SAN JUAN COUNTY COMMISSION MINUTES JULY 5, 1988
The regular meeting of the San Juan County Commission commenced at 10:00 A.M. at the San Juan County Courthouse, Monticello, Utah.

A motion to approve the minutes of June 27, 1988 as corrected was made by Commissioner Mark Maryboy and seconded by Commissioner Bailey. UNANIMOUS.
COMMISSIONER MARK MARYBOY'S REPORT
Recreation Complaints - Commissioner Maryboy asked that Recreation Director Edward Allred meet with some Monticello residents at 3:00 p.m. this afternoon regarding some complaints with the recreation program. UNDC Van - UNDC will loan out a van for recreation purposes if the County will pay for the gas. Recreation Director Edward Allred will need to contact Worthy Glover when the van is needed. Bluff Mosquito Problem - Commissioner Maryboy asked about the possibility of hiring Roy Pehrson part time to administer the mosquito fogger in Bluff. The residents had said they would volunteer to run the fogger if the County would purchase one. The County made the purchase but now the residents would like a part-time person hired to run the fogger. The Commission felt that the residents should be willing to finish out this season on a volunteer basis and then make a request for part-time help when the budget is set for next year.
State Road Department - Commissioner Maryboy would like to have better cooperation from the State Road Department on road problems on state highways. The Commission suggested that Mr. Maryboy contact the district supervisor Dyke LeFevre to get the problem rectified.
COMMISSIONER CALVIN BLACK'S REPORT
State Tax Commission Meeting - Commissioner Black and County Assessor Barbara Montella attended a meeting with the State Tax Commission last week in Green River. Mr. Black reported that the meeting was very informative on equalization and what responsibility the County Commission has regarding property taxes, etc.
Millard County RMP - Commissioner Black reported that in areas of scenic value and research natural value has not had visual restrictions placed on them in the Millard County BLM Management Plan. Public Safety Building - Numerous letters and heresay type reports have been received regarding improper building procedures at the new public safety building. Commissioner Bailey reported that the problems have been corrected and he feels this superintendent is more conscientious than the previous one. The sub-contractors seem to have been the source of the majority of the problems. County Attorney Craig Halls sent the contractor a letter stating that the County will not accept the sub-contractors guarantees and that the General Contractor is responsible for all work completed on the project.
State BLM Meeting - Commissioner Black will be meeting with State BLM Director Jim Parker to review issues pertinent to San Juan County.
National BLM Advisory Council Meeting - Commissioner Black will be attending a National BLM Advisory Council Meeting in Elko prior to the next Commission meeting on July 18th.
COMMISSIONER KENNETH BAILEY'S REPORT
Guymon Lane Road - Ken Brown met with the Road Department meeting to discuss the extension of the Guymon
Lane Road. The County is currently upgrading that road.
Monticello Golf Course - There are problems concerning the cart trail fees at the Monticello Golf Course.
Commissioner Bailey felt that if there were proper signs posted the problem would be alleviate.
Administrative Assistant Rick Bailey was asked to obtain information from other golf courses as to the
fees that are charged and the issue will be discussed with Monticello Golf Course Manager Grant Leavitt
and Recreation Director Edward Allred on July 18th.
Channel Four Television - Complaints have been received because Channel 4 is down. Communications
Engineer Bill Bayles reported that the unit is out and he is waiting for a new unit before transmission
can be restored.
Montezuma Creek Police Station - John Peterson of the Dana Larson Roubal and Associates firm will be
willing to help draw up some specs on the Montezuma Creek Police Station to "assist with the remodeling of
the building. Administrative Assistant Rick Bailey was asked to accompany Mr. Peterson to the site during
the week to determine the placement of the gas, water, sewer, and electric utilities. Commissioner Bailey
was authorized to proceed with the project.
Road Department Acting Foreman - Commissioner Bailey has contacted George Barry regarding the position of
acting foreman for the Road Department beginning July llth for six weeks to two months. A salary range
needs to be determined for both Mr. Barry and the road foreman's position that is currently being
advertised. A motion to approve the hiring of George Barry as acting foreman was made by Commissioner
Bailey and seconded by Commissioner Maryboy. UNANIMOUS.
Oljato Road Archaeological Clearance - Commissioner Bailey stated that he would contact Walter Atene and
asked that Commissioner Maryboy contact Bill Todachennie and Robert Billy to see what help can be obtained
in getting Tribal approval on the Oljato Road Archaeological clearance. There is a possibility that the
funding will be used for other projects if the clearance is not obtained as soon as possible.
Wheel Loaders - Conmissioner Bailey asked Administrative Assistant Rick Bailey to check with the surplus
to see if there are any wheel loaders available.
Patching Crew Employees - The following persons were presented for six-month employment by the road
department patching crew: Marvin Lopez, Jason Shumway and Gerald Harvey. They will be hired at Grade 5
Step 1, $6.02 per hour. A motion to approve the request was made by Commissioner Bailey and seconded by
Commissioner Maryboy. UNANIMOUS.
State Hospital Association Meeting - Commissioner Bailey reported on the meeting he attended with the
State Hospital Association personnel. They discussed the unique problems connected with the rural
hospitals taking patients out of the state for medical services. Mr. Bailey and Hospital Administrator
John Fellmeth felt that legislative consideration ought to be given to providing contracts with out-of-
state providers compatible with in-state hospitals.
ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT
Emergency Operations Plan - Every four or five years the State evaluates and updates the emergency operations plan which gives the information of what to do in case of an emergency in which people would need to be relocated. The title sheets of the procedure books to be distributed to the various organizations need to be signed by the Commissioners. In the event of a real emergency the Commission has the authorization to declare an emergency and set up an emergency operations center. A motion to approve the Emergency Operations Plan was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.
CURRENT BUSINESS
Utah Power and Light - Mike Hayes from Utah Power and Light presented a proposal from Utah Power and Light Company to purchase the power line which San Juan County currently owns from Montezuma Creek to the television translator station. The line originally cost $2,312.61 to build and the calculated depreciation is $1,323.55, leaving the current value at $989.06. Utah Power and Light would continue to supply power to the translator station but the sale would relieve the County of further responsibility fo maintenance. A motion to accept the proposal from Utah Power and Light Company was made by Commissione Bailey and seconded by Commissioner Maryboy.
Guymon Lane Power Poles - An agreement was also made with Utah Power and Light for $823.00 to relocate two power poles on the Guymon Lane road. A motion to approve the agreement was made by Commissioner Bailey and Seconded by Commissioner Maryboy. UNANIMOUS.
Halls Crossing Airport - Keith Kohler of Armstrong Consultants met with the Commission to discuss the Halls Crossing Airport preapplication that needs to be filed with the FAA for that project. Mr. Kohler indicated that Armstrong Consultants would be willing to put the preapplication together. In talking Nance Early and Barbara Johnson, the Environmental Impact Statement will be completed in approximately year. A designer will need to be selected approximately a month prior to the completion of the EIS. motion to approve Armstrong Consultants going ahead with the preapplication was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.
Sheriff Claude Lacy - Sheriff Lacy reported that a Supreme Court decision stated that cities could be charged for holding prisoners in County jails. San Juan County has been billing $4 a night but the cities have not been paying the billing. Mr. Lacy will send the cities a copy of the Supreme Court decision and continue to bill the cities. A new fee schedule will be considered when the new public safety building is ready for occupancy.
Liquor Confiscation - An article in the newspaper indicated that Navajo Police are confiscating liquor out of the KOA Campground in Monument Valley. As the Campground is private property it would be illegal to confiscate it in the campground proper. Rumor has also indicated that liquor is being confiscated on the road to the Paiute Farms Marina. Commissioner Black stated he felt the Marina would not be successful unless a good manager was hired and allow him to run it as it needs to be and the sale of alcohol allowed. Until people are allowed to have the things they have a legal right to have tourism will not prosper in the area. Sheriff Lacy will check with the Navajo Police to see if the reports are accurate.
Commissioner Black felt that when county law officers make contact with the public they could make visitors welcome to the area and provide information and brochures to County attractions and provide good public relations for the County. If the contact is made for speeding, just remind than they were speeding and if they would slow down they would be able to see more of our county and state.
Extension Service Request - A bid for a stainless steel sink cabinet and a 30 gallon water heater was received from Whipple Plumbing for $885.00 and from E.A. Black Plumbing and Heating for $978.50. A motion to approve the bid from Whipple Plumbing for $885.00 was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.
Monticello Golf Course Request - A motion to approve the bid from Young Builders for cement work at the Monticello Golf Course for $1,350.00 was made by Commissioner Bailey and seconded by Commissioner Maryboy UNANIMOUS.
Recreation Employees - Commissioner Black signed the request for a payroll change for Heidi Slavens for $4.54, Mike Halls for $4.16 and Heidi Worth for $4.16.
LaSal Road - Paul Redd - Paul Redd met with the Commission to discuss putting gravel on the LaSal Mountain road. Mr. Redd indicated that the Forest Service has several timber sales just over the Colorado border and by improving that road it would make it feasible for the companies to bring the logs into San Juan County rather than into Paradox. An agreement with Fred Stocks of Southern Paving provides for gravel being put on several bad sections of the road this year. Mr. Redd indicated that he had told Mr. Stocks he would give the County $30,000 worth of gravel if he can specify where it is to be put. The Commission was not aware of this offer. However Mr. Redd would like to sell the property were the gravel is located and may not be able to make the offer over a long period of time. If a three-year program to gravel the complete road could be agreed upon, Mr. Redd would give the gravel to the County. Mr. Stocks would crush all the gravel while he is crushing the gravel he needs. Mr. Redd would like to have the road to Buckeye Reservoir graveled as there are many people that use that road. There are also at least three places that need larger rock placed to stop erosion of the road. Mr. Redd's proposal would be for free gravel where the road crosses his property but any other gravel used would have to be paid for at a rate of $1 per yard for the first 10,000 yards, 50 cents for the next 20,000 yards and all other at 25 cents a yards All of the yardage crushed and bought by Southern Paving that's used on the road will be used to determine the price. County Engineer Doug Pehrson will be asked to go over the project and estimate the amount gravel needed.
Alcohol and Drug Request - The Social Service has some Alcohol and Drug money that can be used to purchase training equipment to conduct the classes. They received identical bids from Southeast Utah Computers and Alpine Computers for $5,577 for a Laser writer, LocalTalk Locking Con Kit-din 8, LocalTalk Locking Con Kit-D89, Apple Hard Disk 80sc and a Laser writer II legal cassette. A motion to approve the bid from Southeast Utah Computers because of local service was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.
Executive Session - Commissioner Maryboy made a motion to go into executive session to discuss hospital personnel matters. Commissioner Bailey seconded the motion. UNANIMOUS.
