SAN JUAN COUNTY COMMISSION MINUTES APRIL 4, 1988

The regular session of the San Juan County Commission convened at 10:00 a.m. at the San Juan County Courthouse in Monticello, Utah.

A motion to approve the minutes of March 28, 1988 as corrected was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.

COMMISSIONER KENNETH BAILEY'S REPORT

Road Department Equipment - Bids for the purchase of a key cabinet have been received from SA-SO for

$288.95 and Viking Office Products for $179.68. Bids for the purchase of three I Beams were received from

Rusty's Iron for $1,866.40 and Young's Machine for $2,509.00. A motion to approve the bids from Viking

Office Products for the key cabinet and from Rusty' s Iron for the I Beam's was made by Commissioner Bailey

and seconded by Commissioner Maryboy. UNANIMOUS.

Road Projects - Commissioner Bailey reported that the construction crew is finishing the Hovenweep road

project to a gravel surface that can be oiled. The next project will be Brown's Canyon road then the

Hart's Draw road. There are four or five projects between Brown's Canyon and Montezuma Creek that will be

completed this summer and by fall they should be working on the Aneth to Ismay road.

Public Safety Building - Some of the concrete slabs have settled at the Public Safety Building project and

have affected the drain lines underneath. The concrete slabs will have to be removed to retest the soil

compaction and the problems corrected before the concrete is replaced. The responsibility for the

additional expense will be determined after the tests are made.

Boundary Commission - Commiissioner Bailey asked that an official letter be sent

to Monticello's Mayor Ernest Sonderegger and Blanding's Mayor Jim Shumway asking that they appoint an

elected official of the municipality to serve on the Boundary Commission.

Lopez Property - The FHA appraiser was in the area last week and made an appraisal of the Lopez property.

A copy of the appraisal will be available in about two weeks. If the appraisal is not acceptable, the

County can then reject it and get an independent appraisal.

Joint Roads Committee Meeting - Commissioner Bailey reported on the Joint Roads Committee Meeting held in

St. George. The State Department of Transportation wanted to give San Juan County maintenance control of

the road to the Robert Redd Ranch, the Goosenecks, the Isabelle Hill road from Mexican Hat to U95, and the

White Mesa to Montezuma Creek road. It was noted that San Juan County is not willing to make those

changes. UDOT will ,keep the roads to the Robert Redd Ranch and the Goosenecks but will meet with the

County to try and work out a solution on the other roads. The County has also asked that the Montezuma

Creek to Red Mesa, Aneth to Ismay, and from the Colorado line to Hovenweep National Monument roads be

placed on the State system. The only other road requested to be placed on the State system was a road in

Morgan County.

The Oljato Bridge was listed as a project. The engineering needs to be completed on the Piute Creek Bridge; Creamer & Noble will be asked to submit a proposal on that bridge.

Tax Limitation Bill - The Joint Road Committee is suggesting that each County in the State prepare a tentative budget using figures with the Tax Limitation Bill in effect. That would let the County and the public know what they will be faced with.

House Bill 157 - The Committee authorized Clyde Naylor and Jerry Lewis to meet with Rick Johnson and Dave Spatafore to see if a compromise can be worked out on House Bill 157. Commissioner Bailey stated that transfers were already being made to the urban areas in population through the present formula and that it will continue to accelerate in the future. The study showed more needs in the rural areas; therefore, any change in the formula should favor the rural counties.

Five Cent Gas Tax - The motion proposed by the Joint Road Committee was to consider the five cent gas tax along with additional money that will be obtained from UDOT and it will be figured as new money under any change in the formula and any change in the 60/40 split with DOT. The motion was passed by one vote. Congressman Howard Nielsen - Congressman Howard Nielsen will be visiting San Juan County on April 15 and 16. There will be a town meeting in Monticello and Blanding on the 15th then a town meeting in Navajo Mountain on Saturday, the 16th of April as well as a tour of Hovenweep National Monument. Truck Bid - Commissioner Bailey made a motion to approve the bid from Great Basin for two 10-wheel auto-car cab and chassis with cat engines and locking rear end for $53,999.00. Commissioner Maryboy seconded the motion. UNANIMOUS.

Monticello Road Shed Tools - A motion to approve the purchase of needed tools for the Monticello Road Shed in the amount of $1,304.51 from Motor Parts was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

COMMSSIONER CALVIN BLACK'S REPORT

Lake Powell Region Resource Development Council - An executive order by Governor Norman H. Bangerter has established the Lake Powell Region Resource Development Council to resolve various management conflicts in the Lake Powell vicinity. A representative from the San Juan County Commission has been asked to serve as a member of the council. Commissioner Bailey made a motion to appoint Commissioner Calvin Black to the Lake Powell Region Resource Development Council. Commissioner Maryboy seconded the motion. UNANIMOUS. Utah Counties Finance Cooperative/Closing Details - The closing for the Pooled Capital Improvement Financing Program: San Juan County Equipment Lease/Purchase Project was held Friday, April 1, 1988 at 10 a.m. at the Jones, Waldo, Holbrook. & McDonough offices. Boettcher & Co., Inc. will purchase from San Juan County its legally issued Revenue Bonds, Series 1988 for $595,000. The underwriters discount will be $17,850. Commissioner Black stated that with this reissuance there is a subsidy that cuts the interest rate some. The interest rate averages 8.14% and there may be an additional subsidy which depends on how many people borrow money through the Utah Counties Finance Cooperative.

San Juan Area Resource Management Plan - The Utah State Office of the Bureau of Land Management has announced the reopening of the public contnent period in order to allow further review and comment on the proposed San Juan Resource Management Plan/Final Environmental Impact Statement (RMP/EIS). The Commission would like to meet with local BLM officials to try and work out some compromises in the Final Environmental Impact Statement.

National BLM Advisory Council - The National BLM Advisory Council meeting will be held in southern Utah May 4-7, 1988. The meeting will begin in Cedar City with a public coimient period at 10:45 - 11:45 a.m. with both verbal and written comments being accepted on such issues as the San Juan Area Resource Management Plan, Burr Trail project and the C02 project in Garfield County and other areas. Commissioner Black made a proposal to involve high school students by offering cash awards for 1st, 2nd and 3rd places for the best essays or statements with respect to the benefits of multiple use of public lands. The papers could be on a specific area of concern or a general statement. The winners would present their essays along with all the other papers to the Council at the public coimient period in Cedar City. Commissioner Black will also try to arrange public comment periods in other areas where the Advisory Council will be meeting.

COMMIlSSIONER MARK MARYBOY'S REPORT

Oil Companies Lawsuit - Commissioner Maryboy reported on the meeting with the Tribal Tax Commission and Attorney Lyle Anderson on the oil companies lawsuit. The Tax Commission wanted more written information and a meeting with all of the Utah Chapter officials to get their feelings about the lawsuit before they state their position.

Indian Health Service Trash Dump - The Indian Health Service trash dump in Montezuma Creek is becoming a real problem as it is not being maintained. The County has made an application to the BLM to put a landfill dump near Montezuma Creek but there are problems with mining claims and may not be able to be cleared up. The existing IHS dump is on Navajo Tribal land and the County has no authority there. Chapter Planning Meetings - Cornnissioner Maryboy said he would be attending Chapter planning meetings in Mexican Water, Aneth and Red Mesa tonight. The extended San Juan Area Resource Management Plan comment period will be discussed. Garments or resolutions need to be submitted to the BLM requesting that the plan be amended to allow wood gathering and other activities with reasonable regulations.

ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT

San Juan/Grand County Line - Earlier County Engineer Doug Pehrson was asked to survey the San Juan/Grand County boundary line as there was some question by Spanish Valley residents as to double taxation. Mr. Pehrson will check the survey with County Assessor Barbara Montella and County Recorder Louise Jones and then make a recommendation to the Commission.

Wildland Fire Agreement - Commissioner Bailey made a motion to approve and authorize Chairman Black to sign the agreement between Utah State Lands and Forestry and San Juan County on the Wildlife Fire Protection with the adjustments that had been previously discussed. Commissioner Maryboy seconded the motion. UNANIMOUS.

Oil and Gas Production Summary - The 1987 year end oil and gas production summaries were discussed. There were 30 new wells but oil production was down 10% at 7,725,607 barrels and gas production was down 3% at 33,154,229 barrels. The assessed value of oil and gas two years ago was approximately 75% of the total property tax; last year approximately 65% of the total and is expected to drop even further this year. Fire Control Equipment - While John Baker was working with the Fire Control he applied for State Rural Community Protection funding. San Juan County was awarded $817.50. Administrative Assistant Rick Bailey recommended that the money be used to help purchase a radio and turnout suits for the fire department. Commissioner Bailey made a motion to approve the purchase of a Max Trac radio from Motorola for $697.00 with the State paying $350.00 and three turnout suits be purchased from L.N. Curtis & Sons for $1,215.00 with $467.50 being paid by the State. Commissioner Maryboy seconded the motion. UNANIMOUS. Fire Truck - A used fire truck is available at L.N. Curtis in Salt Lake. Rick Bailey and Joe Slade will check it out to see what condition it is in and what equipment it would need. With the purchase of two new trucks for the surveyor and communications departments, the old vehicles will be transferred for use in the County fire department.

Hazardous Materials Response Plan - The State of Utah is taking their eleven commercial truck officers and using them as the hazardous material responders in addition to their other duties. One or two additional people are requested within the response area to be trained as responders also. Rick Bailey has been asked to be one of those responders. It would require approximately five weeks of training before September. The Commissioners felt that Mr. Bailey would not have the time required for the needed training. Sheriff Lacy was contacted to see if someone would be available from that department for the training. Sheriff Lacy felt that with the new Public Safety Building nearing completion he would be in a bind because of training needed by his staff for the added responsibilities.

CURRENT BUSINESS

Sheriff's Department - Commissioner Bailey made a motion to approve the promotion of Andrew Peterson as a Certified Peace Officer with a salary at Grade 9 Step 2, $1,215.00 per month effective April 1, 1988. Conmissioner Maryboy seconded the motion. UNANIMOUS.

Bluff Gravel Pit Rejects - Jerry Holliday met with the Commission to report that rejects are being hauled out of a pit leased from the BLM for County use. The contractor that is crushing gravel for the County is loading the reject material for an individual and it is being sold for $10.00 a load to Bluff residents. The contractor was notified that the material was not to be hauled out of the pit but apparently it is still being moved. The Sheriff's Department will see that the activity is stopped and investigate the matter.

Air Service in San Juan County - A letter from Scenic Aviation, Inc. stating the available air service to Monticello was discussed by the Commission in connection with the tannery operation proposal for the Monticello area.

Human Services Board Recommendations - Commissioner Bailey made a motion to approve the recommendation of the Human Services Board in funding Social Service programs. Commissioner Maryboy seconded the motion. UNANIMOUS. The requests recommended by the Human Services Board were: CEU Counseling, $34,000; Transportation Services $22,000; Project Good Work $13,000 with an additional $3,000 for this year; Transition Center $13,500 with $5,000 additional for this year; and the UNDC Developmentally Disabled program $10,000. The Transportation Services had requested $32,000 but the Navajo Tribe has agreed to give that program $10,000 so there will be an additional $10,000 available through the Human Services Board to fund other programs or to keep in reserve.
