SAN JUAN COUNTY COMMISSION MINUTES DECEMBER 5, 1988

The regular meeting of the San Juan County Commission convened at 10:00 A.M. at the San Juan County Courthouse at Monticello, Utah.

A motion to approve the minutes of November 28, 1988 as corrected was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.

COMMISSIONER MARK MARYBOY'S REPORT

Aneth and Red Mesa Chapter Planning Meetings - Commissioner Maryboy will be attending the Aneth and Red Mesa Chapter planning meetings tonight.

Old Blanding Health Clinic - Commissioner Maryboy will talk to UNDC Executive Director Lester Lansing about the possibility of using the Old Blanding Health Clinic as a senior citizens center for Blanding. Mr. Maryboy did not think that the clinic was being used by the UNDC at the present time. If the clinic is not being used, Mr. Lansing will need to write a letter to the County Commission releasing that building. If the senior citizens move into the clinic, there would be the space in the basement of the library that could be utilized by the Historical Society.

COMMISSIONER CALVIN BLACK'S REPORT

Bluff Senior Citizens Request/building Lease - A letter from the Bluff Senior Citizens signed by Louise Berensen, President, and Dorothy Nielson, Secretary, is requesting permission to lease that part of the Bluff Community Building that is used by the senior citizens, namely, the kitchen and dining room. They would like to lease it for three years for the sum of $12.00. Administrative Assistant Rick Bailey will work with the people to try and reach an equitable agreement in the control and use of the space used by the senior citizens.

Appreciation - Commissioner Black expressed appreciation for the card and floral arrangement that was sent to him from the County employees while he was in the hospital.

Circuit Court Judge Appointment - A phone call from Governor Norman Bangerter indicated that Bryce Bryner would be appointed as the Circuit Court Judge for the northern area of the four county area.

Governor Bangerter Meeting - Commissioner Black and Sam Taylor will be meeting with Governor Bangerter on the Halls Crossing Airport and the Lake Powell Land Trade along with other issues on Friday, Dec. 9, 1988.

Halls Crossing Airport - The Park Service is insisting that the Halls Crossing Airport have no beacon, no fuel services and no fixed base operations. Commissioner Black indicated that without those features there would be little public or local economic value in having the airport. One of the major needs of the airport is for emergency needs and without the fixed base operation it would double the time required to fly a person out for emergency services. A beacon acts the same as a highway sign in telling people where to go. The sale of fuel is one of the major revenues for supporting and building airports. A meeting with the FAA and Park Service will be scheduled after the first of the year to discuss these issues.

Justice Department/Election Monitoring - County Attorney Craig Halls will be asked to request, under the Freedom of Information Act, a copy of any memos, letters, reports or information developed by the group of people from the Justice Department that monitored the election process in San Juan County. The Justice Department indicated earlier that there would be no report or information forthcoming for the County. Commissioner Black expressed appreciation to County Clerk Gail Johnson and her staff for their efforts in the recent elections and felt that they have done everything possible to conduct the elections as efficiently as possible. Mrs. Johnson has expressed a desire to receive the information so that she can make any improvements that need to be made.

AOG Meeting - Commissioner Black attended an AOG meeting last week in Price. The position replacing Les Prall will be moved to Moab to serve all of the four-county area with economic development. There will be a decrease of $8,000 in EDA money for the operation of the AOG. The funding from the Community Development Block Grant for the entire four-county area for economic development will be raised from $32,000 to $40,000 so that the present levels of service can be continued. Applications have been made for $250,000 each from Farmer's Home Administration and EDA for revolving loan program that will have to be matched. A proposal to form a western coalition of states, local governments, and school districts and others to preserve multiple use of public lands was supported by the AOG board.

AOG Legislative Conference - A variety of legislative issues were discussed at the AOG Legislative Conference held Wednesday evening. Commissioner Black and Commissioner-elect Ty Lewis attended that meeting. Primarily the mineral lease money and the payment in lieu of taxes on state lands was addressed as it is expected to have some entities challenge the present formula. It was also recommended that the legislature fund a study to be done on the economic impacts of wilderness designation. Mr. Lewis stated

that a thesis has been completed and shows by a study in Idaho that wilderness designation has in fact inhibited economic growth.

Peavine Corridor Commments - Commissioner Black will write a letter to Lee Bennett, Monticello District Ranger of the National Forest Service, expressing the desire of the County that the Peavine Corridor being left open to multiple use as intended by Congress when they established the wilderness area. Commissioner-elect Ty Lewis expressed the fact that the corridor in its present state does not have wilderness characteristics and should never be considered for wilderness designation. Mr. Black indicated that the corridor needs to be left open to provide an access route to the backpackers, for search and rescue and for management.

COMMISSIONER KENNETH BAILEY'S REPORT

San Juan County Health Care Board - Commissioner Bailey reported that he and Commissioner Maryboy met with the Hospital Board last Tuesday and turned the responsibilities over to the newly formed San Juan County Health Care District Board. All of the appointed members were in attendance. Rayburn Jack was elected as Chairman, Nancy Cahoon as Vice-chairman and Ron Johnson as secretary-treasurer. Rita Walker was asked to remain as secretary to the board. Appreciation was expressed on behalf of the Commission to the new board members for accepting the appointments. It was reported that they will use the $350/000 provided by tax revenue for their budget with $50,000 for capital for the ambulance service.

San Juan County Road Projections - A list of the road improvements needed in the County for next year are listed in the road department minutes.

Road Department Shop Supervisor - The job description for the shop supervisor responsibilities for both the Blanding and Monticello road shop has been changed and was approved in the road department meeting.

ADMINISTRATIVE ASSISTANT RICK BAILEY' S REPORT

State of Utah, Division of Aging and Adult Services Contract Amendment - Administrative Assistant Rick Bailey recommended that the current year contract with the State of Utah, Division of Aging and Adult Services be amended. The contract increases the funding the State will provide through State and Federal sources by $10,678.57. It also decreases the requirement of local public funding by approximately $5,000. The adjustments were made based on minority counts and services provided. A motion to approve the recommendation of Mr. Bailey and authorizing Chairman Black to sign the contracts was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Budget Worksheet - Mr. Bailey asked what tax valuation the Commissioners wanted on the budget worksheet. The current year valuation was set at $650 million as the taxable valuation. When the figure was actually computed it was closer to $675 million dollars. The oil and gas prices have decreased considerably since that time and it was Mr. Bailey's recommendation that the valuation be lowered for the 1989 budget. The Commissioners felt that the estimated figure should be retained at the $650 million figure.

CURRENT BUSINESS

Utah Power & Light Billing - Utah Power & Light has sent a letter requesting reimbursement for a business activity tax for sales on the reservation which is being assessed by the Navajo Tribe. UP&L is having to pass that on to their customers. The amount billed to San Juan County is $765.45 that has accrued since 1978 and is for the pole at the Montezuma Creek swimming pool, the pole for the fire station, ambulance garage and a few poles used by the communications department. Commissioner Maryboy will check with the Navajo Tribe to see if the County can be exempt from this tax because of the services provided to the Tribe.

Historical Items - In searching for additional space in a basement storage room, County Clerk Gail Johnson found four boxes of materials which seemed to be of a historical nature. She asked Oleen Hatch, a member of the Historical Society board, to go through the boxes to make a determination of the contents. Mr. Hatch made a summary of the material and presented to Mrs. Johnson. Mrs. Johnson recommended that the items be microfilmed and the originals kept with the Historical Society records. The Commission approved the recommendation.

Personnel Policy - A motion to approve the San Juan County Personnel Policy as revised September, 1988 was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.

Extension Secretary/Probationary Raise - A motion to approve the probation raise for Janet Hazelton, Extension Secretary, to grade 2 step 2 at $965 was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.

Bluff Resident/Electrical Fees - A letter was received from Clemma Johnson regarding an electrical charge for an inspection that was made by the County building inspector on a meter box that was moved from a pole to a house that has been in existence for 30 years. The Commission stated that several years ago UP&L was asked not to put any new connections to buildings without first being inspected as people were moving trailers wherever they wanted to in the County without proper water installation and septic systems which created very unsanitary conditions. If they were first inspected, the County could control these conditions. County Building Inspector Jerry Jackson will write a letter to UP&L and explain that inspections are required only on new structures but if electrical service is just being moved on an already existing building that an inspection will not be required. Commissioner Black recommended that Mrs. Johnson's check be refunded because of the misunderstanding.

County Engineering Department/File Cabinet - Bids have been received on a 4-drawer, 26 1/2" deep, file cabinet from Office Outpost for $167.60 and Palmer's for $175.45. A motion to approve the purchase from Office Outpost for $167.60 was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.

County Sanitarian - Jerry Jackson - San Juan County Sanitarian Jerry Jackson met with the Commission to discuss who was going to operate the Halls Crossing Landfill. There has been a request from Tim Harvey from the Glen Canyon Recreation area for permission to use the landfill for a fee. The County has dug the original pit and will go in occasionally and cover the garbage and dig a new pit as necessary. Bill Duckett will be contacted to find out how much is being charged in other areas for landfill fees and an agreement entered into with the Glen Canyon Recreation department.

Mr. Jackson also inquired as to how often the garbage dumps throughout the County are covered. The Commission said that as there was no written operational plan for the dumps, the County goes in whenever needed to cover the garbage and dig new pits. Mr. Jackson recommended that in order to meet the health code that the pits be covered on a more regular basis.

Bluff Special Service Water, Recreation, Sewer & Mosquito Abatement District - Administrative Assistant Rick Bailey contacted Attorney Ken Chamberlain to discuss the addition of water, recreation and mosquito abatement to the Bluff Special Service Sewer District resolution. The original intent was to include those other issues within the special service district but the wording of the resolution did not reflect that. Mr. Chamberlain agreed that the other issues needed to be included in the resolution. Mr. Bailey returned the papers to Mr. Chamberlain to have the wording changed to reflect the motion. The law

requires that the notice after the intent to establish the district was made, has to run for at least three weeks in the local newspaper and for at least 21 days before the next public hear. If the papers are returned by Friday, the notices will be run the 14th, the 21st, and the 28th of December which would

allow for a public hearing to be held on the 9th of January at 7:00 P.M. at the Bluff Elementary School.

Questar Application/Abajo Peak - Questar Service Corporation of Salt Lake City, Utah has made application for an additional frequency at Abajo Peak. The request will be given to County Communications Engineer, Bill Bayles for comment.

San Juan Proposed Resource Management Plan/Final Environmental Impact Statement -Notice has been received

that the revised Proposed RMP is scheduled for completion and release to the public in April 1989. A 20-day protest period will follow, consistent with BLM planning regulations.

Enterprise Zone Designation - A letter has been received from Alice Shearer, Deputy Director Department of Community and Economic Development, announcing San Juan County's formal designation as an "Enterprise

Zone" in accordance with newly enacted state legislation. This designation shall be in effect until September 1, 1994. The "Enterprise Zone" legislation (Section 59-19-101, Utah Code Annotated 1953)

provides for corporate franchise tax or personal income tax credits for investment and job creation within designated counties.
