COUNTY PASSES ORDINANCES PROVIDING FOR RESERVE FUNDS FOR CAPITAL IMPROVEMENTS

Upon motion of Commissioner Marion H. Hazleton, seconded by Commissioner Bartell, and unanimously carried, the following Ordinances providing for reserve funds for capital improvements were adopted:

ORDINANCE NO. 1959-5

AN ORDINANCE PROVIDING FOR RESERVE FUND FOR CAPITAL IMPROVEMENTS, adopted pursuant to Chapter 4, Title 17, Utah Code Annotated, 1953, as amended.

The Board of County Commissioners of the County of San Juan Ordains as follows:

Sec. 1. There is hereby established a cumulative reserve fund to be accumulated by levy, for the following purpose(s):

To finance the purchasing of real property and the cost of planning, constructing and equiping a San Juan County Medical Clinic at Blanding, Utah.

Sec. 2. The governing body of this county may include in the annual budget or estimate of amounts required to meet the public expenses of such subdivision for the ensuing year such sum not to exceed an amount as forth in section 3 of this ordinance, as it may deem necessary for the uses and purposes of the fund. Such sum may be included in the annual tax levy of this county. The monies in said fund shall be allowed to accumulate from year to year until the governing body of this county shall determine to spend any money in the fund for the purpose specified. Any monies in said fund at the end of the fiscal year shall remain in-act as surplus available for future use, and shall not be transferred to any other fund or used for any other purpose, except as authorized by law.

Sec. 3. The annual amount to be accrued by levy for the purpose of this ordinance shall not exceed the quivalent of seventy-five cents ($.75) per one thousand dollars of assessed valuation. In the event that a legal overall tax limitation for San Juan County is prescribed by law, then the above prescribed schedule of limitations in this section shall be included within such overall tax limitation.

Sec. 4. At any time after the creation of this reserve fund, the governing body of this county may trans-fer to such fund any unimcumbered surplus funds remaining on hand in this county at the end of any fiscal year. In all cases when the total amount in this reserve fund and all other reserve funds created under this same statutory authority is equal to three per cent (3%) of the assessed valuation of this county, the provisions of section 2 and 3 of this ordinance shall not apply.

Sec. 5. All monies belonging to the fund created by this ordinance shall be invested in such securities as are legal for other funds of the county. The interest and income from the investments shall be a part of the fund.

Sec. 6. The governing body of this county may submit the proposition of using such reserve funds for pro-jects other than originally specified to the electors of this county at a special election, provided such projects are for the purposes set forth in section 17-4-6, Utah Code Annotated, 1953, as amended. When such proposition is proposed, the governing body of such county shall fix a time and place for special election on the proposition which shall be held as provided by law.

CORRECTION MADE IN LEASE AGREEMENT

By unanimous consent the San Juan County Commissioners executed an instrument to correct an error in the description as given on an Oil and Gas lease as executed on the 23rd day of November, 1959. The last "call" in Tract #1 as given on the lease, should have been "thence North 857.67 feet to the point of beginning", and not "thence North 867.67 feet to the point of beginning".

HOWARD HURST DISCUSSES,INSURANCE WITH COMMISSIONERS

Howard Hurst met with the Commissioners to suggest that the County let his Insurance Firm handle all insurance for the County, with various agents participating in the benefit fees. No action taken but Commissioners will consider.

ROUTINE WORK WITH ROADMEN WAS DISCUSSED

Routine work with the roadmen was discussed. Among the items discussed was the road crossing in Monte-zuma Creek which feasibility is still doubtful.

APPROVAL OF PURCHASE OF EQUIPMENT AND SUPPLIES FOR EXTENSION SERVICE

After estimating the December expenses the Extension Service will have a balance of approximately $370.00 for which they have asked to purchase supplies and equipment. Unanimous approval was given by the Board.

WORKING HOURS FOR ROADMEN CHANGED

A motion was made by Commissioner Hazleton, seconded by Commissioner Bartell, and unanimously carried, that that the number of hours work per week be changed from 45 to 40 hours per week. The hourly rate of $1.80 to remain the same for extra men hire

ENGINEER HIRED ON MONTHLY BASIS

A motion was made by Commissioner Bartell, seconded by Commissioner Hazleton, and unanimously carried t hat George H. Newell be hired on a monthly salary of $650 instead of an a per day basis, and to act as County Engineer and Purchasing Agent for the County Road Department.

ELMER JONES DESIRES TO SELL USED EQUIPMENT TO COUNTY

Elmer Jones was present to see if he could interest the County in purchasing some of his used equipment which must be disposed of in the near future. He stated that he had a 1955 HD5 Loader and a 1950 Dozer which he would sell for $5000 each. It was unanimously agreed that the shop foremen would inspect the equipment and make their recommendations to the Commissioners.

SETH WRIGHT REPORTS UNFAVORABLE OPERATION OF THE TWIN ROCKS TAVERN

Seth Wright, County Sheriff reported that conditions regarding the operation of the Twin Rocks Tavern are very unsatisfactory due to operation of women who have no control over their customers. The Commis-sioners stated that they will go along with the Sheriff's recommendations, that if the tavern owners do not comply with the agreement as signed by tavern owner, Sheriff and County Commissioners, then the Sheriff is authorized to close the tavern.

ESTABLISHMENT OF TOURIST AND INDUSTRIAL COUNCIL STRESSED

Bill Cline of Blanding, Utah, met with the Commissioners to further interest them in the establishment of a Tourist and Industrial Council for San Juan County. He stressed the benefits that the County will derive from such an organization. The Commissioners stated that they had been considering the matter and that the County Attorney was looking into the legality of such an organization. The matter will be given full consideration before adopting the final budget.

BILL CLINE REPORTS ON PROGRESS OF CLINIC BUILDING IN BLANDING

Bill Cline further stated that the Harvey Builders had submitted their first claim for payment on the construction of the Clinic Building at Blanding and that the City of Blanding would make the first payment as per their agreement, the amount to be $10,064 which is less the 10% holdback.

BEN HESS AND GEORGE BLQOMFIELD PRESENT IN BEHALF OF CHAMBER OF COMMERCE OF MONTICELLO

Ben Hess and George Bloomfield were present in behalf of the Chamber of Commerce of Monticell to request that San Juan County consider putting approaches to the South on the Big Indian road to the Charles Steen mine which will help direct traffic to cities in San Juan County instead of Grand County. They also asked that the road in the Big Indian vicinity which goes to the U. S. V. mill and Shattuck Den mine be connected with the Steen road so that traffic will be directed further into San Juan County instead of Grand County.

They were promised that the County Engineer would look over the suggested possibilities and make his re-port to the Commissioners.

REQUEST FOR WATER SURVEY TO BE MADE IN SAN JUAN COUNTY

Ben Hess requested that San Juan County do everything possible toward having a water survey conducted in the County to be followed by the establishment of a Water Conservancy District, and asked that the County consider such survey in this year's budget. He presented material to back his request.

F. Bennion Redd, County Attorney, was called in for an opinion and stated that the matter had already b een brought to his attention and he ahd done some investigation on his own. He further stated that he had written to the State for information but to date had received no answer.

No action was taken at this time, the matter to be continued until the next meeting.

COUNTY ATTORNEY ASKED TO INVESTIGATE THE DISPOSITION OF THE OLD HOSPITAL BUILDING WHEN NEW ONE IS OCCUPIED

F. Bennion Redd, County Attorney, was asked to pursue the disposition of the old hospital building when the new one is occupied. The old hospital is being used by San Juan County under agreement with the War

Assets Boardthat it be used for medical purposes for a period of 25 years after which it will become the sole property of San Juan County together with three dwellings which are now occupied by hospital

personnel. Moving into a new building presents a problem of whether the County may continue to occupy

the buildings and receive ownership at the end of the 25 year period.

ALL COUNTY OFFICIALS TO BE DELEGATES TO STATE CONVENTION

It was unanimously agreed that all County Commissioners attend the State Convention of County Officials as delegates.

INSURANCE ON OLD HOSPITAL BUILDING DISCUSSED

George Bloomfield stated that the insurance on the old hospital building is about to expire and requested that it be renewed. He was informed by the Board of County Commissioners that the Hospital Board was responsible for making such decision.

DECEMBER 14th SET FOR DISCUSSING PROGRAM OF RURAL CIVIL DEFENSE

December the 14th has been set as the day for discussing the Rural Civil Defense Program. The Clerk was directed to contact Jay Redd to be in attendance at said meeting.

TYPEWRITER APPROVED FOR COUNTY NURSE'S OFFICE

The Clerk was directed to order a Smith Corona Typewriter for the County Nurse's Office.
