SAN JUAN COUNTY COMMISSION MINUTES NOVEMBER 2, 1987
The San Juan County Commission met in regular session November 2, 1987 at the hour of 10;00 A.M. at the San Juan County Courthouse, Monticello, Utah.

A motion to approve the minutes of October 26, 1987 as corrected was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.
Reservation Tax Case Litigation - Attorney Bills - Commissioner Bailey made the motion for the Commission to go into executive session with Lyle Anderson, Attorney, to discuss the pending tax lawsuit. Commissioner Maryboy seconded the motion. UNANIMOUS.
Commissioner Maryboy made the motion for the Commission to return to the regular session. Commissioner Bailey seconded the motion. UNANIMOUS.
COMMISSIONER CALVIN BLACK'S REPORT
License Plate Contract - Box Elder County - An article in the newspaper stated that the State Tax Commission has entered into a contract with Box Elder County for license plates similar to what our County has with them. They have two state employees there and they are paying them 45 cents for license renewals, 90 cents for license plate replacements, $1.55 for a title transfer and amounts ranging up to $2.25 for other transactions. This has been referred to the County Clerk, Gail Johnson, and County Assessor, Barbara Montella, to make sure the County is getting the same amounts.
Mental Health - A letter received from the Salt Lake County Mental Health Board was received which reviews their policy and procedures. Copies of this letter will be forwarded to Mark Lyman, San Juan County Mental Health Director. There is a proposed cut at the State level of $70,000 in the County mental health budget over the next three years. That will amount to 46% of the total amount now provided. Commissioner Black will meet with the State Mental Health Board to appeal that proposal.
Integral Vista - Commissioner Black attended a meeting on the Integral Vista situation last Tuesday. The representatives of the southern counties that attended the meeting adopted a recommendation that the committee not enact Integral Vista on the basis that it is not necessary. It was supported with evidence including portions of Secretary of Interior Hodell's speech wherein he said it was not required by law and that it's not necessary to protect the scenic areas and the air quality of southern Utah. The State Site Implementation Plan states that visibility impairment does not come from anything in southern Utah. It comes mostly from the Wasatch front and surrounding states. A more formal statement on that recommendation will be acted on at the meetings of the Utah Association of Counties held in St. George this week.
UAC Meeting in St. George - Other issues that will be discussed at the meeting of the Utah Association of Counties will be the RS2477 Right-of-ways which the Burr Trail addresses; discussion and adoption of a resolution supporting the lard exchange in the Lake Powell area; and a resolution supporting payment-in-lieu of taxes on State Lands. In a meeting of the State Land Board a resolution was adopted supporting the payment-in-lieu of taxes.
Decline in Public Schools - The Interagency minutes report a significant decline of students at the San Juan Center and the public schools in San Juan County. There are a total of 89 less students registered in the public schools this year. Some of that number is reflected in kindergarten registration, the rest primarily in the llth and 12th grades.
Jeep Jamboree - The Jeep Jamboree has been scheduled for April 8-10, 1988 to the Hole-In-The-Rock area. There will be approximately 250 people participating in this event.
Fire Cooperative Agreements - Commissioner Black and Administrative Assistant, Rick Bailey met with Dick Clayson and Mike Grosjean of State Lands and Forestry on fire cooperative agreements. The purpose of this meeting was to try and work out different arrangements for next year.

Uniform Building Code Meeting, November 5, 1987 in Price. It was determined that Greg Adams, County Building Inspector, would not need to attend that meeting.
Utah Arts Council Meeting November 2, 1987 in Moab.
COMMISSIONER KENNETH BAILEY'S REPORT
Small Business Conference - Commissioner Bailey attended the Small Business Conference held last Wednesday at the county library. He reported that the attendance was good and the information presented would be of great benefit to the local businessmen.
CDBG Funds for Seed Loans - The Commissioners discussed the CDBG Funds as a possible help to the county in the future. It was felt that good policies and guidelines would have to be set up to regulate these funds. Loans obtained just for a new business to compete with another business should not be given and the applicant should have some equity capital of his own to give them more incentive to make a success of the business.
Sprinkler System Contracts - Recreation Dept - Commissioner Maryboy made a motion to authorize the signature of Chairman Black approving the contracts on the sprinkler systems for the Recreation Department. Redd Plumbing of Blanding has the installation contract on the Blanding Golf Course and Whipple Plumbing of Monticello has the installation contract on the Monticello Park.
BLM Gravel Pits - Gary Crowley wants to get some materials off two BLM gravel pits that the County is working on. Commissioner Bailey told him that if they went in an area where the County wasn't getting rock or gravel out of that it would be all right because it is being used on a road that we will eventually get anyway.
Mineral Lease Funds - Doug Pehrson, County Surveyor, has sent in the request for mineral lease funds to the Department of Transportation in Price for projects on County Roads.
Public Safety Bldg. - Commissioner Bailey has written a letter of concern to the architects about the finish on the concrete walls of the Public Safety Building. He is also concerned about the joint spacing
in the block that is being laid. The architect will be in town tomorrow to work things out. Commission Bailey further stated that the mortar color is good and progress is being made there but the brick layers seem to be about two months behind in their portion. They have been waiting for the jail doors and security doors and could have been laying brick during the past couple months.
COMMISSIONER MARK MARYBOY'S REPORT
Archealogical & Environmental Studies - Commissioner Maryboy will check with the Utah Chapter Delegates to see about the needed archealogical and environmental impact studies required on gravel pits. The Chapters may be able to get those studies without having to use County money.
Montezuma Creek Police Station - Commissioner Maryboy will get together with the Navajo Police Department to obtain an estimate on the Montezuma Creek Police Station remodeling.
Red Mesa Chapter Meeting - Commissioner Maryboy will attend the Red Mesa Chapter meeting tonight. He will report that the road department will start putting white shale on the Red Mesa road Wednesday or Thursday. They will armour coat the first mile and white shale the second mile and continue on toward the Arizona border.
Recreation Board Meeting - The San Juan County Recreation Board will hold a meeting November 3, 1987. Commissioner Maryboy will be in attendance.
ADMINISTRATIVE ASSISTANT, RICK BAILEY'S REPORT
Montezuna Creek application to the community Impact Board - The Road Shed project will be added to the application at a cost of $30,000. One of the questions asked on the application is: Has the project been priortized against other projects contemplated for the current and next two years by the applicant. Commissioner Bailey commented that the project had been priortized as the #1 county road improvement for the last five years.
Budget - The first draft of the budget should be ready to present to the Cormiission next Monday.
Commissioner Black suggested that Mr. Bailey contact Mr. Allred, County Recreation Director, about the
possibility of raising the fees on the golf courses, swimming pool and baseball activities to generate needed revenue.
IBM Photo Copier - Rick Bailey told the Commissioners that the main copier in the Courthouse has needed repairs at least four times during the past month and it is getting to be quite a problem. The County has had a service contract on the copier which has saved considerable repair bills. The Commission asked Mr. Bailey to get proposals on both the leasing and purchasing of a new copier.
COUNTY CLERK, GAIL JOHNSON'S REPORT
Bluff Cemetery Property - The Commission discussed the acceptance of a quit-claim deed for property in the Bluff Cemetery now owned by several different individuals. Mrs. Johnson was asked to have the Recorder, Louise Jones, check the description, etc. and also ask the County Attorney, Craig Halls, what the County responsibility is in this matter.
Circuit Court Contracts - County Clerk, Gail Johnson, reported that she is waiting until after the UAC meetings in St. George before presenting the Circuit Court Contract to the Commissioners to be signed. She has found there are inequities on the amount each county is being paid by the State for the rental of circuit court space in the Courthouses. She has asked that this matter be put on the Clerk's agenda at the UAC meeting to see if something can be done to rectify this inequity.
CORRECT BUSINESS
Sheriff's Department - The drug money has been deposited with the County Treasurer, Marian Bayles. Two thousand five hundred of that will go to the public defender, Keith Chiara, and the rest into the general fund.
Vendors selling in County - There are no county permits for vendors coming into the area but they do need a State Sales Tax license. The sheriff's department can enforce this ordinance and stop some of this activity whichis offensive to the local businesses.
Gun Bids - Sheriff Lacy presented some bids on guns to be purchased for the Sheriff's Department. He was instructed to obtain bids from all local dealers as well as outside the area. The Commissioners also asked him to make sure all county equipment is on an inventory list in the County Clerk's office.
Jeep Bids - Sheriff's Department - The following bids were discussed for the purchase of a Jeep Cherokee 4dr for the Sheriff's Department:

Commissioner Maryboy made a motion to accept the low bid from Keesee Motoe Co. for $15,435.00. Commissioner Bailey seconded the motion. UNANIMOUS.
Airport Hangar Leases - The following leases were signed:

Wade Redford Monticello Hangar #5
Monticello Hangar #8 is available as Mr. James Wolfe has moved and no longer needs the space. The road department will clean out the hanger at which time Stanley Gabriel wishes to move into that space leaving hangar #3 vacant.
Public Defender - Keith Chiara - Public Defender Keith Chiara appeared before the commissioners to explain his bill on the defense of Edward Day.
Bookmobile Contract - State Library Supervisor, Cecil Barton, Director Douglas Abrams, and San Juan County Library Board members Oleen Hatch and Rowland Francom presented the new contract for bookmobile services to the Coninission. They also stated that the County Library Board needs one more member. Mr. Francom will present some names for the Commission to select and approve one. The signing of the contract also allows the State Library to build a restroom at the County Road Shed where the bookmobile is parked. Comnnissioner Maryboy made a motion to approve the contract and authorize Chairman Black to sign them. Commissioner Bailey seconded the motion. UNANIMOUS.
Russell Stevenson, UNDC Health Director - Russell Stevenson provided the letter requested by the Commission on the amount owed the government on the sigmoidoscope machine. Mr. Stevenson also discussed with the Commissioners the future plans for the southern Utahf northern Arizona areas with relation to health care for the Navajo Tribe.
