MINUTES OF THE SAN JUAN COUNTY COMMISSIONERS MEETING HELD

APRIL 5, 1982

Time: 10:00 a.m. in the Commissioner's Room at the Monticello Courthouse.

Members Present: Chairman Calvin Black, Commissioner Kenneth R. Bailey, and Commissioner Robert Low.

Minutes of the previous week were read and approved with the stipulated corrections upon the motion of of Commissioner Low and the second of Commissioner Bailey and it carried unanimously.

CITY OF MONTICELLO MEETS REGARDING ROAD,GOLF COURSE AND AIRPORT;

Monticello City Manager, Rick Terry; Councilmen Jack Young and Ron Sharp; Darroll Young, Larry Sorrell, and Paul Dean Black met with the Commission at 10:00 a.m. to discuss the Cooperative Road Agreement, the San Juan Airport, and Golf Course.

It was clarified by Commissioner Bailey that under the new Cooperative Road Service Agreement the cost to the city for construction services shall be 30% of the actual cost of labor, material and equipment rental

The problem of low utilization of the San Juan County Airport at Monticello was discussed. The Commission felt that utilization could be improved if the City of Monticello could manage the airport, and requested that the city council consider taking over the management responsibility of the airport, while the County would continue to provide the necessary funding. The City Council said that they would consider the County's proposal.

Erosion along the creek bank at the San Juan Golf Course was discussed. Commissioner Bailey reported that the County Engineer, Doug Pehrson, has estimated it would cost between $25,000 and $30,000 to control the erosion on fairways #2 and #3 with a 6' culvert and modifications in the landscape to provide for any over-flow. Darroll Young felt that a smaller, but longer culvert with inlet and outlet aprons and trash guards would be adequate and save the County the expense of the 6' culvert. The Commission requested that Mr. Young prepare a written report and diagram of his recommendations for the golf course. Darroll Young returned later in the afternoon to present his report. It was his recommendation, at that time, to control the erosion by placing a 175' long, 5' culvert and a 175' long, 4' culvert side by side in the creek bed at fairways #2 and #3, and by placing two 75' long, 4' culverts (all with aprons and trash guards), in the creek bed at fairway #8. Darroll Young also recommended that one additional section and trash guard be added to the 6' culvert at the shed crossing. The Commission approved Darroll Young's recommendations, as presented, and authorized Commissioner Bailey to work with the Road Department, the Golf Course manage-ment and Mr. Young to get the necessary work done as soon as possible.

BEER LICENSE APPLICATION FOR FRY CANYON STORE;

Mr. Steve Bronson, doing business at Fry Canyon Store, made an application for a Beer License. The Comm-ission reviewed Mr. Bronson's application and stated that no decision could be made until the necessary recommendation of the County Sheriff had been obtained.

BLUFF TO MONTEZUMA CREEK ROAD RIGHT-OF-WAY:

Because the building of the Bluff to Montezuma Creek road is of high priority to the County, Commissioner Bailey moved to authorize Doug Pehrson to apply immediately to the B.L.M. for the necessary right-of-way. The motion was seconded by Commissioner Low with those voting for the motion: Calvin Black, Robert Low, and Kenneth Bailey. Those voting against the motion: None.

BLUFF TO MONTEZUMA CREEK ROAD FUNDS FROM THE B.I.A.;

The following letter of conformation of funds for the Bluff to Montezuma Creek road was received by the

Commission:

The Board of Indian Affairs, at its monthly meeting on March 4th, approved your request for $750,000 for the proposed road from Bluff to Montezuma Creek. The funds will be included in our FY 1983 budget. The funds will be available anytime after July 1st; but, as I in-dicated to you at the meeting, we would appreciate it if you would use these funds at the end of the project so that interest revenue will not be lost.

We are happy to participate in this important project with you.

BID FOR GAS, DIESEL, TIRES, ETC. DISCUSSED;

It was the consensus of the Commission that the bid should be held for gasoline, diesel, tries, corru-gated steel pipe as soon as possible. Commissioner Bailey phoned Bernal Bradford and requested that he make the necessary preparations for the soonest possible bid date.

ROAD DEPARTMENT TO WORK FOUR-TEN HOUR DAYS:

Commissioner Bailey reported that the road crews will be working four-ten hour days per week. This is an

advantage when the weather permits the crews to work on jobs further out in the County. Commissioner

Bailey has directed that the work is always of high priority and should continue as long as the weather

permits.

GRAVEL PIT LANDS REQUESTED FROM B.L.M.;

Upon the motiom of Commissioner Bailey and the second of Commissioner Low it was unanimously voted to authorize Chairman Black to sign the County's request to the B.L.M., Monticello Office, for land which the County wishes to acquire for gravel pits at Lem's Draw, LaSal, Spring Creek, Brown's Canyon, Zeke's Hole West, Zeke's Hole East, and Bluff.

JOHNSON CREEK ROAD PROJECT AGREEMENT WITH THE FOREST SERVICE SIGNED:

Upon the motion of Commissioner Bailey and the second of Commissioner Low it was unanimously voted to sign the Johnson Creek Road Agreement between the Forest Service and San Juan County, Utah, Supplement No. 13 to the Forest Development Road Cooperative Agreement dated May 6, 1966. The Agreement was then signed by each Commissioner.

AL HASKINS REPORTS:

The Commissioners complemented Mr. Al Haskins on the inventory maps and County property descriptions that he presented to the Commission. It was requested that Mr. Haskins also incorporate all county owned buildings into the inventory he had prepared.

Mr. Haskins reported that 6,000 pounds of cheese has been obtained from the Department of Agriculture for distribution on the Utah portion of the Reservation.

Visiting Mr. Haskins, in his capacity as Emergency Management Director for the County, were Lorraine Tempest, State Director of Emergency Services, and aids Paul Ross and Jerry Kaffer. While at the Court-house, they stopped briefly to greet the Commissioners.

RICK FRANCOM'S SALARY DISCUSSED;

Commissioner Low reported that Rick Francon has been working for the County Road Department for four months and has not been raised from probationary status. Commissioner Bailey will check with the Road Department and see that the paper work is completed to change Rick Francom's employment status as indicated.

AL PRICE MEETS REGARDING HEALTH INSURANCE:

Blue Cross/Blue Shield Agent, Al Price, met with the Commission to present Information on a self-funded health insurance plan for the County. The Commission agreed that if it were to enroll in a self-funded program with Blue Cross, it would want a Stop Loss Attachment.

HEALTH INSURANCE. PROPOSALS OPENED;

At 1:30 p.m. Chairman Black opened County Health Insurance Proposals that had been received from the

following agencies:

Olympus Insurance Agency

Leonard Hurst Agency

Earl E. Stevens, Agent for Utah Farm Bureau Mutual Insurance Company

Blue Cross/Blue Shield of Utah

The Commission studied the varied benefits offered under each proposal and Commissioner Low moved to accept the proposal of Blue Cross/Blue Shield for a self-funded insurance program with a Stop Loss Attachment to commence May 1, 1982. The motion was seconded by Commissioner Bailey and it carried unani-mously.

1981 INDEPENDENT AUDIT BID OPENING;

At 2:00 p.m. Chairman Black opened the only bid received for the 1982 Independent Audit for San Juan County. The bid was as follows:

Smuin, Rich & Company, proposing a maximum fee of $6,500.00 to perform the audit and commit to have the audit report completed and make report to the State Auditor's Office by June 30, 1932.

Commissioner Bailey moved to accept the bid proposal of Smuin, Rich & Company. The motion was seconded by Commissioner Low and it carried unanimously.

1982 POPULATION ESTIMATE FOR SAN JUAN COUNTY;

Chairman Black reported that he has received the 1982 Population Estimate for Utah, and it lists the population of San Juan County at 12,700.

LAKE POWELL PROMOTION MEETING TO BE HELD:

Chairman Black reported that a meeting to establish goals for the promotion of "Utah's Lake Powell" will

be held May 7, 1982 in Ticaboo, Utah.

MENTAL HEALTH PROGRAM STATUS DISCUSSED:

Mr. Jim Whear, director of Four-Corners Mental Health, Mr. Rick Mainord of San Juan Community Social Services, and Mr. Frank Rose, psychologist for Mental Health, met with the Commission to discuss the Mental Health Program.

Regarding action taken to obtain a portion of the funding for San Juan Community Social Services-Mental Health Unit directly from the State Department of Social Services, Mr. Whear stated that he felt the Mental Health program should be an independent organization responsible to the Commission and not be part of a General Health or Social Service program.

Mr. Mainord stated that he believed the mental health program could work under Social Services, but there would be a lot lost in combining the two.

Mr. Rose was concerned that he might become professionally isolated if peer interaction was not available. He was assured by the Commission that, although the County's remoteness necessitates some seperateness, there is no reason he cannot continue anything that is benificial and needed with Four-Corners Mental Health. Perhaps this would be done on a contract basis.

In response to Mr. Whear's concerns, Chairman Black stated that the County's Mental Health Unit has been part of San Juan Community Social Services for the past three years and nothing is changed except that a portion o'f the program funds which was previously contracted for through Four-Corners Mental Health will now come directly from the State.

BEER ORDINANCE DISCUSSED WITH COUNTY ATTORNEY:

The Commission requested that the County Attorney, Bruce Halliday, prepare a proposal to update the County Beer Ordinance by the next Commission meeting. It was discussed that fees in the various beer license categories should be increased.

B.L.M. REQUESTS COMMENTS REGARDING NUCLEAR WASTE REPOSITORY;

Chairman Black reported that the B.L.M. is requesting comments on the nuclear waste repository. The Commission authouized Chairman Black to submit a statement representative of the Commission's views on this issue.

SAN JUAN TOURISM INDUSTRY WEEK;

Upon the motion of Commissioner Low and the second of Commissioner Bailey, it was unanimously voted to

adopt the following Declaration establishing San Juan Tourism Industry Week, April 18-24, 1982:

DECLARATION

WHEREAS, the tourism industry in the County of San Juan, Utah, is a vital and growing industry which substantially adds to the economic base of the County; and

WHEREAS, Utah's travel industry generates over 60 million dollars in taxes and total expenditures approaching 1 billion dollars; and

WHEREAS, the travel industry is convening for the first annual Governor's Conference on Tourism in Salt Lake City to better understand how to profit in the coming good years;

NOW, THEREFORE, We, the Commissioners of the County of San Juan, Utah, do hereby declare the week of April 18-24, 1982 as

for the purpose of stimulating an awareness of the travel and tourism industry and its many contributions to the welfare and well-being of our County.

SAN JUAN SPECIAL SERVICE DISTRICT # 1;

County Attorney, Bruce Halliday, reported that the engineer's fee for the San Juan Special Service

District #1 sewer project was $1,800 below the estimated price. Upon the recommendation of the County

Attorney, Commissioner Bailey moved to approve an amendment to Step Two of the Design Aspect of the

San Juan Special Service District #1 Sewer project reducing the grant payment by $1,800 because of the

reduction in the engineering fee. The motion was seconded by Commissioner Low and it carried unanimously.

Chairman Black was authorized to sign the Assistance Amendment No. 1 decreasing the grant by $1,800.00.

BUILDING PERMITS APPROVED;

Building permits for Bill A. Hoskins of LaSal for a mobile home, and Curtis Jones of Blanding for a mobile

home in Bluff were approved and signed by Commissioner Ken Bailey.

ADVISORY COUNCIL ON AGING APPROVED;

Upon the recommendation of the San Juan County Advisory Council on Aging, Commissioner Bailey made a motion to

approve the following as members of the Advisiory Council on Aging;

The motion was seconded by Commissioner Low and it carried unanimously.

1982 LAW ENFORCEMENT AGREEMENT FOR PUBLIC LANDS;

Upon the motion of Commissioner Low and the second of Commissioner Bailey it was unanimously voted to authorize Chairman Black to sign the Memorandum of Understanding between the B.L.M., Utah State Office, and San Juan County, Utah, for law enforcement services for the public lands within San Juan County for Fiscal Year 1982. The Law Enforcement Agreement was then signed by Chairman Black.

CEDAR POINT'S OLD SCHOOL HOUSE TO BE PAINTED;

Mr. M.C. Turner, representing the Community of Cedar Point, had previously inquired if the County would furnish the paint and the Community would paint the Old Cedar Point School House. The school house is presently used for recreational purposes. The Commission agreed to have the County furnish the paint for the project, and Mr. Turner will be informed to this effect.
