MINUTES OF THE BOARD OF COUNTY CQMMISSTONER' REGULAR MEETING HELD AT MONTICELLO, UTAH ON OCTOBER 5, 1959
The Board of County Commissioners of San Juan County, State of Utah met in regular session October 5,1959 at 10 A. M. with all commissioners and deputy clerk present, with Commissioner Walton presiding.
DATE SET FOR PHYSICAL CHECK-UP FOR ROAD EMPLOYEES
The physical examination date of San Juan County road employees from Monticello and East Districts was set for October 8th, 1959, with Employees of Blanding District to follow up on October 9th, 1959, Examina-tions to be made by Dr. Carroll D. Goon, at his office.
REPRESESENTATIVE FROM STATE TAX COMMISSION AT MEETING
Gordon Madsen, a representative from State Tax Commission, met in session with commissioners and offered information on uncollected taxes. The present status shows a tax roll that hasn't been cleared, and his suggestion would be to reduce uncollected tax roll to judgment, thus clearing Assessor and treasurer. In-stituting such judgment warrants is the duty of the County Attorney. F. Bennion Redd, county attorney, was consulted and he said that he was aware of the problem and that some action is being taken, and that negotiations with several companies are in progress now.
BID ON AMBULANCE BY SAN JUAN COUNTY
A bid in the amount of $1017.19 was made by San Juan County Commissioners in their meeting October 5th, for a(1948) Ambulance. It was necessary to enclose a certified check of the full amount of the bid or 10%, and forward along with bid to General Services Administration-Region 8, Denver 25, Colorado. SOIL CONSERVATION SERVICE TO BE INCLUDED IN I960 BUDGET
Alfred Frost met with commissioners in behalf of Soil Conservation Service, requesting aid from the County, Commissioners report that no aid can be given this year, but that $300.00 per year will be put in the 1960 budget, to be listed under Agricultural Aid Fund.
NURSE APPOINTED BY COMMISSIONERS
Vera Hazleton was appointed as County Health Nurse and Supervisor in San Juan County. A motion was made by Commissioner Bartell that Vera Hazleton be accepted as county Health nurse and supervisor in San Juan County and that her salary be set at $4500.00 per year beginning November 1, 1959, motion seconded by Commissioner Walton.
QUIT CLAIM DEED SIGNED BY BOARD
Upon resolution, the following Quit Claim Deed was signed by the Commissioners:

SAN JUAN COUNTY, a body politic, existing under and by virtue of the laws of the State of Utah, GRANTOR, hereby Quit Claim to KEITH WALLACE BLACK and MARTHA COLLEEN H. BLACK, husband and wife, as joint tenants, and not as tenants in common, with right of survivorship, of Blanding, San Juan County, State of Utah, GRANTEES, for the sum of One Dollar and other good and valuable consideration, the following described land situated in San Juan County, State of Utah, to-wit:

CONTRACT AGREEMENT FOR PUBLIC HEALTH SERVICE EXECUTED
The executed contract agreement between the San Juan County Commissioners and the Utah State Department of Health for public health services in said county covering the period from July 1, 1959 to and inclusive of June 30, I960, has been received and is as follows:
CONTRACT AGREEMENT
THIS AGREEMENT, made and entered into on the date indicated below, and covering the period of July 1, 1959, to and inclusive of June 30, 1950, by and between the Utah State Department of Health hereinafter called the Department and San Juan County hereinafter called the County.
WHEREAS, the Department is charged by statute with the responsibility of providing certain public health services to the citizens of the State of Utah, and
WHEREAS, the County also is charged by statute with the responsibility of providing public health services to its citizens, and
WHEREAS, it is mutually advantageous to both contracting parties for the Department to contract with the County to provide these public health services, and
WHEREAS, for providing these public health services the Department agrees to pay to the County either
a. $ 3,120.00 as determined by a population formula provided this amount shall not exceed 40% of the total cost of public health services; or
b. $ ___________ as determined by the amount programmed in fiscal year 1959 provided this amount
shall not exceed 4O% of the total cost of the public health services; or
c. $ ___________ provided the County (City) shall first appropriate
$__________ which amount shall provide $1.00 per capita as based on the population of the
County (City) as determined by the report of the Utah Committee on Population Estimation dated January 1, 1958,
(NOTE: Please indicate choice of a., b., or c., above.) NOW, THEREFORE, 1. The County certifies and agrees:
a. that the County Health Department is the only public health authority in the County; that the Board of County Commissioners is the legally responsible board of Officials for the public health program; that Carroll D. Goon, M.D., who is licensed to practice medicine and surgery in the State of Utah has been employed as the Director of the County public health department, and that said county Health Department's authority on January 1, 1958, extended over100_ per cent of the population of said County.
b. that the legally responsible board of ifficials shall meet at least once each three months and that a complete copy of the proceedings of each meeting held shall be sent as soon as
possible to the Director of the State Department of Health, and
c. that the following qualified personnel shall administer and staff the County Health Depart-ment :

f. that the administrative officers and staff shall acquaint themselves with and carry out the Health Laws of the State of Utah and the rules and regulations of the Utah State Department of Health, and such other regulations of their own making as are not in conflict herewith, and
g. to allow the Director of the Department or his delegated representatives to make such audits and inspections as are deemed necessary for assurance of compliance with the terms of this contract, and
h. to provide to the Department such other reports as shall from time to time be requested by the Director, and
i. that a completely itemized and notarized statement shall be submitted to the Department at reg-
ular intervals of not more than three months for all public health services in the immediately preceding like interval. It is mutually understood that failure to render said bill may be
considered just and sufficient cause for forfeiture of said amount of money by the County.
2. The Department agrees:
a. that on receipt of a completely itemized and notarized statement to pay to the County said monies as are detailed in this contract, and
b. to provide consultation services to the County upon the request of the Director of the County Health Department, and
c. to evaluate the public health program of the County in comparison to public health services
in the State of Utah and to apprise the County of this evaluation.
d. to make available to the County such other programs of a public health nature as may be pro- vided by the Department.
IT IS FURTHER UNDERSTOOD AND AGREED that the funds provided herein shall be expended only for services in connection with programs established under the terms of this agreement, and
That this contract agreement may be modified or changed at any time during its effective dates by
mutual agreement of both parties.

COUNTY CLERK IS GRANTED PERMISSION TO ISSUE LICENSE
The county clerk was given permission by county commissioners to issue a license to Ralph and Nada Hunt
to conduct a business whereby privately owned liquor may be consumed on the premises.
The license fee was set at $50.00, which is a minimum fee, and subject to adjust-
ment if needed at termination period. Mr. & Mrs. Hunt were also asked to furnish a bond in compliance with
ORDINANCE -1959- 4-- LIQUOR, prior to issuance of license.
A motion was made by Commissioner Hazleton that regulations and provisions as provided by the Sheriff's office and agreed to by Seth F. Wright, sheriff; Ralph Hunt and San Juan County Commissioners, in connection

with Ordinance No. -1959- 4-"Liquor-", be accepted, motion seconded by Commissioner Bartell and carried.
ORDINANCE NO. - 1959- k
LIQUOR
Sec. 1. It shall be unlawful for any "place of business" as herein defined knowingly to permit or
allow customers, guests or any other person to possess liquor upon which the seal has been broken, or to
comsume "liquor", as defined in this Title, at said place of business without first obtaining a license
under this Chapter. It shall be unlawful for any person to consume "liquor" in an unlicensed place of business, as provided herein.
Sec. 2. "Place of business" as used in this chapter shall be deemed to include cafes, restaurants, public dining rooms, cafeterias, taverns, cabarets, and any other place where the general public is invited or admitted for business purposes. Multiple dining facilities located in one building and owned or leased and operated by one license applicant shall be deemed to be only one "place of business" as herein defined. Premises owned or leased and operated by non-profit corporations bonded, regulated, and operated in com- pliance with the provisions of Title 16, Chapter 6, Utah Code Annotated 1953, are not "places of business" and shall be exempt from this chapter. Occupied hotel and motel rooms are not open to the public and shall be exempt from this chapter.
Sec. 3. It shall be unlawful for any person to store any "liquor" in or on places of business licensed by this chapter. It shall be unlawful for any licensee, or any operator or employee of a licensee, to hold store, or possess "liquor" on premises licensed by this chapter. Persons other than the licensee, or other than the operator or employee or the licensee, may, with the consent of the owner, operator, or employee of either, possess and comsume "liquor" on the 1 icensed premises.
Sec. 4. Each Application for an annual license provided for by this chapter, for which the fee shall be $50.00., shall be accompanied by a chashiers check in the amount of $50.00, which annual fee shall be deposited in the County Treasury if the license is granted, and returned to the applicant if denied. Application for this annual license shall be upon a form furnished by the County, signed under o ath by the applicant, and addressed to the County commission. The form shall require information showing applicants age, citizenship, moral character and reputation, and conviction of a felony or misdemeanor involving moral turpitued, if any. If applicant be a pertnership or association or a corporation the same information shall be obtained with respect to each partner, or association member or corporated director or corporate officer Each licensee must be over the age of twenty-one years, of good moral character and a citizen of the United States. No license shall be granted to any applicant who has been convicted of a felony or mis- demeanor involving moral turpitued. If applicant be a partnership, association or corporations, each part-ner, association member, or corporate director or corporate officer shall meet all of the foregoing quali-fications.
Sec. 5* The Sheriff's Office shall exajnine all applications and investigate all applicants for licenses under this chapter. Following such examination and investigation the recommendations of the Sheriff's Office shall be made on writing to the county commission, who shall be the licensing authority. The Sheriff's Office shall be permitted to have access to all premises licensed or applying for licenses under this chapter,under this chapter, and shall make periodic inspections of £aid premises and report its findings to the county commission. Any license issued pursuant to this chapter may, after a hearing, be suspended or revoked for the violation on the licensed premises of any provision of this or any other applicable ordinance or law relating to the possession, comsumption, storage or sale of "liquor", or if it be determined that the 1 icensee is no longer a fit person to hold said license under the standards herein set forth. The county commission shall hear and determine all suspension and revocation matters.
If at any time a 1 icense under the provisions of this chapter is denied, suspended, or revoked, it shall thereafter be unlarful for any person to possess or consume "liquor" on the premises described in said application or license until the old license is reinstated or a new one is issued by the county comm- ission.
Each license issued pursuant to this chapter shall be displayed at all times on the licensed premises in a place readily visible to the public.
Sec. 6. It shall be illegal to possess or consume liquor on premises licensed hereunder on Sundays and between the hours of 12:00 midnight and 8:00 O'clock A. M. of any other day. It shall be illegal for any licensee, or operator or employee of a licensee hereunder, to permit any customer, guest, or any other person to possess or consume "liquor" on the licensed premises on Sundays and between the hours of 12:00 midnight and 8:00 o'clock A. M. of any other day.
Sec. 7. Premises licensed pursuant to this chapter shall maintain throughout said licensed premises and during business hours a minimum of one candle power light measured at a level 5 feet above the floor.
Sec. 8. Any person convicted of violating any provision of this chapter shall be punished by a fine in any sum not exceeding $299.00 or by imprisonment in the county jail for a period not longer than six months or by both such fine and imprisonment.
Sec. 9. Applicant shall furnish a bond acceptable to the Board of County Commissioners in the sum of $1000.00, assuring compliance with the provisions of this ordinance and said bond shall remain on force and effect during such time as applicant is a licensee hereunder and shall be forfeited to San Juan County upon violation of any provision of this ordinance and after a hearing before said Commission at which hearing licensee shall be given the opportunity to show cause why such bond should not so be forfeited.
Sec. 10. When a license is ussued hereunder, licensee shall be required to sign an agreement in the following form, to wit:
NO pin ball machines allowed.
NO Liquor allowed on premises after midnight, or before 8 A. M.
NO minors allowed, (under 21)
NO gambling allowed.
NO beer or liquor to be allowed in area in which dancing is permitted.
NO beer to be served after midnight.
Premises to be closed and no patrons allowed on premises at a reasonable time after mignight. (15 minutes)
If and when beer or cabaret or special liquor permit is violated by anyone becoming unreasonably in-
toxicated, this will be grounds for revoking any or all permits.

The proprietor will be responsible for the conduct of any patrons who might involve the morals or conduct of other patrons.
Neither the proprietor nor any members of his family, or any employees are allowed to have liquor on the premises.
