MINUTES OF THE BOARD OF COUNTY COMMISSIONERS' MEETING HELD ON JANAURY 30, 1961, AT 10 A. M. IN THE COUNTY
COURTHOUSE AT MONTICELLO, UTAH
Meeting opened at 10 A. M. with Commissioners Marion H. Hazleton, Hyrum T. Black and Ray V. Redd being in attendance, also Clerk Ada Palmer. Chairman Hazleton conducting the meeting.
MINUTES READ AND APPROVED
Minutes of the meeting of January 23rd were read and approved. COUNTY ROAD SUPERINTENDANT REPORTS Mr. Dougherty, road superintendant reports: l.That the roads within the county have been opened after the last storm.
2. That the County discontinue the automatic $10 per month yearly increase in salaries of road men and that salaries be changed ..to a classifed wage scale 'as follows:
Formen to be paid $420 to $450 per month
1st Class Operator $400 per month
2nd Class Operator $385 per month
Truck Drivers $370 per month
1st Class Mechanic $415 per month
2nd Class Mechanic $370 per month
Clerk $360 per month Changed to $370 per month (See Minutes of Feb. 14th)
A first class operator must be able to operate satisfactorily any and all equipment with a proven experience record with the County'.
A second class operator must be able to operate efficiently certain pieces of equipment.
COUNTY ACCEPTS :PROPOSED WAGE SCALE
A motion was made by Commissioner Black, seconded by Commissioner Redd, and unanimously carried, that the County go along with the proposed wage scale as submitted by Mr. Dougherty, and that future raises of the road workers to be given by merit and not by automatic raises.
PRIMARY GRAVEL CRUSHER NEEDED FOR MONTICELLO DISTRICT
Mr. Dougherty stated that a primary crusher can be obtained from the Kimball Equipment Company for the sum of $17,000 and can be traded in at full value at the end of one year if the County desires to get a larger unit at that time.
TOM REDD OF REDD'S ASKS FOR CONSIDERATION ON BIDS
Tom Redd representing the firm of Redd's was present to ask that the Board of County Commissioners give them consideration on bids for trucks.
Mr. Redd was assured that they would be given every consideration possible, the same as every other com-pany that bids.
MONTICELLO CHAMBER OF COMMERCE REPORTS
Kenneth R. Bailey, Jr., President of the Monticello Chamber of Commerce reported that the Chamber of Commerce was interested in seeing San Juan County buy as much equipment from local people as possible and that they also furnish as much business for the people of the County as they can.
Mr. Bailey also reported that he had contacted the Texas Gulf Sulfur Company to indue them to put the mill in San Juan County and to also favor San Juan County as far as building houses for employees was concerned. The Texas Gulf Sulfur Company expressed their appreciation for the concern that is shown to their company, but explained that all proven deposits of potash are in Grand County or in the disputed area, and that be-cause of commitment already made to the D. & R. G. W. and others it will be necessary to put the mill in Grand County. They further stated that they will not go into the business of constructing homes and felt that most employees would be living at Moab and commuting between the two places.
Mr. Bailey felt that the meeting was of great value because it had cleared up many misconceptions about the project.

COUNTY ATTORNEY SUBMITS OPINION REGARDING THE ISSUANCE OF RETAIL BEER LICENSES The following opinion was submitted by the County Attorney:
32-4-17. Retail Licenses.--- Cities and towns within their corporate limits, and counties outside of
incorporated cities and towns shall have power to license, tax, regulate or prohibit the sale of light beer, at retail, in bottles or draft; provided, that no such licenses shall be granted to sell beer in any dance hall, theatre or in the proximity of any church or school. The commission granting the license shall have authority to determine in each case what shall constitute proximity.
COUNTY TO GO ON RECORD TO SUPPORT HOME INDUSTRY BY GIVING 5% BREAK ON BIDS
A motion was made by Commissioner Redd, seconded by Commissioner Black, and unanimously carried, that the County go on record to support home industry by giving a 5% break on bids over out-of-county or out-of-state bids.
NEGOTIATIONS ENSUE REGARDING LAW ENFORCEMENT ON WHITE MESA
A delegation from the Ute Mountain Indian Agency was present to discuss with the Board of County Commission-ers law and enforcement on White Mesa. Among those present were John Kelly, Rehabilitation Director and five of the seven councilmen of the tribe. Mr. Kelly stated that the Ute Mountain Tribe considered that since the allotments on White Mesa were not on the reservation it was doubtful if the present system of law enforcement could be continued with all expenses being paid by the Tribe.
The County Attorney was present and had previously negotiated with Tom Raybon regarding the matter. He announced that the County had agreed to furnish a car and maintenance on the car with the exception of furnishing the gas and oil, if the Ute Mountain Tribe will furnish a residence and pay the salaries of law enforcement officers on White Mesa.
Mr. Kelly stated that the Councilmen present would like to take the matter up with the entire council be-fore making a committment.
A motion was made by Commissioner Redd, seconded by Commissioner Black, and unanimously carried, that the County Attorney draft a resolution for consideration of the entire Ute Mountain Tribal Council that the County furnish a car and maintenance of same, except the gas and oil for such car.

Gentlemen:
The San Juan County Commissioners proposed the following for law and order in White Mesa and Allen Canyon in San Juan County, Utah.
San Juan County will furnish a police car, equipped with radio for use by John Dufer or any other officer mutually acceptable to your tribe and San Juan County. The County will pay for the shop maintenance of said car and the tribe will pay for the oil and gas. The officer who uses this car is to live at White Mesa and his salary and the salary of Chester Cantsee shall be paid by the Tribe.
The County Commissioners do not feel that they can afford to have a full time officer working ex-clusively on White Mesa and Allen Canyon and so they desire to have such a co-operative arrangement with the tribe.
The commissioners would like to enter into a written agreement with your tribe for the above proposal and have such agreement effective until December 31st, 1966.

LA SAL CEMETERY IMPROVEMENTS DISCUSSED
Merrill Stevens of Blanding was present to ask if San Juan County would assume responsibility in helping to fence the La Sal Cemetery. He stated that it was in one of Charles Redd's pastures and that other in-

terested people who have deceased relatives buried in the cemetery are willing to contribute money and time in having the property fenced.
No action was taken on the matter at this time.
DELEGATION PRESENT TO PROTEST THE ISSUANCE OF BEER LICENSE TO LEONARD BAUM
Jim Hunt, Myron Ferree, Bob Nieves and Everett Neff were present to protest the Commissioners1 approval of a retail beer license to Leonard Baum of Mexican Hat. The County Attorney was called in for consultation.
The matter was discussed pro and con and the Commissioners stated that they had no intention of doing any-one any injury. Commissioner Redd wondered about discriminating against individuals if applications were not granted to reliable individuals. The matter of proximity of Churches was also discussed and the opinion of the County Attorny regarding such matter was referred to.
The Chairman of the Board suggested that a letter be written to Mr. Baum stating that protests have been made regarding the issuance of his license and giving him a chance to come in to uphold the license.
It was also suggested that a waiting period be taken before granting an application, and also that the population of a place be taken into consideration ia granting application for beer licenses.
The matter was tabled for the present.
ROAD RIGHT OF WAY EASEMENT ACCEPTED
A motion was made by Commissioner Ray V. Redd, seconded by Commissioner Hyrum T. Black, and unanimously carried, that San Juan County accept and approve the Right of Way Easement from the Shumway to San Juan County as follows:

Guymon and Beth Park Guymon, his wife and Seth Shumway and Vivian Shumway, his wife, Grantors, of Blanding, San Juan County, State of Utah, in consideration of One and other dollars, receipt of which is hereby acknowledged, do hereby grant, bargain, sell and convey unto San Juan County, a body corporate and politic of the State of Utah, Grantee, a Right of Way for road purposes over the following described tract of land in San Juan County, Utah, to-wit:
25 ft each side of a center line described as follows:
Bg 1727.0 ft N and 1168.0 ft W of the SE cor NW1/4 sec 27, T 36 S, R 22 E, S.L.B. and M. and rg th S 88* 15' W 1473.0 ft.

GEORGE SIMMONS TALKS TO COMMISSIONERS REGARDING PURCHASE OF EQUIPMENT
George Simmons was present to discuss with the Commissioners the purchase of equipment for county purposes. Mr. Simmons represents the company of Wheeler Machinery. In buying heavy equipment he asked that the Com-missioners consider the responsibility of the Company, the record of the machinery, who previously used the machinery, and the service of the machinery.
