SAN JUAN COUNTY COMMISSION MINUTES MAY 2, 1988

The regular session of the San Juan County Commission convened at 10:00 A.M. at the San Juan County Courthouse in Monticello, Utah.

A motion to approve the minutes of April 25, 1988 as corrected was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.

COMMISSIONER CALVIN BLACK'S REPORT

National BLM Advisory Council Tour - Conmissioner Black reported that the National BLM Advisory Council was going to change their itinerary to include a stop at the Hovenweep area to view the area proposed for expansion that has significant effects on BLM lands and the Aneth oil fields, which is the largest oil field in the State of Utah. Because of other conflicts, the Council will be unable to tour these areas. The people that are interested will be able to meet with the group at the Butler Wash ruins at 10:00 A.M. Friday morning.

Alcohol Beverage Control - The Citizens Council on Alcoholic Beverage Control sent a letter to the Commission expressing appreciation for approving an ordinance requiring all servers of alcoholic beverages to complete a server training course which is designed to control over-consumption of alcoholic beverages. Halls Crossing Airport - A letter to the San Juan County Commission from Barbara Johnson, Airport Planner of the Federal Aviation Administration, expressed appreciation for the County's assistance in the preparation of the Environmental Impact Statement for the proposed Halls Crossing Airport replacement. BLM Land Sale/Verdure - The Moab District of the Bureau of Land Management notified the County of a proposal to sell 15 acres of land in the Verdure area to William H. Gonzalas. A letter will be drafted from the Commission supporting this proposal.

Greyhound Bus Lines, Inc. - An article appearing in the Salt Lake Tribune regarding the Greyhound Lines, Inc. expressed plans to reestablish bus service to rural America. President Fred G. Currey stated that "We've started an extensive campaign that seeks to reconnect rural areas with our existing network. Although we haven't gotten to Utah yet, it is on our list." The effort could eventually mean the resumption of bus service to such outlying areas of the state as Grand and San Juan Counties. And it could take the form of a light van service, which allows passengers to connect up with existing Greyhound terminals.

"We won't be running 40-foot, $200,000 buses into those areas because it just wouldn't be economical," President Currey said. "But we are working toward using some of the public programs available to see that rural areas receive service."

State Mental Health - Commissioner Black will write a letter to the Utah State Mental Health Director, Sherrill Burge, protesting the cut in mental health funding. When the State Mental Health budget was approved, San Juan County's portion was drastically cut at the request of the area directors. A copy of the letter will be sent to Governor Norman Bangerter.

Southeastern Utah AOG - A letter to Congressman Howard Nielson from the Southeastern Utah AOG signed by Jimmy Walker says, "It has come to our attention that Representative Rahall of West Virginia has submitted HR4181 which would take 26 million dollars from federal mineral lease revenues, generated on acquired federal lands and dedicate the money to state sport fishing and hunting activities. We are concerned this bill will reduce the amount of federal mineral lease money available to the state for mitigation of adverse impacts in local jurisdictions and for other discretionary state uses. Accordingly, we would ask that as the opportunity arises, you oppose this legislation." Commissioner Black stated that the bill may not affect us as acquired federal lands mean lands that were once federally owned. However, the progress of that bill should be monitored.

U95 Corridor Study - The U95 Corridor Study was discussed as it referred to the BLM San Juan Area Resource Management Plan. Nothing could be found within the study to justify the BLM's restrictions in the corridor. The study talks about the scenic beauty being maintained and setting up a mechanism to see that it isn't adversely impacted; that it needs to be controlled and zoned but there is no mention of totat prohibition of activities or development. Conmissioner Black will discuss the plan further with the National BLM Advisory Council when they meet this week.

Mineral Lease Money - At the UAC Conference held this past week, Mark Walsh, Utah Association of Counties, reviewed the mineral lease money and the ways that Nielsen & Senior, a legal firm, indicated that districts could be created. The final recommendations were fairly limited. The letter stated "As we have reviewed the State statutes for possible special service districts to receive and utilize HB 273 mineral lease monies we have eliminated the Special Service Districts, Parking and Business Improvement Districts, County Improvement Districts, Special Road Districts and County Service Areas because the governing body of the county controls and governs those entities. We think there is undue risk of loss of federal PILT payments." These are the very ones used by San Juan County. There is one, Legal and Administrative Entities created under the Utah Interlocal Cooperation Act, that might be used with respect to coordinating the cities and county in doing roads. It provides that entities may be created by contract between two or more government entities to provide any service which the creating entities are authorized under statute to provide. These entities do not have the authority to levy a direct tax and are governed in the manner established by the agreement creating the entities. Commissioner Black felt that the County could continue, no matter what happens to the assessed values, with the agreement with the cities and use the bulk of the money for county-wide work, including work in the cities, as the assessed value goes down.

The estimated distribution to county road districts was reviewed as based on prior years revenues. However, this may change depending on whether there is more or less coal, oil or gas produced from any county. As of now San Juan County's percent of the mineral lease revenues from the past is 17.4% of the total. The County will get $345,000 in 1988, $696,000 in 1989 and $1,044,000 in 1990 assuming we get the same amounts that we've been getting in production and values from our County. This is only on Federal lands within the County.

On the Payment of State in Lieu of Taxes, San Juan County has 297,208.29 acres of State Lands. This year the County will get $17,832.50, in 1990 $89,162.49 and in 1992 and thereafter $154,548.31. Historic Preservation Contract - A Historic Preservation contract for Certified Local Governments was approved for $8,300 with the Division of State History reimbursing 50% of the eligible costs. The participants share can be in the form of donated labor, equipment and materials, or any combination thereof. A motion to approve the contract and authorize Chairman Black to sign was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

COMMISSIONER KENNETH BAILEY'S REPORT

Goulding Dump - A meeting with John Guy, Oljato Chapter President, Monument Valley Hospital Administrator Gerald LaFont, Monument Valley High School Principal Heber Black, and a U.S. Public Health Officer and Loretta Littlesalt, Field Sanitarian out of Kayenta, was held on April 26 regarding a dump at Gouldings. The papers necessary to withdraw the land was given to the Chapter President, Mr. Guy. The Chapter is the only one authorized to withdraw the land. When they withdraw the land, they take total responsibility for

the landfill. A request has been made to the Chapter to withdraw the land and get a grant to fence and secure the area. The County will push out the area on a regular basis and dig the trench as necessary. The Chapter will hire individuals to put a light covering of soil over the trash once a week. A request was also made to put the incinerator located at the County Courthouse at the dump site. There are materials from the hospital that need to be burned.

Montezuma Creek Police Station - A diagram of the remodeling to be done for a Montezuma Creek police substation was discussed. Commissioner Maryboy will contact the Navajo Tribal police about the need for a holding cell and the water, sewer and heat requirements and other modifications that need to be made before the proposal can be drafted and bids obtained.

Montezuma Creek Road Shed - Advertising for the erection of a steel building for the Montezuma Creek road shed will begin as soon as a proposal can be drafted.

Contract Truckers - County Attorney Craig Halls is drawing up a new contract for truckers who do work for the County to include their responsibility to furnish liability and workers compensation insurance. San Juan/Grand County Line - The survey has been completed on the San Juan/Grand County line in the Spanish Valley area and there should be no problems in identifying the land on the plats to prevent double taxation between the two counties.

Oljato to Navajo Mountain Road/Engineering Appropriation - Reed Ivins from Congressman Howard Nielsons office called to report that Congressman Nielson met with the Appropriations Committee, sub-committee on Interior, to make the presentation on the request for a special appropriation for the engineering on the Oljato to Navajo Mountain road. He explained the need to move the marina which facilitated the need for improving the road. Mr. Ivins stated that the prospect for obtaining the necessary funding looks very favorable because it would help economic development on the reservation.

Arizona Strip BMP - Conmissioner Bailey made copies of his comments on the Arizona Strip RMP stressing the importance of mineral development within the Strip.

Road Department Employee - A motion to hire Johnnie Alvarez as a welder-mechanic for the County Road Department was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS. Mr. Alvarez salary will be at grade 10 step 1, $7.35 per hour.

Helicopter Landing Pad - An oil mulch needs to be put around the landing pad at the airport to keep dust out of the jet engine of the helicopter.

Hovenweep Pipeline - There is a problem with a pipeline that was put in the wrong place under an encroachment permit near Hovenweep. County Attorney Craig Halls is working to resolve that problem.

COMMISSIONER MARK MARYBOY'S REPORT

Bluff Recreation - A request from the Bluff Recreation Conmittee was made for two trash barrels to be placed at the baseball field. They would also like to refurbish the concession stand. The Commission stated that the policy was for the County to furnish the materials and the community to furnish the labor for the refurbishing. The lock on the Bluff Community Building has been broken again and needs to be repaired. There has been an on-going problem with break-ins at the center. Conmissioner Maryboy stated that the recreation committee is working towards resolving that problem. The committee also asked if there is an existing sprinkler system for the baseball field. The Commission is not aware of any system and suggested that Bluff citizens may be aware of one if it is there.

Head Start Day at Bluff - UNDC is sponsoring a Head Start Day in Bluff on May 7th at 9 a.m. and invited the County Commissioners to ride in the parade. Commissioner Black will be at a meeting in Moab and Commissioner Bailey will check his schedule to see if he will be able to be there. Commissioner Maryboy will be there.

ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT

Monticello Swimming Pool - A phone call from Mike Glenn of the Utah State Energy Office indicated that a request for a proposal for engineering and design of what type of energy programs could be put on the Monticello swimming pool which would make the pool more energy efficient. That would be paid for out of Utah State Energy funds. That proposal will be complete in two or three weeks and a company could be selected to work on the project and the State Energy Office will prepare the application for funding. The solar panels at the pool work very well but the glazing keeps coming off causing a loss of heating efficiency.

Aging Committee Staff Meeting - Administrative Assistant Rick Bailey reported on the staff meeting held with the Aging Conmittee. The Commission authorized Mr. Bailey to obtain proposals for hiring a cook for the Monticello Senior Center.

Grade/Step Chart - A motion to approve a grade and step chart as a basis for San Juan County employees salaries was made by Commissioner Bailey and seconded by Commissioner Maryboy.

Permanent Part-Time Employees - A cost of living increase was approved for the following permanent part-time employees of San Juan County:

Ruby Bronson to grade 2 step 2, $5.55 per hour.

Mary Ann Brown to grade 2 step 2, $5.55 per hour.

Morris Swenson to grade 2 step 2, $5.55 per hour.

Linda James to grade 1 step 2, $5.33 per hour.

Ron Harvey to grade 1 step 1, to $5.12 per hour.

Alice Redd to grade 1 step I, to $5.12 per hour.

A motion to approve the increase was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

COUNTY CLERK GAIL JOHNSON

Collecting and Assessing - The 2.5 mills that was collected less the amount that was in the County budget for 1987 was $126,727.47. The Commissioners authorized County Clerk Gail Johnson to send a check for that amount to the State Auditors office along with a copy of the letter from the State Auditors Office stating they approved carrying forward the deficit of this year. It is the County's understanding that a portion of that money will be returned to cover some of last year's deficit and carry the balance on this year's budget.

Court Contract - The State Court Administrators Office has sent the court contract for the coming year, effective July 1. The contract has been cut down to 3/4 salary time because the case load is less. County Clerk Gail Johnson explained that the actual case load is less but the work load has remained the same. Mrs. Johnson recommended that the contract not be approved until the full-time salary is restored. Assistant Librarian Raises - County Clerk Gail Johnson wanted to confirm the method of approving increases for assistant librarians. The Commission stated that the Library Board should approve the increases and forward the request on to the Commission for final approval.

Indigent Sanity Hearing Budget - A review of the Indigent Sanity Hearing budget was discussed. County Clerk Gail Johnson stated that the State does not pay for sanity hearings until the individual commits a crime and plead not guilty on the basis of insanity. The local Social Service does not have any control over what happens to the individual once they are committed. The Commission suggested that Mrs. Johnson meet with Steve Keele, San Juan County Social Services, and County Attorney Craig Halls to write a letter and request limitations on the amount of exams and hearings given the individuals.

CURRENT BUSINESS

Harry Jones Road - Harry Jones appeared before the Commission to check on what the Commission had decided to do on the improvement of the road leading to his property. The Commission agreed to grade and gravel the road at the same time the Race Track road is upgraded.

Recreation/Monticello Golf Course - Grant Leavitt presented bids from Highland Equipment for 1 Yama Hauler and 1 68" National Mower for $6,100 and from Turf Equipment Co. for 1 Toro Workmaster and 1 Toro Reelmaker for $10,150. Commissioner Maryboy made a motion to approve the bid from Highland Equipment for $6,100. Commissioner Bailey seconded the motion. UNANIMOUS.

Courthouse Sweeper - A motion to approve the hiring of Paul Weber as the courthouse sweeper was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS. Mr. Weber's salary will be based on grade 1 step 1, $5.12 per hour.

Blanding Airport Transformer - The Bland ing airport transformer for the runway light has gone out. The Commission approved the purchase of another transformer.

Translator Fees - Paul Redd made a request for a waiver of translator fees on BLM lands. The BLM stated that if they provide a public service in connection with their business they would review the request. Because of the remote location of the Redd's ranch they have reported fires and accidents in that area of the County. Administrative Assistant Rick Bailey will write a letter supporting their request.

County Attorney/Out of State Travel Request - County Attorney Craig Halls made a request for approval of out-of-state travel to Anaheim, California for a National Association of Counties meeting in August. The Commission approve the request.

San Juan Health Care - Hospital Administrator John Fellmeth met with the Commission to discuss the request of Director of Nursing Bonnie Conway for pay for shifts worked over and avoce her regular shifts and duties as an administrator and exempt employee on an emergency basis. Mrs. Conway has been serving as a charge nurse on the floor during a shortage of registered nurses. The matter was discussed at the Hospital Board Meeting and the Commissioners had requested further information as to what had already been paid and what Mr. Fellmeth and Mrs. Conway felt would be an equitable amount and why. The Commissioners feel that, as an executive, Mrs. Conway would be expected to put in the number of hours necessary to fulfill her duties. However, they do not want to take advantage of any nurses having to work extra hours over and above their regular responsibilities. The Commission stressed that anything similar that comes up in the future needs to be considered prior to being done.

Request for Flexible Salary/R.N. - Hospital Administrator John Fellmeth discussed the possibility of offering new R.N.'s a flexible salary that would be competitive with other facilities in the area. Liz Palmer has expressed an interest in working at the San Juan County Hospital with only the health insurance being paid by the County and no other benefits. The County already pays for employee health care premiums and the employee pays for 75% of the difference for their spouse and dependents. The Commission approved deducting the same percentage of that monthly premium that the other county employees are paying.

R.N. Loans - After discussing the criteria needed to apply for loans for training as registered nurses, Hospital Administrator John Fellmeth stated that he and Director of Nursing Bonnie Conway will screen the applicants and make sure they have checked all other possible sources for funding. They will present the data and the financial needs analysis from the college to find out what they are eligible for to the Commission for final approval for the loans.

Hospital Administrator Position - Advertising has begun for a new hospital administrator. At the present time, the advertising will be within the local and western region. A tentative deadline for the applications has been set for May 30th.
