SAN JUAN COUNTY COMMISSION MINUTES SEPTEMBER 28, 1987

The San Juan County Commission met in regular session September 28, 1987 at the hour of 10:00 a.m. at the San Juan County Courthouse, Monticello, Utah.

The following matters were present: Cmmissioner Black

Commissioner Bailey Commissioner Maryboy

Conmissioner Maryboy was excused in the morning to attend the dedication of 120 acres of land transferred from the BLM to the Navajo Tribe.

A motion to approve the minutes of September 21, 1987 as amended was made by Commissioner Bailey and seconded by Commissioner Black. UNANIMOUS.

COMMISSIONER CALVIN BLACK'S REPORT

Governor Norman Bangerter's visit to Southern Utah - Governor Norman Bangerter will be visiting in Southern Utah Saturday, October 3, 1987 with stops in Kanab, Panguitch, and Blanding. There will be a meeting at the San Juan High School at 3:00 p.m. At that meeting Governor Bangerter will make an announcement of an iniative that will be of significant interest and potential economic development for Southern Utah.

Hunan Services Meeting - There will be a Human Services meeting held at Kenney's Restaurant October 1, 1987 at 1:00 p.m.

UP&L -PP&L Merger - A letter was received from the Committee of Consumer Services advising the Commission that they have not yet taken a position on the proposed Utah Power and Light merger and requesting that the County take no action at this time. However, the Commissioners have already signed a resolution supporting the merger.

Tax Appeal - Meridian Oil - A letter dated Sept. 17, 1987 advised the Conmission of Meridian Oil's intent to appeal their assessment from the State on property tax; namely, their oil leases and holdings. They are asking the County to reduce their value from $35,537,284 to $28,252,098. The Commissioners do not have the authority to act on State Assessments. The letter will be referred to the County Attorney, Craig Halls.

Mental Health Meeting - Comnissioner Black will attend a Mental Health Meeting to be held in Salt Lake City on October 7 and 8, 1987.

Commissioner's Workshop - Commissioner Black reported on the various sessions conducted at the Cottnissioner's Workshop held in Vernal, September 24 & 25, 1987. Jerry Lewis presented a report on the Highway Needs Study. No action was taken at the meeting but the general concensus of the group was that there should be no change in the formula that would give counties less gas tax money.

There was some discussion of interest expressed on going with the cities to try and get 40% of the total for cities and county instead of the 25% they now get. Most participants felt that could not be successful and it would only serve to get the DOT unhappy with the Commiissioners of the State.

District Court Transfer - A presentation was made on the District Court transfer.

The State had made further changes in the proposal. The Counties did not take a position on that although most of the Contnissioners were very supportive of the changes. Everyone was asked to study the proposal and be prepared to take a position at the St. George meeting in November as to whether they would support it or not. The Commissioners will meet on November 4th prior to the UAC meeting on the 5th and 6th.

Proposed Constitutional Changes - A report was given on the local government article on the proposed Constitutional changes that was changed now the implementation. They will discuss this further at the November meeting.

Transmission Site Fee Increases - Reports were given by both the BLM and Forest Service on the Transmission Site Fee Increase. They indicated that this proposal has not been to make any changes with respect to public use and local government. Those charges were only for commercial uses.

Organization of the Utah County Commissioner's Association - The Utah County Commissioner's Association was more formally organized with a Chairman, Vice Chairman, Secretary-Treasurer, and two board members.

Garfield County - Burr Trail Lawsuit - A resolution was passed supporting Garfield County in their lawsuit on the Burr Trail right-of-way. The Contnissioners agreed they should apply for an impact grant which would pay for everything they have spent to date and all outstanding bills and all costs through appeals. All Counties represented at the Workshop unanimously passed a resolution supporting Garfield County in that request.

County Road Employees- Probationary Increases - Robert Laws was hired as a permanent Road Department

employee based on his previous experience as a seasonal employee and will be elgible for a probationary

raise in ninety days. It was further noted that Tierre Patterson and Victor Nebeker would not qualify for probationary raises.

County Road Requests - Requests for improvements on the Richard Perkins road, Cottonwood road, and the road from the Coke Plant to two and one-half miles north of Richard Gore's be submitted to the Road Department for consideration. Commissioner Bailey will follow up on these requests.

CMMISSIONER KENNETH BAILEY'S REPORT

Monthly Road Board Meeting - the Monthly Road Board meeting will be held next Monday, October 5, 1987 at 8:00 a.m. in the Commiissioner's Room.

Weed Board Meeting - The decision was made by the Weed Board to follow the recommendation made by the Commissioners to control the weeds on the set-aside land.

Another proposal was made that we involve the BLM, DOT, County Commissioners, the Weed Board and the County Agents in both San Juan County and those Colorado Counties bordering San Juan County in common weed problems.

Alkali Road Right-of-Way - The County has the right-of-way on the Alkali Road to realign it from the Windmill down to the Perkins Road.

Cahone Mesa to Hovenweep Project - The Road Department is in need of water on the Cahoon Mesa to Hovenweep project. Commissioner Bailey will discuss this with Commissioner Maryboy.

Long Canyon Road - Commissioner Black reported that he talked with Neldon Holt on the Long Canyon Road. Mr. Holt indicated he would favor the building of the road off into the canyon rather than putting in cattle guards on the Max Dalton property. Further discussion will be needed between the individuals, and the County on this project.

COMMISSIONER MARK MARYBOY'S REPORT

Blanding Rodeo Grounds - Commissioner Maryboy reported the need for several improvements to the Blanding Rodeo Grounds.

RICK BAILEY'S, ADMINISTRATIVE ASSISTANT, REPORT

Monticello Airport Data Sheets - Rick Bailey, Administrative Assistant, presented the finalized data sheets from Armstrong Consultants to be signed by the Commission and sent to the State and FAA. Commissioner Bailey made a motion to approve the information and authorize Commissioner Black to sign the forms. Commissioner Black seconded the motion. UNANIMOUS.

Monticello Airport - Final Payment - Conmissioner Bailey made the motion to approve the application for final payment of the rehabilitation project on the Monticello Airport. Commissioner Black seconded the motion. UNANIMOUS.

Monticello Airport - Change Order - A change order had never been signed when the Comnission decided not to go with the original process of ripping up the runway and laying it back down. These documents were approved under motion of Commissioner Bailey and seconded by Commissioner Black.

Computer software and hardward for Public Safety Bldg. - Rick Bailey and John Fellmeth are going to Sevier and Millard Counties to look at the software and hardware they have installed in their jails. Then they will go to Salt Lake where there is a full system utilized. They will then bring back recommendations for use in the Public Safety Building.

COUNTY CLERK, GAIL JOHNSON'S REPORT

Payroll Notice Forms - Subsequent to the action taken the previous week by the Commission on promotions within the Road Department, Gail Johnson, County Clerk, reminded the Commissioners of the need to submit Payroll Notice Forms on each action taken for all County employees to the Payroll Department.

Building Permits - The County has not recorded any building permits or the collection of any fees within the County for several months. Greg Adams, County Building Inspector, will be asked to meet with the County Commissioners next Monday to report on building activities in the County.

Personnel Policy - Long-term Sickness - The County Policy requests a doctor's written statement for long-term sickness before reimbursement can be made. The current form available is not being used by employees. A County employee had submitted a request for sick pay but as she did not have a doctor's statement the request would be put on her all-purpose leave time and transferred when a doctor's statement is received. This policy will be reviewed by the Commissioners and County Clerk and recommendations made for future situations.

Circuit Court Contract - Gail Johnson, County Clerk, discussed the contract for the Circuit Court. There is question as to the equity of the system regarding the leasing of space. In checking with other counties Mrs. Johnson found a disparity of between $4.39 and $7.05 per square foot on leasing of space. A request was sent to Gordon Bissenger for clarity on how this figure was computed and a list of how much each individual County is being paid. Mr. Bissenger's reply told of how the figure was computed but the listing was not included. The space is computed on the square footage of space used and the days involved. The Commission will hold off signing the contract until the information requested from the State is received.

OTHER BUSINESS

San Juan County Queen Pageant - Kevin and Desiree Rhoades appeared before the Commission to request support as co-chairmen of the San Juan County Queen Pageant. Mr. Rhoades has worked with the Miss Utah Pageant and Desiree has participated in queen contests and helped with staging. The County has budgeted $3,000 in the past with further funds from sponsors. The pageant is handled in conjunction with the San Juan County Fair Board. The Commissioners will support the Rhoades in this project and recommends that the Fair Board give them this assignment. Mr. & Mrs. Rhoades will contact Carol Sallee, Chairman of the Fair Board for their support.

Spikes and Vehicles for Sheriff's Department - Sheriff Claude Lacy requested approval of the purchase of two sets of spikes for use in road blocks. A fifteen foot set would cost $659.99. One set would be put in the Monticello office and one in the Bluff office. Commissioner Bailey made a motion for approval of this purchase. Commissioner Black seconded the motion. UNANIMOUS.

Sheriff Lacy also requested approval for the purchase of two 4-wheel drive vehicles for the Sheriff's Department. There is $39,000 in the budget for this purpose. Commissioner Bailey made a motion to approve the purchase. Commissioner Black seconded the motion. UNANIMOUS.

San Juan County Health Care - John Fellmeth requested the signature of Chairman Black giving temporary privileges to Dr. Bert Reinstien to practice within the County. Dr. Reinstien will be available to the County until November 13.

Emergency Room Coverage - A proposal for Emergency Roan coverage has been developed by Dr. Steve Warren for approval by the Comnission. Basically Dr. Warren proposes a coverage similar to that in Grand County; a minimum of $75 a day plus 80% of bill charges over $75. A minimum charge of $50 is charged for the use of the Emergency Room plus a charge for what the doctor does and a supplies charge. This coverage would apply on a day to day Emergency Room use. The County Policy that has been adopted is that the physicians take turn at Emergency Room coverage as part of their responsibilities in which the doctor receives his fee. It was the understanding of the Commissioners that a means of compensation be for Dr. Warren for the extra coverage he's been covering and will be covering until we get enough other physicians to continue the policy. John Fellmeth indicated many places are compensating their doctors for Emergency Room coverage and the County may not be able to attract doctors without this compensation. This issue will be tabled until Mr. Fellmeth can check further with other hospitals and their policies.

Blanding Health Care Board - A letter dated September 19, 1987 from the Blanding City Mayorf James S. Shumway, giving authority to the Blanding Health Care Board to negotiate with the San Juan County Health

Care Board has been received. This authorized board will meet with John Fellmeth to discuss the disposition of equipment and supplies in the Blanding Clinic. The equipment that is in there is revenue generating and the Commission would expect a percentage of that for the County taxayers unless the Blanding Health Care Board wants to buy it. The Blanding Health Care Board and San Juan County Health Care will try to draft an agreement to that end.

Bluff Post Office Facility - A letter was received from the Postal Department with respect to a new Bluff Post Office. The Postal Department want all the information necessary with respect to zoning requirements, set-back requirements, building and fire codes, local ordinances, local utilities, minimum site size that may affect the project. The letter will be referred to Greg Adams, County Building Inspector, to respond to the Postal Department.

Private Jeep Tour - Joe Slade met with the Commissioners to request a meeting between Dale Lemon, Mark Smith and the Commissioners on October 9. They are organizing an exclusive Jeep Tour of Southern Utah and want to discuss safety procedures with the Commissioners.

BOARD OF EQUALIZATION - The Board of Equalization appreciated all the information received from county residents regarding over-assessments made on tax notices. Virtually all residential property was found to be over-assessed. After calculating the average over-assessment, Commissioner Bailey made the motion that all residential property and buildings be rolled back 15 percent. The motion was seconded by Commissioner Maryboy. UNANIMOUS.
