MINUTES OF THE BOARD OF COUNTY COMMISSIONERS MEETING HELD AUGUST 6, 1979.
PRESENT: Chairman E. S. Boyle, Commissioners Bill Dunow and Calvin Black, also present Marion
Hazleton, Al Haskins, and Deputy Clerk Peggy Jorgensen.
TIME: 10:00 O'clock A. M.
Minutes of the previous meeting were read and approved upon the stipulated corrections. This
being done upon a motion made by Commissioner Black and seconded by Commissioner Dunow.
PUBLIC HEALTH
Marion Hazleton of Public Health met with the Commissioners and discussed with them the tentative plan to relocate all Public Health offices to the new Social Services building in Blanding. For the time being the offices in Blanding will be renting on a month to month basis until the determination of the board. Mr. Hazleton expressed concern for confidentiality in the Public Health deaings, adequate space and adequate facilities for the services to be performed. The Commission & board feels there will be adequate space and confidentiality to move the offices to conform with what had been decided previously. JUSTICE OF THE PEACE, HAROLD MUHLESTEIN
Harold Muhlestein and Mrs. Muhlestein met with the Commissioners to report to them the case load that they are having and request of the Commission a raise in pay for this tremendous job. The Commission stated that they would not make a decision at this time, and suggested to the Muhlesteins that they keep a log of the time they spend doing their work.
M1KE'S CANYON ACCESS
Commissioner Black requested permission to follow through with the BLM and Plateau Mining Co. in obtaining vehicular access through the wash at the base of Mike's Canyon. He will work with the State and others to see if permission can be available as the law provides.
TRAVEL COUNCIL
Brother Juniper and B. J. Rhoades met with the Commission and requested of them the appointment
of Ms. Jean Johnson to the Travel Council and the split term appointment of Eugene Foushee and
John Burden. Commissioner Black made the motion that this be done with Commissioner Dunow seconding
to carry the motion. The gentlemen also requested that the Travel Council's acting director be
given a raise in proportion to the raises given to County Employees. She will be given the same
raise consideration at $605.14 per month, this being done by a motion made by Commissioner Dunow
and seconded by Commissioner Black to carry the motion.
(In regard to the appointments to the Council the secretary will send letters immediately.)
RUBY BRONSON:
Ruby Bronson met with the Commission to discuss with them the booth for the State Fair. She asked for permission to use the extra Senior Citizens bus to take up the booth with Dave Guymon driving. She is to get with Al Haskins on this. She also requested that there be a queen contest when the 4-H fair is held so that San Juan County can be represented at the fair. The Commission stated that it was too late for that now. Mrs. Bronson received the unanimous decision of the Commission to do the County Fair, and pagent next year, and they suggested to her that she be working on her budget with Al so that appropriate funding can be obtainded for next year.
JOHN BAKER:
John Baker met with the Commissioners and discussed with them various matters.
COMMISSIONER BLACK REPORTS;
Commissioner Black reported that he had met with the Utah Association of Governments Roads Steer-ing Committee, and that they had discussed funding for local roads and constructions of new ones. He stated that they are attempting get funding for the B & C Road fund from increasing the fee for registering vehicles $5.00. He also stated that the Revenue and Taxation Sub-Committee is working on a proposal to eliminate Property tax as a funding source for the Uniform School Fund. This will shift revenue to other sources and increase corporate franchise tax for industry and their income tax, it will also tax non-renewable resources to make up the needed amounts.
He also reported on the State Wilderness Committee meeting wherein they reviewed Wilderness and the Committee will make its recommendations on the 13th of August on the Glen Canyon Recreation area. The committee will plan and recommend and their staff compose the presentation. Thursday he will be attending a meeting to present these recommendations.
COMMISSIONER DUNOW REPORTS;
Commissioner Dunow reported that he had received a complaint from a County Employee who had been fired and that the Employee wants a hearing. The Commission will arrange for the Supervisor and the employee to meet with the Commission at an early date.
He also repprted that he Senior Cirtzens do not want the proposed building after careful in-spection by all of the members of the Monticello Swnior Citizens. They feel that it is not feesable for the cose. They also requested that the equipment they have be used for other centers and that they be given credit until such time as they have a Center of their own.

Commissioner Dunow also stated that he had inspected the roads at Spanish Valley and that he will go to Blanding this week.
RE-ROOFING OF COURTHOUSE:
Commissioner Boyle reported that he had received one proposal for re-roofing the Courthouse. This was received from W. W. Roofing of Cortez, Colorado, for $18,900.00. Commissioner Dunow made the motion that this proposal be accepted with Commissioner Black seconding the motion approving of the acceptance of this proposal by the County and Commissioner Boyle to go ahead.
JIM WHEAR:
Jim Whear of Four Corners Mental Health met with the Commission to report on the Mental Health Center and how San Juan's Contract is progressing, He reported on the activities and the number of people contacted by the Centers. Many questions were answered and discussed.
BOB FELLMETH;
Bob Fellmeth met with the Commission to ask questions and discuss In Lieu Taxes.
FARM BUREAU ON WILDERNESS:
Ty Lewis and Joe Barton of the Farm Bureau met with the Commission to discuss the Wilderness Situation. They have offered to help the Commission educate the people on Wilderness and fight the next phase of Wilderness Designation.
CURTIS PEHRSON;
Curtis Pehrson met with the Commission to discuss the job descriptions of County Employees.
He will be sending out a questionaire to all County employees for this study. He also reported
on the events following the County Commission meeting in Grand County.
BRUCE SHUMWAY:
Bruce Shumway met with the Commissioners and reported to them the progress of the Bluff Building. He stated that the Citizens of Bluff would like to opportunity to participate in the management and that they want to form an advisory board and serve in that capacity. This board would be made up of aging, young, Navajos and Utes. It will be taken under advisement.
LYNN LEE:
Lynn Lee reported to the Commission on the Nursing Program that the San Juan Center for Higher Education offers and that they had need of sending a letter to the Four Corners Commission for monitory support for the program. Commissioner Black made the motion that the Chairman write a a letter on this seeking aid, Commissioner Dunow seconded the motion for a unanimous decision by the Commission.
J&S CONSTRUCTION:
Mr. Snow of J&S Construction of Moab met with the Commission to present Release of Lien notices and to ask the Commission to approve a draw for $10,000,00. After discussion Commissioner Black made the motion that this amount be approved, Commissioner Dunow seconded the motion to carry it. He also inquired about some building that he may be doing in the future and the Commission referred him to the County Clerk's office for a Building Permit.
COMMISSIONER BOYLE:
Commissioner Boyle reported on a letter he had received from the Department of Transportation regarding the Pedestrian Safety Program. It stated that sidewalks will be placed along High-way 666 East at the light to 6th East, and in Blanding on State Road 163 from 4th South to 5th South and 1st. East to 2nd East.
He also reported on a letter he had received from Gary Tomsic regarding Radioactive wastes.
He attended meetings Tuesday night in Bluff and discussed with the group grant proceedures that they may attain.
The Commission also discussed the Medical facilities in Blanding. The Commission is awaiting recommendations to aid health facilities.
AL HASKINS:
Al presented to the Commission a check for 7,415.00 from Social Services for Low Income Housing. He also discussed with the Commission the amount Outdoor recreation will supply for the swimming-pool at Montezuma Creek ( }, the engineers fee of $165,325, and the cost of solar heating for the pool.
He also stated that he had spoken with Leon PoVey regarding the establishment of an area agency of Aging on the Navajo reservation. They will have $9,000.00 of Federal funding to start with and Al stated that an Area Plan for San Juan County will have to be submitted by Sept. 4, 1979. He reported on the C.A.P. on the Reservation. The Commission stated that if the Navajo's take over the Aging program the County will be glad to abide by its wishes, but if they wish the County will be glad to continue with the services as now, but only if the County runs the program alone. The Commission will write a letter expressing its feelings on this.
COUNTY ATTORNEY:
The County met with the Commission to discuss insufficient fund checks the County received on equipment at the County sale.

REPRESENTATION OF INDIGENTS:
The Commission was presented a Contract for the representation of Indigents by the San Juan County Attorney, for the employment of Eric Swenson as Counsel for Indigents. Commissioner Dunow made the motion that the Commission sign the agreement with Eric Swenson, Commissioner Black seconded the motion, giving the Chairman authorization to sign the instrument. This Resolution will be in the minutes of this meeting and in the Resolution book of the County.
AGREEMENT FOR REPRESENTATION OF INDIGENTS______
This agreement made and entered into by and between San Juan County, Utah, a body, corporate and politic, hereinafter referred to as COUNTY, and Eric Swenson, of Bluff, San Juan County, State of Utah, an Attorney, licensed to practice law in the State of Utah, hereinafter referred to as ATTORNEY.
WHEREAS, COUNTY has the obligation to provide representation of indigents pursuant to the laws of the State of Utah, and of the United States, and
WHEREAS, COUNTY believes that it can best and most effectively and efficiently provide those services by contracting for those services with one attorney, at the same time allowing flexibility,
A. For the appointment of other Counsel in the event of a conflict of interest, or other appropriate situations, pursuant to the existing ordinances of San Juan County, and
B. To provide for additional fees and expenses between the parties hereto in the event of cases requiring the expenditure of unforseeable time and effort beyond that normally required or anticipated.
NOW THEREFORE, it is mutually agreed as follows:
COUNTY shall pay to ATTORNEY for his services in representing indigents appointed by the following Courts within San Juan County, to wit: Justice of the Peace Court for San Juan County Precinct, Circuit Court in and for San Juan County, and Fifth District Juvenile Court, Seventh Judicial District Court in and for San Juan County, the sum of Five Hundred Dollars, ($500.) per month.
ATTORNEY shall be an independant contractor and not an employee of San Juan County, State of Utah, and the foregoing amount shall be his only compensation, except in Capital Cases and other difficult cases requiring more time, effort, and expense than normally is anticipated. However, arrangements for additional compensation in these cases shall be made prior to providing said services, or incurring said costs or expenses.
ATTORNEY shall notify COUNTY of the exsistance of a Capital and/or Difficult case and advise COUNTY of the terms of compensation for fees and expenses desired through COUNTY'S duly elected Commissioners at their regularly scheduled meetings.
ATTORNEY shall have sole control ober the method of providing the legal services for the person for whom he is appointed to act as counsel, subject to the ethical and legal obligations of attorney's profession and shall be independant and under no control of San Juan County and/or its elected officials, or employees.
This agreement shall go into effect on the 1st day of Aufust, 1979, and shall be for the term of one (1) year provided, however, that this agreement may be terminated by either party with or without cause opon said party giving to the other party written notice of term-ination 30 days prior to the date of said termination.

INSURANCE FOR CUSTODIAN;
Commissioner Boyle brought to the attention of the Commission the desire of Dell Hunter, Courthouse Custodian, to be put on the County Group Insurance. The cost of this is $88.04 per month, which could be deducted from his contract. The secretary will check into the
possibility of this arrangement with Mr. Albert Price, representative of Blue Cross/ Blue Shield of Utah. She will report on this to the Commission at their next meeting.
There being no further business for this day the meeting was adjourned. The Commission will meet again at 9:30 A. M. August 13, 1979 for an employee, hearing, their regular meeting to follow.

ROAD MEETING
TIME: 9:00 A.M.

& L. ADAMS.
MINUTES WERE READ AND APPROVED.
TEEK REPORTED HE WOULD BE THROUGH WITH THE GRADE & DRAIN ON THE RED MESA PROJECT IN APPROXIMATELY TWO WEEKS.
TEEK REPORTED A CRUSHER WOULD BE IN THE AREA IN THE NEAR FURTURE, AND WOULD POSSIBLE BE INTERESTED IN CRUSHING GRAVEL FOR THE COUNTY, THE COMMISSIONERS SUGGESTED DOUG, TEEK, AND BERNAL FOLLOW UP ON THIS.
TEEK REPORTED THE D-8 CAT WAS IN NEED OF MAJOR REPAIRS. TEEK RECOMMENDED WE PURCHASE A NEW DOZER. LYNN WAS INSTRUCTED TO MAKE A REPORT ON THE REPAIRS NEEDED AND THE COST OF A NEW MACHINE,
BERNAL REPORTED RON HARVEY HAD GIVEN TWO WEEKS NOTICE. BERNAL RECOMMEN-DED G. SICKLER BE CHANGED TO MECHANIC AS A 28-1. THIS WAS APPROVED BY THE COMMISSIONERS.
ACE RECOMMENDED D. MC INNES BE GIVEN A 90 DAY PROBATION RAISE. THIS WAS APPROVED BY THE COMMISSIONERS.
ACE SUGGESTED DOUG DESIGN A CROSSING AT VERDURE. THE COMMISSIONERS SUGGESTED DOUG GET MORE INFORMATION.
DOUG PREATOR HAD SENT A BILL FOR $2,600.00 FOR SURVEYING A SIDEWALK AT WHITEHORSE HIGH SCHOOL. HE RECOMMENDED WE DELAY PAYMENT ON THIS BILL UNTIL THEY HAVE COMPLETED MORE WORK ON THIS PROJECT.
DOUG PRESENTED AN ESTIMATE FOR SLURRY SEAL ON THE MONTICELLO AIRPORT FOR APPROXIMATELY $96,000.00 THE COMMISSIONERS RECOMMENDED WE DELAY THIS PROJECT AND PROCEED WITH CRACK FILLING FOR THIS YEAR.
DOUG WAS INSTRUCTED TO SEND COUNTY SPECIFICATIONS FOR NEW ROAD TO RICHARD PERKINS.
