SAN JUAN COUNTY COMMISSION MINUTES JANUARY 4, 1988
The San Juan County Commission met in regular session January 4, 1988 at the hour of 10:00 A.M. at the San Juan County Courthouse, Monticello, Utah.
The following commissioners were present: Calvin Black

Commissioner Bailey made a motion to approve the minutes of December 28, 1987 as corrected. Commissioner Maryboy seconded the motion. UNANIMOUS.
1988 COMMISSION ASSIGNMENTS
Commissioner Bailey made a motion that the San Juan County Commission assignments remain the same as 1987. Commissioner Maryboy seconded the motion. UNANIMOUS.

COMMISSIONER CALVIN BLACK'S REPORT
Conmissioner Black's Agenda - Commissioner Black will attend a State Land Board meeting Wednesday and Thursday in Salt Lake City. There is a Utah Association of Counties meeting on the mineral lease lawsuit at noon on Thursday. A meeting with Bob Weidner of Senator Jake Garn's office and Commissioner Hatch of Garfield County and Conmissioner Underwood of Kane County will also be held on Thursday. Thursday evening there is an AOG meeting with Ted Wilson in Green River.
Long Canyon Road Agreement - Doug Pehrson, San Juan County Surveyor, will meet with County Attorney Craig Halls to work out any problems they have with the Long Canyon Road Agreement. The agreement should be ready by the next commission meeting.
Sheriff's Department - Information Sheet - The Conmission discussed an information sheet prepared by Sheriff Claude Lacy comparing the current salaries paid San Juan County employees with similar employees of other counties. Administrative Assistant Richard Bailey was asked to prepare a spread sheet comparing all San Juan County employees with other counties as well as Blanding and Monticello cities. Canadian Free Trade Agreement - A copy of a letter from Senator Jake Garn to Bill Howell indicates the Canadian Free Trade Agreement has been signed by President Ronald Reagan and the Canadian Premier but still needs to be ratified by our Congress and the Canadian Parliament. Senator Jake Garn says, "I intend to continue a close review of all aspects of the Canadian Free Trade Agreement before making a final decision regarding its adoption. Congress should be thorough in scrutinizing, etc." Senator Garn also points out that he has co-signed a recent letter to the President signed by 24 Senators outlining their concerns regarding the agreement and the uranium industry and requesting his review of this matter. "Also I've co-sponsored Senate Resolution 341 along with five of my colleagues that would permit the Canadian agreement to be amended before its final adoption. As you know, under Fast-Track Authority the Canadian Free Trade Agreement will not be amendable once it comes before the Senate. Senate Resolution 341, if passed by the Senate, will provide an opportunity to amend the agreement into a more equitable treatment of the U.S. Uranium Industry and other areas."
Burr Trail - A copy of a letter to Mark Walsh from Patrick Nolan, County Attorney of Garfield County, with copies of the statement on issues on the appeal filed by the environmentalists on the Burr Trail lawsuit was reviewed. County Attorney Craig Halls was asked to file an amicus brief on behalf of the San Juan County Commissioners supporting Garfield County. Commissioner Bailey made a motion to approve the filing of an amicus brief on behalf of Garfield County. Commissioner Maryboy seconded the motion. UNANIMOUS.
COMMISSIONER KENNETH BAILEY'S REPORT
Congressman Howard Nielsen's Agenda - The Commission reviewed the schedule for the visit of Congressman Howard Nielson to southern San Juan County on Friday, January 8. Issues to be discussed with Congressman Nielson are: Canadian Free Trade Agreement, Communication Site Fees, Lake Powell Land Trade, DNA, road conditions around Navajo Mountain area as well as State Roads in southern San Juan County. San Juan County Tax Notices - Commissioner Bailey requested that Marian Bayles, Treasurer and Barbara Montella, Assessor, and John Fellmeth attend Conmission meeting next week to discuss revising the San Juan County tax notices.
Hart's Draw Road - Forest Service requirements have put additional expense to the Hart's Draw Road; 14,000 yards of top soil needs to be removed and stockpiled to be replaced after the construction of the road. Road Employee - Robert Laws - Conmissioner Bailey made a motion to approve the probationary raise of Robert Laws to Grade 8 Step 2 effective December 28, 1987. Conmissioner Maryboy seconded the motion. UNANIMOUS.
Paula Butler - Commissioner Bailey made a motion to approve the change of status on road employee Paula Butler from a part-time employee to a full-time employee. She will be hired at Grade H Step J . Commissioner Maryboy seconded the motion. UNANIMOUS.
COMMISSIONER MARK MARYBOY'S REPORT
UNDC Board Meeting - Conmissioner Maryboy will attend the UNDC Board Meeting Tuesday, January 5, to get
the road priority list for the reservation.
Navajo Adolescent Mothers - UNDC Education Division has received a grant of $8,000 from Utah State
University to work with adolescent mothers on the reservation. Commissioner Maryboy was inquiring about
the possibility of obtaining matching funds from the Title 20 program of the Human Services Board. A
proposal will need to be submitted to Jed Lyman, chairman of the Human Services Board for their
consideration.
ADMINISTRATIVE ASSISTANT RICHARD BAILEY'S REPORT
San Juan Resource Area Plan - The Commission discussed the San Juan Resource Area draft of the BLM which sets forth the land-use decisions, terms, and conditions for guiding and controlling future management actions. The chapter on special management conditions was of great concern to the Commissioners as it designates areas of critical environmental concern (ACEC). ACEC's severely limit multiple use of BLM land. The Contnission felt that the BLM already has a management authority and laws to protect any other resource so additional restrictions are unnecessary. The Commission is opposed to any designation of ACBC's but in the event they do designate ACEC's in the final plan, there needs to be some changes made before the plan will be acceptable to the County. The BLM plan is also inconsistent with the County master plan and zoning ordinance.
Horn Mountain Transmitter Site - Richard Bailey reviewed the billing from Emery County on the Horn Mountain Transmitter Site with Bill Bayles, San Juan County Communications. Mr. Bayles indicated that there are other users on the system and recommended that the billing is fair and should be paid. Senior Citizens Bus Driver - Sylvan Johnson is postponing his move to Manti because Loretta Carroll will be needing surgery in the near future. Mr. Johnson will remain the Senior Citizens Bus Driver until Ms. Carroll recuperates sufficiently to resume her responsibilities.
Fire Truck - The fire truck from Sevier County is a 1971 Ford with 8,000 miles on it. It has had very little use and very few problems. There is a rust spot on one of the tanks, a valve that is stuck and a couple of bearings that need to be replaced. The truck has a 750 gallon per minute pumping capability and 750 gallon holding tank. The drafting ability for pumping water from a reservoir has been checked recently and is in good condition. Sevier County is asking $22,000 for the truck. One of the communities from Uintah County is looking at it and should let Sevier County know this week if they are interested in purchasing the truck. Richard Bailey is still checking into the fire truck from Mt. Pleasant. Solicitation Policy - Commissioner Bailey made a motion to adopt the following solicitation policy:
Policy: It is the policy of San Juan County to prohibit solicitation and distribution on its premises for private purposes. This includes San Juan County employees involved in private businesses/solicitations.
1. Unrestricted solicitation on County premises interferes with the normal operation of the organization, is detrimental to discipline and efficiency on the part of employees, and is annoying to customers.
2. The County may authorize public purpose fund drives or solicitation by a limited number of charitable organizations when approved in advance by the County Commission. Each employee may decide whether or not to contribute. There will be no discrimination aga-inst employees because of their willingness or unwillingness to participate.
Commissioner Maryboy seconded the motion. UNANIMOUS.
Portable Communication Radios - Richard Bailey submitted bids to purchase portable communication radios for the Commissioners. A Uniden radio with four channels and a charger is $610.00; the Yazu radio with ten channels and a charger is $794.00. Commissioner Maryboy made a motion to approve the purchase of the radios. Commissioner Bailey seconded the motion. UNANIMOUS.
CURRENT BUSINESS
R.N. Program - John Fellmeth, Hospital Administrator, and Bonnie Conway, Ass't Administrator and Director of Nursing, met with the Commission to discuss funding for an R.N. program for San Juan and Grand Counties. The school district is willing to be the applicant for a grant from the Community Impact Board. A legislative appropriation is also being pursued but the feelings are such that the State does not have the funding available. Commissioner Black will write a letter of support for this program to members of the State Senate and House of Representatives.
Supervisor - Blanding Clinic - Applicants for the position of supervisor of the Blanding Clinic are: Linda Chamberlain, R.N.; Dee Street, R.N.; Marsha Keele, EMT; Shan Redd, LPN; and Donna Singer. Bonnie Conway, Hospital R.N. Supervisor, recommended the hiring of Linda Chamberlain. The Commission authorized the recommendation upon similar approval from Dr. Steve Warren as a member of the Hospital Board. Formal approval will be forthcoming at the next Hospital Board meeting.
Beer Licenses - Commissioner Bailey made a motion to authorize the signature of Chairman Black approving the beer licenses for Fry Canyon Store and Lester's Corner in Bluff. Commissioner Maryboy seconded the motion. UNANIMOUS.
State Tax Conmission - Vehicle License Contract - Commissioner Bailey made a motion to approve the Vehicle License Contract with the State Tax Commission - Motor Vehicle Division. Commissioner Maryboy seconded the motion. UNANIMOUS. The State will reimburse the County approximately $5,100 for services provided during the 1986-87 years.
San Juan County Fire Program - The Commission discussed the San Juan County Fire program with John Baker. Upon the recommendation of Richard Bailey, Administrative Assistant, Commissioner Bailey made a motion to hire John Baker as a temporary, part-time coordinator of the San Juan County Fire program. Mr. Baker's salary will be set at $135 per month. A deputy in the Sheriff's department will be assigned to work with Mr. Baker on this program during the high risk fire months.
Public Hearing - CBDG Grant - There is expected to be between $60,000 and $90,000 available for Community Development Block Grant projects. Applicants would have to meet three stringent requirements to qualify. A revolving loan fund plan would make money available in connection with other lending institutions for people who commit to start businesses that would employ local persons. The purpose of this hearing was for persons to put forth their proposals but no one chose to submit a proposal. Commissioner Bailey made a motion to go with the revolving loan fund plan for the County. Commissioner Maryboy seconded the motion. UNANIMOUS.
