MINUTES OF THE SAN JUAN COUNTY COMMISSION MEETING JANUARY 7, 1985
The San Juan County Commission met in regular session on Monday, January 7, 1985, at the hour of 10:00 a.m. in the San Juan County Courthouse at Monticello, Utah.
The following members were present: Commissioner Calvin Black, Chairman

OATH OF OFFICE ADMINISTERED TO ELECTED OFFICIALS
At 10:00 a.m. the newly elected County officials were sworn into office by County Clerk, Gail Johnson. Officials taking the Oath of Office were as follows:

APPROVAL OF THE MINUTES
Minutes of the previous meeting were approved with the specified corrections on the motion of Commissioner Bailey. The motion was seconded by Commissioner Holliday and carried unanimously.
1985 COMMISSIONER ASSIGNMENTS
Commissioner Bailey made a motion recommending Commissioner Black remain Commission Chairman for 1985. The motion was seconded by Commissioner Holliday and carried unanimously. Commissioner Holliday made a motion recommending Commissioner Bailey hold the position of Vice-Chairman for 1985. The motion was seconded by Commissioner Black and carried unanimously.
Commission assignments and responsibilities were reviewed with some discussion regarding who would have the road assignment. Commissioner Holliday stated that his taking over this responsibility was a major factor in his campaign and he felt qualified to handle this position. Commissioner Bailey feels that he has done a good job with this assignment in the past and would like to continue with this position. The decision was made by all present that Commissioner Bailey would continue with the road assignment.

SCHEDULE OF MEETING FOR 1985
The San Juan County Commission shall, as in the past, hold its regular meetings on a weekly basis on Monday of each week, excepting that on a 5th Monday, no meeting will be held. In the event that a holiday falls on Monday, then the regular meeting will be held the Tuesday following. All meetings shall be held in the Commission Chambers at the San Juan County Court House, Monticello, Utah, from the hours of 10:00 a.m. to 12:00 O'clock noon and from 1:00 p.m. until the business of the day has been concluded. All general business of the County shall be the subject thereof.
COUNTY PHONE SYSTEM DISCUSSED
Gail Johnson, County Clerk, and Milt Rose, Communications Engineer, met with the Commission to discuss the proposals received for an upgraded phone system and a call accounting system. Commissioner Bailey will follow-up on this by contacting the Contel representative to discuss the proposals further.
BEER LICENSES APPROVED
Commissioner Bailey made a motion to approve the following beer licenses. The motion was seconded by Commissioner Holliday and carried unanimously.

ORDINANCE 1985-1, ELECTRICAL CODE
Commissioner Bailey made a motion to adopt the following Electrical Code Ordinance. The motion was seconded by Commissioner Holliday and carried unanimously.
ELECTRICAL CODE ORDINANCE
An Ordinance adopting the national Electrical Code, 1984, Edition, as the Electrical Code for San Juan County, Utah, and amending Section 204 of said Electrical Code relating to penalties violations.
THE BOARD OF COUNTY COMMISSIONERS OF SAN JUAN COUNTY, UTAH, ORDAINS AS FOLLOWS: Section 1; Electrical Code Adopted
Those certain provisions establishing rules and regulations and control of design, construction, quality of materials, use and occupancy, locations, and maintenance of electrical systems or equip-ment, entitled NATIONAL ELECTRICAL CODE, 1984, Edition, as prepared by the National Fire Protection Association and printed as a code in book form, be and the same are hereby approved and adopted as the Electrical Code of San Juan County, Utah and by this reference made a part of this ordinance to the same extent and effect as though said code were copied in full.
Section 2;
Three copies of such code are hereby filed for use and examination by the public in the office of the County Clerk of San Juan County, Utah.
Section 3; Penalty provision amended
Section 204 of said National Electrical Code, 1984, Edition, is hereby amended as follows, to wit:
It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, repair, move improve, convert, or demolish, equip, use, occupy, or maintain any electrical system or equip-ment in this county, or cause same to be done, contrary to or in violation of any of the provisions of this Ordinance.
Any person, firm or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Ordinance is committed, continued, or permitted, and upon the conviction of any such violation, such person shall be punishable by a fine of not more than $299.00 or by imprisonment for not more than six months or by both such fine and imprisonment for not more than six months or by both such fine and imprisonment.
Section 4:
All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 5: Effective Date
This ordinance shall take effect sixteen days after its passage, and after same has been published in a newspaper having general circulation in the County for at least one week.

ORDINANCE 1985-2, BUILDING CODE
Commissioner Bailey made a motion to adopt the following Building Code Ordinance. The motion was seconded by Commissioner Holliday and carried unanimously.

An Ordinance adopting the "Uniform Building Code, 1982 Edition," as the Building Code for San Juan County, Utah, and amending Section 205 of said Building Code relating to penalties violation.
THE BOARD OF COUNTY COMMISSIONERS OF SAN JUAN COUNTY, UTAH, ORDAINS AS FOLLOWS: Section 1; Building Code Adopted

MEETING SCHEDULED TO DISCUSS FACTORING ORDER
Bruce K. Halliday, County Attorney, met with the Commission and reported that a meeting is scheduled in Provo on Friday, January llth, at 2:00 p.m. with the UAC to discuss the 1985 State Tax Commission Factoring Order. The County Attorney, Assessor, and Commissioner Black will be attending this meeting.
PUBLIC HEARING RE: ESTABLISHMENT OF A SPECIAL SERVICE DISTRICT IN BLUFF
A public hearing was held at 1:00 p.m. to discuss the establishment of a Special Service District in Bluff. Approximately 15 people from Bluff were in attendance. A discussion was held regarding the cost per household for a sewer system, but no definite figures have been obtained yet. If the Service District is established a Board will be appointed to research all aspects of the establishment of a District.
Commissioner Bailey made a motion to continue with the process of establishing a Service District for Bluff according to the State Statute. The motion was seconded by Commissioner Holliday and carried unanimously.
BEER LICENSE APPROVED - TOP O' TOE HAT LOUNGE
Commissioner Holliday made a motion to approve the beer license request from the Top O' the Hat Lounge in Mexican Hat. The motion was seconded by Commissioner Bailey and carried unanimously.
PUBLIC HEARING SCHEDULED RE: SALARY INCREASE FOR ELECTED OFFICIALS
The Commission will hold a public hearing on January 21st at 2:00 p.m. to discuss a cost of living increase for elected officials.
RESOLUTION 1985-1 RE; TAX ANTICIPATION NOTES
Commissioner Bailey made a motion to approve the following Resolution regarding the issuance and sale of $2.2 million in Tax Anticipation Notes. The motion was seconded by Commissioner Holliday and carried unanimously.
RESOLUTION NO. 1985-1
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF SAN JUAN COUNTY, UTAH, AUTHORIZING THE ISSUANCE AND CONFIRMING THE SALE OF $2,200,000 TAX ANTICIPATION NOTES, SERIES 1985, OF SAN JUAN COUNTY, UTAH.
WHEREAS a report has been made by the Treasurer of San Juan county, Utah (the "County"), that it is necessary to raise the sum of Two Million Two Hundred Thousand Dollars ($2,200,000) for the purpose of meeting the current and necessary expenses of the County and for any other purpose for which funds of the County may be legally expended, during the 1985 fiscal year, until the taxes and other revenues for the 1985 fiscal year are collected, and that such sum can be raised without incurring any indebtedness or liability in excess of seventy-five percent (75%) of the tax revenues and other revenues of the 1984 fiscal year, ninety percent (90%) of the taxes and other revenues of the County estimated to be received in the 1985 fiscal year, or exceeding any limit of indebtedness imposed by the Constitution or statutes of the State of Utah; and
WHEREAS the Board of County Commissioners of San Juan County (the "Board") has requested offers for the purchase of its Tax Anticipation Notes, Series 1985 in the principal amount of $2,200,000 (the "Notes");
WHEREAS the offer of First Security Bank of Utah, N.A., of Salt Lake City, Utah, and associates, for the purchase of the Notes is the highest and best offer received, which offer proposes to purchase the Notes at the price of par and accrued interest to the date of delivery, the Notes to bear interest as herinafter set out; and
WHEREAS in the opinion of the Board, it is in the best interests of the Board that such offer be accepted and the sale of the Notes to First Security Bank of Utah, N.A., of Salt Lake City, Utah, be ratified and confirmed;
NOW, THEREFORE, Be It and It Is Hereby Resolved by the Board of County Commissioners of San Juan County, Utah, as follows:
Section 1. That it is hereby found and declared after due investigation of the best negotiation possible to be made for the sale of the Notes in the principal amount of $2,200,000, First Security Bank of Utah, N.A., of Salt lake City, Utah, has agreed to submit and has submitted its offer to purchase the Notes herein authorized at par and accrued interest to the date of delivery, bearing interest at the rate hereinafter set out, that said offer to purchase the Notes is the highest, best, and most advantageous offer received and that said offer, being satisfactory to the Board is hereby accepted. The Board and the County agree to furnish all necessary documents and information required by bond counsel.
Section 2. That there shall be issued by the County the Notes in the amount of $2,200,000 for the purpose of meeting the current and necessary expenses of the County and for any other purpose for which funds of the County may be legally expended. The Notes shall be known as "Tax Anticipation Notes, Series 1985," shall be dated January 2, 1985, shall bear interest at the rate of 6.25% per annum from their date until paid, payable at maturity, shall fall due as to principal on December 31, 1985, shall be numbered from 1 to 22, inclusive, and shall be in the denomination of $100,000 each.
Both principal of and interest on the Notes shall be payable in lawful money of the United States of America at First Security Bank of Utah, N.A., in Salt Lake City, Utah. The Notes shall be signed by the Chairman of the Board, attested by the County Clerk-Auditor (the signatures of said officers being by manual or facsimile execution), and countersigned by the County Treasurer, and shall have the corporate seal, or a facsimile thereof, of the County impressed or printed thereon. The Chairman of the Board is hereby empowered and directed to sign, the County Clerk-Auditor to attest, and the County Treasurer to countersign, each of the Notes and to cause the seal, or a facsimile thereof, of the County to be impressed or printed on each of the Notes, and the acts of said Chairman, County Clerk-Auditor, and County Treasurer in so doing are and shall be the acts and deeds of the County. The use of the facsimile signatures of the Chairman and County Clerk-Auditor on the Notes is hereby authorized and approved as the authentic execution thereof. All of the covenants, statements, representations and agreements contained in the Notes and the recitals and representations contained in this resolution are hereby considered and understood, and it is hereby ordered and declared that the covenants and promises therein are the covenants and promises of the County, and that the representations and statements therein are the representations and statements of the County.
Section 3. That the Notes Shall be in substantially the following form:

That San Juan County, State of Utah, hereby acknowledges itself to be indebted, and for value received hereby promises to pay to the bearer hereof, the sum of
ONE HUNDRED THOUSAND DOLLARS --- ($100,000)
in lawful money of the Untied States of America, on the 31st day of December, 1985, at the principal corporate trust office of First Security Bank of Utah, N.A., in Salt Lake City, Utah, with interest thereon at the rate of _______percent (6.25%) per annum from date until paid, payable at maturity.
This note is one of an issue of twenty-two (22) notes of like tenor and date, numbered from one (1) to twenty-two (22) inclusive and known as "TAX ANTICIPATION NOTES, SERIES 1985" for an aggregate principal amount of Two Million Two Hundred Thousand Dollars ($2,200,000) issued under and pursuant to the Constitution applicable provisions of the Utah Municipal Bond Act, Chapter 14 of Title 11, Utah Code Annotated 1953, as amended.
It is hereby covenated, certified, recited and declared that this note is given in anticipation of the collection of taxes to be levied and other revenues for the current fiscal year, in evidence of money borrowed to meet the current and necessary expenses of the county and for any other purpose for which funds of the county may be legally expended during said current fiscal year, until payment of the taxes and other revenues for such year, that taxes within the limit provided by law and sufficient to pay principal of and interest on this note as same falls due and, together with other budgeted revenues to be received during such fiscal year, sufficient to pay all budgeted expenses of said San Juan County for such fiscal year will be levied, imposed and collected in such fiscal year on all taxable property within said San Juan County and that a sufficient fund has been appropriated for the payment of the principal of and interest on this note as the same shall fall due.
It is hereby further certified, recited and declared that the aggregate indebtedness incurred by said San Juan County for this current fiscal year, including this and other notes, is not in excess of seventy-five percent (75%) of the total of the taxes and other revenues levied and collected by San Juan County in the preceding fiscal year and is not in excess of ninety percent (90%) of the total of the taxes and other revenues to be levied and collected by said San Juan County in the current fiscal year.
It is hereby further certified, recited and declared that all acts, conditions and things essential to the validity of this note exist, have happened and have been done, and that every requirement of law affecting the issue thereof has been duly complied with, and that this note is within every debt and other limit prescribed by the Constitution and laws of said state. The full fait, credit, resources and all taxable property within the limits of said San Juan County are hereby irrevocably pledged to the levy of taxes for the fiscal year in which this note is issued and for the collection and proper allocation of such taxes and other revenues provided for such fiscal year to the prompt payment of principal of and interest on this note and the issue of which it is one, according to its terms.

Section 4. That the proceeds derived from the sale of the Notes shall be deemed allocated to the general fund of the County as needed to alleviate anticipated deficits in said fund arising from the timing of collection of taxes and other revenues of the current fiscal year and shall be used solely for the purpose of meeting the current and necessary expenses of the County and for any other purpose for which funds of the County may be legally expended, during the 1985 fiscal year, but the holders of the Notes shall be in no wise responsible for the application of the proceeds thereof by the County or any of its officers.

Section 5, That there shall be included in the annual tax levy for the year 1985 for the County a tax which, together with all other revenues of the County other than taxes, shall be sufficient to pay when due the principal of and interest on the Notes herein authorized, and the Notes are issued in anticipation of the collection of such taxes and other revenues for the 1985 fiscal year of the County.
Section 6. That there be and is hereby irrevocably appropriated from the first collection of taxes and other revenues for the current fiscal year of the County a sufficient fund to pay the principal of and interest on the Notes as the same shall fall due.
Section 7. That the offer of said First Security Bank of Utah, N.A. be, and the same is, hereby accepted; that the Chairman of the board, the County Clerk-Auditor and the County Treasurer be, and they are hereby, authorized and directed to sign, seal, execute, deliver and issue the Notes to First Security Bank of Utah, N.A., upon receipt of the purchase price therefor.
Section 8. That the County recognizes that the purchasers and holders of the Notes will have accepted them on, and paid therefor a price which reflects, the understanding that interest thereon is exempt from federal income taxation under laws in force at the time the Notes shall have been delivered. In this connection, the County agrees that it shall take no action which may render the interest on any of the Notes subject to federal income taxation. Prior to or contemporaneously with delivery of the Notes, the County Clerk-Auditor and the County Treasurer, or other appropriate officer of the County, shall execute an arbitrage certificate on behalf of the County respecting the investment of the proceeds of the Notes. Said certificate shall be a representation and certification and an executed copy thereof shall be filed at the office of the County. The County shall not knowingly invest or participate in the investment of any proceeds of the Notes if such investment would violate or make untrue any of the representations made in said arbitrage certificate.
Section 9. That all proceedings, resolutions and actions of the County and its officers, agents and representatives taken in connection with the sale and issuance of the Notes are hereby ratified, confirmed and approved.
Section 10. That resolutions and orders or parts thereof in conflict with the provisions hereof are to the extent of such conflict hereby repealed.
Section 11. That this resolution shall become effective immediately upon its adoption. APPROVED AND ADOPTED this 7th day of January, 1985.

BID OPENING FOR COURTHOUSE HEATING SYSTEM
The bid opening for the Courthouse heating system was held at 2:00 p.m. Only one bid was received. Commissioner Bailey made a motion to accept the amended bid from Monticello Plumbing and Heating in the amount of $11,859.33. The motion was seconded by Commissioner Holliday and carried unanimously.
MEETING SCHEDULED RE: COMMUNITY BLOCK GRANT FUNDS
The Commission has scheduled a meeting for January 16th, at 2:00 p.m. to receive public input regarding the use of the Community Block Grant Funds.
COUNTY ATTORNEY MEETS
Bruce K. Halliday, County Attorney, met with the Commission to present a log of his hours for the month of February, November, and December 1984, as requested by the Commission.

COMMUNICATIONS ENGINEER MEETS
Milt Rose, Communications Engineer, met with the Commission to discuss attending a seminar in Salt Lake City regarding interference on repeaters. Mr. Rose stated that this would be very helpful in
dealing with the Sheriff's Office and EMS repeator systems. The Commission authorized Mr. Rose to attend this seminar.
PHYSICIAN SHORTAGE AREA DISCUSSED
Commissioner Bailey reported that he met with Mr. Jim Crouch, from the Department of Health, on December 26th. At this meeting Mr. Crouch reported that Monticello should be designated as a
physician shortage area soon. It was also reported that the Commission met with Dr. Steven Warren who will be available as a Health Care Doctor on July 1, 1985.
DEVELOPMENT BOARD DISCUSSED
Commissioner Black reviewed a memo to Senator Hatch from the Development Board which requested his support regarding some of the following items:
1. Action to prevent wanton destruction of the County's archeological inheritance.
2. National Park, BLM, and Forest Service approval of the plan to designate the Trail of the Ancients as a national historical trail.
Commissioner Black reported that he is opposed to the designation of the Trail of the Ancients as a
national historical trail because it is under the Park Service and he feels that if anything is put
under the jurisdiction of the Park Service they will control it. The rest of the Commission agreed with this position.
