MINUTES OF THE SAN JUAN COUNTY COMMISSIONERS MEETING HELD

JANUARY 5, 1984

The San Juan County Commission met in regular session on Tuesday, January 3, 1984, at the hour of 10:00 a.m in the San Juan County Courthouse at Monticello, Utah.

The following members were present: Commissioner Calvin Black, Chairman

Commissioner Kenneth R. Bailey Commissioner Robert Low

Minutes of the previous meeting were approved with the specified corrections on the moiton of Commissioner Low. The moiton was seconded by Commissioner Bailey and carried unanimously.

POLICE SERVICE ON THE RESERVATION

Don Kemner, representing the Montezuma Creek Security Needs Council, met with the Commission to discuss police service on the reservation. Sheriff Rigby Wright was also present. Mr. Kemner presented the Commission with written recommendations for local law enforcement in the Montezuma Creek and Aneth areas. The Commission reported that they are working with an architect about the possibility of renovating the old Montezuma Creek Elementary Scholl inot a jail and tribal court facility. Sheriff Wright reported that the Sheriff's department has ordered walkie-talkie pagers which would enable Officer Nelson Begay to be available at all times. Sheriff Wright also reported that there is a toll free number for the Sheriff's Office and suggested any calls for assistance come through his office, sot they can dispatch the necessary officers. The Commission requested Sheriff Wright obtain the deputies who have responsibility in the Southern end of the county logs for the months of November and December, 1983, so they can review the amount of time he spends in these areas.

The Commission reviewed the grant request Sheriff Wright is submitting as a DUI Enforcement Project Proposal for a two man tactical unit. The area of concern is the Navajo Reservation and the south San Juan County off reservation area.

Commissioner Bailey reported that Steve Creamer and an architect toured the old elementary school in

Montezuma Creek and will call with their recommendations about the possibility of using this building

for a jail and tribal court.

1984 COUNTY COMMISSION ASSIGNMENTS

AREA AGING PROGRAM DISCUSSED

Al Haskins presented the Commission with the 1983 Area Aging Year-End Evaluation.

Al Haskins also requested the Mike Young Chevrolet bid in the amount of $10,898,98 for a van be accepted. It is for an eight (8) passenger 3/4 ton van for the Aging Services Program. Commissioner Bailey made a motion to accept Mr. Haskins's recommendation. The motion was seconded by Commission Low and carried unanimously.

BEER LICENSE APPROVED

Mr. Don Olson of the Twin Rocks Grocery Market in Bluff met with the Commission to present an application for a beer license. Commissioner Low made a motion to approve the application. The motion was seconded by Commissioner Bailey and carried unanimously.

RECORDER REQUESTS PART TIME HELP

Mary Lou Mosher, County Recorder, met with the Commission to request part time help for approximately 2 to 3 months to make the 1983 land changes. The Commission suggested Mrs. Mosher consult the County pay scale for a starting salary.

COMMISSIONER BAILEY'S REPORT

Commissioner Bailey reported that Doug Pehrson, County Surveyor, has to choose an engineer for the Bluff to Montezuma Creek Road on January 9, 1984.

Commissioner Bailey also reported on the leaks in the steam lines of the Courthouse heating system. Commissioner Bailey reviewed several possible solutions being considered.

ELECTION JUDGES AND INTERPRETERS DISCUSSED

Gail Dalton, County Clerk, met with the Commission to request the Commission set the fees to be paid for election judges and interpreters for elections. Miss Dlaton recommends $45.00 per day as this will be a thirteen (13) hour day and many of the judges and interpreters will have to take a day off of work to serve as election judges and interpreters. Commissioner Bailey made a motion to accept Miss Dalton's recommendation. The motion was seconded by Commisisoner Low and carried unanimously.

COUNTY VACATION POLICY DISCUSSED

Gail Dalton, County Clerk, met with the Commission to discuss the County policy. An employee is allowed to carry two (2) years of accrued vacation time into the next calendar year. The Commission and the Clerk agreed to give employees until March 31, 1984, to use up any excess days they may have accrued.

TRANSFER OF FUNDS TO TRUST FUND DISCUSSED

Gail Dalton, County Clerk, met with the Commission to discuss the transfer of $1 million dollars in the trust fund as budgeted for 1983. Commissioner Bailey made a motion to approve the transfer of funds. The moiton was seconded by Commissioner Low and carried unanimously.

PROJECT BOLD POSITION REVIEWED

Commissioner Black reviewed the Commision's position on Project Bold with Sam Klemm of Representative Howard Nielsen's office.

SHERIFF WRIGHT MEETS

Shriff Rigby Wright met with the Commission to recommend accepting the Mike Young Chevrolet bid on two patrol cars. The bid in the amount of $9,741.84 is for two (2) 1984 four (4) door Impala sedans. Commissioner Low made a motion to accept Sheriff Wright's recommendation. The motion was seconded by Commissioner Bailey and carried unanimously.

TAX ANTICIPATION NOTES DISCUSSED

Marian Bayles, County Treasurer, met with the Commission to discuss the tax anticipation notes for the 1984 fiscal year. She presented the following bids for one (1) year on $2,000,000:

Zions 1st National Bank 7.10% interest rate

First Security Bank 6.9% interest rate

She recommends accepting the bid from First Security Bank. Commissioner Low made a motion to accept her recommendation. The motion was seconded by Commissioner Black and carried unanimously.

SAM KLEMM MEETS

Sam Klemm met with the Commission to review Representative Howard Nielson's schedule in San Juan County for January 19 & 20. Representative Nielson and the Commission will tour a wildcat well on La Sal Mountain with Ranger Robert Carling of the Forest Service.

CORRESPONDENCE RECEIVED

The Commission received a letter from the City of Blandign stating the City Council has expressed interest in accepting responsibility for the operation and maintenance of the Blanding Airport. They also requested the Commission consider turning over the hangars and other County owner porperties to the City. The letter also stated they would like the airstrip, ramp and parking areas to fall under the present City/ County road and streets agreement and for the County to continue responsibility for snow removal.

The Commission received a letter form the Utah Office of Planning & Budget stating the July 1, 1983, preliminary population estimates for San Juan County. The estimate is 12,900 for 1983. The Commission finds this an acceptable figure.

The Commission received a summary of the computer project for Sna Juan County from Kermit Blake of

Mesa Computer Company. The summary included what has been done and the areas that still need attention.

JUSTICE DEPARTMENT LAWSUIT DISCUSSED

Bruce K. Halliday, County Attorney, and Gail Dalton, County Clerk, met with the Commission to discuss the lawsuit against San Juan County filed by the United States Justice Department. Mr. Halliday reported that the court was unhappy with the following language in the Agreed Settlement & Order:

All reasonable steps to secure the appointment of bilingual poll officials and interpreters shall be taken including, when necessary, on-site recruitment efforts at Navajo Chapter meetings; announcements, in Navajo or English, on KNDN or KRTZ; and written requests for assistance to to the Utah Navajo Development Council, the Navajo Tribe's Board of Election Supervisors in Window Rock and the San Juan County School District. If such steps are taken, the County's inability to secure such appointments shall not be deemed a violation of this order.

Mr. Halliday will explain to the court that the Commission and the County Clerk are uncomfortable with that language being taken out of the agreement even though it is legally not enforceable.

The Commission received a summary of the UNDC Board meeting held December 15, 1983, with the following entry:

Lawsuit Against San Juan County; Donna Chavez reported that the Navajo Tribe Justice Department was considerng intervening in the lawsuit on behalf of the Utah Navajos. The U.S. Justice Department has filed a lawsuit against San Juan County for violation of Federal Laws on voting rights. UNDC Board passed a resolution asking the Navajo Tribe Justice Department to join in the lawsuit on behalf of the Utah Navajos.
