The San Juan County Commission met in regular session August 3, 1987 at the hour of 10 a.m. at the San Juan County Courthouse, Monticello, Utah.

The following members were present: Commissioner Black, Chairman

Comnissioner Bailey Commissioner Maryboy

Minutes of the July 27, 1987 Commission Meeting were approved with corrections on the motion of Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.

COMMISSIONER BLACK'S REPORT

Region Corrections Facility - Commissioner Black reported on the meeting with the Governor last Thursday on the Monticello site for the Region Corrections Facility in which Representative Adams led the discussion. A number of people participated in making comments and addressing the issues for the Governor's consideration. Those in attendance supporting the Monticello site were Sam Taylor and his wife, UDOT Commissioner, Grand County Commissioner Zimmerman, Lynn Lee, SJCEU, Joe Slade, Development Board, Keith Redd, Mayor of Monticello, Robert Anderson, Hardy Redd, Representative Jack Redd, Winn Wescott, and Gordon Stroghn, Contel Service. There was a good turn out and the Governor was very attentive but made no commitment.

River Trip - Commissioner Black said he was invited by Harvey Wickware, Superintendent Park Service, to go on the Cataract River Trip August 24-27. Also invited are Gene Nodine, BLM, George Morris, Forest Supervisor, Bob Weidner, assistant of Senator Jake Garn, and other representatives from state agencies.

COMMISSIONER KENNETH BAILEY'S REPORT

Road Needs Study - Commissioner Bailey reported on the road needs study that was in Provo last week. A

paper was presented with allocation costs between users and non-user gas tax. Commissioner Bailey said he

feels it's not fair to say that money is to be spent on the roads that the tax comes from. Commissioner

Bailey said he is going to prepare a paper showing the rural position on the needs study for the meeting

in September. The road needs study committee will meet on August 21 in which the final paper on the

road needs study will be presented.

Administrative Jurisdiction - Legislature - The DOT Committee and Wilbur Smith Company are going to meet

with the Legislature on administrative jurisdiction. There are certain guidelines in trading state,

county and city roads. The study is recommending the legislature set up guidelines and let UDOT make the

changes in jurisdiction.

Gravel at Montezuma Creek Baseball field - Commissioner Bailey reported that gravel has been installed at

the Montezuma Creek baseball field.

Gravel Pit at Johnson Creek - There is a problem with the gravel pit at Johnson Creek because the Forest

Service will not allow the county to haul gravel out of bottom of the creek. They are having to haul the

gravel from Lem's Draw. The Forest Service said there are mining claims and other complications in

getting it released. Commissioner Bailey said he will find out who has the mining claims. State

Bookmobile install bathroom at county road shed - Commissioner Bailey said the State Library Division

wants to install a toilet at the county road shed where the bookmobile is located. Commissioner Bailey

made a motion to let the State to install a bathroom at their own expense. Commissioner Maryboy seconded

the motion. UNANIMOUS.

Monticello Airport - Septic Tank - The Monticello Airport has a steel septic tank by the trailer which

has rusted out. Commissioner Bailey said he is getting prices on whether to tie it into the present one

or to install a fiberglass one by the building. The Commission authorized Commissioner Bailey to follow

through with what is economical and feasible to do.

COMMISSIONER MARK MARYBOY'S REPORT

Roads on Reservation - Commissioner Maryboy reported that he met with several Utah chapter officials to

discuss the main roads on the reservation. There are complaints that they need to be graveled, oiled or

paved. The Commission suggested that they mark on a map the roads that need to be repaired.

UNI - Management - Commissioner Maryboy said he was told by several ladies of UNI that the sewing plant is

about to shut down. The Commission said this should be brought before the UDIA board.

In-Holding Exchange of State Lands - Commissioner Maryboy said the Navajo Tribal Land Administration

Office called him to set up a meeting with him and Commissioner Black to discuss the In-Holding Exchange

of State Lands. The meeting will held be sometime this month.

BIDS MONTEZUMA CREEK SIDEWALKS

The road department meeting with all of the Commission was postponed until next week but bids for curb,

gutter and sidewalk at Montezuma Creek were opened at 10:00 a.m.

The following two bids were received:

Young Builders Inc. $12.50 per foot curb and gutter

$ 8.30 per foot sidewalk Tri-Hurst $14.51 per foot curb and gutter

$10.53 per foot sidewalk

Commissioner Bailey made the motion to award the low bid to Young Builders Inc. Commissioner Maryboy seconded the motion. UNANIMOUS.

1987 TAX ANTICIPATION NOTES

Gail Johnson, clerk, presented the Commission a resolution for the 1987 Tax Anticipation Notes for the sum of $800,000. Commissioner Bailey made the motion to approve the Resolution and authorized Commissioner Black to sign the notes. Commissioner Maryboy seconded the motion. UNANIMOUS.

ALCOHOLIC BEVERAGE CONTROL - TRAINING & EDUCATION SEMINARS

Gail Johnson, clerk, discussed with the Commission the requirements of the Department of Alcoholic Beverage Control for training and education seminars for holders of licenses for on premise drinking of alcoholic beverages. The state has approved only two training programs and they are located in Salt Lake. Mrs. Johnson said this will be an inconvenience to the county license holders. The Commission said that the county ordinance on beer licenses will have to be amended to meet this requirement.

PERSONNEL POLICY - JIM HEATON - WEED CONTROL - HOLIDAY PAY

Jim Heaton, county weed and rodent control, met with the Commission regarding his leave time. The Commission said that because he is seasonal help he is not entitled to benefits, one being holiday pay. The Commission agreed to discuss this with Jim Keyes, agent, next week.

WEED AND RODENT CONTROL

Jim Heaton told the Commission that the BLM reimbursement rate for the county spraying of weeds is not enough. The Commission told Mr. Heaton to bring this up with the county weed board.

PHYSICIAN RECRUITMENT - PAYMENT

The Commission met with John Fellmeth, hospital administrator, Dr. Steve Warren, Mrs. Warren, and Kent

Adams, Blanding Health Care Committee to discuss the emergency situation of the need for physicians-in the county. Commissioner Black reported and was verified by Kent Adams that in the meeting with the Blanding City Council and the Blanding Health Care Committee, the Committee unanimously requested that the county proceed with the negotiation with the doctors who are interested. If they are able to meet the conditions of hospital privileges and malpractice insurance that is under negotiation to transfer as quickly as possible.

SHERIFF'S DEPARTMENT - HIRE CORRECTIONAL OFFICER - BILL CHRISTENSEN

Claude Lacy, sheriff, told the Commission that he and a staff interviewed several people for deputy sheriff, corrections officer and secretary. Mr. Lacy said he would like to hire only one corrections officer as of now and later hire another officer, a deputy sheriff and secretary. Commissioner Bailey made the motion to hire William Neal Christensen at grade 4 step 4 - $1004.00. Commissioner Maryboy seconded the motion. UNANIMOUS. The Commission said that the salary amount is approved subject to the grade and step. Probationary period is one year. (Rick Bailey is redoing the sheriff department step and grades.)

PUBLIC MEETINGS - STATE LANDS AND FORESTRY

Rick Bailey, Administrative Assistant, reported that he attended the State Lands and Forestry's public meeting in Moab last Thursday. The meeting was to invite public comment on the Draft General Management Plan for the LaSal Mountain Planning Unit. Mr. Bailey said only four people attended the meeting.

AOG MANAGEMENT MEETING

Rick Bailey, Administrative Assistant, reported that he attended the AOG meeting on Thursday in regards to Community Right to Know Act Title #3. It is the responsibility of the southeastern region to come up with a response plan in handling hazardous materials. Bill Howell, AOG director, is going to recommend that an executive board with one or two people from each county and they would be responsible to come up with a group to do their own planning based on their own needs.

COMMUNICATIONS - MICRO-WAVE SYSTEM

Rick Bailey said he talked to Steve Proctor, state telecommunications, about the county changing over to the micro-wave communications system. The state is interested in sharing these services if the county changes. The state uses the micro-wave system for long distance phoning and can access local dial tones.

Mr. Bailey said this would save the county money and give an advantage to possible problems with the system because the state would help.

HILL-BURTON OBLIGATIONS - DEPARTMENT OF HEALTH & HUMAN SERVICES

The Commission received a letter from the Department of Health and Human Services regarding the Hill-Burton obligations. The letter states that they are anxious to reach an agreement with the Commission pertaining to this recovery. The Commission told Rick Bailey to write a letter telling them the county would like to reach a satisfactory resolution for this matter.

UNEMPLOYMENT CLAIMS FOR JANUARY TO JUNE 1987

Rick Bailey, Administrative Assistant, reported that the county paid $3346.90 in unemployment claims for the period January 1 to June 30, 1987.

MEXICAN HAT TAILINGS SITE - GROUNDBREAKING CEREMONY

Representatives of the U.S. DOE and the Navajo Nation will conduct a groundbreaking ceremony at 11 a.m. on August 6, near the Mexican, Utah inactive uranium mill tailings site. Commissioner Maryboy will represent the Commission at the groundbreaking.

U.S. SENATOR ORRIN G. HATCH - UTAH TASK FORCE

U.S. Senator Orrin G. Hatch will be making his annual swing through the state to meet with each of the Utah Task Forces. The southeastern meeting will be held Monday, August 24, from 3:15 p.m. to 4:15 p.m. Commissioner Bailey said he plans to attend this meeting.

MONTEZUMA CREEK VOLUNTEER RECREATION COMMITTEE - BASEBALL FIELD LIGHTS

The Commission received a copy of a letter from the Montezuma Creek Volunteer Recreation Committee to UNDC requesting a contribution of $300 for baseball lights. The county recreation has budgeted $6000 for this project and the bids total cost is $6330.00.

RESOLUTION TO AMEND THE COUNTY'S ASSESSING AND COLLECTING FOR 1987

Gail Johnson, clerk, and Lyle Anderson, attorney representing the county in the tax litigation, met with the Commission about amending the county's budget for 1987 assessing and collecting. Expenses for the Texaco Lawsuit have exceeded the amount that was budgeted. Mrs. Johnson said she will advertise August 17 to adopt a resolution. The amended budget will be sent to the state auditor for approval.

DEAD HORSE STATE PARK - UDOT ASKS PARK SERVICE TO REBUILD PART OF ROAD

The Commission received the following letter from UDOT concerning the access road to Dead Horse Point:

Dear Mr. Black:

We are asking for a letter of support from you for our efforts in asking that the National Park Service spend $9 million to rebuild part of the access road to Dead Horse Point State Park, State Route 313 (SR-313).

In 1985, the National Park Service (NPS) began construction on an access road to the Island in the Sky area in Canyonlands National Park. Roadbed material sites were unavailable near the project, so both roadbed and bituminous materials were hauled from Moab over fourteen miles of SR-313. Because the road was not built to withstand heavy truck traffic, the pavement has been irreparably damaged by the materials hauled.

Prior to construction on the Canyonlands access road, the Utah Department of Transportation (UDOT) met with the National Park Service and the Federal Highway Administration, the agency which supervises national parks road construction. These agencies were informed of the potential damage to the state highway from materials haul and were asked to participate in preventive maintenance. The request was refused, and in interim, UDOT has spent approximately $665,000 for emergency maintenance. Another $650,000 is needed this tourist season just to provide a temporary dust-free surface.

We are, therefore, asking for your support of our request for NPS funding of the reconstruction of State Route 313 between US 191 and the access road to Canyonlands. Since letters of support will serve as part of the documentation of our request to NPS, we would appreciate an early response from you.

Dear Mr. Findlay:

San Juan County supports the decision of the State of Utah, Department of Transportation in its request to the National Park Service to provide funding to rebuild part of the access road to Dead Horse State Park, State Route 313 (SR-313).

Part of the bill authorizing Canyonlands National Park provided that the Federal Government was authorized to fund access roads from the state highways into the park. Those roads would be constructed from those highways now designated as US-191, SR-95, SR-24.

As it was the construction company hired by the Park Service that caused the severe damage to the road, it only seems appropriate that the National Park Service be required to replace or repair SR-313 and provide the other access roads as the bill provided.
