MINUTES OF THE SAN JUAN COUNTY COMMISSIONERS MEETING HELD
MAY 3, 1982
Time: 10:00 a.m. in the Commissioner's room at the Monticello Courthouse.
Members Present: Chairman Calvin Black, Commissioner Robert Low, and Commissioner Kenneth R. Bailey.
Minutes of the previous week were read and approved with the stipulated corrections upon the motion of Commissioner Low and the Second of Commiss. Bailey and it carried unanimously.
BLANDING VOTING DISTRICTS DISCUSSED;
Chairman Black brought the discrepancy between the boundaries of the Blanding Southeast #17 and Blanding Southwest #11 voting districts to the attention of the Commission. Several voters registered and voting in Blanding Southwest #11 are residing in Blanding Southeast #17; therefore, the Commission is seeking the legality of the situation from Bruce Halliday, San Juan County Attorney. Mr. Halliday advised the Commission that boundaries could be legally changed upto ninety (90) days prior to elections; with a change the registration agents must meet to determine the separation of voters.
A Motion was made by Commissioner Bailey, second by Commissioner Low and carried unanimously that the
description of the voting district #11 and voting district #17 be changed to read as follows and all
reference to 163 be changed to U.S. 191 and that the Clerk's Office proceed with making said changes forthwith:

HOSPITAL RETIREMENT:
A letter was received by the Commission in reference to the Hospital Employees not being put back into the State Retirement System. A question was raised on the legal aspect of this process to Bruce K. Halliday, San Juan County Attorney. He will draft a letter to the State Retirement Board for:
(A) Reconsideration of their decision.
(B) Obtaining recommendations from the Attorney General's Office.
HOSPITAL EMPLOYEE HOUSING;
Commissioner Low stated the new Administrator of San Juan Hospital will be arriving the latter part of this month; however, the housing promised is not adaquate as the roof needs repair, house needs paint-ing, carpets need cleaning. A policy needs to be adopted for the cleaning of these homes and it was suggested that a person be hired for part-time maintenance, fixing up the homes.
MEXICAN HAT AMBULANCE:
The Mexican Hat Ambulance has been put out of service by the State as it does not meet the standards needed. Mr. T.J. Knight has requested a letter from the Commission requesting nonuse of this ambul-ance. The suggestion was brought up to look into the need for the County and contact Monument Valley Hospital to work out a service deal for ambulance service for the Mexican Hat area.
MONTICELLO CIRCLE PARK TRADE DISCUSSED:
Commissioner Low reported on his presence at the City Council meeting in reference to the trade of property. Jack Young proposed a motion before the council to make the trade and its was carried; the deed for the property will be obtained and presented.

NUCLEAR WASTE PUBLIC INFORMATION MEETING;
Commissioner Low has contacted Mr. Gary Sandquist, Professor at the University, to address the public
on Nuclear Waste at a date to be determined later.
LA SAL SANITATION DEPOSITORY;
Commissioner Low stated that La Sal has located the space for a sanitation depository but they need the assistance of the Road Department "cat". Commissioner Bailey will see to the necessary arrange-ments and contact Bobby Wilcox at the La Sal Post Office to coordinate the project. A call will be made to determine if this land is on BLM property.
BLUFF/MONTEZUMA CREEK ROAD;
Commission Bailey reported that Doug Pehrson, Winston Hurst and BLM are working on the right-of-way
project on this road project.
COMMISSIONER BAILEY'S STATEMENT; May 3, 1982
Statement concerning questions raised about road improvements on the reservation and vandalism to road department equipment while doing road work on the reservation.
We all abhor the vandalism that takes place almost daily all over our county both on and off the reservation, to road equipment, signs, schools, public buildings and private property. We do need to do more to apprehend and punish those who destroy through vandalism. We need to appeal to all citizens of the county to be on the watch for this type of activity and report to the Sheriff's Office suspicious activities or outright vandalism that we observe.
The San Juan County Road Department has the same responsibility to do maintenance and new construction both on and off the reservation.
Because of the great needs for improvement of roads on the reservation there have been some very effective cooperative programs instigated and are presently being carried out on a cooperative cost sharing basis between San Juan County, The Navajo Tribe, The Bureau of Indian Affairs, the Local Chapters and UNDC. These cost sharing programs enables the San Juan County Road Department to accomplish more with the resources they have allocated to the reservation roads in upgrading them and especially the School Bus routes that are so important to the operation of the new schools being built near and on the reservation. The upgrading of these roads on the reservation is very much appreciated by the local Navajo Indian people as evidenced in our meetings with them on a local basis. There is as much concern at these meetings about vandalism on their part as we have, and much progress has been made the last few years to curtail this vandalism. There is an organized attempt being made to build in Montezuma Creek a building to house the ambulance, a fire truck and approximately 1/2 of the building will be for use of the county road department to store supplies locked up and to keep equipment for road maintenance on the reservation and where it also can be locked up.

STATE ASSESSMENTS;
Commissioner Bailey mentioned that the State Assessments are to be in by the middle of June. This
subject will be discussed with Marian Bayles further at a later date.
PARK CITY ROAD SCHOOL;
Commissioner Bailey reported that Doug Pehrson, Bernal Bradford and himself will be attending a road school in Park City on the 19th thru 21st of May. The school will consist of talks about management, pavement, designs, bridge and asphalt.
PACK CREEK ROAD;
Commissioner Bailey reported that Doug Pehrson had determined a need for approximately 600 feet of oil/gravel to be removed and put down a rock base. Rather than haul gravel from La Sal the Southern Paving will sell gravel from their pit and haul it to the road where needed.
RURAL COMMUNITY FIRE PROTECTION;
John Baker announced to the Commission the awarding of $1200 to purchase equipment for the La Sal Fire Department; however, the money is to be matched from the budget. This transaction must be completed by August 15, 1982. There were not any approvals for Monticello, Bluff, or Cedar Point because of lack of funds.
Mr. Baker stated twenty (20) training slots were allotted for Mexican Hat and Montezuma Creek from Utah Tech.
PARTISAN POLITICAL ACTIVITIES;
Chairman Black wrote up a memo to be handed to all county employees, including hospital, nursing home,
and both road sheds. It stated:

It is requested that no partisan political activity be conducted during working hours or in County offices by candidates or their supporters.

STATE HISTORICAL SOCIETY;
Chairman Black was presented a suggestion from Janet Wilcox and Charles Peterson from the State Historical
Society asking about the feasibility of the County advancing money for the publication of a book on San Juan
County and then being reimbursed from the sales of the book.
A letter was received from Mr. Kent Powell explaining the financial aspects of a book of this nature.
As soon as the money situation can be resolved, the Commission all agreed to proceed.

BIDS ON GAS AND DIESEL: A motion to accept the Bid from Abajo Petroleum for gas and diesel was made by Comm. Ken Bailey and second by Comm. Bob Low, carried unanimously. The remaining Bids will be discussed and accepted or denied. GOVERNMENT SELLING SURPLUS LAND: Chairman Black reported on the Federal Government selling their surplus lands. He suggested that the Commission appoint a Task Force to look into the possibility of San Juan County having Federal land that should be privately owned. Chairman Black will bring this up to the BLM on May 4, 1982 at the BLM Meeting but they may not be able to serve on the committee but hopefully will work with the Commission on this Task Force. This Task Force should be made up of all occupations such as businessmen/women, ranchers/ farmers, miners, and other people to make up a broad base of the population. PERSONNEL POLICY: Commissioner Bailey made the motion for the personnel policy as follows: In order to clarify the sick leave and pay schedules adopted in July 1979, I move that we in-corporate the pay schedule and the Sick Leave Policy that was filed in the Secretary's file, into today's minutes. As per the motion made by Commissioner Bailey the sick leave is amended for the Personnel Policy as follows:
As an insurance against loss of income when an employee is unable to perform his work because of illness or injury of the employee, sick leave with pay is provided each regular, fulltime employee. Sick leave may be accumulated at the rate of one half work day for each full calendar month of service.
Sick leave in excess of three successive working days shall be supported by a medical certificate or other acceptable proof.
Sick leave is allowable in the case of the employee's personal illness or injury only. Abuse of sick leave privileges may be considered as grounds for suspension or dismissal.
To receive consideration for sick-leave allowance the employee must make certain that his Department Head is notified of the illness on the first day of such illness.
Applicable changes are to be made in the Personnel Policy pursuant to this action or any subsequent action and destroy all old copies. The new policy is to be presented at the next regular Commission Meeting for approval.
CORRESPONDENCE:
Letter was received from Four Corners Mental Health on the subject of the property. Chairman Black presented the letter and contract to Bruce K. Halliday, San Juan County Attorney, to determine the legal aspects and alternatives San Juan County has with the property involved. Mr. Halliday is to give written report to the Commission upon completion.
