MINUTES OF THE SAN JUAN COUNTY COMMISSIONERS MEETING HELD
NOVEMBER 8, 1983
The San Juan County Commission met in regular session on Tuesday, November 8, 1983, at the San Juan County Courthouse at Montciello, Utah.
The following members were present; Commissioner Kenneth R. Bailey
Commissioner Robert Low Commissioner Black was excused.
Minutes of the previous meeting were approved with the specified corrections on the motion of Commissioner Low. The motion was seconded by Commissioner Bailey and carried unanimously.
MONTICELLO CITY MANAGER MEETS
Rick Terry met with the Commission to report on the secondary water system being installed to bring irriga-tion to the park. The line will be brought down 1st North on the South side of the street and the lines will be drilled under the roads. The only problem may be down by the library where they will need to make a trench along the south side of the concrete dip by the parking area. Mr. Terry discussed using cold mix for patching this area.
Mr. Terry and the Commission also reviewed getting an agreement in writing between the City of Monticello and San Juan County regarding operation of the Monticello Airport. The placement of the McCann's mobile home was also discussed.
WILLARD PEASE OIL & GAS COMPANY REIMBURSEMENT CHECK RECEIVED
John Baker met with the Commission to report a reimbursement check for $122.50 was received by the Bluff Fire Department from Willard Pease Oil & Gas Company for foam used to put out a fire on an oil battery.
AIRPORT HANGAR LEASE APPROVED
The Commission approved the lease submitted by Mitch McCann for Monticello Airport Hangar #5. BUILDING PERMITS APPROVED
Commissioner Low made a motion to approve the following building permits. The motion was seconded by Commissioner Bailey and carried unanimously.

CEDAR POINT ROAD DISCUSSED
Ernie Waller met with the Commission to discuss the Cedar Point Road. Mr. Waller claims the road has been graded only once this year and does not feel the road is adequate. Bernal Bradford will go with Mr. Waller to inspect the road and report back to Commissioner Bailey. Mr. Bradford reported later during the day that there are a few bad spots and they will patch them and grade the road.
BIDS FOR AUDIT DISCUSSED
Gail Dalton, County Clerk, met with the Commission also present deal Bradford and Rayburn Jack to discuss getting bids on the County audit and including the health care services in it. Miss Dalton thinks the audit should be bid on every year. The Commissior has no objection to MISS Dalton's recommendation.
BIDS FOR NEW ROOF AT THE MQNTICELLO SWIMMING POOL DISCUSSED
Bids were discussed by the Commission for the new roof at the swimming pool in Monticello. The rec-reation Board recommends accepting Bruce Bunker Construction's bid. The Commission will accept the bid with the following requiremnets met:
1. All overlap panels of metal to receive double face seal.
2. The amount of $612.00 be deducted due to a different method of trussing the roof.
Commissioner Low made a motion to accept the bid with these requirements for the amount of $4096.25. The motion was seconded by Commissioner Bailey and carried unanimously.
ALTERNATE FOR STATE ADVISORY COUNCIL ON AGING APPOINTED
Al Haskins met with the Commission to recommend Mr. LaRay Alexander form the San Juan Area Agency be appointed as an alternate to the State Advisory Council on Aging. Commissioner Low made a motion to approve Mr. Haskin's recommendation. The motion was seconded by Commissioner Bailey and carried unanimously .
COMMISSIONER LOW'S REPORT
Commissioner Low reported the possibility of purchasing the Country Club at the Golf course. The Commission Mr. Haskins searched the title and reported the following:
1. On December 21, 1960, the County leased it to the Golf Club.
2. On March 21, 1961, the County sold the building for $3,000.00 to the Golf Club and was issued a quit claim deed.
Commissoner Low also reported on the meeting he attended with Commissioners from Montezuma County, Colorado The Montezuma County Commissioners seemed in favor of a road connecting Montezuma Creek to Cortez through Mc Elmo Canyon.
HEARING ON JERRY HOLLIDAY'S PRELIMINARY INJUNCTION
Bruce K. Halliday, County Attorney, met with the Commission to report on the hearing on the preliminary injunction pretaining to Jerry Holliday's gravel pit. Mr. Halliday reported that the court ruled to allow the temporary injunction to stay in effect.
STATE TAX COMMISSION SETTLEMENT DISCUSSED
Attorney Bill Peters met with the Commission to review the position of the Commission and of Barbara Montella, County Assessor, concerning the suit brought by the State Tax Commission on a settlement.
Mr. Peters, Mr. Halliday, and Mrs. Montella met with the Commission again to report on the progress being made. Mr.s Montella and Joe Dunlop of the State Tax Commission reviewed Mrs. Montella's figures and Mr. Dunlop feels a settlement could be reached at $16,500.00. Mrs. Montella and Mr. Dunlop's figures were close but two different methods of calculating were being used. Mrs. Montella figured with an arthimatic means and Mr. Dunlop used a weighted means. Mr. Peters, Mr. Halliday, and Mrs. Montella recommended settling with the State Tax Commission for $16,500.00 instead of the original $57,000.00 to go to the uniform school fund.
Mr. Halliday met with the Commission to report on the agreement for a settlement reached with the State Tax Commission. San Juan County will agree to pay the San Juan School District the sum of $16,500.00 payable as follows;
$8,000.00 prior to January 1, 1984, and $8,500.00 on or before March 31, 1984.
Commissioner Low made a motion to accept this settlement. The motion was seconded by Commissioner Bailey and carried unanimously.
SEPTEMBER FUND BALANCE REPORT REVIEWED
John Fellmeth, Cheif Deputy Auditor; Al Haskins, Emergency Services; Mary Lou Mosher, County Recorder; Barbara Montella, County Assessor; and Gail Dalton, County Clerk, met with the Commission to review the September 1983, Fund Balance Report. Some of the department heads expressed concern over unexpected expenditures causing them to exceed their budgets.
BLUFF TO MONTEZUMA CREEK ROAD
Commissioner Bailey reported that he met with George Thompson in Salt Lake City and the state is going to get the environmental clearance on the Bluff to Montezuma Creek Road. Commissioner Bailey also reported that if we want to have the state do the engineering we will have to make a formal request to Sterling Davis. The right-of-way has been obtained from the BLM. All we have from the State is the agreement to get the right-of-way. Doug Pehrson is sending the application in for the right-of-way from the state. The State requires full market value whereas the BLM provides free right-of-way for public roads.
ANNUAL MEETING WITH DOT SCHEDULED
Commissioner Bailey reported that the DOT wants to meet with the Commission and would like the cities of Monticello and Blanding to meet with them also. The tentative date for the meeting is February 22, 1984, at 1:30 p.m.
COMMISSIONER BAILEY'S REPORT
Commissioner Bailey reported that the building for the bookmobile is ready and they should be moving into it it.

Commissioner Bailey reported that Mr. Halliday sent a letter to Mr. Milton Oman concerning his property by the Clyde Sanchez Road. Mr. Halliday informed Mr. Oman that lowering the drain would not help with the water retention on his property.
Commissioner Bailey also reported that the Aneth to Ismay Road is ready to start work on but they have been unable to obtain a right-of-way from the BIA.
/BUDGET HEARING SET
The budget hearing has been tentatively set for December 8, 1983, at 7:00 p.m. in the courtroom. NURSING HOME ADDITION BOND DISCUSSED
The possibility of holding a bond election for funding of the Nursing Home addition was discussed by the Commission and Rayburn Jack, Health Care Services Executive Director; Norma Nielson, Hospital Coordinator; and Cleal Bradford, Chairman of the Health Care Services Board. The Health Care Services Board recommends a bond election for $1,250,000.00 for the Nursing Home addition. The possibility of creating a Health District to enable them to levy mills for Health Care Services was also discussed. The Board is recom-mending a dual election for the bond and the districting issue. A tentative date for a public meeting on this matter is scheduled for December 2, 1983 with a tentative date for the election scheduled for December 6, 1983.
Terry Rock and John Sagar from First Security Bank of Utah met with the Commission to present their pro-posal for handling the bond sale for the County. The approximate fee for their services is $9,025 with an additional $3,00.00 for attorney's fees.
Paul Barr of First Western Bank and Lyle Larson of Continental Bank met with the Commission. Mr. Larson presented his proposal for handling the bond sale for the County. The approximate fee for his service would be $9,375.00 with an additional $3,000.00 for attorney's fees.
Commissioner Low made a motion to approve the election and to authorize Mr. Jack to follow through with the necessary publication. Commissioner Bailey seconded the motion and it carried unanimously.
Commissioner Low made a motion to accept the proposal presented by First Security Bank for handling the bond sale. The motion was seconded by Commissioner Bailey and was approved unanimously.
BLUE CROSS/BLUE SHIELD REPRESENTATIVE MEETS
Al Price met with the Commission to discuss the possibility of making the insurance reimbursement payments to the hospital instead of to the individual. Mr. Price will further research the matter and report back to the Commission. Also discussed was changing the maternity benefits for the hospital to coincide with the rest of the County. Mr. Price feels that upon the instruction of the Commission the insurance benefits could be payed to the County hospital on County employees.
