MINUTES OF THE BOARD OF COUNTY COMMISSIONERS MEETING HELD AUGUST 7, 1978

Minutes were read and approved. CALVIN VAN DYKE

Blanding District Justice of the Peace, Calvin Van Dyke, met with the commissioners to discuss raising his salary based on the increase in the number of cases that he handles. The commissioners will take this under advisement. They will take into consideration the increase in cases & when his reports are filed.

CAP PROGRAM MEETINGS

Commissioner Guymon reported that he had attended meetings on the CAP Program in Durango. Commissioner Guymon wanted to know how we arrive at the amount of money spent and how much money we have left. Mr. Haskins stated that the computer print-out in the clerks office gave the amount spent and what was left.

MEXICAN HAT TRUCK RUN AWAY LANE

Commissioner Guymon stated that nothing had been done on the Mexican Hat Truck Run Away Lane. The commissioners tried to get in touch with the UDOT and Bill Davis but were unable to make a connection. They will work on this during the week.

AGING MEETING

Mr. Al Haskins reported that he had attended a series of Aging Meetings that were held in Salt Lake City.

MONTEZUMA CREEK SWIMMING POOL

The Commissioners received a letter from the Utah Association of Counties requesting that the Commissioners read the enclosed letter and make corrections on it and return it to the Association so that they could submit it for additional funds for the Swimming Pool as well as an extension of time on the completion date.

STATE FAIR BOARD

Commissioner Guymon reported that the Fair board had decided to use the same mural at the State Fair this year that was used last year. He also asked for permission to have a check made out for advance payment for $300.00 to get started on the fair booth. This permission was given.

BLUFF SPECIAL ELECTION

The commissioners received a copy of a letter to Judge Boyd Bunnell on the Special Election held in Bluff to settle a conflict on the Beer Licenses. Both proposels were defeated.

ORDINANCE ESTABLISHING TAX STABILITY AND TRUST FUND

County Attorney, Bennion Redd, presented a draft copy of an Ordinance establishing Tax Stability and Trust Fund. The Commissioners will take this under advisement and act on it next week when they have a full commission.

ABAJO PEAK COMMUNICATIONS INSPECTION

The Commissioners received a letter from the Forest Service giving the schedule for the Abajo Peak Permit inspection. The Deputy Clerk, Kristine Frost is to notify all interested parties for the county.

BLUFF TOWN ANNEXATION

The Commissioners received a letter and a petition from certain citizens of Bluff and the Bluff Town Council requesting annexation of certain persons property into the town of Bluff. The commis-sioners stated that they didnTt have the right or responsibility under law to do this. This would have to be done by the town council of Bluff. County Attorney, Bennion Redd, is to respond to this.

UTAH STATE FAIR PUBLICITY

Pearl Whittaker met with the Commissioners to discuss putting an ad in State Fair Publication. Commissioner Black stated that this must be handled through the Travel Council.

BRUCE SHUMWAY

Mr. Bruce Shumway met with the Commissioners to discuss the welfare program. Commissioner Black and Mr. Shumway will be at a meeting on welfare reform next week.

PUBLIC MEETING - RARE II

The following people were present at a public hearing held at 2:00 P.M. in the Commissioners Room on August 7, 1978: Greg Beckstrom of the SEUAOG, Clay Clemens Utah Energy Office, Stan Elmer: Natural Resources, Dale Torgeson: US Forest Service, Bryant L Christensen: US Forest Service, LaRue McDaniel: Blanding City Council, Opal Hooper, Bluff City Council, Richard Walker, SEUAOG.

Mr. Clay Clemns stated that they (the Forest Service) were there to get an Assessment

on the problems and implications on mining and grazing etc., so that the Government could

draft a repsonse to the RARE II concept.

Commissioner Black asked Dale Tor gesson if a wilderness area meant no mining unless the people who were mining had the money to fight the government and the environmentalists in Court Lawsuits. He stated that this was a fair assessment.

Commissioner Black also stated that in a Wilderness the only thing that was allowed was livestock grazing as long as no vehicles were used in maintenance and as long as no development took place. There is also a chance that if these wilderness areas are designated that they will also be designated as Class 1 air areas. This would vertually halt any mining or industry within about one hundred miles of the wilderness areas.

Commissioner Black asked Bryant Christensen: Do you under present management authority have the ability to manage an area as almost total wilderness? Mr. Christensen stated that they had control over timber harvest and soft minerals. Mr. Black asked if this wasn't almost total management control? Mr Christensen stated that it was almost total.

Commissioner Black stated that the environmentalists were trying to bring the country to its knees economically by closing down mining during a time of an energy crisis.

The following areas are in danger of being designated as wilderness areas: Arch Canyon, Hammond Canyon, and Wooden Shoe Canyon. These areas are rimmed by a mineral formation that is known to have important minerals in the formation such as gold, silver, and uranium.

Commissioner Guymon stated that this should be put to a vote by the residents who will be affected by the wilderness areas rather than people from around the nation who know nothing about the areas or the problems involved.

Commissioner Guymon also stated that the government was discriminating against the Elderly and the Handicapped by closing off these areas to all but those who had the time and the health to backpack into these areas.

Commissioner Black stated that we don't need any Congressional designated wilderness areas. The various agencies have management policies to protect the resources. This is how these areas should be governed, not locked up by legislative mandate.

MINUTES OF THE SAN JUAN COUNTY ROAD MEETING HELD AUGUST 7, 1978

TIME: 9:00 A.M.

PRESENT: Commissioners C. Black and D. Guymon, Engineer D. Pehrson, Foremen L. Lyman, B. Bradford,

A. Holden and L. Adams

Doug reported the well at red mesa would not be available for use by the by the construction crew: other sources of water were dicussed. Lynn was instructed to check with contractors in the area and see if they would be interested in Leasing equipment or contracting the pumping work from the San Juan River. Doug suggested the crusher be moved to red mesa and start crushing gravel for the C. R. Project. Doug reported he had inspected 01 Jato and Monticello Airports with the

State Aeronautical personnel. The county will be able to repair the 01 Jato airport possible this year: The state aeronautic board will bid an overlay for the monticello airport.

Bernal reported the roads in the MOnticello area were not ready for chip seal when the chipping crew showed showed up. The commissioners reviewed the authority and responsibility. Bernal was assured he had full authority over the oiling in the county. The Commissioners suggested better communications be maintained in the road dept.

Bernal suggested some work be done on Maverick Dugway. Bernal and Doug were instructed to make recommendations to the commissioners.

Teek reported Jimmy Grant had not been paid the raise he had asked for. Lynn was instructed to check on what had been paid and make the correction if this is the case.

Bernal recommended the oiling crew be paid straight time for overtime. Dave made a motion that the oiling crew be paid straight time for overtime in connection with oiling-this does not apply to employees not working on the oiling or patching crew. This to be retroactive to July 25, 1968. must be approved by foremen. Motion carried
