MINUTES OF THE BOARD OF COUNTY COMMISSIONERS' MEETING HELD AT MONTICELLO, UTAH ON JULY 6, 1959 at 10 A. M.
The Commissioners met in regular session in the Commissioners' Room of the County Court House on July 6, 1959, at 10 o'clock a. m., all Commissioners and Clerk being present.
ROUTINE WORK WITH ROADMEN CONDUCTED
Routine work was discussed with the Roadmen and the following are things that need to be done:
1. Work signs are needed in all Districts.
2. George H. Newell to survey the Swimming Pool Grounds to get a description of land to be transferred.
3. George Barry to hire movers to move old road shed to new location.
4. George Barry to tell Darrell Redd that he is to pay for a culvert and the county will install it.
MONTICELLO CITY COUNCILMEN MEET WITH BOARD
A. J. Redd and Homer Chandler met with the Board to discuss acceptance of the Swimming Pool at Monticello, They stated that the City of Monticello would accept the Swimming Pool on the following conditions:
1. The City and County must work out a date of acceptance.
2. The County must guarantee to underwrite any deficit incurred by the City in operation of the City.
In answer to the above requirements, the Board of County Commissioners agreed to cooperate as follows:
1. County and City to work out a date of acceptance.
2. County and Recreation Board to underwrite any deficit up to a sum certain.
3. County to require City to furnish an annual financial statement of Swimming Pool Operations.
4. That all revenues from the Swimming Pool to be used for operation and maintenance of the Swimming Pool.
MELVIN DALTON ASKS COUNTY TO TAKE ROAD ACROSS COAL BED CREEK IN VICINITY OF SEMADENI HOME FROM COUNTY SYSTEM
Melvin Dalton was present to ask that the County Commissioners to consider taking the road across Coal Bed Creek in the vicinity of the Semadeni home from the County Road System, to which the Commissioners refused because it has become a public road. Mr. Dalton then asked that the County furnish cattle guards at both entrances to the road across the creek, because the land was fenced prior to making the road. He was informed that since the land is under the control of the Bureau of Land Management and Mr. Dalton is a grazing permittee, it has been customary in the past for for the Bureau of Land Management and permittee to furnish the cattle guard and the County to install such cattle guards. Mr. Dalton was promised that the county would follow the same procedure in this case if the cattle guard is furnished.
WILBUR LAWS ASKS COUNTY TO FURNISH CATTLE GUARD ON LAND OWNED AND OPERATED BY THE SEVENTY'S QUORUM OF BLANDING WHICH IS SOUTH OF DEVIL CANYON ON THE EAST SIDE OF THE ROAD.
Wilbur Laws of Blanding asked that the County furnish cattle guards on a county road that runs through land owned and operated by the Seventy's Quorum of Blanding. The Quorum desire to fence the property which necessitates installing cattle guards or gates.He was informed that since the land has never been fenced, if the County installed cattle guards it would be setting a precedent for installing many more. However, after due consideration, the County approved that if the Quorum will pay for one cattle guard, the County will pay for one and install both of them.
COMMISSIONERS WALTON AND HAZLETON TO ATTEND CONVENTION IN DETROIT ON JULY 25, 26 & 27, 28 & 29
A motion was made by Commissioner Bartell, seconded by Commissioner Hazleton, and carried, that Marion Hazleton and William C. Walton be given $500 each to cover expenses to the National Convention of County Officials to be held in Detroit the latter part of the month.
SAN JUAN COUNTY QUIT CLAIMS INTEREST IN STREET IN NORTH MONTICELLO
The Commissioners of San Juan County, upon the recommendation of County Attorney, F. Bennion Redd, unan-imously agreed to quit claim any interest that the County has to the following parcel of land which is being used for a street in North Monticello:
Beginning at a point 102 rods West and 13 rods South of the East quarter corner of Section 25, Township 33 South, Range 23 East, Salt Lake Meridian, and running thence South 25 feet, thence East 214.5 feet, thence North 25 feet, thence West 214.5 feet to the point of beginning.
All Commissioners signed the Quit Claim Deed.
COOPERATIVE AGREEMENT ENTERED INTO BETWEEN BUREAU OF LAND MANAGEMENT, FISH AND WILDLIFE SERVICE AND SAN JUAN COUNTY
A cooperative agreement was entered into between San Juan County, Bureau of Land Management and Fish and Wildlife Service, San Juan County furnishing 120 man days labor at $12.00 per day or $1440.00, Fish and Wildlife Service furnishing 2000 lb. 1080 grain @ $ .10 or $200.00, and the Bureau of Land Management furnishing 7000 miles equipment operation or $7000.00, making a total program of $2340.00.
SETH WRIGHT, COUNTY SHERIFF, TO ATTEND SHERIFF'S NATIONAL CONVENTION IN MILWAUKEE
Hazleton
Commissioner/moved that the County let Seth Wright have $400.00 for expenses to attend the National Con-vention in Milwaukee, seconded by Commissioner Bartell, and unanimously carried.
DELEGATION FROM BLANDING MEET WITH COMMISSIONERS REGARDING HEALTH CENTER FOR BLANDING
The following delegation from Blanding met with the Commissioners to discuss the possibilities of having a clinic built in Blanding for the purpose of diagnostis: Dr. Fallen, Dr. Porter, Bill Cline, Marvin Ly-man, and Chan Moulton which make up the medical board of Blanding.
F. Bennion Redd, County Attorney, was called in to meet with the group.

The following estimate of such a building and equipment was submitted for the Commissioners' consideration: Clinic for diagnostic purposes, no in-patient facilities. $40,000.00 includes cost of ground Equipment for building, (estimated cost) 30,200.00 Ambulance,Etc 10,800.00 Complete cost $81,000.00
It was unanimously agreed that the San Juan County Commissioners will agree in any possible to obtain the health facilities for Blanding that have been requested.

CLOTH COPIES OF PLATS NOW IN HANDS OF THE PETROLEUM OWNERSHIP MAP COMPANY TO BE INSURED
A motion was made by Commissioner Bartell, seconded by Commissioner Hazleton, and carried, that the cloth copies of the plats of San Juan County which are now in the hands of The Petroleum Ownership Map Company be insured as per their request in a letter to F. Bennion Redd, County Attorney and dated June 30, 1959, ;in the amount of $9,000.00, the premium to be $0.244 per 100 dollars of value, the policy to cost $21.96 each year, or $59.29 for three years.

EXECUTED AGREEMENT FOR STATE ADMINISTRATION OF LOCAL SALES AND USE TAXES RECEIVED AND APPROVED
The following executed agreement for State administration of local sales and use taxes was received and unanimously approved:
AGREMENT FOR STATE ADMINISTRATION OF LOCAL SALES AND USE TAXES
To administer the provisions of Senate Bill No. 32 enacted into law by the 1959 Session of the Utah Legislature titled and known as "The Uniform Local Sales and Use Tax Law of Utah", the State Tax Commission pursuant to said act and the County of San Juan, pursuant to a sales and use tax ordinance of said County, a copy of which ordinance is attached hereto, do agree as follows:
ARTICLE 1 DEFINITIONS
Unless the content otherwise requires, whenever the following terms appear in this agreement they shall be interpreted to mean the following:
1. "Commission" shall mean the Utah State Tax Commission.
2. "County" shall mean the County above noted, through its authorized elective officers or officials who are authorized to execute binding agreements in the name of, for, and in behalf of said County.
3. "Local Taxes" shall mean the sales and use taxes, penalties and interest imposed by the County under an ordinance which complies with the "Uniform Local Sales and Use Tax Law of Utah" above noted.
4. "County Ordinance" shall mean the sales and use tax ordinance, a copy of which is attached hereto, as it may be amended from time to time.
5. "Local Tax Law" shall mean Senate Bill No. 32 enancted into law by the 1959 Session of the Utah Legis-lature and entitled "The Uniform Local Sales and Use Tax Law of Utah".
6. "Retailer" shall mean any person, partnership, corporation, public utility, joint venture or other entity from whom the tax specified in the Uniform Local Sales and Use Tax Law is collected.
ARTICLE II ADMINISTRATION AND COLLECTION
1. Administration. The Commission and County agree that the Commission shall perform exclusively all the
functions incidental to the administration and operation of the County Ordinance.
2. Applicable Laws. The Commission and the County agree that the provisions of the local tax law together
with applicable sections of Title 59, Chapter 15, and Title 59, Chapter 16, Utah Code Annotated 1953, as
amended, referred to in the local tax law, shall be applicable to the administration and operation of the
County Ordinance.
3. Disposition of Funds. Money collected pursuant to the County Ordinance may be deposited in the State Treasury to the credit of a Special Sales Tax Fund and may be drawn from that fund for the purpose of making refunds, for the purpose of compensating and reimbursing the Commission pursuant to Article IV of
this Agreement and for the purpose of transmitting to the County the amount to which the County is entitled. Such transmittals to the County shall be quarterly.
4. Rules. The Commission shall prescribe and adopt such rules and regulations as, in the judgment, are necessary or desirable for the administration and operation of the County Ordinance and distribution of the local taxes collected hereunder.
5. Preference. Unless the payor instructs otherwise and except as otherwise provided in the Agreement, the Commission shall give no preference in applying money received for sales and use taxes owned by a taxpayer, but shall apply all monies collected to the satisfaction of the claims of the State and the claims of the County as their interests appear.
6. Security. The Commission agrees that any security which it hereafter requires to be furnished under the local tax law or the general state sales and use tax laws will be upon such terms that it also will be available for the payment of the claims of the County for local taxes owing to it as its interests appear. The Commission shall not be required to change the terms of any security now held by it and the County shall not participate in any security now held by the Commission.
7. Records of the Commission. The Commission agrees to permit authorized personnel of the County to examine the records and procedures of the Commission concerning the local tax law, the County Ordinance and records of taxpayers subject thereto.
8. Change of Area. TheCounty agrees that if the area subject to the County Ordinance is increased or de-creased, the Commission shall not be required to give effect to such change for the purpose of collecting and distributing the local earlier than the first day of the calendar quarter which commences not less than one month after written notice is received by the Commission. The notice shall include a verified copy of the metes and bounds of such change.
ARTICLE III ALLOCATION OF TAX
In the event a retailer has no permanent place of business in the State or has more than one place of bus-iness, the place or places at which the retail sales are consummated for the purpose of this act shall be determined under the rules and regulations prescribed and adopted by the Commission. In the case of public utilities, the Commission shall apportion to the County revenue derived from the tax on such services of said utilities in:the County on an equitable basis pursuant to rules and regulations to be prescribed and adopted by it.
ARTICLE IV COSTS OF ADMINISTRATION
The County agrees that the Commission may withdraw from the Special Sales Tax Fund for the purpose of ad-ministering this Agreement, an amount not to exceed two and one-half percent (2 1/2%) of the tax imposed by the County Ordinance and collected by the Commission. The figure may be renegotiated in future agree-ments to reflect more accurately actual costs of collection, but in any event not to exceed two and one-half (2 l/2%) Of the tax collected.
ARTICLE V GENERAL PROVISIONS
This agreement shall be in effect for a term of one year from the effective date and shall be automatically renewed from year to year unless one of the parties gives written notice of termination at least two months prior to the end of the term. The effective date of this Agreement shall be the first day of July, October, January or April following execution of this Agreement by both parties.
