has

not been upgraded. Road Foreman Bernal Bradford needs to be contacted to see how soon the road crews will

be able to get on that project.

Oljato Marina - The Oljato residents are protesting the lay-off of residents at the Oljato Marina when UNI

changed the management there. The UNI Board will meet this week to try and resolve the problem.

Navajo Senior Citizens Services - The Navajo Senior Citizens Services has agreed to set aside $28,600 for

services to Navajo citizens in the Bluff area.

BLM San Juan Area Resource Management Plan Hearing - The Red Mesa residents feel that the hearing for the

BLM San Juan Area Resource Management Plan will be supported better if it is moved from Bluff to Red Mesa.

ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT

Hazardous Reduction Meeting - Administrative Assistant Rick Bailey attended the Governor's Conference in

Park City last week entitled Hazardous Reduction. Enough said!

Bluff Fire Truck - The fire truck for the Bluff area was brought from Salt Lake City and is undergoing

minor repairs at the County road shop. A representative from L.N. Curtis will take the truck on to Bluff

and demonstrate the operation of the truck and equipment.

Anastacio Lopez Property - The Farmers Home Administration has completed an appraisal on the Anastacio

Lopez property for $6,300. Commissioner Bailey had made a recommendation to approve the purchase of the

property if it can be obtained at that price. A motion to authorized Administrative Assistant Rick

Bailey to negotiate with Farmers Home Administration and Mr. Lopez on the purchase of the property was

made by Commissioner Maryboy and seconded by Commissioner Black. UNANIMOUS.

Aging Department/Bus Drivers - Administrative Assistant Rick Bailey made a recommendation to hire William

D. Brown as a permanent part-time bus driver for the Monticello senior citizens to replace George Kensley.

Mr. Brown will be hired at grade 2 step 1 at $5.33 per hour. Doyle B. Rowley to be hired at grade 1 step

1 for $5.12 per hour as a relief driver replacing J.J. Steffen. A motion to approve the recommendation

was made by Commissioner Maryboy and seconded by Commissioner Black. UNANIMOUS.

Public Safety Building Payment - A request for payment by Valley Building on the Public Safety Building in

the amount of $172,410 of which $148,842 goes to Valley builders, $16,538 to retainage, and $7,030 to

Motorola who is under a separate contract. A motion made by Commissioner Maryboy and seconded by

Cortmissioner Black approved the payment. UNANIMOUS.

Hospital Administrator Position - Eight applications have been received for the position of San Juan

County Hospital Administrator and will be reviewed by the Commission during the week.

CURRENT BUSINESS

Weed & Rodent Control - Jim Heaton presented a request to hire John G. Adair as a seasonal full-time employee for the Weed and Rodent Control at grade 5 step 1 at $963.00 per month. Commissioner Maryboy made a motion to approve the request. Coimiissioner Black seconded the motion. UNANIMOUS.

Ucolo Road - John Skidmore met with the Commission regarding a gate on his property that has been placed across a county road. Mr. Skidmore reported that the gate was built approximately twenty years ago and was closed temporarily to hold his cattle in a pasture while fences can be mended in other areas. A request to close the gate temporarily will be acted upon by the Commission at their meeting on May 16th.

Bluff Property - County Attorney Craig Halls reported that a 12 foot right-of-way through some property owned by Rosalie Goldman in Bluff has been dedicated as a street. Mr. Halls stated that a street can't be dedicated unless it's dedicated to a valid city and Bluff is not an incorporated city, therefore it must have been dedicated to the County. The property was transferred to Mary Fountain Nagle and Ms. Nagle would like to sell the property but the dedicated strip needs to be settled prior to the sale. It was suggested that the County give a quit claim deed to Mrs. Nagle for the strip. The Commissioners had questions as to the proper procedures to be followed. County Attorney Halls will check on the legal aspects of the issue and report back to the Commission next week.

Southern Paving/Timber Sale - Fred and Brenda Stocks of Southern Paving met with the Conmission to see if the County would be willing to participate on upgrading a road in the LaSal mountains for hauling timber. Southern Paving has purchased some timber in Colorado and the Forest Service wants them to haul it out through Paradox. There are some steep switchbacks on this route that they would like to avoid. They are proposing an alternate route but the road would need upgrading to make it adequate for hauling. They have received approval from Paul Redd to crush some rock on his property but need to obtain approval from the Forest Service on the type of rock in the pit. Commissioner Black indicated the County would be in favor of cooperating on the road. However, it would probably only be the slick clay areas that would be graveled at the present time. The matter will be discussed further when approval has been obtained from the Forest Service to use the alternate route.

KUED/KUER Translator Maintenance - The County Communications Engineer Bill Bayles services the TV translator for KUED, and the University of Utah would like to enter into an agreement for the County to maintain the KUER FM translator as well. They have also had their antennas mounted on the towers under the large dish and when the ice melts it wipes the antennas out. A request has been made to put their translator and antenna in the County building. The Commission felt there would be no problem with putting the translator and antenna in the building but will check further into the maintenance of the equipment. The matter will be discussed further next week when Cortmissioner Bailey can be there.

Montezuma Creek Fire Truck Bid - Only one bid was received for the purchase of a new fire truck for the Montezuma Creek area. The bid was from L.N. Curtis & Sons for $96,556 for the fire truck and equipment. Administrative Assistant Rick Bailey recommended that the bid be accepted. A motion to approve the recommendation was made by Commissioner Maryboy and seconded by Commissioner Black. UNANIMOUS.

San Juan County Health Care - Hospital Administrator John Fellmeth met with the Commission to further discuss the question of the duties of the Director of Nursing Bonnie Conway.
