The San Juan County Commission met in regular session on March 9, 1987 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.

The following members were present: Commissioner Black, Chairman

Minutes of the March 2, 1987 Commission meeting were approved with corrections on the motion of Commiss-ioner Maryboy and seconded by Commissioner Black. UNANIMOUS.

COMMISSIONER CALVIN BLACK'S REPORT

Community Impact Board - Closing Date - Commissioner Black will be going to Salt Lake tomorrow to sign the papers for the grant money and bond for the Public Safety Building.

UDIA - Road payment - Commissioner Black reported that Worthy Glover, UNDC, talked to him about an invoice that was sent to UDIA for payment of 25% of road work done that the county did for UNDC. Commiss-ioner Bailey met with Mr. Parashonts several times last year and this was believed to have been resolved. Commissioner Black said that Mr. Glover gave him a letter from Mr. Parashonts stating that he received an invoice in regards to roads and regrets to inform the county that UDIA can't pay the amount of $6,191.45. The amount has not been approved by the UNDC board or the UDIA board nor has the amount been budgeted. Mr. Parashonts also says that he would not receive any more invoices from the county. Any road work that is being done by the county is being done between the county and UNDC. The UDIA has no formal agreement or commitment to the county for payment of road work. Re: Realignment of County Access Road

On Tuesday the 3rd of March, 1987, the County Road Surveyor, Doug Pehrson, County Road Maintenance, Bernal Bradford, the San Juan County Water Conservancy District Chairman, Norman Nielson, a private property owner, Ervin Guymon, and the Chairman of the County Commission, Calvin Black, met at the Recap-ture Lake for the purpose of discussing problems with a county road in that location.

The current road providing access to the Guymon property is located below the high water mark of the reservoir and it was determined that a realignment of the road in a different location would provide the most cost effective and satisfactory solution to all parties. The parties have reached an understanding as follows:

The County Surveyor, Doug Pehrson, together with Ervin Guymon will determine the alignment of a road across the Guymon properties as recommended by Ervin Guymon taking into consideration the natural contours of the properties. The road will be approximately 12 feet wide and it will go from the existing county road about 1/2 mile north of the existing access southwesterly across Bull Dog Wash and intersecting the existing access road. The Road will be constructed with pit-run gravel, placed on it from existing county road. The gravel shall be placed to approximately 100 feet westerly from the bottom of the wash. The crossing on the wash is currently gravel and no culvert or special work will be required. The County will furnish and install one culvert between the wash and the existing access road, all work to be provided by county equipment and crews.

The location of the present road has required that two of the gates of Mr. Guymon be moved or modified. The San Juan County Water Conservancy District has accepted responsibility for provided two steel gates, they will furnish and install two steel gates at locations designated by Ervin Guymon immediately with the signing of this understanding.

The parties agree to expedite the completion of this project and Ervin Guymon agrees in connection with this letter of Understanding that he will sign any documents necessary to allow the pipeline project sponsored by the San Juan County Water Conservancy District to go forward.

The parties have signed that this documents contains the understanding reached on the 3rd day of March, 1987, and each of them are in agreement with the statements made herein.

Brown's Canyon Road - Commissioner Black reported that he talked to David Perkins about the widening of the Brown's Canyon Road. Mr. Perkins owns land on the south side of the road and is willing to give the county a 50 ft right-of-way if the county will build a fence.

Energy Fuels Nuclear Inc - Commissioner Black said that Energy Fuels Nuclear, Inc. is attempting to negotiate the opening of a new mine called the Hermit Mine Project but there is strong opposition from the environmentalists. Energy Fuels is asking for support by writing to U.S. Dept. of Interior, BLM. The mine is located 30 miles southwest of Kanab, Utah. Letters of support make a big difference in combating the negative reports from the environmentalist.

Commissioner Black said he will be going to St. George this Wednesday to Land Board Meetings then, Friday he will be in Washington, D.C. attending NACo meetings until Tuesday.

COMMSSIONER MARK MARYBOY'S REPORT

New Commissioner's Workshop - Commissioner Maryboy reported that he attended the new Commissioner's Workshop in Salt Lake last week which was very informative. Commissioner Maryboy said the panel dis-cussion about state lands was good but he needs more information about this matter. Land in the State of Utah is 80% federally owned and only 8% of the land in San Juan County is privately owned.

BLANDING SWIMMING POOL - BIDS FOR FILTERS

Eddie Allred, Recreation director, presented the Commission the following bids for the Blanding swimming pool:

Bruce Bunker Construction - To supply labor and materials to remove all pipe work and fittings, also remove four filters, sand, and gravel content of filters for $1,260.00

Redd Plumbing & Solar - same as above for $1490.00

Aquatech Pool & Patio Shoppe - Filter Replacement and equipment re-do for $11,158.00

Commissioner Maryboy made the motion awarding the bids to Bruce Bunker Construction and Aquatech Pool & Patio Shoppe. Commissioner Black seconded the motion. UNANIMOUS.

SHERIFF'S DEPARTMENT - CROSS-DEPUTIZATION & PERSONNEL

Sheriff Lacy met with the Commission to report that the Navajo Tribe has approved San Juan County deputies to be cross-deputized. Sheriff Lacy said that William Kellogg, Navajo Police Director, sent a notice saying there will be no schooling required but just a signing of an agreement. Sheriff Lacy said he will hold a staff meeting and give each deputy a copy of the policies that are required. The Commission will have to approve the deputies who will be cross-deputized and they will be issued a special deputy card. Sheriff Lacy thanked Commissioner Maryboy for helping the county get the Tribe's approval to do this. Sheriff Lacy said he wants to schedule the jailers on a complete rotation basis. In the personnel policy a county employee has to take their holiday time two weeks before or after the holiday. Sheriff Lacy said he would like to change this for the sheriff's department personnel and recommends that it be extended to two months. This will be put on the agenda next week for consideration.

HALLS CROSSING AIRPORT

Commissioner Black read a copy of a letter dated Feb. 26, 1987 from Senator Jake Garn to Jordan Phillips Group of Park City, Utah concerning the construction of the new airport at Halls Crossing. The letter states that he strongly supports the proposal by San Juan County to construct a safe new landing strip at Halls Crossing. The existing dirt strip is not a good facility and should be upgraded at the earliest opportunity. Sen. Garn says that he intends to do whatever he can to move this proposal forward and believes that their argument about ruining the environment of the Glen Canyon area by construction of a new airport is stretching any legitimate concern which may exist. In this case, a need for a safe airstrip far outweighs other considerations.

BURR TRAIL - HEARINGS

Commissioner Black said that the Burr Trail hearings are still in continuance after five full days. This is being heard in the Federal District Court and attorneys and witnesses are involved which is costing a lot of money. The lawsuit is to determine whether Garfield can upgrade and drain a county road that goes across BLM land. Commissioner Black said if the environmentalists win this lawsuit it will affect San Juan County. The Judge's decision may be made today.

PUBLIC DEFENDER - ADVERTISE

Honorable Judge Halliday met with the Commission concerning the open position of public defender in the county. The Commission agreed that it should be advertised as soon as possible.

SUE COOK - CANYONLANDS EXPANSION

Sue Cook, assistant to Congressman Nielson and Senator Garn, met with the Commission to discuss the following various topics:

H.R. 899 to expand Canyonlands National Park - Congressman Owens introduced a bill to expand the Canyonl-ands National Park. Presently, the park has a total of approx. 337,258 acres and the bill proposes to expand it to 754,600 acres.

Superintendent - Sue said she plans to meet with the new Canyonlands Superintendent when he arrives the end of the month. Halls Crossing Airport - The Commission updated Sue on the progress of the Halls Crossing Airport.

COMMUNICATIONS - NATIONAL TRANSLATOR SEMINAR

Bill Bayles, Communication Engineer, met with the Commission to ask for out-of-state approval to attend a National Translator Association Seminar in Albuquerque, New Mexico on April 30, and May 1 & 2. Commissi-oner Maryboy made the motion approving this out-of-state travel. Commissioner Black seconded the motion. Unanimous.

CONTEL - MAINTENANCE AGREEMENT - COURTHOUSE TELEPHONE SYSTEM

Gail Johnson, Clerk, told the Commission that Mae Systems waived the county the 30 day cancellation period to terminate the maintenance agreement on the telephone equipment. Mrs. Johnson said she would like Continental Telephone to pick up this service immediately. A maintenance agreement with Contel was approved on the motion of Commissioner Maryboy and authorized Commissioner Black to sign it. Commissioner Black seconded the motion. UNANIMOUS.

SOCIAL SERVICES TRADE-OFF

Rick Bailey, Administrative Assistant, reported to the Commission that he attended a meeting in Salt Lake in which they discussed the trade-offs for Human Services vs. Detention for Indigent. The county is now required to pay 10% match of the state and federal funds for the Aging Department. The county will be required to pay 20% match for the Alcohol & Drugs Dept., which will be an increase and 20% for Mental Health. In the trade-offs the county will receive a $45,000 refund but this will go right back into the program.

QUEEN PAGEANT - BECKY YOUNG RESIGNS

Becky Young, director of the county queen pageant, told the Commission that she is resigning from her position. The Commission told Mrs. Young that she has made the queen pageant a very formal affair and told her they appreciated the work she has done in the past. Mrs. Young said the franchise for Miss Utah is in her name and can't be given to the county but said she is willing to hold the franchise as long the county wishes. Mrs. Young said she is willing to help whoever accepts the position. Again, the Commis-sion thanked Mrs. Young for her efforts.

BRIDGE AT OLJATO WASH

The Commission received a copy of letter from UNDC that was written to UDOT concerning a request for a bridge at Oljato Wash. The letter states that Navajos living near Oljato have difficulty traveling and children can't go to school unless the water is low enough to wade across. A marina at Paiute Farms at

Lake Powell is being proposed to be constructed and the road across Oljato wash is the only access to the marina.

PRIVATE ROADS CLOSED

On March 23 at 4 p.m. during the Commissioner's meeting the Commission will discuss the status of road at Long Canyon Point (Max Dalton's) and the road at the bottom of Long Canyon (Old Palmer's Place). Pre-sently, both of these roads are on the county system and have been requested to be closed as private roads. The roads go into public land and this is the concern.

TYPEWRITER BIDS

Two bids were received for a typewriter for Commissioner Maryboy. Palmer's Office Supply a Royal 410 typewriter for $564.72 and Parker's Inc. a Panasonic Typewriter for $599.00. The bid was awarded to Palmer's because of lowest bid.
