MINUTES OF THE SAN JUAN COUNTY COMMISSION MEETING HELD
MAY 7, 1984
The San Juan County Commission met in regular session on Monday, May 7, 1984, at the hour of 10:00 a.m. in the San Juan County Courthouse at Monticello, Utah.
The following members were present: Commissioner Calvin Black, Chairman
Commissioner Kenneth R. Bailey Commissioner Robert Low
Minutes of the previous meeting were approved with the specified corrections on the motion of Commissioner Low. The motion was seconded by Commissioner Bailey and carried unanimously.

USU EXTENSION OFFICE DISCUSSED
Helen Neal, USU Home Economist, met with the Commission to review the 4-H Program and to present the Commission with a copy fo the 4-H Council minutes for the past year. Mrs. Neal also presented the Commission with several proposals for 4-H activities for the future.
Commissioner Bailey also reviewed his meeting with Marilyn Noyse from the USU in regards to some of the concerns the Commission has had about the Extension Office. Commissioner Bailey further reported that Mr. Thompson and Mrs. Neal have been placed on probation by the University.
APRIL CHECK RECEIVED FROM RIO ALGOM
Gail Dalton, County Clerk/Auditor, met with the Commission and reported that the check for the month of April has been received from Rio Algom Corporation in the amount of $8,238.20.
GOLF COURSE DISCUSSED
Grant Leavitt met with teh Commission to review the progress of the new golf course pro shop building.
Mr. Leavitt and the Commission also discussed the land trade proposal made by J.B. Grain. The Commission requested Mr. Leavitt obtain a written proposal with appropriate maps and legal descrip-tions and submit a recommendation.
The Commission received the following letter from Jensen Dvelopment Company concerning a problem they are having with the Golf Course:

Gentlemen:
PROBLEM: Personnel at the San Juan Golf Course have removed several hundred yards of soil (to be used as fill) and have piled several truckloads of used concrete blocks, culverts, concrete water pipe, lumber, tree clippings etc. on land owned by R. Buckley Jensen just across the road north from the 6th fairway and green. (See plat attached hereto) This was done without permission.
REQUESTED REMEDY: That San Juan County allow County personnel to clean up debris from above described area (a truck and a front end loader should suffice) and then grade the property to fill in the craters, and level the area to a manner satisfactory to the owner. ( a few hours of work with a Cat will do the job.)

DISTRICT FIRE MANAGER REPORTS
John Baker, District Fire Manager, met with the Commission and reported on a fire in the Aneth-Montezuma Creek area. Mr. Baker reported that the fire was at the Phillips #1 plant and caused approximately $3,000.00 worth of damage. Mr. Baker also reported that the Montezuma Creek Volunteer Fire Department responded to the call and the Bluff Volunteer Fire Department was on stand by.
LAW ENFORCEMENT AGREEMENT BETWEEN THE COUNTY AND THE FOREST SERVICE APPROVED
Commissioner Low presented an agreement between the Forest Service and the San Juan County Sheriff's Office for approval. The agreement is for the Sheriff's Office to provide law enforcement services on Forest Service land. Commissioner Low made a motion to approve the agreement and to authorize Commissioner Black to sign it. The motion was seconded by Commissioner Bailey and carried unanaimously.
DEATH IN COUNTY JAIL REPORTED
Commissioner Low reported that one of the prisioners in the County Jail committed suicide last Friday night.
SHERIFF'S GRANT REQUEST APPROVED
Commissione Low reported that he met with representatives from the Highway Safety Department to discuss a grant proposal submitted by Sheriff Wright to help fund DUI enforcement. Commissioner Low further reported that a $55,000.00 grant was approved.
COMMISSIONER DISTRICTING DISCUSSED
Lorraine Ferguson and Ron Faich from the Navajo Tribal Justice Department met with the Commission
to discuss the proposals for dividing the County into districts for the electing of County Commissioners
by these districts. It was decided that preserving community interest is of major importance as
well as deviation percentages. Several additional proposals for the method of districting were
reviewed. All proposals submitted will be presented to the public and discussed. Ms. Ferguson
will also schedule some meetings with the Chapters for the Commission and notify the Commission of

the dates and times. Commissioner Bailey requested a letter specifying the type of information that would be helpful to the people in understanding the districting proposals. The Commission also requested a tribal representative be present at the public hearings. Mr. Faich will meet with the Navajo Advisiory council and report to them about today's meeting and get their input. The Commission stated that they welcome the response and input of the Navajo Tribe, U.N.D.C. and the United States Justice Department.
BIA-ROAD MAINTENANCE AGREEMENT APPROVED
George Maestis from the Western Navajo Agency of the B.I.A. met with the Commission to review the road maintenance agreement. The agreement is for the roads within San Juan County to become effective October 1, 1985. Commissioner Bailey made a motion to approve the agreement and to authorize Commissioner Black to sign it. The motion was seconded by Commissioner Low and car-ried unanimously.
HEALTH CARE SERVICES BONDS DISCUSSED
Terry Rock from First Security Bank met with the Commission to review the ammoritization schedules and the bond payment schedule. The first principal payment will become due in January, 1985. The official notice of bond sale was read and reviewed. Commissioner Bailey made a motion to approve the notice and authorize Commissioner Black to sign it. The motion was seconded by Commissioner Low and carried uananimously. The public sale has been rescheduled for May 22nd. The Commission will hold a special meeting on May 22nd at 2:00 p.m.
OIL AND GAS LEASE DISCUSSED
Allen Coleman met with the Commission to discuss a proposal for leasing the following property:

Section 3: Lot 2 (40.08) X 1/2 interest
Last leased November 23, 1959 Other 1/2 interest terms:

The Commission decided to publish an invitation for bids on this in the paper and accept sealed written proposals until May 29th at which time they will be opened during the Commission meeting at 2:00 p.m.
COUNTY EMPLOYEES INSURANCE DISCUSSED
John Fellmeth, Chief Deputy Auditor, met with the Commission to report on his progress concerning negotiating for a lower administrative cost with Blue Cross/Blue Shield for the County insurance program.
COMPUTER SOFTWARE DISCUSSED
John Fellmeth, Data Processing Manager, met with the Commission to discuss the purchase of fixed asset and warehouse inventory software programs. Mr. Fellmeth reported that the cost for both would be $6,300.00. The Commission authorized Mr. Fellmeth to make the purchase.
HEALTH CARE SERVICES DISCUSSED
Rayburn Jack, Health Care Services Executive Director, met with the Commission to discuss the physicians' salaries. Mr. Jack reported that the private physicians are paid the following fees for on call service per physician:
nights $45.00
weekends $760.00
approximate yearly total each: $25,000.00
The physicians had the option of receiving $500.00 per weekend and billing the patients themselves. It was also reported that the County employed physicians do not get paid in addition to their salaries for on call service at night or on weekends and do not bill the patients for their services. Any fees go to the clinic for overhead costs. The county employed physicians get the following salaries:
Dr. Redd $75,000.00 plus a percentage of the net proceeds
Dr. DeWolfe $55,000.00
The Health Care Services board has also given Dr. Redd and Dr. DeWolfe an additional $200.00 per month for providing consulting services to mental health. Mental Health pays the Health Care Services for providing these services. The physician's current contract is effective thru June, 1984.
Al Haskins reported that at the Governor's Mini Conference on Aging the possibility of the County physicians only charging the approved Medicare amount was brought up by several senior citizens. The Commission stated that this type of practice would be unfair to the private physicians in the County.
COUNTY TELEPHONE SYSTEM DISCUSSED
Milt Rose, Communications Engineer, met with the Commission to report on his recommendations for a new phone system. Mr. Rose recommended the Meritor HX by Contel but stated that he would like to further study the matter. Mr. Rose also reported that there is a possibility of updating the current equipment.
Mr. Rose also requested that a petty cash account be established for his department. The Commission approved the request for the amount of $100.00.

STATE TAX COMMISSION HEARING REPORTED ON
Bruce K. Halliday, County Attorney, met with the Commission to report on the formal hearing San Juan County had with the State Tax Commission.
GRAVEL PERMIT FOR MC ELMO GRAVEL PIT DISCUSSED
Commissioner Baiely reported that he received a letter form the Navajo Tribe requesting the County kuse the McElmo Creek Gravel Pit north of Aneth to do gravel and road work on private roads and drives. Commissioner Bailey further reported that the letter stated that it would be a requirement to do the requested work in order for the County to have use of the gravel pit. Commissioner Bailey will draft a letter to the Tribe explaining the County policy in regards to doing private roads and drives. The letter will request permission to use the gravel on County roads on the reservation. A copy of this letter will be sent to the U.N.D.C. A letter will also be drafted to the U.N.D.C. explaining that the County has the equipment and the manpower and the ability to do the roads but the County does not feel they can purchase the gravel and is requesting their assistnace in obtaining a gravel permit.
TENTATIVE AUCTION DATE SET
Commissioner Bailey reported that the County surplus auciton has been scheduled for June 16th at the County Road Shed.
MONTICELLO AND BLANDING SWIMMING POOLS DISCUSSED
Commissioner Bailey reported that he has spoken to Sam Chamberlain in regards to the pumps at the Monticello and Blanding swimming pools. Mr. Chamberlain reported that the pumps at both pools will need new impellor pumps.
COMMISSIONER BLACK REPORTS
Commissioner Black reported that he has been contacted by Martin Pearson from the Tri-Arc Travelodge in regards to the County's contract for room rates. Mr. Pearson stated that the rates will be going up approximately $10.00 per night effective immediately. The Commission instructed the Clerk to send letters to several of the hotels in Salt Lake requesting proposals.
COMMISSIONER BLACK ASKED TO TESTIFY AT SENATE HEARINGS RE: B.L.M. GRAVEL PERMITS
Commissioner Black reported that he has been contacted by Dorothy Allen from the Federal Research Committee in regards to a bill introduced by Senator Jake Garn to amend the law pertaining to gravel permits by the B.L.M. Commissioner Black has been asked to testify at hearings on the bill before the Senate Energy and Natural Resources on May 22nd in Washington, D.C.
WIR-NACO REPORTED ON
Commissioner Black reported on the Western Interstate Regional Convention of the NACO. Commissioner Black stated that there is another Supreme Court case in regards to P.I.L.T. The case was reviewed by the Commission.
RATIFICATION AND RENTAL DIVISION ORDER APPROVED
Commissioner Bailey made a motion to approve a ratification and rental division order submitted by Phillips Petroleum Company for the following described land:
TOWNSHIP 33 SOUTH, RANGE 24 EAST, SALT LAKE BASE & MERIDIAN
Section 36: A strip of land 100 feet wide, being 50 feet on each side of the center line of the State Road Commission Survey, siad center line being more particularly described as follows: Beginning at a point 1,460 feet South fo the Northwest corner of Section 36, thence South 73°55' East 5,523 feet to the East Section line.
The motion was seconded by Commissioner Low and carried unanimously. NOMINATION TO THE NATIONAL REGISTER OF HISTORIC PLACES DISCUSSED
The Commission received a letter from the Utah State Historical Society reporting that the Coal Bed Canyon Site (42SA920) East half of Northwest quarter of Section 2 T37S R24E, will be considered by the State Review Board for nomination to the National Regiaster of Historic Places.
PROJECT BOLD DISCUSSED
Commissioner Balck reported that he has received a letter from the Governor in regards to Project Bold. Also enclosed was a copy of a letter from the Governor to all of the Commission Chairman in the State regarding Project Bold.
Commissioner Black will draft a letter of respons to the Governor's letter.
