MINUTES OF THE BOARD OF COUNTY COMMISSIONERS' REGULAR MEETING HELD AT MONTICELLO, UTAH ON SEPTEMBER 28, 1959 at 10 A. M.
Meeting opened at 10 A. M. with all Commissioners and Clerk present, Wm. C. Walton officiating. ROADS IN MONTEZUMA AREA ALMOST IMPASSABLE
Mr. A. B. Smith of Montezuma Creek reported that the road from Highway S-406 near the San Juan Bridge to the trading center west of the airport is in very bad shape and needs considerable work done on it. He stated that it has a fairly good base of large rock but needs a topping of gravel to stand up under the amount of travel that it carries.

The 3 mile strip of road on Highway S-406/was also discussed, and Mr. Smith was promised that when the responsibility for upkeep of this road is finalized, and if the County must assume such responsibility then both roads would be graveled at the same time or improved.
Mr. Smith further stated that gravel could be obtained at 85 cents per yard at bin in that vicinity at the present time, which was confirmed by Commissioner Hazleton who had gone over the roads with the County Engineer.
BROTHER JUNIPER DISCUSSES ROAD ROUTE FROM TUBA CITY, ARIZONA TO CORTEZ, COLORADO
Brother Juniper of St. Christopher's Mission was present to talk over preferred routes from Tuba City, Arizona to Cortez, Colorado as had previously been discussed by groups within the County. He asked that the Commissioners endorse a route by way of Hovenweep National Monument through the Aneth Oil Field, Bluff and Mexican Hat to the Arizona border, as it will possibly be of greater benefit to the people of Utah.
No action was taken.
BROTHER JUNIPER ALSO DISCUSSED THE AIRPORT AT BLUFF
Brother Juniper also asked the Commissioners about increasing the width of the Airport at Bluff, Utah to meet State specifications.
No action taken.
URANIUM PRODUCERS PRESENT TO ASK HELP FROM COMMISSIONERS IN ADJUSTMENT ON PRODUCTION TAX
Howard Balsley,of the Yellow Circle Uranium Group, Louis Gaz of the Anschutz Drilling Company, and John S. Copeland of the W. C. T. Engineering Company stated that the smaller producers were paying an inadequate production tax based on an average of three years production and recommended that the tax be based on a quarterly production report that would be sent to the State Tax Commission. They said they would very much like an adjustment on taxes and had contacted the State tax Commission but were not making any progress toward an adjustment. They felt that if the San Juan County Commissioners would make a recommendation that an adjustment be made the State Tax Commission would make such adjustment. With such procedure taken in Grand County an adjustment was finally made. It was the recommendation that production reports be sub-mitted to the County Commissioners and that the County Commissioners will then write such a recommendation for an adjustment to the State Tax Commission.
Mr. Copeland also stated that work was needed to be done on the road to their mines. COUNTY COMMISSIONERS TO BE GUESTS OF UTAH STATE UNIVERSITY ON OCTOBER 10, 1959.
An invitation having been received by the Board of County Commissioners from Utah State University to be Guests of the University on October 10, 1959, on the campus at Logan, it was unanimously agreed that if possible all Commissioners should be in attendance and that the expenses should be bourne by the County.

RESOLUTION COMMENDING MR. G. KEN COATES FOR PERFORMING AN OUTSTANDING JOB IN THE CHAIRMANSHIP OF THE SAN JUAN COUNTY RECREATION COMMITTEE
WHEREAS, Mr. G. Ken Coates was appointed Chairman of the San Juan County Recreation Committee in September 1956 and has served without intermission in the above capacity to date, and,
WHEREAS,the recreation program for San Juan County has experienced heavy grouth during the above period and created a need for orderly planning and development,
NOW THEREFORE, be it resolved as follows:
That we the Commissioners of San Juan County wish to take this formal opportunity to express our apprec-

iation to Mr. Coates for a "job well done". Mr. Coates has at all times conducted himself and the San Juan
County Recreation Program with propriety and dispatch and has worked unceasingly to promote a well round-ed County-wide recreation program.
Again, the San Juan County Commissioners want to say thanks to Mr. Coates and to have the San Juan County Clerk to so inform Mr. Coates by forwarding an official copy of this resolution to him and extend our best wishes to him in the future.
Adopted by an official and unanimous vote of the San Juan County Commissioners.
Motion for the adoption of the above resolution was made by Commissioner Bartell, seconded by Commissioner Hazleton, and carried, and the resignation of Mr. Coates was received this day and accepted.
R. J. FELLMETH APPOINTED TO REPLACE MR. COATES AS MEMBER OF RECREATION BOARD
Mr. Hazleton submitted the name of R. J. Fellmeth to replace Mr. Coates as member of the San Juan Recre-tion Board. Motion by Commissioner Bartell, seconded by Commissioner Hazleton that Mr. Fellmeth be appoint-ed to the Recreation Board for a period of 5 years.

A motion was made by Commissioner Hazleton, seconded by Commissioner Bartell, and unanimously carried, that San Juan County accept the bid of Utah Oil Refining Company for the purchase of Utoco Ethyl and Utoco Regular Gasoline for the next three months period, and Diesel Fuel from Desert Oil Company for the same period, the Clerk to notify the Companies of the bid acceptance and Hub Newell to notify the road men of such action.
AGREEMENT BETWEEN SAN JUAN COUNTY AND DR. GOON CONSUMATED AS PER DISCUSSION OF SEPTEMBER 8, 1959
Pursuant to the discussion on September 8, 1959 between Dr. Goon and the San Juan County Commissioners the following agreement was consumated:
AGREEMENT
Agreement made this 8th day of September, 1959 by and between San Juan County, a body corporate and pol-itic hereinafter referred to as County and C. D. Goon and Marguerite N. Goon, his wife, of Monticello, Utah, hereinafter referred to as Second Party.
WITNESSETH:
Whereas, C. D. Goon is the only practicing physician in Monticello and the northern portion of San Juan County and it is necessary for the health and welfare of the residents of San Juan County that there be such a physician available, and
Whereas, the Second Party is building a dwelling house immediately west of the new San Juan County Hos-pital in Monticello, Utah, and the land is described as follows, to wit:
Beginning 80 rods East and 429.5 feet North of the Southwest corner of Section 25, Township 33 South, Range 23 East, Salt Lake Meridian, and running thence North 120 feet, West 120 feet, South 120 feet, East 120 feet to place of beginning, Excepting and reserving therefrom all coal, oil, gas, mines, metals, gravel and all other minerals.
and if the future Second Party should move from San Juan County the County the County would like to pur-chase Second Party's said dwelling house and premises so as to have it available for use in connection
with the operation of said hospital and/or to be used in procurring the services of another physician or hospital personnel:
Therefore in consideration of the mutual covenants and agreements herein contained it is agreed between the parties as follows:
1. That if second party moves from San Juan County and is unable to make a private sale of said dwelling house and premises that Second Party will sell to the County and the County will purchase the said dwell-ing house and premises at its then fair market price to be determined by mutual agreement between the par-t ies and if they are unable to agree upon such price , that its said selling price shall be determined by three arbitrators, one arbitrator to be appointed by the County, one arbitrator to be appointed by the Sec-ond Party and the third arbitrator to be selected by the other two arbitrators with the parties hereto to share equally in the cost of such appraisal and the parties hereto agree to accept the market price of said dwelling house and premises as determined by such arbitrators.

RAYMOND MCALISTER MAKES PROPOSITION TO COMMISSIONERS REGARDING STATE FAIR BOOTH
Raymond McAlister suggested that the Booth at the State Fair be remodeled now so that it will be in readi-ness for another year. He stated that he would do the necessary remodeling for $500 plus his expenses. No definite commitment was made at this time but a survey will be made of available funds.
PLANS FOR SAN JUAN COUNTY CLINIC AT BLANDING APPROVED
A prior meeting having been held on September 21, 1959 at 8 P. M. to discuss the plans of the San Juan County Clinic to built at Blanding, a motion was made at this time by Commissioner Marion H. Hazleton that the plans of the Clinic as submitted by the Blanding Clinic Committee be approved by the Board of County Commissioners, seconded by Commissioner Bartell, and carried.
FREDRICK ROGERS TO RECEIVE INCREASE IN SALARY AS CRUSHER OPERATOR
A motion was made by Commissioner Bartell, seconded by Commissioner Hazleton that Fredrick Rogers be given an increase in salary from $350.00 to $365.00 per month, retroactive to September 1, 1959.

J. P. GONZALEZ FINDS ROADS IMPASSABLE/TO HIS RANCH AT VERDURE AND WOULD LIKETHE COMMISSIONERS TO USE THEIR INFLUENCE IN OBTAINING NEW ACCESS TO RANCH
Mr. J. P. Gonzalez stated that the road he has to use to gain access to his ranch at Verdure is very dan-erous and almost impassible, and he would appreciate having the Commissioners use their influence to get permission from Max Dalton to use his private road to Montezuma Creek for part of the way and then to go across country to his ranch. He feels that this route would be very good at any time of the year. The Com-missioners were aware of the dangers of Mr. Gonzalez' present road and consented to speak to Mr. Dalton regarding the new access to the Gonzalez ranch.
