SAN JUAN COUNTY COMMISSION MINUTES JANUARY 5, 1987

The San Juan County Commission met in regular session on January 5, 1987 at the hour of 9 a.m. at the San Juan County Courthouse, Monticello, Utah.

The following members were present: Commissioner Black, Chairman

Minutes of the December 22, 1986 Commission Meeting were approved on the motion of Commissioner Holliday and seconded by Commissioner Bailey. UNANIMOUS.

COMMISSIONER CALVIN BLACK'S REPORT

The Commission on the Administration of Justice in the District Court of the State of Utah - Commissioner

Black said he is planning to attend a meeting in Salt Lake this Friday for all commissioners, clerks,

sheriffs, attorneys in the state to discuss legislative recomendations of changes in the District Court

System.

State Commission Meeting on Thursday - Commissioner Black said he will be attending a meeting Thursday for

the Commissioners of the state to discuss various topics.

National BLM Advisory Council - Commissioner Black reported that he received a letter from Secretary

Hodell stating he was re-appointed to the National BLM Advisory Council for a three year term which will

expire December 31, 1989.

Travel Coalition Diner - There is a Travel Coalition Dinner in Salt Lake on January 21, 1987 for tourist

promotion people. Commissioner Black said he will talk to Peggy Humpreys, county tourist & promotion, to

see who should attend from the development board.

Trust Fund - Commissioner Black said he talked to Commissioner Creasy from Tinnamook County, Oregon, (who

is also a member on the National BLM Public Advisory Council) asking information about the county's trust

fund. Commissioner Black said he sent him the state statute on it, the county's ordinance implementing it

and a letter explaining on how it's working in the county. Commissioner Black said the interest from the

county's trust fund last year will yield twice as much revenue than from the tax on all local assessed

property in the county.

Disposal Areas - Commissioner Black reported that he received a letter from Steve Griles, Assistant

Secretary of Interior for Lands & Minerals, indicating that the county's application for disposal areas

should no longer be held up. Commissioner Black said he will talk to Ed Sherick, BLM, and Roland

Robinson, State Director BLM, about getting the county's requests for their applications approved.

State Lands - Commissioner Black said he will make recommendations to the State Land Board to begin an

initiative of all the counties in the state that have state lands in federal reservations such as

military, national parks , national monuments, national recreation areas and Indian reservations.

Commissioner Black said he recommends a group be formed in each county consisting of state land staff,

county commissioners and interested parties and submit a proposal for exchange of these lands.

License Plates - Sales & Use Tax - Commissioner Black said he will be meeting with Clyde Nichols, Director

of the State Tax Commission, with respect to his promise of increase compensation on license plates and

also to discuss the sales and use tax question.

Elk Transplant - Commissioner Black wrote the following letters concerning the proposed elk transplant:

Dear Max:

Thank you for your letter commending the Commission for our efforts with respect to the BLM Management Plan to maintain multiple use of these public lands.

Your letter also addressed the proposed elk transplant which is supported by the Commission and with which you disagree. You further stated that while we could take a personnel position, we should not as a Commission because local stockmen who run livestock on forest lands are opposed.

While we appreciate and respect your viewpoint, we believe the support of the elk transplant is consistent with the multiple use principals on public lands.

There are those who advocate eliminating or limiting livestock grazing, oil, gas, mining, etc on some or all public lands. The San Juan County Commission opposes such limitations.

We believe supporting an elk transplant is supportive of multiple use and to oppose it would be contrary to good multiple use management.

Dear Bob:

The San Juan County Commission supports the proposed elk transplant on Elk Ridge and the Abajo Mountain in San Juan County.

This support is consistent with our long standing support of multiple use and sustained yield of public lands.

While we recognize there are some conflicts between various users of public lands and their individual interests, we believe such differences are far less important than the difference between the users of public lands and those whose interests are to eliminate nearly all beneficial uses.

With this in mind, we further recommend that future herd limits be maintained so as not to significantly impair the valid existing heights of current users and that rangelands and water be developed to increase forage and water resources for all wildlife and domestic livestock.

COMMISSIONER BAILEY'S REPORT

San Juan County Road - Hired Trucks - Commissioner Bailey presented the Commission a memorandum that is addressed to the county road district foreman from the county road commission concerning the hired trucks. The memo reads that the hiring, scheduling and accounting for all hired trucks shall be the responsibility of the District Foreman. Commissioner Black asked if the trucks would haul when they wanted or when needed and suggested that guidelines be set and specified in writing. Commissioner Bailey said they would be scheduled fairly and equally as possible and all trucks will bill on forms for better record. Commissioner Bailey said he would present a final memo next week.

Sam & Gwen Halls refund county money - Commissioner Bailey reported that he received a refund payment from Sam & Gwen Halls of $1565 for a overpayment.

COMMISSIONER JERRY HOLLIDAY'S REPORT

AMOCO DRILLSITE - LA SAL ROAD

The Commission received a letter from Amoco Production Company with an agreement which has been executed by both Amoco and the State of Utah for the Geyser Creek #1 wellsite and access road. Commissioner Bailey made the motion to approve the county entering into the agreement and authorized Commissioner Black to sign it. Commissioner Maryboy seconded the motion. UNANIMOUS.

AGREEMENT

The parties to this agreement are as follows:

The Utah Division of State Lands (the State of Utah); Amoco Production Company (Amoco); and San Juan County, Utah, represented by the San Juan County Board of Commissioners (San Juan County).

WHEREAS, Amoco has drilled a well for oil and gas on Utah State Lands and entered into an agreement dated July 14, 1986, to reclaim and reseed the drilling pad and one mile of road, more specifically described as being located from the gate crossing just above Dark Canyon Road in the NW/4 Section 29-T27S-R25E and continuing northwesterly into Sections 20, 30, and 19 of T27S-R25E and ending at the Geyser Creek No. 1 wellsite located SE/4 Section 19 T27S-R25E.

WHEREAS, San Juan County is desirous that the road be left intact and the drilling pad be reclaimed in such a manner as to provide for a reasonable parking-turn around area for public use.

WHEREAS, the parties to this agreement are desirous of modifying the reclamation agreement agreed upon by the State of Utah and Amoco in the interest of the public and all parties following the suggestion of the San Juan County Board of Commissioners.

IT IS THEREFORE agreed as follows:

The reclamation agreement between Amoco and the State of Utah will be amended to leave the road intact, with appropriate reseeding of cut and fill slopes, and to reclaim and reseed the drilling pad area in such a way as to provide for a parking-turn around area.

San Juan County Board of Commissioners accepts the future responsibility and all cost and expenses of maintaining the road and parking-turn around area, including trash pick up and liability, any signs, safety measures such as guard rails, retaining wall, etc. to safeguard the public who may have occasion to use such road and turn around and accepts all liability for damage and/or loss of all property and injury to or loss of life of all persons.

Amoco agrees to pay San Juan County the sum of $2,500 for maintenance costs in lieu of reclamation. Amoco and the State of Utah will have no further responsibility for maintenance or liability upon completion of dirt work by the construction company contractor.

PASSENGER & FREIGHT SERVICE IN SAN JUAN COUNTY

William Habel, Manager of Regulated Carrier Section from State of Utah Department of Business Regulation, met with the Commission to discuss additional passenger and freight service to the county area. (Continental Trailways plans to discontinue service to the Southeastern Utah area.) Commissioner Black said someone needs to research and investigate the possibility of other bus companies or businesses that might be interested in picking up this service and continue south through the reservation to the Phoenix area. Mark Ewart, agent for Milne Truck Lines, said the freight that comes into this area is in a big enough quantity that there could be several more companies. Mr. Ewart said the county also needs daily service for medical supplies, lab samples, blood, etc. Eighty percent of the bus travelers are Navajo and Ute and it would be a good idea to generate interest for bus service on the reservation. Commissioner Black talked to Bill Howell, AOG, and Mr. Howell said he would ask Les Prall to look into some funding for an economic feasible study.

EMPLOYEE CONTRACTS

Rick Bailey, Administrative Assistant, said the county needs to have employee contracts for each employee that provides special services. (Library custodian, golf course, recreation, communications, etc.) Mr. Bailey said he will have Craig Halls, county attorney, draft a contract for each such employee.

HOSPITAL ADMINISTRATOR - BUILDING MAINTENANCE

John Fellmeth, hospital administrator, met with the Commission to report that the Hospital's preheat coil system in the air handler is leaking. The hospital custodian wants a repairman to also tune the boiler and spend some time with him going over the controls and also position some bleeders on the hot water lines. Commissioner Bailey said that someone local could assess the problem in the leaking and maybe repair it. Commissioner Bailey said the system is fairy new and might still be under warranty. It should be checked to see if there was either faulty installation or freezing. The Commission authorized Mr. Fellmeth to work with Commissioner Bailey on getting this repaired.

HEALTH CARE BOARD MEETING

The Health Care Board will be meeting on January 21, 1987, at the hospital.

TELEPHONE SYSTEM - COURTHOUSE - MAE SYSTEMS

Gail Johnson, clerk, met with the Commission to report that the Mae Systems, telephone repairman in Durango, will be at the courthouse this Wednesday to give the employees user training. The User Training was specified in the contract and the county has not received the service they have been billed for.

HALLS CROSSING AIRPORT - CREAMER & NOBLE

Rick Bailey, Administrative Assistant, received the following letter from Creamer & Noble Engineers on the Halls Crossing Airport.

Following our conservation of December 22, 1986, I submitted to Mr. Flaherty a letter requesting clarification regarding his concerns and a copy of the Preliminary Draft Master Plan. I have also requested copies of future correspondence from FAA when such correspondence is regarding the Master Plan project, so that we can assist in providing any information he might require.

Regarding the progress of the Master Plan, as I also discussed with you, we have contacted Mr. Bob Weidner of Senator Garn's staff regarding his concerns over the runway length. I believe we will adequately address his concerns in the final draft.

Also, we have been in contact with the National Park Service (NPS) regarding obtaining granular material within the National Recreation Area (NRA). While NPS regulations appear to allow obtaining granular material from within the NRA boundary for projects constructed within the Recreation area, NPS representatives indicate the possibility as unlikely. Since the cost estimates in the Master Plan were based on obtaining granular material from within the NRA, we are preparing a second cost estimate for the preferred Site #2 based on hauling granular base from Bluff, Utah for comparison. The revised draft document should be to you within the next week.

I have also enclosed for Commissioner Black's signature Request for Reimbursement #4. Please return the signed forms to me, and I will forward them to the appropriate agencies. If you have any questions or require additional information, please contact me at your convenience.

Commissioner Holliday made the motion to approve the payment of $6,365.80 and authorized Commissioner Black to sign the forms. Commissioner Bailey seconded the motion. UNANIMOUS.

HUMAN SERVICES BOARD - MILEAGE REQUEST

Rick Bailey, Administrative Assistant, said there has been a mileage request from a Bluff member of the Human Services Board and asked the Commission for clarification on how this should be handled. The Commission told Mr. Bailey to talk to the AOG about this.

PUBLIC SAFETY BUILDING - IMPACT BOARD ATTORNEY

Rick Bailey, Administrative Assistant, said he talked to Blaine Carlton, attorney, who is representing the county with the Community Impact Board on the Grant money for the public safety building. Mr. Bailey said he recommends that a CPA confirm an amount the county can purchase a bond and then buy the bond as soon as possible. The Commission agreed this is a top priority and told Mr. Bailey to follow up on this with Mr. Carlton.

COMMUNICATIONS - NATIONAL TRANSLATOR ASSOCIATION

Bill Bayles, communication engineer, asked the Commission to approve the county's joining the National

Translator Association. Mr. Bayles said it designed to help the translator user and as a member they send them flyers, bulletins, and information from the FCC. Commissioner Holliday made the motion for approval and Commissioner Bailey seconded the motion. UNANIMOUS. The membership fee is $100.00

Translator Montezuma Creek to Aneth - Mr. Bayles said he will check on the electrical power line from Montezuma Creek to Aneth. Utah Power & Light will not purchase it if the county does have the right-of-way. Mr. Bayles said he will have Doug Pehrson, surveyor, survey the line before making an application to the Navajo Tribe for a right-of-way permit.

OIL, GAS & MINING - NATURAL RESOURCES

The Commission received maps from the State of Utah oil, gas and mining division showing oil and gas fields located in San Juan County. The Commission said these maps will be very helpful in studying the oil and gas production in the county.

PUBLIC HEARING - ELECTED OFFICIALS 6% BONDS

A public hearing was held at 1 p.m. to discuss a 6% increase in elected officials' salaries for the 1986 calendar year. The following people were present: The Commission, Vernon Schafer, Gary Halls, John Johnson, Leona Bailey, Ruth Palmer, Tully Lameman, and elected officials.

Commissioner Black opened the hearing by asking the public for their views with respect to the proposal. For a number of years San Juan County has held the line on pay increases because the state of the economy and the potential drop in assessed values. Few, if any other public entities has been so concerned. Last year the Commissioners specifically said there would be no increase in salaries and wages because of these factors. Such was not the case of the schools and cities, each of which take much more of property taxes than the county. Because the county's assessed value did not fall last year as expected in fact it increased slightly the Commission proposed retroactively on a one time basis to give a 6% payment to all county employees including elected officials. This proposal was discussed in the budget hearing. Such an increase can be, and was given to employees without a public hearing but a public hearing must be held before such an increase can be given to elected officials. We believe the elected officials have performed well in serving the public in the past year and are asking the public for an increase in their pay for the past year only of 6%.

Vernon Schafer; Under the circumstances of bad economy of San Juan County taxes came up. I circulated a petition around the county and got about 350 signatures opposing the Commissioners or any elected officials receiving a bonus at this time. Farmers in the county has had a substantial loss and taxes are too high.

Gary Halls; A big part of the county's revenue comes from the farming communities and land owners that pay property taxes. The county officials have done a good job but if there is a surplus of money I would think it could be used somewhere better.

Commissioner Bailey; The county has always been the focal point of taxation and people have a tendency to be critical of the county because they collect all the taxes and I'm not opposed to that in any way. But to point out a few things; the City of Monticello employees received a 5% increase in 1985 and in 1986 another 5 % increase plus $100 Christmas bonus. The city also increased the water rates by 20%, sewer by 30% which is a huge increase in taxes. The School District employees receive increases automatically by how many years they work and also received a bonus of 2% in December last year and will receive a salary adjustment in January of 8%. But yet no one shows up at their yearly budget hearing. The City of Blanding received a 5% plus $50 a month in 1985 and another 3% increase plus $50 a month in 1986. One should be consistent by attending the city and school budget hearings.

After the discussion the comment was made; "If it doesn't raise our taxes, I'm not so against elected officials getting a bonus."

The Commission thanked those present for coming and voicing their opinion.

Commissioner Bailey made the motion to approve the 6% increase in the elected officials' salaries for the 1986 calendar year. Commissioner Maryboy seconded the motion.

FENCE TURNER WATER ALLOTMENT IN DRY VALLEY

Clem Washburn met with the Commission requesting permission to put a gate at Turner Water Allotment in Dry Valley on Hart Point Road. It would be closed only during the months of December through May. Commissioner Bailey said he would discuss this at the next road meeting and will have Merz Hugentobler, foreman, contact him if there is a problem.

SHERIFF'S DEPARTMENT - Jailers, Shift Work, Uniform Allowance

Sheriff Lacy met with the Commission to discuss the following changes:

Dodge Pick-up - Sheriff Lacy said the lease agreement on the Dodge truck terminates the end of January

and recommended to the Commission that the county keep it. Rick Bailey said he will call Freed Leasing

(the company the truck is being leased from) to see whether it would be better to continue the lease or

buy it.

Security Contract - Sheriff Lacy said he talked to a representative of the security board in Salt Lake

concerning the legality of a movie security agreement and was told that in his opinion it is illegal.

Sheriff Lacy said he will follow up on this with the county attorney.

Jailers hired - Sheriff Lacy told the Commission he hired Bill King as jailer and asked them to approve

the hiring of Monty Dalton. Job Service will pay from 500 to 1000 hours of Mr. Dalton's salary. Sheriff

Lacy said he will advertise next time and have'a new roster filled up with more people. Commissioner

Bailey made the motion to approve the hiring of Bill King and Monty Dalton. Commissioner Maryboy seconded

the motion. UNANIMOUS.

Shift Pay - Sheriff Lacy said he would like to have the employees of the sheriff's department be paid

shift pay effective this month. He proposed a 5% increase for week-day swing shift, 10% increase in

graveyard shift and for week-ends a 10% increase for swing shift and a 15% increase in graveyard shift.

The Commission asked that this be put on the agenda next week for approval.

Daily Activity Log - Commissioner Black said he would like to see the Sheriff's department keep a daily

activity log. It should show where the deputy is, contacts made, time on duty, mileage, etc., which would

be an invaluable record at a later time.

Uniform Allowance - Sheriff Lacy indicated he will request that all the sheriff department employees to

wear a uniform. He also asked the Commission for a $35 increase in uniform allowance. The Commission

asked that this be put on the agenda next week for action.

Navajo Police - Sheriff Lacy discussed the special cards for Navajo and Ute Police acting as special

duties. The Commission said the cards should be brought to them for approval, to keep in compliance with

the law and for public information. Sheriff Lacy said he will check the legality of this with Craig

Halls, county attorney.

COUNTY AGENT - OUT-OF-STATE TRAVEL

The Commission approved out-of-state travel for Jim Keyes, county agent.
