SAN JUAN COUNTY COMMISSION MINUTES NOVEMBER 28, 1988

The regular meeting of the San Juan County Commission convened at 10:00 A.M. at the San Juan County Courthouse at Monticello, Utah.

A motion to approve the minutes of November 21, 1988 as corrected was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

COMMISSIONER KENNETH BAILEY'S REPORT

Fairgrounds Fence - Commissioner Bailey reported that the fence around the County Fairgrounds at Monticello has been repaired so that the grounds can be secured.

Harts Draw Road Construction - County Engineer Doug Pehrson withheld $5,000 from the final payment to Crowley Construction for compaction on the Harts Draw project. As soon as the compaction is corrected that money will be paid.

Perkins Crossing - The road department is working to complete the project at the Perkins Crossing. The pilings were driven last year but the spring runoff prevented the completion.

COMMISSIONER MARK MARYBOY'S REPORT

Follow-up Projects - Commissioner Maryboy reported that he has been sick during the week but will follow-up on the shale pit at Mexican Water, the trash dump at Oljato, the Montezuma Creek trash dump, and the Bluff sewer project. Mr. Maryboy will also contact the Navajo Tribal headquarters concerning the $20,000 committed towards the Montezuma Creek Police Station.

Historical Society Space - Commissioner Maryboy has met with the Historical Society Board regarding the possibility of locating additional space for their records. Commissioner Bailey felt that there might be space available in the Courthouse when the new Public Safety Building is completed and the various departments have moved their offices there. Mr. Bailey indicated that there is not funding available for a separate building for the Historical Society.

COMMISSIONER CALVIN BLACK'S REPORT

San Juan County Roads - Commissioner Black outlined the San Juan County road priorities that need consideration for federal funding in a letter to Congressman Howard Nielson. Mr. Black expressed appreciation to Mr. Nielson for his efforts in attempting to get $950,000 for the engineering on the Navajo Mountain to Oljato road in the last legislative session and urged continuation of that effort. In suggesting the projects for consideration, Mr. Black suggested the number one priority is the engineering and construction of the road from Navajo Mountain to Oljato. When Canyonlands National Park was created in 1964, the Needles District of this park was recognized by those who testified at the hearings, Senator Moss, the sponsor of the bill; and Stewart Udall, Secretary of Interior; as the prime area of the entire park. Promises were made at that time and the plan for the future was adopted which would establish the main development at the Needles area, such as the administration buildings, a series of roads with a loop through the park and out through what was to be called the Kigalia Scenic Way.

The projections for visitation to the Needles area were to have been over one million visitors per year after twenty years. Because these developments in the Needles area were not accomplished, visitation has not reached even 10% of that number and the current plan for this park does not adequately develop what is recognized by everyone to be the most prime area of the park.

Because of the interest in attempting to realize sane of the visitation projections, San Juan County has over the years developed a priority for roads to be built in this area. Our highest priority in this area is the road from Monticello Lake on the Blue Mountain to the Dugout Ranch. The County has already invested funding in engineering this road and have completed several miles of grade and drain with a gravel surface for a cost of . This road traverses U.S. Forest Service and Bureau of Land Management lands.

Our third priority would be to upgrade the road from Dugout Ranch through Beef Basin, across Salt Creek Mesa to Natural Bridges National Monument, with a connection to Blanding via the Causeway. This road was to be known as the Kigalia Scenic Way.

Commissioner Black recommended that San Juan County also enter into a major maintenance cooperative agreement with the Forest Service to restore the loop road from Blanding to Monticello to its original grade and width with the use of a big grader, the scarifier and rippers, a loader and the grid roller. If the road is restored to the smoothness possible and a small amount of gravel put in the clay areas, then the road should last for a long time and be more accessible to the public. Mr. Black also stated that the road across Elk Ridge and the Maverick dugway should also be included in the major maintenance program.

Mr. Black reiterated the support of the County with regards to the BLM project in Trough Canyon but felt that the other priorities should take precedence over that project.

AOG Legislative Conference/BLM Advisory Council Meeting - Commissioner Black, Commissioner-elect Ty Lewis and Administrative Assistant Rick Bailey will attend the AOG Legislative Conference in Price on Tuesday, November 29th. They will also attend the BLM Advisory Council meeting on Wednesday afternoon.

President Ronald Reagan Letter - The following letter to Commissioner Black was received from President Ronald Reagan:

BLM Letter of Appreciation/Elizabeth Hailling Rescue - The following letter was received from the Bureau of Land Management, Edward R. Scherick, Area Manager:

On behalf of the Bureau of Land Management (BLM) I am taking this opportunity to recognize the outstanding job done by the San Juan County Sheriff's Department and emergency service personnel during the rescue of Elizabeth Nailling on November 14, 1988. Sheriff Claude Lacy and Emergency Services Director Rick Bailey directed operations in an exemplary manner, and the personnel under their direction were professional and extremely competent. The extra-ordinary effort on the part of everyone involved may have saved Miss Nailling's life.

Peavine Corridor - A letter has been received from Lee A. Bennett, District Ranger for the Forest Service, regarding the management of the Peavine Corridor. A draft Peavine Corridor Management Activity Standards was enclosed for comments. The Commission will draft a response at the next Commission meeting.

ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT

Budget Worksheet - Administrative Assistant Rick Bailey reported that with the exception of the road department all department budget requests have been received for consideration by the Commission. One thing that will need to be considered next week is the taxable valuation, whether that will need to be raised or lowered for the coming year. The general tax rate has been reduced to .0026 in order to reflect the .0006 for the San Juan County Health Care District.

San Juan Water Conservancy District - Administrative Assistant Rick Bailey revised the terms of the current members of the San Juan Water Conservancy District to comply with State law. The records indicated that the terms of sane board members expired in 1988 and others in 1989. The law states that the terms should be a two-year staggered basis. Those board members whose terms expired in 1989 were changed to 1990. Chairman Norman Nielson will be contacted to see if those members whose term expires in 1988 are desirous of serving for another term.

CURRENT BUSINESS

Representative David Adams - State Representative David Adams met with the Commission to discuss County concerns. Mr. Adams expressed appreciation to Commissioner Bailey for the many years of service that he has given Monticello City as Mayor and as a County Commissioner.

Commissioner Maryboy had written to Representative Adams concerning projects

on the reservation. Mr. Adams felt that Mr. Maryboy should continue to pursue funding for those projects and that he would support them in any way he could. Mr. Adams stated that he would have more influence through the Community Impact Board rather than any bonding process. He needed further information as to who would own the buildings and how they would be administered.

Commissioner Maryboy had also requested assistance with improvements on the State highways in the Aneth-Montezuma Creek area. Representative Adams stated that those projects will need to be placed on a priority listing with the state road department and he will continue to work towards getting cooperation with the State Department of Transportation.

Representative Adams will also write a letter to the Commission in support of the expansion of the Edge of the Cedars Museum.

Other legislative issues will be discussed at the AOG Legislative Conference in Price on Tuesday, November 29th.

Merrill - Lynch/Executive Session - Commissioner Bailey made a motion to go into executive session to discuss legal matters regarding the Merrill-Lynch investments. Commissioner Maryboy seconded the motion. UNANIMOUS.

A motion to return to the regular session of the San Juan County Comnission was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

A proposal was made by Phil Acton, CPA, to revise the report of Anderson, Peterson & Co., gather additional information as needed, and provide an analysis showing where the County actually ended (total selling price all funds less total cost of all funds) and where they could have ended had their investments been made in such instruments not subjecting the principal to risk. Mr. Acton would revise the report for a fee of $8,000 to $9,000. If any unforseen circumstances came to his attention which would bring the fee to more than $9,000, he would review the problems with the Commission before proceeding with the annalysis. Such additional work would be billed at the rate of $75.00 per hour or an additional fee mutually agreed upon before completing the analysis.

A motion to approve the proposal of Mr. Action was made by Commissioner Bailey and seconded by Commissioner Maryboy. UNANIMOUS.

Supplemental Retirement Program - County Clerk Gail Johnson and Deputy Auditor John Fellmeth met with the Commission to discuss the possibility of the County adopting a deferred compensation or supplemental retirement program as an option for County employees. The program is the State 457 program which is in conjunction with the State 401K program. It is a program which would strictly be a deferred tax program for the employees with no employer contribution. Commissioner Black felt that a similar program with NACo should be researched before a decision is made.

Library Request - Bids had been received from Bro Dart for $154.00 and Highsmith for $172.00 for a book truck (6 shelves). A motion to approve the low bid from Bro Dart for $154.00 was made by Commissioner Maryboy and seconded by Conmissioner Bailey. UNANIMOUS.

Executive Session - Sheriffs Department - A motion to go into an executive session to discuss matters pertinent to the Sheriffs Department was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.

Bluff Special Service Sewer District - The hearing for the Bluff Special Service Sewer District convened at 2:00 P.M. There were five Bluff residents in attendance at the hearing. Commissisoner Bailey stated that the resolution did not reflect the water, recreation and mosquito abatement requests that had been discussed as a portion of the district. Jerald Baum stated that a service district can do anything an incorporated city can do and felt that the other projects could be handled within the special service district without specific identification. Considerable discussion was presented to the fact that other alternatives to the sewer problem had not been investigated prior to the request for a special service sewer district. Mark Richmond and his wife indicated that if the special service district is approved they will use all legal means to prevent the installation of the system on their property and felt that other residents felt the same way. Commissioner Bailey stated that the purpose of this hearing is for the Commission to approve the motion of intention to establish a service district. The resolution will be published and comments received during the comment period until December 27, 1988.

A motion to adopt the resolution and decide whether to approve or abandon the creation of the Bluff Special Service Sewer District with provisions being made to include the mosquito abatement, recreation and water on December 27, 1988 and hold that meeting in Bluff at 7:00 P.M. in the evening was made by Commissioner Maryboy and seconded by Commissioner Bailey. UNANIMOUS.
